HomeMy WebLinkAbout20192460.tiffCORRECTED RESOLUTION (Corrected as to File Location) RE: APPROVE RESUBDIVISION, RES18-0006, TO REDESIGN LOT 31 OF BLOCK N AND LOT 35 OF BLOCK K OF EVANS SUBDIVISION - ELSA VALDEZ, AND JARED AND KAITLIN LIPPERT WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 26th day of June, 2019, at the hour of 9:00 a.m., in the Chambers of the Board, for the purpose of hearing the application of Elsa Valdez, 239 Dunmire Street, Frederick, Colorado 80530, and Jared and Kaitlin Lippert, 309 Dunmire Street, Frederick, Colorado 80530, fora Resubdivision, RES18-0006, to redesign Lot 31 of Block N and Lot 35 of Block K of Evans Subdivision, on the following described real estate, being more particularly described as follows: Lots 31 and 32 of Block N and Lots 35, 36, and 37 of Block K, Evans Addition; being part of Section 30, Township 5 North, Range 65 West of the 6th P.M., Weld County, Colorado WHEREAS, at said hearing, Elsa Valdez was present, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, studied the request of the applicants and the recommendation of the Weld County Department of Planning Services and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be approved for the following reasons: 1. The submitted materials are in compliance with the Resubdivision application requirements of Section 24-5-30.A of the Weld County Code. The applicant submitted a resubdivision application that included all the items applicable for review and a draft plat map of the subject lots being resubdivided. The application materials include an explanation of the resubdivision request. No rules, regulations, and ordinances are proposed to be changed and the resubdivision plat will not be altered in any way which will adversely affect the character of the original subdivision plat. 2. The application was processed according to the review procedures of Section 24-5-30.B for a Resubdivision, as follows: A. Section 24-5-30.B.1 -- Any person wanting to apply for review of a resubdivision shall arrange for a preapplication conference with the Department of Planning Services. Upon receipt of a complete resubdivision application, the Department of Planning Services will schedule the request before the Board of County Commissioners. A Pre -Application (PRE16-0088) meeting was held in April, 2016. At that meeting it was determined that a resubdivision was applicable. The vacation of Koch Avenue needed to be completed prior to the Resubdivision and the incorrect recorded deed and plat were noted as issues that would need to be addressed through the process. PL CA5 / 7P) 1O t(7 2019-2460 PL2717 RESUBDIVISION (RES18-0006) - ELSA VALDEZ, AND JARED AND KAITLIN LIPPERT PAGE 2 B. Section 24-5-30.B.2. -- In the event a utility easement is affected, the Department of Planning Services shall schedule the resubdivision request on the first available Utilities Coordinating Advisory Committee meeting before presenting the request to the Board of County Commissioners. No utilities are affected by the proposal. Both properties are already serviced by electricity, public water and public sewer. Therefore, this case was not reviewed by the Utilities Coordinating Advisory Committee. C. Section 24-5-30.B.3. -- The Planner shall give notice of the resubdivision and the public hearing date to those person listed in the application as owners of property located within five hundred (500) feet of the resubdivision lots. Surrounding property owners within 500 feet were notified of the proposed Resubdivision. Forty- four (44) notifications were mailed out and three (3) were returned undeliverable. Planning Staff received no letters in opposition to the request. D. Section 24-5-30. B.6. -- The Planner shall send the application for resubdivision to referral agencies, including, but not limited, to municipalities within a three (3) mile radius of the property. The site is located within three (3) mile referral areas of the Towns of Firestone and Frederick and the City of Dacono. The City of Dacono responded with no concerns. No responses were received from Firestone or Frederick. The Saint Vrain Sanitation District and the Frederick -Firestone Fire Protection District also indicated no concerns on referral responses. The site is not located within an Urban Growth Boundary (UGB) of any municipality or Regional Urbanization Area (RUA). NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application of Elsa Valdez, and Jared and Kaitlin Lippert, for a Resubdivision, RES18-0006, to redesign Lot 31 of Block N and Lot 35 of Block K of Evans Addition, on the parcel of land described above be, and hereby is, granted subject to the following conditions: 1. Prior to Recording the Resubdivision Plat: A. The plat shall be amended to delineate the following: 1) All pages shall be labeled "Resubdivision of Block N and Block K of Evans Addition, RES18-0006". 2) The plat shall be prepared per Section 24-5-30.A.15 of the Weld County Code. 3) The plat shall contain the certification blocks, per Appendix 24-B.A and Appendix 24-G of the Weld County Code, including property owner certification blocks for Elsa Valdez, Jared Lippert, and Kaitlin Lippert and the Board of County Commissioners Chair. 4) Dunmire Street is a gravel road and is designated on the Weld County Functional Classification Map as a local road which requires 60 feet of 2019-2460 PL2717 RESUBDIVISION (RES18-0006) - ELSA VALDEZ, AND JARED AND KAITLIN LIPPERT PAGE 3 right-of-way at full buildout. The applicant shall delineate and label on the site map or plat the future and existing right-of-way (along with the documents creating the existing right-of-way) and the physical location of the road. All setbacks shall be measured from the edge of right-of-way. This road is maintained by Weld County. 5) Show and label the approved access locations, approved access width and the appropriate turning radii (25') on the site plan. The applicant must obtain an access permit in the approved location(s). 6) Show and label the drainage flow arrows. B. The following notes shall be delineated on the Resubdivision Plat: 1) This Resubdivision, RES18-0006, redesigns Lots 31 and 32 of Block N and Lots 35, 36 and 37 of Block K, Evans Addition, to create two lots, Lot 31 of Block N and Lot 35 of Block K. 2) Approval of this plan may create a Vested Property Right pursuant to Article 68 of Title 24, C.R.S., as amended and Chapter 23, Article VIII of the Weld County Code. 3) Allowed uses in the Resubdivision consist of A (Agricultural) uses listed in Chapter 23, Article III, Division 1 of the Weld County Code. 4) The Resubdivision shall comply with all the regulations and requirements of Chapter 24, Article V of the Weld County Code. 5) Installation of utilities and requirements of the service providers shall comply with Section 24-9-10 of the Weld County Code. 6) Buildings and structures shall conform to the requirements of the various codes adopted at the time of permit application. Currently, the following have been adopted by Weld County: 2018 International Building Codes, 2006 International Energy Code, 2017 National Electrical Code, and Chapter 29 of the Weld County Code. A plan review shall be approved, and a permit must be issued prior to the start of construction. 7) All access and utility easements are dedicated for the benefit of all owners of lots depicted on this plat, including owners of future lots created therefrom, regardless of lot configuration of number of users, and without limitation of the use or intensity of the use of such easements. No lot owner may install a gate or otherwise impede the use of such easements without the approval of all persons with rights use of such easements. 8) The property owner or operator shall be responsible for controlling noxious weeds on the site, pursuant to Chapter 15, Article I and II, of the Weld County Code. 2019-2460 PL2717 RESUBDIVISION (RES18-0006) - ELSA VALDEZ, AND JARED AND KAITLIN LIPPERT PAGE 4 9) The historical flow patterns and runoff amounts on the site will be maintained. 10) Water service may be obtained from the Town of Frederick. 11) Sewer service may be obtained from the Saint Vrain Sanitation District. 12) The site shall comply with all applicable rules and regulations of state and federal agencies and the Weld County Code. 13) RIGHT TO EXTRACT MINERAL RESOURCES STATEMENT: Weld County has some of the most abundant mineral resources, including, but not limited to, sand and gravel, oil, natural gas, and coal. Under Title 34 of the Colorado Revised Statutes, minerals are vital resources because (a) the state's commercial mineral deposits are essential to the state's economy; (b) the populous counties of the state face a critical shortage of such deposits; and (c) such deposits should be extracted according to a rational plan, calculated to avoid waste of such deposits and cause the least practicable disruption of the ecology and quality of life of the citizens of the populous counties of the state. Mineral resource locations are widespread throughout the County and person moving into these areas must recognize the various impacts associated with this development. Oftentimes, mineral resource sites are fixed to their geographical and geophysical locations. Moreover, these resources are protected property rights and mineral owners should be afforded the opportunity to extract the mineral resource. 14) The Weld County Right to Farm Statement, as it appears in Section 22-2- 20.J.2 of the Weld County Code, shall be placed on the map and recognized at all times. C. The applicant shall submit one (1) electronic copy (.pdf) of the draft plat for preliminary approval to the Weld County Department of Planning Services. 2. Upon plat approval by the Department of Planning Services, the applicant shall submit the RES18-0006 plat for recording in accordance with Sections 24-5-30.A.15 and 24-5-40 of the Weld County Code. A. The resubdivision plat shall be recorded within sixty (60) days from the date of the Board of County Commissioners Resolution. The applicant shall be responsible for paying the recording fee. If the resubdivision plat has not been recorded within sixty (60) days from the date of the Board of County Commissioners Resolution, or within a date specified by the Board of County Commissioners, the Board may require the landowner to appear before it and present evidence substantiating that the resubdivision has not been abandoned and that the applicant possesses the willingness and ability to record the resubdivision plat. 2019-2460 PL2717 RESUBDIVISION (RES18-0006) - ELSA VALDEZ, AND JARED AND KAITLIN LIPPERT PAGE 5 The Board of County Commissioners may extend the date for recording the plat. The Evans Addition Subdivision, a historic subdivision, was recorded October 21, 1917, Reception No. 123229. The Resubdivision will define the boundaries of the two lots to encompass the vacated portion of Koch Avenue. The Resolution was recorded May 16, 2018, Reception No. 4399678. When the ROW was vacated, half was granted to each property, however the applicants desire to divide the vacated ROW unequally. An incorrect quitclaim deed and a draft Resubdivision plat were recorded by the applicants who misunderstood the process on August 26, 2016, Reception No. 4231675. This Resubdivision and subsequent new deeds will properly define the property boundaries and clean the titles for these lots. The Resubdivision request is consistent with the size and use of the other lots in the vicinity and does not change the overall design, concept or nature of the subdivision. It will allow applicant Valdez to remove a single -wide mobile home and replace with a home on a permanent foundation that will be consistent in size with neighboring dwellings. The Department of Planning Services' staff recommends that this request be approved for the following reasons: 1. It is the opinion of the Department of Planning Services that the submitted materials are in compliance with the Resubdivision application requirements of Sections 24-5-30.A. and B. of the Weld County Code as amended by Ordinance 2018-03. A. Section 24-5-30.A -- An applicant shall submit a complete resubdivision application and application fee to the Planner. The applicant submitted a resubdivision application that included all the items applicable for review and a draft plat map of the subject lot being resubdivided. The application materials include an explanation of the resubdivision request. No rules, regulations, and ordinances are RES18-0006 — Valdez Lippert Page 2 of 6 proposed to be changed and the resubdivision plat will not be altered in any way which will adversely affect the character of the original subdivision plat. B. Section 24-5-30. B. -- Review procedures for resubdivision. The application was processed according to the review procedures for a Resubdivision. Pertinent processing information includes: 1. Section 24-5-30.6.1. -- Any person wanting to apply for review of a resubdivision shall arrange for a preapplication conference with the Department of Planning Services. Upon receipt of a complete resubdivision application, the Department of Planning Services will schedule the request before the Board of County Commissioners. A Pre -Application (PRE16-0088) meeting was held in April of 2016. At that meeting it was determined that a resubdivision was applicable. The vacation of Koch Avenue needed to be completed prior to the Resubdivision and the incorrect recorded deed and [;at were noted as issues that would need to be addressed through the process. 2. Section 24-5-30.8.2. -- In the event a utility easement is affected, the Department of Planning Services shall schedule the resubdivision request on the first available Utilities Coordinating Advisory Committee meeting before presenting the request to the Board of County Commissioners. No utilities are affected by the proposal. Both properties are already serviced by electricity, public water and public sewer. Therefore, this case was not reviewed by the Utilities Coordinating Advisory Committee. 3. Section 24-5-30.8.3. -- The Planner shall give notice of the resubdivision and the public hearing date to those persons listed in the application as owners of property located within five hundred (500) feet of the resubdivision lots. Surrounding property owners within 500 feet were notified of the proposed Resubdivision. Forty-four (44) notifications were mailed out and three (3) were returned undeliverable. Planning Staff received no letters in opposition to the request. 4. Section 24-5-30.8.6. -- The Planner shall send the application for resubdivision to referral agencies, including, but not limited to municipalities within a three (3) mile radius of the property. The site is located within three-mile referral areas of the Towns of Firestone and Frederick and the City of Dacono. The City of Dacono responded with no concerns. No responses were received from Firestone or Frederick. The Saint Vrain Sanitation District and the Frederick -Firestone Fire Protection District also indicated no concerns on referral responses. The site is not located within an Urban Growth Boundary (UGB) of any municipality or Regional Urbanization Area (RUA). This recommendation is based, in part, upon a review of the application materials submitted by the applicant, other relevant information regarding the request, and responses from referral agencies. The Department of Planning Services' Staff recommendation for approval is conditional upon the following: 1. Prior to Recording the Resubdivision Plat: A. The plat shall be amended to delineate the following: 1. All pages shall be labeled "Resubdivision of Lots 31 of Block N and 35 of Block K, Evans Addition" (Department of Planning Services) 2. RIGHT TO EXTRACT MINERAL RESOURCES STATEMENT: Weld County has some of the most abundant mineral resources, including, but not limited to, sand and gravel, oil, natural gas, and coal. Under title 34 of the Colorado Revised Statutes, minerals are vital resources because (a) the state's commercial mineral deposits are essential to the state's economy; (b) the populous counties of the state face a critical shortage of such deposits; and (c) such deposits should be extracted according to a rational plan, calculated to avoid waste of such deposits and cause the least practicable disruption of the ecology and quality of life of the citizens of the populous counties of the state. Mineral resource locations are widespread throughout the County and person moving into these areas must recognize the various impacts associated with this development. Often times, mineral resource sites are fixed to their geographical and geophysical locations. Moreover, these resources are protected property rights and mineral owners should be afforded the opportunity to extract the mineral resource. 14. WELD COUNTY'S RIGHT TO FARM STATEMENT: Weld County is one of the most productive agricultural counties in the United States, typically ranking in the top ten counties in the country in total market value of agricultural products sold. The rural areas of Weld County may be open and spacious, but they are intensively used for agriculture. Persons moving into a rural area must recognize and accept there are drawbacks, including conflicts with long-standing agricultural practices and a lower level of services than in town. Along with the drawbacks come the incentives which attract urban dwellers to relocate to rural areas: open views, spaciousness, wildlife, lack of city noise and congestion, and the rural atmosphere and way of life. Without neighboring farms, those features which attract urban dwellers to rural Weld County would quickly be gone forever. Agricultural users of the land should not be expected to change their long-established agricultural practices to accommodate the intrusions of urban users into a rural area. Well -run agricultural activities will generate off -site impacts, including noise from tractors and equipment; slow -moving farm vehicles on rural roads; dust from animal pens, field work, harvest and gravel roads; odor from animal confinement, silage and manure; smoke from ditch burning; flies and mosquitoes; hunting and trapping activities; shooting sports, legal hazing of nuisance wildlife; and the use of pesticides and fertilizers in the fields, including the use of aerial spraying. It is common practice for agricultural producers to utilize an accumulation of agricultural machinery and supplies to assist in their agricultural operations. A concentration of miscellaneous agricultural materials often produces a visual disparity between rural and urban areas of the County. Section 35-3.5- 102, C.R.S., provides that an agricultural operation shall not be found to be a public or private nuisance if the agricultural operation alleged to be a nuisance employs methods or practices that are commonly or reasonably associated with agricultural production. Water has been, and continues to be, the lifeline for the agricultural community. It is unrealistic to assume that ditches and reservoirs may simply be moved "out of the way" of residential development. When moving to the County, property owners and residents must realize they cannot take water from irrigation ditches, lakes, or other structures, unless they have an adjudicated right to the water. Weld County covers a land area of approximately four thousand (4,000) square miles in size (twice the size of the State of Delaware) with more than three thousand seven hundred (3,700) miles of state and County roads outside of municipalities. The sheer RES18-0006 — Valdez Lippert Page 5 of 6 magnitude of the area to be served stretches available resources. Law enforcement is based on responses to complaints more than on patrols of the County, and the distances which must be traveled may delay all emergency responses, including law enforcement, ambulance, and fire. Fire protection is usually provided by volunteers who must leave their jobs and families to respond to emergencies. County gravel roads, no matter how often they are bladed, will not provide the same kind of surface expected from a paved road. Snow removal priorities mean that roads from subdivisions to arterials may not be cleared for several days after a major snowstorm. Services in rural areas, in many cases, will not be equivalent to municipal services. Rural dwellers must, by necessity, be more self-sufficient than urban dwellers. People are exposed to different hazards in the County than in an urban or suburban setting. Farm equipment and oil field equipment, ponds and irrigation ditches, electrical power for pumps and center pivot operations, high speed traffic, sand burs, puncture vines, territorial farm dogs and livestock, and open burning present real threats. Controlling children's activities is important, not only for their safety, but also for the protection of the farmer's livelihood. C. The applicant shall submit one (1) electronic copy (.pdf) of the draft plat for preliminary approval to the Weld County Department of Planning Services. 2. Upon plat approval by the Department of Planning Services, the applicant shall submit the plat for recording in accordance with Section 24-5-30.A.15 and Section 24-5-40 of the Weld County Code. A. The resubdivision plat shall be recorded within sixty (60) days from the date of the Board of County Commissioners resolution. The applicant shall be responsible for paying the recording fee. Be aware that physical roadways may not be centered in the right-of-way. This road is maintained by Weld County. Per Chapter 12, Article 4, Section 12-4-30.B, a Weld County Right -of -Way Use Permit is required for any project that will be occupying, constructing or excavating facilities within, and/or encroaching upon, any County rights -of -way or easement. A final drainage report and detention pond design completed by a Colorado Licensed Professional Engineer is required prior to recording the USR map. Prosecution of Actions 1. Option to Pay, Settle or Compromise Claims The Company shall have the option to pay, settle or compromise for or in the name of the Assured any claim which could result in loss to the Assured within the coverage of this Binder, or to pay the full amount of this Binder. Such payment or tender of payment of the full amount of the Binder shall terminate all liability of the Company hereunder. 6. Limitation of Liability - Payment of Loss (a) The liability of the Company under this Binder shall be limited to the amount of actual loss sustained by the Assured because of reliance upon the assurances herein set forth, but in no event shall the liability exceed the amount of the liability stated on the face page hereof. (b) The Company will pay all costs imposed upon the Assured in litigation carried on by the Company for the Assured, and all costs and attorneys' fees in litigation carried on by the Assured with the written authorization of the Company. No claim for loss or damages shall arise or be maintainable under this Binder (1) if the Company after having received notice of any alleged defect, lien or encumbrance not shown as an Exception or excluded herein removes such defect, lien or encumbrance within a reasonable time after receipt of such notice, or (2) for liability voluntarily assumed by the Assured in settling any claim or suit without written consent of the Company.
