RE: ACTION OF THE BOARD CONCERNING IMPROVEMENTS AND ROAD
MAINTENANCE AGREEMENT ACCORDING TO POLICY REGARDING COLLATERAL
FOR IMPROVEMENTS AND ACCEPT OFF -SITE COLLATERAL FOR USE BY
SPECIAL REVIEW PERMIT, USR16-0041 - HUNT BROTHERS PROPERTIES, INC.,
C/O ASPHALT SPECIALTIES COMPANY, INC.
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, on August 2, 2017, the Weld County Board of Commissioners approved Site
Specific Development Plan and Use by Special Review Permit, USR16-0041, for Hunt Brothers
Properties, Inc. / Asphalt Specialties Company, Inc., 10100 Dallas Street, Henderson,
Colorado 80640, for Mineral Resource Development Facilities including an Asphalt Batch Plant;
Asphalt and Concrete Recycling Operations; any Use permitted as a Use by Right, Accessory
Use, or Use by Special Review in the Commercial or Industrial Zone Districts (heavy equipment
maintenance shop, administrative office building, quality control lab, liquid asphalt storage,
company fueling station and outdoor truck and equipment parking, staging and storage and raw
and processed material storage when screened from public rights -of -way and adjacent properties)
provided that the property is not a lot in an approved or recorded subdivision plat or part of a map
or plan filed prior to adoption of any regulations controlling subdivisions in the A (Agricultural)
Zone District, on the following described real estate, being more particularly described as follows:
Part of the NE1/4 and part of the E1/2 of the NW1/4
of Section 25, Township 1 North, Range 68 West of
the 6th P.M., Weld County, Colorado, which will
become Lot A of 2nd Corrected Recorded
Exemption, RECX16-0183, and Lot A of 2nd
Corrected Recorded Exemption, RECX16-0184,
once recorded in accordance with Condition of
Approval #1.6 of this Resolution
WHEREAS, a hearing before the Board was held on the 30th day of October, 2019, at
which time it was deemed advisable to continue said matter November 25, 2019, to allow for
consideration by a full quorum of the Board.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the abovementioned matter, be, and hereby is, continued to November 25,
2019, at 9:00 a.m.
