RE: APPROVE RIGHT OF ENTRY AGREEMENT AND AUTHORIZE CHAIR TO SIGN -
TOWN OF JOHNSTOWN
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with a Right of Entry Agreement for Various
Purposes between the County of Weld, State of Colorado, by and through the Board of County
Commissioners of Weld County, on behalf of the Department of Public Works, and the Town of
Johnstown, with terms and conditions being as stated in said agreement, and
WHEREAS, after review, the Board deems it advisable to approve said agreement, a copy
of which is attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the Right of Entry Agreement for Various Purposes between the County
of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County,
on behalf of the Department of Public Works, and the Town of Johnstown, be, and hereby is,
approved.
BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized
to sign said agreement.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 23rd day of September, A.D., 2019.

Brief description of the problem/issue: The town of Johnstown is requesting to access a parcel of land
that we own at the intersection of CR 17 and CR 50 in order to conduct a survey, and to locate existing
utilities in order to evaluate an alignment for an improvement of the town's sanitary sewer system. The
attached map indicates the parcel which includes CR17/CR50 rights of way. We at the Public
Works Department have no objection to the request.
What options exist for the Board?(include consequences,impacts,costs, etc. of options):
1. Approve the request for right of entry
2. Deny the request for right of entry

Re : Sewer Interceptor Installation Project COMMISSIONERS
Dear WELD COUNTY :
The Town of Johnstown ("Town" or "Johnstown") is in the process of a significant community
evaluation of the Town ' s sanitary sewer collection system. The study and evaluation focuses on
the need to expand the system by installing sewer interceptors throughout the community. The
new sewer lines are needed to increase collection capacity to accommodate anticipated growth in
the incorporated limits of Johnstown.
Preliminary engineering is complete, and the Town ' s engineers have identified the potential
alignment to install the new infrastructure. A map depicting the proposed alignment is enclosed
herewith. The proposed alignment shows that sanitary sewer interceptor infrastructure will run
for several miles in certain areas of the Town. In order to identify the suitability of the proposed
alignment, the Town needs to perform an on-site inspection of the property and conduct
boundary surveys, geotechnical and environmental analyses, identifying the location of existing
utilities, structures and other facilities . As additional information is obtained on existing
conditions and constraints that may exist in this route, adjustments to the alignment may be
considered.
While performing this work, the Town will endeavor to remain in existing rights of way and
easements where possible. However, in certain instances, such as in your case, the Town will
need to access private property to identify the optimal alignment. Consequently, the Town is
requesting access to your property to perform the necessary work as detailed above.
To accomplish the foregoing, enclosed please find a "Right-Of-Entry" ("ROE") agreement. The
ROE agreement gives your permission for Johnstown, its surveyors, employees, agents and
representatives, which include IMEG, Inc, FRO Resources, SurvWest, Ninyo & Moore, and
PWSI who have been retained to assist the Town in this project, to access your property and
perform the surveys and analyses described above, but only for the purposes of this project. The
Town requests that you please sign the ROE agreement and return it via United States Postal
Service mail using the provided self-addressed stamped envelope . The Town will not enter your
property without first coordinating access with you.

Town will be hosting a meeting at Town Hall (450 S . Parish Avenue) on Wednesday, September
11 , 2019 from 6 : 30 p .m. - 8 : 00 p .m. where we will be happy to answer any questions or
comments you may have.

("Johnstown") (who may be referred to individually as a "Party" or collectively the "Parties"), for
the purposes of performing land surveys, soils testing, environmental and archaeological
assessments, utility locates and similar work (the "Work") .
1 . Landowner {s } represents that {he/she/they/it} own { s } the Property and has the
authority to make this grant of Right of Entry.
2 . Landowner { s } grant { s } to Johnstown, its employees, agents, contractors,
consultants and representatives, the right to enter upon the Property for the purposes of performing
the Work.
3 . The activities of Johnstown, its employees, agents , consultants and representatives,
will be coordinated with Landowner { s } so as not to unreasonably interfere with Landowner' s
activities .
4. Johnstown shall be responsible for all costs associated with the Work and this Right
of Entry.
5 . Johnstown agrees to require its agents, contractors and consultants hired by
Johnstown to do Work on the Property to obtain and maintain Commercial General Liability
insurance in the minimum amount of 51 ,000,000 . 00.
6 . As a condition of the granting of this Right of Entry, Johnstown covenants and
agrees to restore the Property to a level comparable to the condition of the Property prior to
Johnstown undertaking the Work.
7 . The Parties hereto agree that neither has made or authorized any agreement with
respect to the subject matter of this instrument other than expressly set forth herein and no oral
representation, promise or consideration different from the terms herein contained shall be binding
on either Party or its agents or employees hereto .
8 . This Right of Entry shall inure to the benefit of, and be binding upon, the Parties,
their respective legal representative, successors, heirs, and assigns .
IN WITNESS WHEREOF, Landowner{s} has/have executed this grant of Right of Entry
and Johnstown has accepted the same on the terms and conditions set forth herein effective as of
the Effective Date.
