WHEREAS, evidence was presented in support of the granting of the Special Use Permit for an oilfield fluids disposal site on the abovedescribed real estate, and WHEREAS, Section 3. 3 (E) (2) of the Weld County Zoning Resolu- tion authorizes such a use in an Agricultural District upon appro- val by the Board of County Commissioners , and 790253 WHEREAS, the Board of County Commissioners of Weld County, Colorado heard all of the testimony and statements of those pre- sent, has studied the request of the petitioner and the recom- mendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter, and having been fully informed, is satisfied that the request for a Special Use Permit for an oilfield fluids disposal site on the hereinabove described real estate, conforms to the purposes of Section 3 .3 . (E) (2) of the Weld County Zoning Resolution. NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado that the application of the petitioner for -a Special Use Permit for an oilfield fluids dis- posal site on the hereinabove described tract of land be, and hereby is, granted subject to the development standards con- tained in the Special -Use Permit. Jeff Rech was present, on his fathers behalf, and answered questions regarding this request. Catherine Sprague an adjacent landowner was present and stated the problems they have encountered with said operation under the prior special use permit and expressed opposition to the present request. Mr. & Mrs. Anderson, adjacent landowners were present with their legal counsel, Kenneth Lind, and said they are basically pleased with the new plans. However, Mr. Lind mentioned some concerns they have with said plans. ASSISTANT COUNTY ATTORNEY LEE MORRISON NOW PRESENT Further discussion was held. Commissioner Roe made a motion to approve the special use permit request of Stan Rech for an oilfield fluids disposal site including the development standards as recommended by the Planning Commission. DEVELOPMENT STANDARDS 1 . The water and oil fluids recycling and disposal site granted by this Special Use Permit on the hereon described parcel is limited to the facilities shown hereon. Said facilities shall be: a. Emergency Lagoon — lined with bentonite with dimensions as shown hereon. b. Main Lagoon #1 - lined with bentonite with dimensions as shown hereon. c. One 300 barrel tank for use by Amoco Oil Company d. Five 4-00 barrel tanks for use by Amoco Oil Company. e. Three 30D barrel tanks . f . Parking area with dimensions as shown hereon. g. Skim Pit (Pit #2) with dimensions as shown hereon. --h. Settling Pit (Pit #1) with dimensions as shown hereon. -i . 10 ' wide x 350 ' long fresh water and 'gel pit. j . One circulating pump and motor. k. One -8 ' x 10 ' structure for use by, -operator. Additionally, all uses permitted by right in Section 3. 3 of the Weld County Zoning Resolution are allowed within the Special Use Permit area. 2. Access to the -Special Usc Permit area is limited' to one access point shown hereon. The access shall have the approval of the Weld County Engineering Department. The access shall be constructed in accordance with the recommendations and/or requirements of the Weld County Engineering Department. All private interior roads shall be graveled. Any damage caused to Weld County roads due to seepage created by this request shall be cause for immediate revocation of this permit and repairs shall be the financial resnonsibility _of the owner and/or operator. 3. All phases of the operation shall comply with all County and State -Health Standards and Regulations pertaining to air quality, water quality, noise emission, and sanitary disposal systems. Representatives or members of the Weld County Health Department, Weld County Department of Planning Services Zoning Inspectors, and/ar Colorado :Department of Health shall be granted access onto the site at any reasonable time in order to insure the operations carried nut on the site comply with all applicable Weld County and State Health Regulations . 5. Upon cessation of operations at the site all structures shall be removed to 30" below grade and all ponds or pits shall be filled and graded so .as to conform with the surrounding terrain. The Special Use Permit area shall be reclaimed to a farmable state upon completion of the operations . The property shall be seeded in wheat or alfalfa or other appropriate -ground rover approved by the Soil Conservation Service. 6. Storage of oil field drilling and associated equipment shall not be permitted within the Special Use Permit area. 7. Parking on County Roads 18 and 31 will be prohibited. Parking will only be allowed within the property described hereon. 8 . Construction of the lagoons and bentonite blanket embankment shall be in accordance with the designs as shown on the Special Use Permit plat and the recommendations -as contained in the Chen and Associates Subsoil Investigation Report, Job No. 19, 083, dated August 29, 1979. Capacity of the pond shall be constraine6 by the designed capacity and actual size of the ponds as constructed in accordance with the designs as shown on the Special Use Permit plat and the recommendations as contained in the above report #19083 by Chen and Associates. 9. The settling pit and skim pit as shown hereon shall be screened with a one-inch wire mesa to prevent wildlife gaining access to the pit. If at any time the lagoons as shown hereon contain oil, the applicant shall be required to screen them in a like manner as the settling pit. 10. There shall be a groundwater well to monitor possible leakage from the evaporation ponds and other pits on the property. The Weld County Health Department and State Health Department shall have access to this well at all times to determine possible contamination of the groundwater. This well shall be installed as per Weld County Health Department guidelines for depth to groundwater table. 11 . The Special Use Permit shall be limited to the plans shown hereon and governed by the Development Standards stated above and all applicable Weld County Regulations. Any material deviations from the plans and/or Development Standards as shown or stated above shall require the approval of an amendment to the Special Use Permit by the Planning Commission and the Board of County Commissioners before such changes from the plans and/or Development Standards shall be permitted. Any other changes from the plans and/or Development Standards shall be filed in the office of the Department of Planning Services. 12 . The property owner and/or operator of this operation shall be responsible for complying with all of the above stated Development Standards. Noncompliance with any of the above stated Development Standards shall be 'reason for revocation of the Special Use Permit by the Board of County Commissioners. 13 . The Weld County Health Department shall be given notice within a 24 hour period of use of the emergency lagoon by the operator of the site. Such use -must be a true emergency and not for normal storage of water or normal operations of the site. 14. The freeboard allowance for all dikes designed to retain water or other fluids shall be as specified by the Weld County Health Department. 15 . All pits, lagoons, and other excavations containing water at any time shall be lined with bentonite or other impervious material as per State and County Health Department guidelines to prevent seepage to the groundwater. COMMENTS : 1 . The Fort Lupton Fire Protection District and Fort Lupton Public Service did not respond to the referrals sent to them regarding this request. 2. The Weld County Engineering Department in a letter dated August 13 , 1979 stated that the request will result in increased traffic to the property. The Engineering Department also has concerns regarding possible damage to county roads due to seepage. These recommendations have been incorporated into Development Standard #2 . 3 . The Colorado Division of Wildlife has in a letter dated August 1 , 1979 recommended that any pond that has oil in it at any time should be protected in such a manner that no wildlife could gain access to it. This recommendation has been incorporated into Development Standard #9. - 4 . Additionally, all uses permitted by right in Section 3. 3 of the Weld County Zoning -Resolution are allowed within the Special Use Permit area. 2. access to the Special Use Permit area is limited' to one access point shown hereon. The access shall have the approval of the Weld County -Engineering Department. The access shall be constructed in accordance with the -recommendations and/or requirements of the Weld County Engineering Department. All private interior roads shall be graveled. Any damage caused to Weld County roads due to seepage created by this request shall be cause for immediate revocation of this permit and repairs shall be the financial responsibility of the owner and/or operator. 3. All phases of the operation shall comply with all County and State Health Standards and Regulations pertaining to air quality, water quality, noise emission, and sanitary disposal systems. Representatives or members of the Weld County Health Department and/or Colorado Department of Health shall be granted access onto the site at any reasonable time in order to insure the operations carried out on the site comply with all applicable Weld County and State Health -Regulations . 5. Upon cessation of operations at the site all structures shall be removed to 39" below grade and all ponds or pits shall be filled and graded so as to conform with the surrounding terrain. The Special Use Permit area shall be reclaimed to a farmable state upon completion of the operations . The property shall be seeded in wheat or alfalfa or other appropriate ground cover approved by the Soil Conservation Service. 6. Storage of oil field drilling and associated equipment shall net be permitted within the Special Use Permit area. 7. Parking on County Roads 18 and 31 will be prohibited. Parking will only be allowed within the property described hereon. Fr _ 8 . Construction of the lagoons and bentonite blanket embankment shall be in accordance with the designs as shown on the Special Use Permit plat and the recommendations as contained in the Chen and Associates Subsoil Investi ation Re ort Job No. 1-9 083, dated August 29, 1979. Capacity of the pond shall be constrained' by the designed capacity and actual size of the pond-s as constructed in accordance with the designs as shown on the Special Use permit plat and the recommendations as contained in the above report #19083 by Chen and Associates. 9. The settling pit and skim pit as shown hereon shall be screened with a one—inch wire mesh to prevent wildlife gaining access to the pit. of at any time the lagoons as shown hereon contain oil, the applicant shall be required to screen them in a like manner as the settling pit. 10. There shall be -a groundwater well to monitor possible leakage from the evaporation ponds and other pits on the property. 7Phe Weld County Health Department and State Health Department shall have access to this well at all times to determine possible contamination of the groundwater. -This well shall be installed as per Weld County Health Department guidelines for depth to groundwater table. 11 . -The Special Use Permit shall be limited to the plans shown hereon and governed by the Development Standards stated above and all applicable Weld County Regulations. Any material deviations from the plans and/or Development Standards as shown or stated above shall require the approval of an amendment to the Special Use Permit by the Planning Commission and the Board -of County Commissioners before snch changes from the plans and/or Development Standards shall be permitted. Any other changes from the plans and/or Development Standards shall be filed in the office of the Department of Planning Services. 12. The property owner and/or operator of this operation shall be responsible for complying with all of the above stated Development Standards. Noncompliance with any of the above stated Development Standards shall be reason for revocation of the Special Use permit by the Board of County Commissioners. T111i - - COMMENTS: 1 . The Fort Lupton Fire Protection District and Fort Lupton Public Service did not respond to the referrals sent to them regarding this request. 2. The Weld County Engineering -Department in a letter dated August 13, 1979 stated that the request will result in increased traffic to the property. The Engineering Department also has concerns regarding possible damage to county roads due to seepage. These recommendations have been incorporat-ed into Development Standard #2 . 3. The Colorado Division of Wildlife has in a letter dated August 1 , 1979 recommended that any pond that has oil in it at any time should be protected in such -a manner that no wildlife could gain access to it. This recommendation has been incorporated into Development Standard #9. 4 . Groundwater was relatively shallow, encountered within the upper sands at approximate depth 5 to 9 feet. (2) The natural subsoils are suitable for support of the proposed low embankment sections. Minimal site prepration for fill placement will be required. The on-site soils are also suitable for use as embankment fill material. (3) Considering the subsurface profiles and soil types, construction of relatively impervious embankment and foundation sect ions does not appear feasible. IIIT - 2 - SCOPE This report presents the results of a subsoil investigation for the p opbsixl evaporation ixand to he located at 15267 County l:na1 No. 18, approximately 5 miles northeast of Fort Lupton, Weld County, Colorado. The report presents the general subsoil conditions and reaxnnended pxnnd construction procedures. PROPa8ED CONSTRUCTION The proposed evaporation pond will he located within an area extending approximately 800 feet south of the existing plant facilities at the north end of the lot. The proposed pond will he cut arxi filled to obtain a hottan elevation of approximately 50(17 feet and an impoundment depth on the order of 6 to 8 feet. Tentative interior :rif exterior slopes of 4:1 and 3:1 (horizontal to vcrittca1 ), respectively are propx)sed. The overall ground surface is relatively flat and stores down to the west, southwest with approximately 10 feet of elevation differential. The existing plant facilities to the north consist- of several small tanks aril pits with a fairly new bentonite lined lagoon, which will be used as ucergency capacity. Slopes of this rind are approxirrately 5: 1 interior and 3:1 exterior. SUBSOIL CONDITIOfiS The subsoil ccxxiitions were investigated by drilling 5 explora- tory holes within the embankment and rx>n1 bottom areas at the alI roxi- mate locations shown on fig. 1. Graf#ric lots of the subsoil profiles encexrnterni at the test hole locations are shown on fig. 2. fkanerally, they consist of fairly clean to silty sands overlying a combination of stiff clays and claystone txxdrock belch,' approximate depth, 5 to 14 feet. An approximate 4 frxst depth of sand fi1l was encountered at Test Hole 2 within the northeast corner of tl.e site. The fill and natural sands are predominantly fine to haulm ,mai-ned and generally mixiiiun dense in their natural state. Sarx3y to very sandy clays were generally encountered below the sands at the north end, whereas claystone bedrock was encountered at the south end. The exposed surface within the entire pond area should then he scarified a minimum 6 inch depth, moistened and ccxnructed. After a truck _goes to -a lease and picks up a lend of water, he would bring the load to our disposal and unload into -a it series of tanks. These tanks would strain the oil out of the water and then the water would go into •pen pits. PIT #1—The water comes out of the tanks into this pit and it is covered with 1" mesh wire, with steel tubing frame. This pit will be 75' square, and 5' deep. PIT #2-The water will come into this pit thru underground 7" pipe. This pit is also 75' square and 5' deep. PIT #3-The water comes into this pits thru 8" pipe also underground. This pit is 300' h . long and 12' -wide. From_these three pits the water will go into evaporation pits. EVAPORATION PIT #1-This pit will be 300' by 500' . The dikes will be built to the states and the engineers specifications. These 2 pits are connected with 8" pipe. c,VAPJRATION PIT #2— This pit -will be 320' by 850' . The dikes on this pit will be the same as pit #1. All the above mentioned pits will be sealed with bentonite according toy the States recommendation and our private engineers report. The amount of water hauled into this disposal will be limited to what these pits will take care •f en an evaporation basis. Presently, the development of the unit is not corresponding with the plans on the blueprint. There should be no problem -with the operation from a wildlife standpoint , if the plans -project a true picture of the operation. There is some rather serious doubt in my mind concerning the present opera- tion. There is one large pit with oil that is properly covered with poultry netting; -however, right inside it is a small pit covered with oil that is completely unprotected. Also, just to the east of the tanks and new large pond is a trench with oil; and 3t, too, is not protected in any away. Of course, I had no -way of telling -when the oil was placed in these open -pits; but it was obvious that they are presently in use. • It is recommended that no further permits be issued until the present operation is cleaned up and -properly protected. As you-know Stan Rech Disposal is under a Cease and Desist Order issued by the Colorado Department of Health. No documentation, in the form of proposed or preliminary plans and engineering design , has been received to date by this -office. An engineering design of the renovated pits must be submitted to this office before the Cease and Desist Order can be lifted. Specifically, this office must have the following information: I . An engineering drawing of typical pit design with specific detail of liner design. 2. Specifications of materials to be used in the liner construction and specific method of emplacement of salt, liner. 3. Construction standards, methods or specifications insuring that the proposed liner will be properly installed to provide an impermeable (K=<10'� cm/sec) barrier to percolation of contaminating fluids to groundwaters. 4. Designation of responsible party (preferably a registered pTofessional engineer) who will oversee the project to insure use of suitable materials and proper installation and certify same. In the- opinion of the Division of Water Quality Control , the owner Mr. Rech and hi-s desivated engineer Mr. Ed Lind have had sufficient time to submit the requested data and commence work to alleviate the groundwater contamination, Ms. Vickie Traxler I August 1 , 1979 Page 2 which would occur should the -disposal site begin operations. The Division of Water Quality Control , will not lift the Cease and Desist Order unless or until the above information is received and approved. A field recorraissance i-nspection of the Stan Rech Disposal site on July 26, 19-79, revealed that some materials are being admixed into the native soil . The work inspected produced a totally unacceptable product which would have little benefit in preventing ground water Contamination. 1 hope this answers your questions. It formed Dmealian deposits. Included in this unit are some soils with lime above -40 inches. Typically the surface layer is brown -sand about 8 inches thick. The underlying material, to a depth of 60 inches is brown sand. Permeability is rapid. Available water capacity is moderate: Effect— ive rooting depth is 60 inches or more. Surface runoff is slow and erasion hazard is low. This soil is suited to limited xropprng; intensive cropping is hazardous bexause of erosion. The cropping system should be limited to -close grown xrops such as alfalfa, wheat and barley. The soils also are adopted to irrigated pasture. A suitable cropping system would be alfalfa 3 to 4 years followed by xorn and small grain for 2 years and alfalfa seeded with a nurse crop. Close grown props may be irrigated from closely spaced •contour ditches or sprinklers. Contour furrows or sprinklers -should be used for new crops. Applications of barnyard an-d commercial -fertilizer will -help maintain good production. The potential vegetation on this sail is dominated by sand bluestem, sand reedgrass, switchgrass, sideoats grams, needle and thread, little bluestem and blue grams. Potential production ranges from 2500 pounds Cper acre in favorable years to 11300 pounds per acre in unfavorable years. When range condition -deteriorates, send bluestem, switchgrass, sand reed- grass , sideoats grama and little bluestem decrease and production drops. In nonirrigated areas this soil in suited to winter wheat, barley and sorghum. Most of the area is devoted to winter wheat which is alter- nated with summer fallow to allow moisture accumulation. Normally, precipitation is too low to make beneficial use of fertilizers. Good cultural practices such as stubble mulch farming, strip cropping and minimum tillage are needed to combat wind and water erosion. Terr- acing tray also be needed to control water erosion. The potential native vegetation on this site is dominated by sand bluestem, sand reedgrass and blue grama. Needle and thread, switch- grass, sideoats grama and _western wheatgrass are also prominent. Po- tential production ranges from 2200 pounds per acre in favorable years ( to 1800 pounds per acre in unfavorable years. When range condition deteriorates, sand blwestem, sand reedgrass and switchgrass decrease and blue grams, sand dropseed and sand sage increase. Annual weeds and grasses invade the site as range condition becomes poorer. Management of vegetation on this soil should be based on taking half II and leaving half of the total annual production. Also included are some soils with loamy substratums and some soils that are noncalcareous to depths of 60 inches . Typically the surface layer is a grayish brown loamy sand about 6 inches thick. The subsoil is a brown to light yellowish brown fine sandy loam about 22 inches thick. The substratum, to a depth of 60 inches, is a sandy loam or loamy sand. CPermeability is moderately rapid. Available water capacity is _moderate. Effective rooting depth is 60 inches or more. Surface runoff is slow and erosion hazard is low. Where irrigated this soil is suited to the commonly grown crops in the area. However, perennial grasses and alfalfa or close grown crops should be grown at least 50 percent of the time. Close grown crops and pasture can be irrigated with contour ditches and corrugations. Furrows, contour furrows and cross slope furrows will work on row crops. Sprin- kler irrigation is also recommended. Minimum tillage and crop residue utilization will help control erosion. Fertility maintenance is important . NW NW4, Section 12, T1N, R66W LOCATION: 2 miles east and Z mile south of Fort Lupton APPEARANCE: Jim Smith, Attorney DISCUSSION: Tom Honn was first asked by Chairman Otis to bring the Planning Commission members up-to-date regarding the continuance of this application since July 17 , 1979. This item was tabled pending receipt of additional information as requested by the State Health Department regarding evaporation. The plans have been revised which now show a change to the design of the operation. There is presently a Special Use Permit on the site, but because an violation has taken place, the applicant chose to solve the problem by amending the SUP to add one additional pond ane redesign the system. Mr. Smith then explained that one of the pits collapsed due to last year ' s hard winter. The modification now is for one large pit which would enable more evaporation. There will also be an emergency lagoon and will be constructed exactly the same as the new pit. The emergency lagoon will be resealed with bentonite and an emergency overfill dike will be provided. Jim Gilbert then asked John Hall of the Weld County Health Department to comment on what possible testing could be used to insure the seal is there and continues to be there over a period of years. Mr. Hall stated it would be most appropriate to have some type of test well initiated to monitor possible contamination of the water from leakage. WZSW4, Section 22, T2N, R66W LOCATION- 1 mile north and 2 miles east cf Fort Lupton iAPPEARANCE: Jeff Rech and Sam Olr1enlurg, Attorney DISCUSSION: Tom Honn brought the Planning Coi::uiission up-to-date i regarding the continuance of this application since its continuance from August 21, 1979. There was a Special Use Permit en this site, however, the Board of County Commissioners has recently revoked the i permit when several problems arose. This application is for a revised plan. Mr. Oldenburg gave a brief historical background of the site. Discussion followed regarding the problems that occurred on the site ' which eventually caused the revocation of the permit, basically because of the failure of the dike and leaching. County Road 31 was closed because of this problem. Cathy Carter, Zoning Inspector, gave her report of inspections she has made at the site and eventual issuance ' of a zoning violation. John Hall of the Weld County Health Department questions the amount of evaporation from the pit from excess water in the pits. Discussion followed. The subject was also brought up regarding free-boarding on the dike. Tom Honn then read the Planning I Staff' s recommendation for approval, the Development Standards , and comments. Jeff Rech answered several of the technical questions regarding the proposal as regards the stability tests and free-boarding . Discussion followed. Ken Lind, representing Mr. and Mrs . Adolph Anderson, expressed several concerns. These basically being that he would like to have approval from the County Health Department as regards the design standards and operation of the site, whether or not the pits will be or are to be sealed, free-boarding of the dike, and that the County Health Department be notified 24 hours after the ' emergency lagoon is used and that it be used only for an emergency. MOTION: Be it therefore resolved to recommend approval with the Development Standards based on the Planning Staff ' s recommendation. Tom Honn first read into the record the Planning Staff' s recommendation for approval and the Development Standards for each. Mr. Sears stated he that is in agreement and will comply with the Development Standards as proposed by the Planning Staff. Mr. Sears then discussed the sewage situation as it regards the soil condition in that area. He stated that the land there is no different than other land west of Greeley which has already been developed and uses septic tanks . Mr. Gilbert asked John Hall of the Weld County Health Department if he saw any problems with the septic tanks system. Mr. Hall stated he was concerned with the number of tanks which would be used (approximately 168) and feels there are alternatives to this . It was later suggested that perhaps the septic tank system could be limited to the first filing and would no longer be used once the City of Greeley system is available. Chairman Otis then asked if anyone in the audience would care to comment on the proposal . Bryan Shaha, attorney representing the Homeowners Association and also a property owner in Westridge, expressed their concern regarding the proposal especially as it concerns 24th Street. Mr. and Mrs. Archer built the residence on the lot unaware that the frontage was nonconforming. The other lot contains the utility services. He then stated that he had visited with Mr. Mondt who had requested that Mr. Intermill visit with him and answer some of his concerns regarding the proposal. He also stated that he has met with the County Engineering Department regardining maintenance of County Road 380. The Highway Department still does not feel they should be totally responsible for the maintenance of this road, but will be responsible for minor maintenance as necessary. The Planning Staff ' s recommendation for approval was read into the record at the last meeting. Tom Honn stated that at the last meeting the issue was brought up regarding the use of a rock crusher in Operation Standard #8. It was felt by the Planning Commission members at that time that rock crushers may not be allowed. Mr. Honn requested that this matter be dealt with one way or the other at this hearing. Only two Planning Commission members were present at this meeting who had heard previous testimony regarding the application who could vote at this meeting. Mr. Intermill was given the option of having a vote taken at this time or waiting until other Planning Commission members had had an opportunity to listen to the tapes of the August 21, 1979 meeting so they could vote at this time. The existing Erie landfill was closed by order of the Board of the County Commissioners in June, 1979 which is located immediately to the east of the proposed site. This site was closed due to a lack of a written lease and problems with cover. The new landfill proposal is proposed so that Weld County will be in compliance with the 1976 Resource Conservation and Recovery Act. He also asked that the site not be limited to the area as recommended in the Planning Staff' s recouuiendation. Frank Suckla expressed concern regarding the protection of Coal Creek and possible contamination of the Fox Hills Sand. Chairman Carlson stated he hoped no chemicals would be dumped onto the site. Mr. Nelson assured him this will be strictly controlled. Discussion followed regarding hazardous wastes as brought up by John Hall of the Weld County Health Department. Discussion followed regarding dust abatement, access to the site and concerns of the Town of Erie. The Town has indicated there will be proposed development in the area of the proposed site and indicated disapproval of the landfill in that area. General discussion followed. Highway 34 Bypass APPEARANCE : Art Uhrich of ARIX and Dick Weber DISCUSSION: This proposal is for a proposed subdivision on approximately 146 acres with 114 lots proposed. Mr. Uhrich stated that the Highway Department was concerned about the access to the area south of the Greeley-Loveland Ditch which is not shown on the plat. They requested that some means of access other than the highway should be planned for this area. The Planning Staff had several concerns regarding the proposal, one being that the City of Greeley has indicated city water is available to the site providing the developer meet and initiate all city requirements. The Greeley Planning Commission recommended approval of the proposal conditional upon the development meeting City standards. The applicant' s intent as to whether or not the development will be built to City of Greeley standards which includes curb, gutter and sidewalks was not clear at this time. The present proposal does not include standards for curb, gutter and sidewalk. If the development is not to be built to City standards, it was the opinion of the Planning Staff that the City will not provide water service. If this occurs, the preliminary plan will not be consistent with the Subdivision Regulations . These regulations requires that water service will be available prior to approval of the plan. The staff was also concerned whether the subdivision will be served by a public sanitation system or on-lot sewage disposal system that will not result in water pollution. The Weld County Health Department has questioned the suitability of the septic systems . Since these were the concerns by the Planning Staff their recommendation at this time was to continue the hearing until some of these concerns had been satisfactorily resolved which was read into the record by Tom Honn. Dick Weber then presented a letter to the Planning Commission which states that they agree to develop the proposed subdivision according to the City of Greeley standards as it regards sidewalks , streets, water and sewer installations as requested by the Greeley Planning Commission in their meeting on August 28, 1979. There will be no septic systems which was a concern by the Weld County Health Department. John Hall of the Weld County Health Department stated that they Health Department would have no further concerns in this regard if the septic system is eliminated. At this time Josephine Jones asked several questions regarding whether or not the electrical lines would be above or below ground and if there was a provision for open space within a three miles radius. Jerry Paul stated he had not seen a copy of the revised plat which he was then shown by Mr. Uhrich indicating the street plan to him. Lawrence Smith and Diane Discoe expressed concern about 24th Street becoming a traffic problem and safety of children in the area. Harry Cross stated he was concerned about drainage from the area. Marge Speaker expressed concern about the entrance to the area which could create dust pollution because the street is not paved and was also concerned about the children in the area and their safety. She also felt there could be a problem with mosquitoes from the detention ponds . Discussion followed regarding responsibility for road maintenance. Mr. Sears first asked that the Planning Staff read their recommendation to the Planning Commission. Tom Honn read the Planning Staff' s recommendation for continuing the hearing for the change of zone requests only. The staff had several concerns regarding availability of water from the City of Greeley, whether or not the subdivision will be served by a public sanitation system or on-lot sewage disposal system. The County Engineer has also expressed several concerns as well as the City of Greeley which need to be resolved before the Planning Staff can make a recommendation on the proposal. Mr. Sears then commented that he feels this is the best conceived, most carefully planned subdivision he has ever been involved with and was very much concerned about some of the recommendations received by several referral agencies . He stated he was most anxious to have his "day in court" with them at the next scheduled Planning Commission hearing. He stated he feels they are at somewhat of a standstill regarding the water service. He also stated that the septic system was designed for installation of a total sewer system, but they must comply with the Greeley-Loveland Shareholders Agreement. There was also some discussion regarding 24th Street and the possibility of it becoming a collector street. Dr. Smith, surrounding property owner, again expressed concern about 24th street. He feels that when the city and the county meet regarding an issue of this nature that surrounding property owners should be included and asked for their comments since they live in the area in question. Victor Clifton also couruiented on the loss of prime agricultural farmland and concern for the safety of the children on 24th Street. Don Billings stated he found it somewhat unrelated that a property owner in a subdivision has objection to another subdivision. Discussion again followed. The general nature of the improvements have been discussed with the Commissioners . The plans will be forthcoming within the next week to ten days and may be the subject of further public hearings . The exceptions are necessary in order for 31 Disposal- to. increase the evaporation capability of the lagoons in order to accommodate the current needs in Weld County for disposal of contaminated water, and prevent freezing of certain pipes and other facilities of 31 Disposal during the upcoming winter months . Freezing would curtail the opera- tions conducted at 31 Disposal. It is the understanding of the undersigned, that an emergency exists with respect to disposal of contaminated water within Weld County, Colorado. 31 Disposal is currently operating at its maximum permitted capacity and during the course of the last week to ten days has been forced to curtail its operations. We are informed that the only similar opera- tion within Weld County is also experiencing operating diffi- culties , which, taken together with the limited capacity Weld County Commissioners September 19 , 1980 Page Two of 31 Disposal has created a serious problem. No additional capacity exists to dispose of contaminated water in the Weld County area to meet the current needs for disposal of con- taminated water. Under the circumstances outlined above , 31 Disposal seeks emergency exception to its special use permit to allow it to increase the size of the dikes or walls of the south lagoon by some two and a half to three feet. At the same time 31 Disposal seeks to establish electrical connections and a gas tap upon its site in order to insure continuous evaporation during the upcoming winter months which continuance may only be insured by the presence of electricity and gas . Both the addition to the dikes and the electric and gas connections will be part of the final plan submitted to the Commissioners in connection with 31 Disposal ' s amendments to its special use permit. There will be further opportunity for a public hearing on this matter prior to final approval by the Commissioners of the entire proposal from 31 Disposal. 31 Disposal intends to use Mr. George Norden, Norden and Sons , Box 310 , Fort Lupton, Weld County, Colorado, to perform the necessary construction of the lagoon dikes . Mr. Norden has reviewed the site and informs us the capacity of the south lagoon can be increased by building up the walls of the lagoon by some two and a half to three feet. Sand for the building of the walls will come from sand currently existing on the southern portion of 31 Disposal' s property. Mr. Norden informs us that it will take him approximately two weeks after notification to proceed to get proper equipment to perform the necessary work. Once the equipment is assembled, it will take Mr. Norden approximately a week to ten days to finish construction. Mr. Norden has assured us that no equipment will be used on the inner face of the lagoon and that there will be no disturbance of the bentonite seal of the lagoon. 31 .Disposal will obtain whatever additional bentonite is necessary in order to insure proper seal of the extension of the lagoon dike. Thus 31 Disposal would have limited capacity for a week to ten days during construction of the dikes . 31 Disposal is informed that Public Service Company of Colorado can provide proper electric and gas connections or extensions to the site. Due to two days of rain, project has boon slowed down. Excavation equipment was not in operation today. Pictures were taken. Contact was made with Stan Rech. He stated the following: 1. Several loads of bentonite have boon spread and several more loads will be delivered on May 3, 1980. Sealing will begin Monday, May 5, 1980. He hopes he will have enough bentonite to complete the project on Monday. 2. John Hall was on site with approximately seven people from the FPA on Thursday, May 1, 1980. I will get a report fran John Hall regarding said visit. 3. I reviewed with Stan what needs to be done to get the development standards in compliance. He understood my review and felt that the only thing that would it stop/fran being done by May 14, 1980 was the weather. I gave him my business runs card and advised to call me if he / into any problems that would stop him fran being done by the 14th. He agreed. 4. The settling pit is screened but has oil floating on the surface which Stan admits. 5. The long narrow trench to the east of settling pit and emergency lagoon is partically filled with sand. Stan will have this trench canpletely filled and closed by May 14, 1980. 4. Stan admits that trucks have been dumping drilling mud directly into the emergency lagoon, which is at least half full of fluid at this point and time. He was once again warned that the emergency lagoon cannot have water in it effective May 14, 1980. Stan admits that the trucks dumping drilling mud into the emergency lagoon have destroyed the bentonite sealer and further admits that he has allowed water trucks to dump their drilling mud into the anergency lagoon as a sealer. I advised him that he cannot do this and that he will have to repair the emergency lagoon dikes before May 14, 1980 hearing in order to be in compliance. Pictures taken will show that the west dike of the anergency lagoon has eroded grossly with the last two or three rainstorms. Stan agreed that this would be fixed prior to May 14, 1980. He also agreed that it would remain free of erosion in the future even if he had to seal the dike with bentonite. 7. Stan admits he has a contract with Milton Adams to purchase the operation. Milt told him he would be willing to buy it when he has everything in compliance with the development standards. Stan said he was not sure he wanted to sell now that he is almost done. --X8. Pictures taken also indicate erosion on the west dike of the lagoon number 1. Stan said he would constantly grade this dike and seal it with bentonite if he had to stop erosion. 9. Stan admits that trucks have not been recycling their water waste through his cycling system but have been dumping directly into the skim pit. He feels that if he keeps the operation,he wants to hire a security person to be present during the hours trucks are utilizing the waste disposal site. 10. We are fearful of a similar incident which occurred the week of August 13, 1979, when a similar disposal pond released oil waste into the Speer Canal. The Fulton Canal carrying water to several thousand acres of land owned by Weld County farmers flows through Section 21, less than a mile west of the disposal pond. Any overflow or seep from the pond will pollute the waters of Fulton and damage farm lands.
