HEARING CERTIFICATION DOCKET NO. 2019-29 RE: A SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT, USR18-0115, FOR MINERAL RESOURCE DEVELOPMENT FACILITIES INCLUDING OIL AND GAS SUPPORT AND SERVICE, INCLUDING FOUR (4) GAS COMPRESSORS, MOTOR CONTROL CENTER AND RELATED EQUIPMENT AND UP TO FOUR (4) CONSTRUCTION OFFICE TRAILERS, AND SIX (6) CONEX CONTAINERS FOR USE DURING THE CONSTRUCTION OF THE FACILITY IN THE A (AGRICULTURAL) ZONE DISTRICT - KAUFFMAN BROTHERS LIMITED PARTNERSHIP, C/O CURETON MIDSTREAM, LLC A public hearing was conducted on March 6, 2019, at 10:00 a.m., with the following present: Commissioner Barbara Kirkmeyer, Chair Commissioner Mike Freeman, Pro-Tem Commissioner Sean P. Conway Commissioner Scott K. James Commissioner Steve Moreno Also present: Acting Clerk to the Board, Jessica Reid Assistant County Attorney, Bob Choate Planning Services Department representative, Angela Snyder Public Works Engineer representative, Hayley Balzano • Health Department representative, Ben Frissell The following business was transacted: le I hereby certify that pursuant to a notice dated January 28, 2019, and duly published February 1, 2019, in the Greeley Tribune, a public hearing was conducted to consider the request of Kauffman Brothers Limited Partnership, c/o Cureton Midstream, LLC, for a Site Specific Development Plan and Use by Special Review Permit, USR18-0115, for Mineral Resource Development Facilities including Oil and Gas Support and Service, including four (4) gas compressors, motor control center and related equipment and up to four (4) construction trailers, and six (6) conex containers for use during the construction of the facility in the A (Agricultural) Zone District. Bob Choate, Assistant County Attorney, made this a matter of record. El Angela Snyder, Department of Planning Services, presented a brief summary of the proposal which is located on a 20 -acre lot in the north-east corner of the property, and Subdivision Exemption, SUBX18-36, is being processed in conjunction with the USR. She noted it is within the three (3) mile referral area of the Town of Keenesburg, which did not request annexation at this time, and stated the application was sent to 11 referral agencies. Ms. Snyder explained the request is for an unmanned compressor station that will be fully fenced and have a gravel pad and lay down yard. She further stated the area outside the fence will be revegetated with native grasses, and the facility will operate 24 hours a day, seven (7) days a week. She described surrounding property uses, displayed images of the site, noted there had been no correspondence from surrounding property owners (SPO), and entered the favorable recommendation of the Planning Commission into the record as written. c,G PL( aS/TP),Pwc(-t(3), EhtCBF) ou/o'flq 2019-0851 PL2645 HEARING CERTIFICATION - KAUFFMAN BROTHERS LIMITED PARTNERSHIP, C/O CURETON MIDSTREAM, LLC (USR18-0115) PAGE 2 El Hayley Balzano, Public Works Engineer representative, presented a brief overview of the transportation plans and requirements, provided information about the access and stated it will require an access easement. She described the map requirements, gave daily roundtrip counts and speeds, stated a Road Maintenance Agreement will be required during construction, and addressed the drainage requirements. Ej Ben Frissell, Department of Public Health and Environment, reviewed the water and sewer provisions and stated bottled water and portable toilets will be used during construction. He indicated only a small amount of fuel will be stored onsite, and Development Standards (DS) #17- 32 address Environmental Health (EH) items. El Nick Holland, applicant, gave a PowerPoint presentation sharing company highlights, their business model, and a footprint of the existing and proposed compressor stations. He stated there was a community meeting in October of 2018, with no attendees, and noted he had received letters of support from SPOs. Mr. Holland displayed images of the site, including the access on CR 63, showed a depiction of the proposed compressor station, and described surrounding land uses. El Andrew Truitt, Behrens and Associates Environmental Noise Control, Inc., provided results of the Acoustical Engineering Assessment encompassing an Ambient Sound Study, Noise Modeling Methodology, and a Noise Contour Map, and stated the facility will comply with the Development Standards for the proposed site, based on the results. • Mr. Holland provided examples of Cureton Midstream, LLC's, safety standards evidenced in their mechanical design, testing, control systems, and hiring and training process. He discussed compliance with regulatory oversite agencies, and their community involvement. No public testimony was offered concerning this matter. El The Board and staff discussed Conditions of Approvals (COA) and DSs, and agreed to delete COA #1.C (access agreements with SPOs), as this has already been submitted. Per Ms. Balzano, COA #1.D.4 needed to be changed from 80 feet to 60 feet of right-of-way at full buildout, in COA #1.D.6 the "s" needed to be removed from the word "locations", and COA #1.A (drainage report) could be deleted, and the Board agreed. In response to Commissioner Moreno, Mr. Holland stated the Emergency Action Safety Plan has been completed and submitted to the applicable parties. El In response to Chair Kirkmeyer, Mr. Holland indicated he reviewed, and agreed to abide by, the Conditions of Approval and Development Standards, as amended. • Chair Kirkmeyer compared the proposed compressor station to other compressor stations, and stated, due to the location of this compressor station it is not necessary to require buffering, the Dark Sky Policy, lighting, design of building, noise, a communications plan, or visual mitigation 2019-0851 PL2645 HEARING CERTIFICATION - KAUFFMAN BROTHERS LIMITED PARTNERSHIP, C/O CURETON MIDSTREAM, LLC (USR18-0115) PAGE 3 to include landscaping. She explained if the compressor station was in an urban density area, the items listed above are things the Board would consider. Commissioner Conway moved to approve the request of Kauffman Brothers Limited Partnership, c/o Cureton Midstream, LLC, for a Site Specific Development Plan and Use by Special Review Permit, USR18-0115, for Mineral Resource Development Facilities including Oil and Gas Support and Service, including four (4) gas compressors, motor control center and related equipment and up to four (4) construction office trailers, and six (6) conex containers for use during the construction of the facility in the A (Agricultural) Zone District, based on the recommendations of Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as amended. The motion was seconded by Commissioner Freeman, and it carried unanimously.
