The Weld County Department of Public Works has reviewed this proposal. Staff comments made during
this phase of the application process may not be all-inclusive, as other issues may arise during the
remaining application process.
COMMENTS
GENERAL PROJECT INFORMATION/LOCATION
Project description: A Site Specific Development Plan and Use by Special Review Permit for Any use
permitted as a Use by Right, an Accessory Use, or a Use by Special Review in the Commercial or industrial
zone districts (equipment and truck and trailer sales, vehicle modification, dismantling of wrecked vehicles
and sale and/or recycling of dismantled vehicle parts) provided that the property is not a Lot in an approved
or recorded subdivision plat or lots parts of a map or plan filed prior to adoption of any regulations controlling
subdivisions.
This project is south of and adjacent to CR 50 and is east of CR 65.
Parcel number 105104000001.
Access is from CR 50.
ACCESS
An Access Permit application was not submitted with the application materials. Public Works has reviewed
the submitted materials and provides the following recommendation for access locations based on County
code and safety criteria in accordance with the Weld County Engineering and Construction Criteria. The
existing eastern access proposed for proposed shop site does not currently meet the safety spacing criteria
for a locally classified road. To get a new access point for the western side of the proposed shop site the
landowner/applicant will have to work with Bonanza Creek to consolidate the existing horseshoe access
points to the west of the site. Questions concerning access requirements can be directed to Public Works
access permit division.
Per Chapter 12, Article 5, Section 12-5-30, an Access Permit is required for access to Weld County
maintained roadways. We strongly encourage you to discuss your access with Public Works prior to laying
out your site plan to ensure the approved accesses are compatible with your layout.
For new accesses and/or change of use of an existing access, the fee and photos are required (photo
looking left and right along roadway from the access point and looking in to and out of the access point).
These photos are used to evaluate the safety of the access location. Access permit instructions and

Sections 6.3, 6.4 and 6.5 of the Weld County Engineering and Construction Criteria offer access design

Per Chapter 12, Appendix 12A.4.1 of the Weld County Code, an access approach that is gated shall be
designed so that the longest vehicle (including trailers) using the access can completely clear the traveled
way when the gate is closed. In no event, shall the distance from the gate to the edge of the traveled surface
be less than 35 feet.
For shared accesses, Public Works strongly recommends the property owner establish an access road
maintenance agreement so future owners of the properties will be aware of their requirements for shared
maintenance of the access road. This is not a requirement, but is recommended to avoid property owner
conflicts in the future.
ROADS AND RIGHTS -OF -WAY
County Road 50 is a gravel road and is designated on the Weld County Functional Classification Map (Code
Ordinance 2017-01) as a(n) local road, which requires 60 feet of right-of-way. The applicant shall delineate
on the site map or plat the future and existing right-of-way and the physical location of the road. If the right-
of-way cannot be verified it shall be dedicated. Pursuant to the definition of setback in the Weld County
Code, Chapter 23, Article III, Section 23-3-50, the required setback is measured from the future right-of-
way line. Be aware that physical roadways may not be centered in the right-of-way. This road is maintained
by Weld County.
County Road 65 is a section line road. Section line right-of-way does not exist in all sections in Weld County
and should be verified before a decision to utilize it is made. Weld County commonly refers to these
locations as "Non -Maintained Section Line Right -of -Way." The existence of a physical road does not imply
public right-of-way and the road may be located on private property. All right-of-way should be verified and
physical roads located in relationship to the public right-of-way to ensure trespassing does not occur. The
applicant shall verify the existing right-of-way and the documents creating the right-of-way and this
information shall be noted on the site plan or plat. The applicant shall delineate on the site map or plat the
existing right-of-way and physical location of existing or proposed roads. If the right-of-way cannot be
verified it shall be dedicated or an adequate easement between property owners shall be provided.
Pursuant to the definition of setback in the Weld County Code, Chapter 23, Article III, Section 23-3-50, the
required setback is measured from the future right-of-way line. Be aware the physical roadway(s) may not
be centered in the right-of-way. This road is NOT maintained by Weld County.
The Colorado Department of Transportation (CDOT) has jurisdiction over all accesses to state highways.
Please contact Tim Bilobran at the Greeley office (970-350-2163) to verify the access permit or for any
additional requirements that may be needed. (State Highway 34)
Per Chapter 12, Article 4, Section 12-4-30.B, a Weld County Right -of -Way Use Permit is required for any
project that will be occupying, constructing or excavating facilities within, and/or encroaching upon, any
County rights -of -way or easement. Right -of -Way Use Permit instructions and application can be found at

Weld County will not replace overlapping easements located within existing right-of-way or pay to relocate
existing utilities within the County right-of-way.
TRAFFIC
No traffic counts are available in the area.
The traffic information submitted with the application materials indicated there will be approx.. 20 passenger
vehicles, 8 tandem trucks and 4 truck/trailers.
TRACKING CONTROL POLICY
Per Chapter 12, Appendix 12A.10.1, traffic volumes to the proposed facility may require the installation of
a tracking control device and/or a minimum of four inches of compacted recycled asphalt or aggregate road
base. Tracking control is required to prevent tracking from the site onto public roadways. Temporary
Tracking Control shall be used during construction unless permanent tracking control is installed ahead of
construction activities. Recycled concrete is not allowed in County right-of-way. Tracking control devices
can be double cattle guards or rip rap (6" washed rock). Tracking control for unmaintained public right-of-
way is required just prior to entering publicly maintained roadways. A variance request for alternatives to
the tracking control requirement can be submitted to Public Works for review and consideration.
4 to 10 round truck trips/day (tandem or semi -trucks):
• Access onto gravel roads requires recycled asphalt or road base on all driving surfaces.
• Access onto paved roads requires a tracking control device and a minimum of 100 feet of recycled
asphalt/road base OR 300 feet of asphalt. (Surface improvements less than 300 feet may be
allowed if site constraints would prohibit meeting condition.)
IMPROVEMENTS AND ROAD MAINTENANCE AGREEMENT
Public Works may require an Improvements Agreement for one or all the following reasons:
• Off -Site Public Improvements
• Road Maintenance Agreement
• Construction Maintenance Agreement
• Access Improvements Agreement
An Improvements Agreement is required for sites with required off -site improvements per Chapter 12,
Article 5, Section 12-5-60. Collateral is required to ensure the improvements are completed, and
maintained.
Improvements/Road Maintenance Agreement: An example agreement is available at:

eviewlsprusr.pdf. It will detail the approved haul route(s), outline when off -site improvements will be
triggered, and include a maintenance agreement for the haul routes. Possible mitigations included in the
road maintenance agreement may include but are not limited to: dust control, specified haul routes, damage
repairs, and future improvement triggers.
Drainage Requirements:
This area IS within a Non -Urbanizing Drainage Area:
Non -Urbanizing Drainage Areas typically require detention of runoff from the 1 -hour, 100 -year, storm falling
on the developed site and release of the detained water at the historic runoff rate of the 1 -hour, 10 -year
storm falling on the undeveloped site for NON -URBANIZING areas.
Detention Pond summarized in a Drainage Report:
A drainage report and detention pond design shall be completed by a Colorado Licensed Professional
Engineer and adhere to the drainage related sections of the Weld County Code. The drainage report must
include a certification of compliance stamped and signed by the PE which can be found on the engineering
website. General drainage report checklist is available on the engineering website. More complete
checklists are available upon request.

Grading Permit
A Weld County Grading Permit will be required if disturbing more than 1 acre. Grading Permit applications
are accepted after the planning process is complete (plan recorded). An Early Release Request Form may
be entertained only after the applicant, Public Works and Planning Department have reviewed the referral
and surrounding property owner comments. The Early Release Request may or may not be granted
depending on referral comments and surrounding property owner concerns. Contact an Engineering
representative from the Public Works for more information.
Geologic Hazard Area:
This area IS NOT in a Geologic Hazard Area.
Floodplain:
This area IS NOT in a FEMA regulatory floodplain.
CONDITIONS OF APPROVAL
A. An Improvements and Road Maintenance Agreement is required for off -site improvements at this
location. Road maintenance including, but not limited to dust control, tracking control, damage repair,
specified haul routes and future traffic triggers for improvements will be included. (Department of Public

B. A Final Drainage Report and Certification of Compliance stamped and signed by a Professional
Engineer registered in the State of Colorado is required. (Department of Public Works)
C. The applicant shall submit a recorded copy of any agreement signed by all of the owners of the property
crossed by the access. The access shall be for ingress, egress, utilities and shall be referenced on the
USR map by the Weld County Clerk and Recorder's Reception number. (Department of Public Works)
D. The plan shall be amended to delineate the following:
1. County Road 50 is a gravel road and is designated on the Weld County Functional Classification
Map as a local road which requires 60 feet of right-of-way at full buildout. The applicant shall
delineate on the site plan the existing right-of-way. All setbacks shall be measured from the edge
of right-of-way. This road is maintained by Weld County. (Department of Public Works)
2. County Road 65 Section Line is shown to have 30 feet of unmaintained section line right-of-way
per the Weld County GIS right-of-way map. The applicant shall delineate the existing right-of-way
on the site plan. All setbacks shall be measured from the edge of right-of-way. (Department of

3. Show and label the approved access locations, and the appropriate turning radii (60') on the site
plan. The applicant must obtain an access permit in the approved location(s) prior to construction.

4. Show the approved Colorado Department of Transportation (CDOT) access(es) on the site plan
and label with the approved access permit number if applicable. (Department of Public Works)
5. Show and label the approved tracking control on the site plan. (Department of Public Works)
6. Show and label the entrance gate if applicable. An access approach that is gated shall be designed
so that the longest vehicle (including trailers) using the access can completely clear the traveled

9. Show and label the parking and traffic circulation flow arrows showing how the traffic moves around

Prior to Construction:
A. The approved access and tracking control shall be constructed prior to on -site construction. This site
requires road base or recycled asphalt on all driving surfaces for tracking control. (Department of Public

B. If more than one (1) acre is to be disturbed, a Weld County Grading Permit will be required.

DEVELOPMENT STANDARDS (NOTES ON THE SITE PLAN)
1. The property owner shall control noxious weeds on the site. (Department of Public Works)
2. The access on the site shall be maintained to mitigate any impacts to the public road including damages
and/or off -site tracking. (Department of Public Works)
3. There shall be no parking or staging of vehicles on public roads. On -site parking shall be utilized.

4. Any work that may occupy and or encroach upon any County rights -of -way or easement shall acquire
an approved Right -of -Way Use Permit prior to commencement. (Department of Public Works)

Environmental Health Services has reviewed this proposal for a Site Specific

vehicle modification, dismantling of wrecked vehicles and sale and/or recycling

According to the application water will be provided by a commercial tap from
Central Weld County Water District. A commercial on -site wastewater treatment
system (OWTS) will be installed. The existing residence on site will be
demolished.
Maintenance and body work will occur on the property. The application
indicates a water recycle system will be installed for the wash bays. There will
be pits in the wash bays with would empty into the recycle system. The
application indicates the water recycle system will be used for vehicles and parts
washed inside. If any washing is done outside the discharge guidance
document provided by the State titled: "Low Risk Discharge Guidance:
Discharges From Surface Cosmetic Power Washing Operations To Land July
2010" shall be adhered to.
Oil will be stored and picked up by an appropriate disposal company. There will
be a paint booth onsite so an APEN may be required.
There will be a 1,000 -gallon diesel fuel tank with secondary containment on site
which would require an SPCC plan.

We recommend that the following requirement be incorporated into the permit as a
condition that must be met prior to the issuance of the Certificate of Occupancy:
1. An On -Site Wastewater Treatment System (OWTS) is required for the proposed
facility and shall be installed according to the Weld County On -Site Wastewater
Treatment System Regulations. The OWTS is required to be designed by a
Colorado Registered Professional Engineer according to the Weld County
Individual Sewage Disposal Regulations.
We recommend that the following requirements be incorporated into the permit as
development standards:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal
Sites and Facilities Act, 30-20-100.5, C.R.S.) shall be stored and
removed for final disposal in a manner that protects against surface and
groundwater contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is
not meant to include those wastes specifically excluded from the
definition of a solid waste in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S.
3. Waste materials shall be handled, stored, and disposed in a manner
that controls fugitive dust, fugitive particulate emissions, blowing debris,
and other potential nuisance conditions. The applicant shall operate in
accordance with Chapter 14, Article 1 of the Weld County Code.
4. Fugitive dust should attempt to be confined on the property. Uses on
the property should comply with the Colorado Air Quality Commission's
air quality regulations.
5. The facility shall adhere to the maximum permissible noise levels
allowed in the Commercial Zone as delineated in 25-12-103 C.R.S.
6. Any septic system located on the property must comply with all
provisions of the Weld County Code, pertaining to On -site Wastewater
Treatment Systems.
7. Adequate drinking, hand washing and toilet facilities shall be provided
for employees, at all times. A permanent, adequate water supply shall
be provided for drinking and sanitary purposes.
8. Any vehicle or equipment washing areas shall capture all effluent and
prevent discharges in accordance with the Rules and Regulations of
the Water Quality Control Commission, and the Environmental
Protection Agency and shall adhere to "Low Risk Discharge Guidance:
Discharges From Surface Cosmetic Power Washing Operations To
Land July 2010" as specified by the State.
9. A current PE certified and signed copy of the Spill Prevention, Control
and Countermeasure Plan shall be available on site, at all times.
10.The facility shall comply with all provisions of the State Underground
and Above Ground Storage Tank Regulations.
11.The applicant shall submit an Air Pollution Emission Notice (A.P.E.N.)
and Emissions Permit Application and obtain a permit from the Air
Pollution Control Division, Colorado Department of Public Health and
Environment, as applicable.
12.All potentially hazardous chemicals must be handled in a safe manner
in accordance with product labeling. All chemicals must be stored
secure, on an impervious surface, and in accordance with
manufacturer's recommendations.
13. Secondary containment shall be constructed around tanks to provide
containment for the largest single tank and sufficient freeboard to
contain precipitation. Secondary containment shall be sufficiently
impervious to contain any spilled or released material. Secondary
containment devices shall be inspected at regular intervals and
maintained in good condition. All secondary containment will comply
with the Colorado Oil and Gas Conservation (COGCC) Commission
Rule 604 and/or the provisions of the State Underground and Above
Ground Storage Tank Regulations.
14. The applicant shall obtain a Colorado Discharge Permit System or
CDPS permit from the Colorado Department of Public Health and
Environment (CDPHE), Water Quality Control Division, as applicable.
15. The facility shall notify the County of any revocation and/or suspension
of any State issued permit.
16. The applicant shall notify the County upon receipt of any compliance
advisory or other notice of non-compliance of a State issued permit, and
of the outcome or disposition of any such compliance advisory or other
notice of non-compliance.
17. The operation shall comply with all applicable rules and regulations of
State and Federal agencies and the Weld County Code.

Chris,
A new project near CR 50 & 65 was recently brought to our attention. Review of the E permit site
confirms that that USR18-0001 is in process. Central Weld is the water provider to this property but
was not contacted as part of the referral process. I was able to review the application and
accompanying questionnaire on the E permit site. Central Weld does have a tap at this site but it is a
residential 5/8" tap. We have not been contacted by the landowner about this project or provided
with volume of water necessary to operate a commercial enterprise at this location. The District will
need to be provided with fire flow requirements from the servicing fire department and have
appropriate fees and documents submitted to determine whether capacity is available on existing
infrastructure for a project of this nature. At minimum, there will be backflow prevention
requirements if it is determined that the existing tap can provide adequate flow and volume for the
project (and no fire protection is necessary). We encourage the applicant to contact the District at
their earliest convenience to begin a water study. We would appreciate the opportunity to respond
to any additional applications submitted within our service area.

Chris,
Based on the estimated flow for day to day operations that Brett provided me with they will use less
than the 300,000 gallon annual allotment that the existing 5/8" tap currently provides. If usage
through the tap is exceeded the District will assess surcharges and also retains the right to require
additional water to be transferred by the landowner to the District if it is deemed necessary.
Because the fire department provided requirements that can't be met with existing infrastructure,
the study is necessary if we are trying to meet those. Ideally, at this point, the fire department would
provide us with a document indicating that they have agreed to an alternate plan for fire protection.
Perhaps they are able to agree on storage of water (pond, tank, pump system, etc) for fire
protection using the well that Brett says is on the property. I have no idea what type of well they
have or if the proposed use is an acceptable one for which the well is permitted.
If you can determine that no additional water is needed from CWCWD for fire protection the study
can be bypassed with the understanding that backflow prevention requirements must be met prior
to water being connected to the new structure OR their well system OR the proposed water
recycling system. At minimum, a reduced pressure backflow assembly must be installed after the
meter and before any tee offs on the customers system. A review of water usage practices by a
CWCWD backflow technician can be requested after their plans are approved by the County and
before connection is made on the customer's side. The backflow device must be tested at the
customer's expense after installation and annually thereafter, with results submitted to a Aqua
Backflow Inc. to meet District requirements.

Kathy,
I forwarded his response to our Building Department as it is a code issue. He may have to address
this to the Fire District (as the Fire District has to sign off on the building permit) but I am waiting
to hear back on that.
Although, even if they can get a different method of providing fire flow. Don't you still need to
review the line to see if it is adequate flow -wise... for their normal day to day business operations?
On our staff side we are reluctant to proceed we recommended to Mr. Bloom to hold off on
proceeding with to USR hearings until the water system study is completed (whether it needs to
address fire flows or not).

Chris,
The study is used to determine whether the current infrastructure can produce the amount of
water needed to meet the customer's demand for both flow through the tap and fire protection.
Study results include a 30 day commitment from the District on the installation costs. Water lines in
the east end of the District where this property is located are among some of the older and smaller
lines. As I shared with Brett a few minutes ago, producing the fire flow required by PVFPD in that
area will require a lengthy line extension (10 miles). The nearest point where we have that rate of
flow available is at Hwy 34 & CR 49. Water can be made available, but in this case it is at significant
cost.

Thank you. It looks like the applicant may want to hold off on proceeding the with the hearing
process until the study is completed.
The question I had:
1) Is the study to determine whether Central Weld has enough water and pressure to provide
sufficient fire flow to supply the property (period)?
2) Or is it that the water is available — but a question is simply what infrastructure is required to
get the water and pressure to the site?

Thanks for providing the fire flow requirements as they are a necessary component to complete the
study. I did speak and correspond with Brett Bloom yesterday and let him know the cost of the
study. Once the study fee is paid it will take a minimum of 30 days and likely closer to 60 days for the
study to be completed. There will be a fair amount of engineering involved in this one as a line
extension is necessary to accommodate the fire flow requirements.

Chris,
A new project near CR 50 & 65 was recently brought to our attention. Review of the E permit site
confirms that that USR18-0001 is in process. Central Weld is the water provider to this property but
was not contacted as part of the referral process. I was able to review the application and
accompanying questionnaire on the E permit site. Central Weld does have a tap at this site but it is a
residential 5/8" tap. We have not been contacted by the landowner about this project or provided
with volume of water necessary to operate a commercial enterprise at this location. The District will
need to be provided with fire flow requirements from the servicing fire department and have
appropriate fees and documents submitted to determine whether capacity is available on existing
infrastructure for a project of this nature. At minimum, there will be backflow prevention
requirements if it is determined that the existing tap can provide adequate flow and volume for the
project (and no fire protection is necessary). We encourage the applicant to contact the District at
their earliest convenience to begin a water study. We would appreciate the opportunity to respond
to any additional applications submitted within our service area.

Yes. CDOT will be writing a permit for the site. Our only concern was with the
proposed traffic volumes. We accept the volumes, but do so cautiously. The
volumes seem lower than one would expect but given the location of the site we
accept them. The permit will have a specific term that addresses CDOT's ability to
review the access should volumes end up being greater than shown in the traffic
study.
