HomeMy WebLinkAbout20190590.tiffRESOLUTION RE: APPROVE ADDITIONS TO SECTION 2.000 CHILD WELFARE OF THE DEPARTMENT OF HUMAN SERVICES POLICIES AND GUIDELINES MANUAL WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with the Additions to Section 2.000 Child Welfare of the Department of Human Services Policies and Guidelines Manual, and WHEREAS, after review, the Board deems it advisable to approve said additions, a copy of which is attached hereto and incorporated herein by reference. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Additions to Section 2.000 Child Welfare of the Department of Human Services Policies and Guidelines Manual be, and hereby is, approved. Request Board Approval of the Department's Policies and Guidelines Manual Additions. These policies were revised to reflect current processes and/or further define the Department's activities and responsibilities. The policies were developed by involved Department staff and were provided to Legal for review and comments. 2.2.30. Kinship Background Checks for Emergency Placements (New) This policy was drafted pursuant to the provisions of C.R.S. 19-3-406. The Department has an obligation to perform initial criminal history checks on any person residing in a home that is being considered for an emergency kinship placement. These background checks are completed by the Weld County Sheriff's Office, through the use of, the Criminal Justice Information Services (CJIS) and the National Crime Information Center (NCIC) databases. Kinship Background Checks for Emergency Placements A. Introduction Pursuant to the provisions of C.R.S. 19-3-406, Weld County Department of Human Services (DHS) has an obligation to preform initial criminal history checks on any person residing in the home being considered for the emergency placement. These background checks are completed by the Weld County Sheriffs Office through the use of the Criminal Justice Information Services (CJIS) and the National Crime Information Center (NCIC) databases. B. Request Process NCIC backgrounds are required for an any emergency placement in a kinship home. Weld County Sheriffs Office and DHS have a :signedMemorandum of Understanding (MOU) outlining the roles and responsibilities to conduct these required background checks for DHS staff. 1. Emergency placementincludes assigned safety plan amongst family members and DHS, or a verbal order by the court;grantingtemporary custody to DHS or a kinship home. The DHS NCIC Request Form, included as Exhibit A, must be used for all requests. e NCIC Request Form must indicate a telephone number for ispatch to call and must be submitted via county email by a supervisor or designee. The faun must include verified names in their entirety, as well as, an accurate date of birth for each adult over the age of 18 living in the home. A social security number may be requested by booking staff to determine an accurate match has been made. The form will be emailed to Book.ingStaffnco.weld.co.us. Results of the background checks will be given to the supervisor or designee verbally, by booking staff, at the telephone number provided. i. Booking staff will notify the supervisor if the individuals in the household are clear or have disqualifying factors pursuant with C.R.S. 19-3-406. c) If an individual has a disqualifying factor, booking staff will notify the supervisor of the offense, the year of the offense and if there was a conviction noted. d) The booking staff will not communicate to DHS any charges that are not listed in section 4 of the C.R.S. 1 Department of Human Services' Policies EXHIBIT A Department of Human Services Emergency Placement Criminal History and Warrant Check Request Emergency placement request queries must be emailed to Booking Staff distribution list in Outlook on this from only. No requests will be accepted from personal email accounts. All requests must come from an employee listed on the approved Weld County DHS employee list.
