RE: APPROVE PARTIAL VACATION OF USE BY SPECIAL REVIEW PERMIT,
USR18-0047 - TODD G. MCCORMICK, C/O OAK LEAF 40 LLC, C/O

WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, by Resolution dated August 15, 2018, the Board did approve the request of
Todd G. McCormick, 17461 CR 25, Platteville, Colorado 80651, do Oak Leaf Solar XXIX, LLC,
2645 E. 2nd Avenue, Suite 206, Denver, Colorado 80205, for a Site Specific Development Plan
and Use by Special Review Permit, USR18-0047, for a Small Scale Solar Facility (2MW) in the
A (Agricultural) Zone District, on the following described real estate, to-wit:
N1/2 SE1/4 and E1/2 SW1/4 of Section 1,
Township 3 North, Range 67 West of the 6th P.M.,
Weld County, Colorado
WHEREAS, the Board has received a request from the current property owner, Todd G.
McCormick, do Oak Leaf 40 LLC, do Michael McCabe, to partially vacate Use by Special Review
Permit, USR18-0047, and
WHEREAS, the Board of County Commissioners heard all of the testimony and
statements of those present, studied the request of the applicant and the recommendations of the
Department of Planning Services staff and all of the exhibits and evidence presented in this matter
and, having been fully informed, deems it advisable to approve said partial vacation, conditional
upon the following:
1. Pursuant to Section 23-2-200.G.5 of the Weld County Code, the applicant
shall submit a revised plat, titled "Use by Special Review Permit,
USR18-0047, Partial Vacation", conforming to Section 23-2-260.D of the
Weld County Code.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that Use by Special Review Permit, USR18-0047, be, and hereby is, partially
vacated, with the abovementioned condition, with said plat to be titled and recorded as Use by
Special Review Permit, USR18-0047, Partial Vacation.

SUBX Size: ± 13.301 acres
Parcel Size: ± 148.698 acres
Zone District: A (Agricultural)
Narrative: Use by Special Review Permit USR18-0047 for a Small-Scale Solar Facility (2 MW) in the A
(Agricultural) Zone District was approved by the Weld County Board of County
Commissioners on August 15, 2018. The request is to reduce to size to ±7.475 acres to
accommodate a three-lot recorded exemption.
USR18-0047 will be located on Lot C of Recorded Exemption RECX19-0104. USR19-0050,
also for a small-scale solar facility approved on September 17, 2019, will be located on Lot
A of Recorded Exemption RECX19-0104, which is approximately 13.481 acres. The solar
facilities will not take up the entire properties and will cover approximately seventeen (17)
acres together.
If the request for partial vacation is approved, the Subdivision Exemption Lot(SUBX18-0025)
which defines the Use by Special Review boundary will be amended and recorded in
conjunction this partial vacation.
The Department of Planning Services staff has reviewed this request and recommends that this
request be approved.
If approved, the Partial Vacation will satisfy condition 1.B of USR19-0050 BOCC Resolution. The applicant
shall submit a revised USR18-0047 partial vacation map to the Department of Planning Services for review
per Section 23-2-260.D and Section 23-2-280 of the Weld County Code. Upon approval, the revised
USR18-0047 partial vacation map signed by Mr. McCormick and recorded with the 1AMSUBX18-0020 and
prior to recording the plat of RECX19-0104 and the USR19-0050 map.

Regarding Pre19-010 aka USR19-050, on July 11 you sent a note stating: "We'll also have to do a partial
vacation of the original USR as a condition of a approval SUBX. To my knowledge, that isn't an application
process, but just a new map submittal, that we would review, approve and then record."
Please find that new map submittal attached. I will upload the amended attached map to the USR19-050
OneHub SubX Folder as well.
