Gentlemen:
My property is located in Section 29 -1N -67W approximately 112 mile to the west of the
proposed Broomfield Compressor Station. I have a number of concerns regarding this
facility. I attended the open house held on June 12, 2018 at which I do not recollect any
mention of a 60 foot tall communication tower. I object to this tower because you cannot
screen a structure this tall and if it is not required for the operation of the compressor station it
does not need to be constructed at this location.
I have reviewed the Planning Questions submitted with the USR application and have the
following comments.
Planning Question No. 2 cites Section 22-2-20. 6.2.A. Policy 7.2 of the Weld County Code
which states that the conversion of agricultural use to industrial use "should attempt to be
compatible with the region? The site plan does not appear to show any attempt to be
compatible with the rural agncuiturai nature of the area.
Planning Question No. 4 states "Explain how the proposed use is consistent and compatible
with surrounding land uses." The applicant did not provide this explanation.
Planning Question No. 12 states that "A Landscape Plan can be developed with a request from
comments from the adjacent property owners." Although my property is not "adjacent" to the
proposed site it is in view of and within earshot. lam requesting that the proposed compressor
station be surrounded with adequate herring to ensure that noise decibel levels at the property
lines of the proposed site not exceed the residential levels of 55 daytime and 50 nighttime, In
addition, I request that the site be screened with trees so that it will be more compatible with
the surrounding area. I raised these concerns with Discovery personnel at the June 12th
meeting and they did not voice any objections to meeting these requests.
I did not see any mention of"flaring" in the application and therefore presume that there will
be none. Please let me know if this is not the case.
I would very much appreciate being notified of the date and time of the planning hearing for
this project in order that 1 may attend.

proposed Broomfield Compressor Station. I have a number of concerns regarding this
facility. I attended the open house held on June 12, 2018 at which I do not recollect any
mention of a 60 foot tall communication tower. I object to this tower because you cannot
screen a structure this tall and if it is not required for the operation of the compressor station it
does not need to be constructed at this location.
The Communication tower is a required part of the operation. This compressor facility is
monitored and can be operated remotely and the communication tower is how the two
locations communicate. It is imperative to have a dedicated communication system for the
overall operation and safety of the site and surrounding community.
At this point it is not known the exact height of the tower, up to 60'. If permitting is not done
at this time for a tower up to 60' in height the permitting process takes months to go through
It is the intention of the applicant to use the shortest communication tower possible. The
shorter the tower the less money they cost.
I have reviewed the Planning Questions submitted with the USR application and have the
following comments.
Planning Question No. 2 cites Section 22-2-20. .2,A. Policy 7.2 of the Weld County Code

compatible with the region." The site plan does not appear to show any attempt to be
compatible with the rural agricultural nature of the area.
Section 22-2-20. G. 24 Policy 7.2 states "Conversion of agricultural/and to nonurban
residential, commercial and industrial uses should be accommodatedwhen the subject site
in an area that can support such development and should attempt to be compatible with the
region." The proposed site is in a semi -rural area where there is a significant amount of oil
and gas activity already occurring.
Planning Question No. 4 states "Explain how the proposed use is consistent and compatible
with surrounding land uses." The applicant did not provide this explanation.
Section 22-2-10(D) of the Weld County Code states that "extraction of natural resources is
an important part of the economy of the County. "the proposed compression facility will
contribute to the expansion of the county's industrial economic base by providing
increased capacity for fut ure marketing of oil and gas production in Weld County.
Additionally, Section 22-5400(A) states that a County goal is to "promote the reasonable
and orderly exploration and development of oil and gas mineral resources." The proposed
facility is consistent with this section. Per Chapter 22, oil and gas facilities are allowed as
a use by right in the A (Agricultural) Zone District. Oil and gas storage facilities, oil and
gas support, and associated services require a Use by Special Review SR) permit in
Weld County.
The proposed site is in a less densely populated area within the Agricultural Zone district
in proximity to a significant amount of oil and gas infrastructure. Section 23-3-40 indicates
that oil and gas support and service facilities are acceptable as a Use by Special Review
(US')?) within the district. Additionally, Section 23-3-10 indicates that uses that are "more
intense and have a potentially greater impact" are permitted within the A (Agricultural)
zone district.

After discussions with the sound engineers about noise suppression using berms it was
revealed that berms provide no sound suppression qualities until the berms are 20' tall and
over. Instead of using berms for noise suppression the compressor Buildings were designed
and insulated for noise suppression. Additionally, the compressors fan blades were designed
for noise suppression, they are called quiet tip blades which are also used around hospitals
for noise suppression.
This ,facility was designed to meet the noise decibel levels for the area and not to exceed this
level.
A landscape plan has been developed to help screen the facility from the nearest neighbors.
I did not see any mention of"flaring" in the application and therefore presume that there will
be none. Please let me know if this is not the case.
The facility will use a 30' tall enclosed combustor so there will be no flare.
I would very much appreciate being notified of the date and time of the planning hearing for
this project in order that I may attend.

This objection and notice letter is submitted to the City of Brighton (the "City") on behalf of
Anadarko Land Corps ("ALC") and Anadarko E&P Onshore LLC ("AEP") with respect to the USR18-
0106 Broomfield Compressor Station that has been submitted for approval to the County by Rocky
Mountain Midstream, LLC ("Applicant") for the property referenced above in Weld County in a portion of
the SE/4 of Section 29, Township 1 North, age 67 West ("Property").
ALC and AEP (together the "Anadarko entities") own all of the mineral interests, including the oil
and gas and coal and other hard rock minerals, which underlie the Property.
The following are comments in support of this Notice and Objection:
1. Ownership of the _Hard Rock Mineral interests and (he O11 and Gra interests.
ALC owns the hard rock minerals, including the coal, which underlies the Property. The Anadarko
entities together own all of the oil and gas that underlies the Property.

2. There is Clear Statutory Authority and Direction for the City to Take Into Account the Ri its of
Mineral Interest Owners in Its Consideration of Application r Development.
The State of Colorado recognizes the important rights of mineral owners and lessees in C.R.S.
30-28-133(10) which states and acknowledges that both the mineral estate and the surface estate are
interests in land and that the two interests are "separate and distinct" The subsection specifically recognizes
that the owners of subsurface mineral interests and their lessees have "the same rights and privileges as
surface owners."
3. Owners of -)lit Estates Must Exercise Their Rights in a Way Mat Ciiyes Due Re and to the Rights
of the Other.
Colorado law provides that the mineral owner has the right of reasonable access to and use of the
surface estate to extract minerals and that the mineral estate owner and the surface estate owner are to give
due regard to the rights of the other and reasonably accommodate each other's rights.
The mineral interests of the Anadarko entities have significant value and consequently they are
concerned that the approval by the City of a final application for development and the subsequent build -out
of the Property will impair the ability of the Anadarko entities to develop their mineral and oil and gas
interests.
4. The Anadarko Entities Object to the Application.
The Anadarko entities have extensive mineral and oil and gas interests throughout the State of
Colorado and have successfully worked with many parties who wish to develop the surface estate in order
to assure the compatible development of the surface estate and the oil and gas estate and that provides for
the disposition of the hard rock minerals owned by ALC.
In order to protect their mineral interests and private property rights, the Anadarko entities object
to the subject Broomfield Compressor Station due to its encroachment on the 800' x 800' NE drilling
window in the SE/4 of section 29 and ALC's ownership of fee minerals in section 29. The Anadarko entities
request that the County make any approval of the application conditioned upon the Applicants and
Anadarko entities mitigating these issues.

Dear Scott,
I will add this to the record. Have you responded directly to Hazel? Yes, I have spoken with Hazel
directly and addressed the comments she submitted to you in an email and provided you a copy.
Your response refers to a landscape plan — what exactly is the landscape plan? (The application
refers to a 7 -foot fence with slats). FYI: this might be an issue with the Board of County
Commissioners as they are not a fan of slats (in my experience with previous cases). All of the
previous compressor stations approved by the PC and BOCC were constructed using a 7' tall chain -
link fence using Carlsbad Tan slats and landscaping similar to the one attached. I have also attached
a setback map showing the distances to the neighbors surrounding the property.
Theclosest neighbors are slightly over 1000' feet to the SE.
To the east WCR 17 parallels with eastern fence The of the compressor station 705' away.
The rest of the property owners are all over a 1/2 mile away to the SW, West and North.
WCR 15 is almost a mile away to the west and WCR 6 is over mile away to the north and WCR 4 is
close to 1/2 mile away to the south.
The Landscaping Plan was designed to shield the closest houses to the SE and along the entire
Eastern side of the compressor station to help shield WCR 17 to the East by using Austrian Pines,
Blue Spruces, Burning Bush and Feather Red Grass.
Finally — the substation is located on existing "prime" cropland. Do you know if the property owner
still intends to farm the remaining area to the south of the compressor station site? I spoke with our
Land Manager and he confirmed the landowner still intends to farm his land.
Note: at the Elevation Gathering Facility (USR1S-0061) — last week — the applicant was praised for
their Public outreach and measures that they have taken to address neighbors' concerns. Something
to consider moving forward on this case and other facilities in the future — as I think the expectations
of the Planning Commission and Board of County Commissioners are likely going to be higher
moving forward.

On reviewing the site specific development plan and Use by Special Review Permit USRI 8-0106, I
submit the following comments.
1. The plan shows installing six natural gas engine and two electric motor -powered compressors.
This compressor station (CS) should be all electric. There are already many running and
approved CS sites within a three-mile radius of this site. They produce hundreds of tons of
pollutants per year. This area is in the Big Dry Creek drainage, which occasionally accumulates
stagnant air that flows toward the Platte River. The smelly air that flows from the Northglenn
wastewater plant at CR 2 and 11 and sits along the Big Dry Creek reminds us regularly. It would
be best to not add more pollutants to the mix. We hope for better air quality, not more pollution.
Attached is a spreadsheet comparing the pollutants contributed by a recently approved CS using
motor driven compressors and a recently approved Rocky Mountain CS with a similar design to
the proposed site. Note that the motor driven CS is about six times larger but has much lower
NOx and CO numbers.
The recently approved, Arnold Substation has capacity to power the proposed CS and is less than
a mile away, almost due west,
The move to renewable power is clearly continuing. Xcel announced plans to be fully renewable
by 2040. If this plant is built based on natural gas engines it seems unlikely that it would be
changed out to electric. It should be electric from inception. As more renewable electricity is
delivered to the power grid, an increasingly higher percentage of power used by this CS will be
low polluting.
It is expected that the CDPHE application is months from approval as it recently entered their
system. Construction of the Compressor Station should not begin until CDPHE has given
approval.
3. Traffic routing plans show a 50/50 split expected of vehicles coming off CR 6 and CR 2 to the
site. There should be a "Shortest distance to pavement" principle applied here. By coming off
CR 6 there is only one-half mile of dirt road and one residence. When a vehicle goes to the site
from CR 2 there is one and a half miles of dirt road that passes 13 houses, Some of these houses
have children, grandchildren, farm animals, etc. and would be better off without more traffic and
dust,

Of course, these roads have a speed limit 0155 miles per hour. Reducing that to 35 would help
lower the dust and hazard.
Perhaps a route that takes vehicles to CR 19 then to CR 4, West to CR 17 and South to the site
would also work having very few houses close to the road,

NOISE
At the June 12, 2018 community meeting, Discovery's response to the question "How much noise are we
going to hear on a regular basis" was "As we have done at previous locations, our sound consultant will
develop predictive models showing how we will meet Colorado's public noise standards -- [50 at night and
to 55 decibels during day] ."
Discovery's "Noise Mitigation Plan" states `rThe facility shall adhere to the maximum permissible noise
levels allowed in the applicable Zone District as delineated in Section 25-12-103, C.R.S., and comply with
the Noise Mitigation Plan, as approved," Section 25-12-103, C.R.S. states the Residential Zone limits to
be 55 db(A) from 7:00 a.m. to 7:00 p.m. and 50 db(A) from 7:00 p.m. to 7:00 a.m.
Section 802.b. of the Colorado Oil and Gas Conservation Commission Aesthetic and Noise Control
Regulations states "Oil and gas operations at any well site, production facility, or gas facility shall comply
with the following maximum permissible noise levels."
ZONE

item 24 of the Development Standards for USR 18-0106 states "The facility shall adhere to the maximum
permissible noise levels allowed in the Commercial Zone as delineated in 25-12-103 C.R.S." (Emphasis
added) This facility is to be located in the Agricultural Zone. Therefore, I believe this Development
Standard should be amended to permissible noise levels allowed in the Residential/Agricultural/Rural
Zone (55 db(A) daytime, So db(A) nighttime.
Both Discovery's Noise Mitigation Plan and 25-12-103, C.R.S. allow for noise levels to be increased by ten
db(A) for a period of 15 minutes in any one -hour period. The State statute states that this may occur
between 7:00 a.m. and 7:00 p.m. but Discovery's Noise Mitigation Plan states "between the hours of 9:00
p,m. and 7:00 a.m." This needs to be corrected to comply with The State statute.
Discovery's Noise Mitigation Plan states "Following new facility commissioning, but not later than twelve
(12) months after startup, the Company will commence initial sound level testing to monitor compliance
with permissible Noise Level Limits." I asked Weld County's Department of Public Health how long after
the facility goes on line should testing be done and the paraphrased response was "well not a year." I
would suggest that this testing should be done within 30 to 60 days of the facility going on-line and this
should be in the development standards or a condition of approval, whichever is appropriate.
Discovery's Noise Mitigation Plan states that they will respond only to complaints from "Stakeholders."
Stakeholders are defined as only those who are "immediately adjacent to" their facility. The eastern
boundary of our property is /3 mile from Discovery's western boundary. Provided Discovery adheres to
the Residential noise limits, I think it is unlikely that we (or any future home on our property) would have
a problem. However, there are only 9 homes in Section 29 and I do not think it would be unreasonable
for Discovery to expand their "Stakeholder's" definition to include all of us who live in Section 29.
COMMUNICATIONS PLAN
Again, "Stakeholders" is defined as those "immediately adjacent to" Discovery's facility. 1 think it is
particularly important, for safety reasons, that the Communications Plan include all of us who live in
Section 29.
LANDSCAPING/SCREENING
item 2.A of the Draft Resolution of Recommendation for this USR states that the proposed facility is
required to submit a landscape and screening plan. This plan has not been available to me. The USR
application stated that the site fencing will be a 7' chain link with desert tan fire resistant privacy slats.
Section 22 -2 -2 -G.2 -A Policy 7.2 of the Weld County Code states "Conversion of agricultural land to
nonurban residential, commercial and industrial uses should be accommodated when the subject site is
in an area that can support such development, aria s'rould attempt to be compatible with the region."
(Emphasis added) A chain link fence with tan slats is not compatible with our rural area. I would request
that vegetative screening be planted along this fence and that trees be planted to distract from the
equipment that will be taller than the fence (apparently the combustion unit is 30 foot tall).

In reference to USR18-0106, I as an adjacent landowner to this property am in total disagreement to this
USR.
The change of 135 acres from A-1 to 1-2 or 3 shows a total disrespect to the land use policy of Weld
County. The Amount needed for the compressor is 10 acres not 155 and to give the oil and Gas a blank
slate for 155 acres shows a lack of any kind of reasonable planning for land that is agriculture zoned.
It is the responsibility of the Planning Commission and Board of Commissioners to act responsible in the
decisions of the use of property, especially when that use could affect the values of adjacent properties.
Future USR for the 155 acres should be applied for when needed and a subdivision of 10 acres from the
155 acres is poor planning to say the least.
I also have a few of my own questions about answers provided by the co -applicant
PLANNING QUESTIONS
#2 About the proposal being compatible with the area and their answer is significant O&G operations
in the area. The oil and gas operations in the area are existing wells and new drillings with support
services. There are NO compressors in the section of land proposed for this USR, one mile to the east
there is significant O&G operations or 2 miles to the west there is significant industrial operation where
it would be a better fit.
#10 proposed site is 10 acres, NOT 155
#12 Landscape plan CAN be developed? A landscape plan SHOULD be developed with berms at least 20
feet higher than highest spot in location, this also includes height of any roads in the vicinity if they are
the highest spot. Trees and shrubs should be planted and maintained on the berms,
ENGINEERING QUESTIONS
#2 Travel routes 50-50 on 17 north and south. Absolutely not, the only travel route should be the
shortest road to pavement which would be north on CR17 to CR6, all their travel is based on Highway85
so that would be the shortest and fastest route. If allowed to go south on CR 17 To E 168th than there
should be an ENFORCED speed limit of 35 from CR 4 South to E 168th.
ENVIRONMENTAL HEALTH

#8 Air Emissions. Applicant states they have applied for all permits from CDPHE. They just applied for
the permits and CDPHE says it would be at least a month before they would even look at applications.
Based on this, USR should not even be considered until they have All permits in place.
The Kirkmeyer Compressor units (2) on CR4 east of CR 13 (Colorado Blvd) violated the Benzene emission
levels in 2016 by 3 times the amount, 25 pounds maximum they produced 75 pounds. Until the CDPHE
investigation is completed this USR should not even be on the schedule.
#10 Nuisance Management
N/A? Really, how about the noise, especially at night. What, there are not going to be any lights? Yes, l
can see a N/A answer because it's not near their homes!
Amendment 74 failed, but I can see a reintroduction of it or something similar in the future. The face of
Colorado is changing and even if another amendment fails I still can see Class action lawsuits or general
lawsuits in the future against the landowner/permit holder which l feel would be successful,
grandfathered in or not.
In conclusion I am AGAINST a BLANK SLATE for the O&G for this 155 acres when only 10 is needed. A
subdivision of the 10 acres from the 155 is totally unacceptable, and in my opinion shows poor judgment
and decision making by the Planning Commission and Board of County Commissioners.
Please govern yourselves accordingly

2. Noise testing will be performed within 60 days of each phase of the facility going
on line and annually thereafter.
3. All residents of Section 29 will be considered "Stakeholders" under Discovery's
Noise Mitigation Plan and Communications Plan.
4. Vegetative screening will be placed around the outside of the chain link fence on
the east, south and at least part of the west sides, and trees planted to visually
distract from tall structures, in order to make this industrial facility more
compatible with our rural agricultural area.
