As residents located along Larinner County Road I and Weld County Road 13, we would like to express our desire to have the Thornton Water Project pipeline placed in the middle of the current road right-of-way. We understand that the Town of Timnath has agreed to allow the alignment of the pipeline within the portion of the road located in Timnath immediately north or adjacent to our properties. The current maps supplied to us from Western States Land Services, Inc. show that the proposed pipeline on LOR Mk/CR*13 south of Harmony Road is aligned within the mad right-of-way unfil Larirner County Road 32 where is crosses into private land in Weld County. The pipeline confinues in Larimer County part way through the George parcel until it crosses over to the Weld County property of Westwind Farm, LL. This route causes concern for us as property owners in that the proposed route cuts through irrigation ditches that are needed to service our crops anti ti would impact i our property —clues. We would ask that Larimer and Weld Counties require the Thornton Water Project pipeline to remain in the middle of the County Line Road right f -way from Harmony until Latimer County Road 32NVeld County road 68 1/2. We also note that Lorimer County is now asking for additional informationimaterials from the City of Thornton regarding Field Surrey Information, Pipe Alignment, Anticipated Construction Schedule, Pavement Restoration Plan and Utility Coordination. Larimer County requested this information in its January 26, 2018 letter for the 2.6 mile segment along County Road 54. We would request the same type of intonation for the portion of Larimer County Road lfweld County Road 13 that impacts our properties. It is our hope that the City of Thornton will be consistent in its application to Larimer County to include the additional information/materials for all properties along the TWP route. Thornton has informed us that Weld County has directed them to keep the TWA pipeline outside of Weld County rights -of -way (ROW) and to pursue easements with private property owners. In 2008 Weld County adopted a plan for realignment of Quebec Ave/CR 17 that would place the realigned section of the road on our property. The study can be found at: http://www1adcogov.org/sites/default/files/482_01pdf. The relevant page is attached. Thornton's representatives have met with me on several occasions to determine a routing that will least affect the future of the property, and it is our desire to minimize encumbrances to maintain maximum flexibility. Thornton has proposed several alternatives for routing the pipeline, including purchase of an existing unused easement. Drawings are attached. We believe it is in our best interest to pursue the route across our property that places the waterline in the east side of the realigned ROW of Quebec Ave/CR 17. This will allow the greatest flexibility by maximizing useable land along the east side of CR 17. Please consider committing to follow the Recommended Alternative road plan and allow Thornton to install their pipeline in the future CR 17 ROW. It meets Thornton's needs and is in our best interest as Weld County residents and property owners. Thank you for your consideration. You provided valuable information and guidance on communicating with the Board of County Commissioners. After we spoke, I contacted Thornton about any existing USR related to their water pipeline plans involving our property. Their response was clear in that there is no USR at this time. However, Thornton wants to submit one before the end of the year. Therefore, the B000 should be able to consider our question at this time without it being entangled with the larger project. Attached is our request letter to the Commissioners and three attachments that clarify the situation. If a physical copy is needed, just let me know. I can quickly get as many copies as might be needed to you. Box 758 Greeley, CO 80631 **sent Via Email to Diana Aungst--daungst@weIdgov.com** Subject: Thornton Water Project Pipeline Location Comments Dear Commissioners: The city of Thornton (Thornton) has contacted me requesting easement for the Thornton Water Project (TWP) pipeline across property owned and operated by Varra Companies, Inc. and Pasquale Varra along Weld County Road (WCR) 17 between WCR 26 and State Highway 66. Thornton has informed me that Weld County has directed them to keep the TWP pipeline outside of Weld County rights - of -way (ROW) and to pursue easements with private property owners. It is my understanding that the intent of this requirement is to benefit private property owners in the form of compensation for the easement. Properties owned by Varra Companies potentially affected by the TWP are either being actively mined or will be mined in the near future. Mining and reclamation plans have been developed and approved or are in the process of development for all these properties. Thornton's representatives have met with Varra Companies on several occasions to determine routing that will least affect mining operations; however, any permanent easements on these properties will result in significant loss of gravel resources and water storage volume after reclamation. Loss of these resources cannot be recovered by the value of the easement. I met with Thornton representatives and Weld County staff on site May 17, 2018 to discuss these issues and potential alternatives, including whether Weld County would allow the TWP in WCR 17 and WCR 28 ROWs. At that meeting, staff indicated that this would be considered, subject to Thornton providing sufficient survey to show that the TWP pipeline could be in ROW without conflict to existing and planned utilities and road maintenance. Thornton has obtained that survey and shown that the pipeline can be installed without conflict. Gravel mining is a significantly different land use than most of the rest of the TWP alignment. In agricultural areas, the pipeline can be in an easement without long term effect on land use after construction. Farming and ranching can continue on the property encumbered by the easement once construction is complete. In areas planned for development, the easement can be located in required setbacks from the county road, which does not affect area available for development. Conversely, gravel mining makes use of the property to the highest degree, so any easement would have a long-term negative impact to the use of the property. Permanent easements on the existing and proposed gravel mines owned by Varra Companies would have a detrimental impact to our business that cannot be compensated in the cost of the easements. Varra Companies strongly requests the Commissioners allow Thornton to install the TWP pipeline in the WCR 17 and WCR 28 ROWs adjacent to our properties. Thank you.
