HomeMy WebLinkAbout20190789.tiffFINDINGS AND RESOLUTION RE: FINDINGS AND RESOLUTION CONCERNING APPLICATION FOR COUNTY DANCE HALL LICENSE NUMBER 396, EXPIRES DECEMBER 31, 2019, AT 12:00 MIDNIGHT, AND AUTHORIZE CHAIR TO SIGN - R AND D 14 CORRIDOR, LLC, DBA DEWEY'S BAR AND GRILL The application of R and D 14 Corridor, LLC, dba Dewey's Bar and Grill, 41611 Marble Avenue, Stoneham, Colorado 80754, for a County Dance Hall License, was presented in a public hearing on the 20th day of February, 2019, at 9:00 a.m., and the Board of County Commissioners of Weld County, Colorado, having considered the testimony, evidence and remonstrances filed with said Board, and having carefully weighed the same, now makes the following findings: 1. That the premises are equipped with sufficient water, lighting, parking and restroom facilities to accommodate the number of persons expected to attend dances thereon. 2. That the premises are not in such a state of disrepair that it is more likely than not to be a safety hazard to persons expected to attend dances thereon. 3. That, if the premises consist of an enclosed structure, the structure is sufficient in size and fire rating to safely accommodate the number of persons expected to attend dances therein, and all requirements of the applicable fire department, district or authority have been met. 4. That the premises are capable of being accessed from a public road, street or highway safely without causing an increased risk of accidents. RESOLUTION WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, R and D 14 Corridor, LLC, dba Dewey's Bar and Grill, presented the Board of County Commissioners with an application for a County Dance Hall License to hold public dances at the location described as follows: 41611 Marble Avenue Stoneham, Colorado 80754 WHEREAS, said applicant has paid to Weld County the sum of $25.00 for said Weld County Dance Hall License, and WHEREAS, the Board deems it appropriate to grant a Weld County Dance Hall License to R and D 14 Corridor, LLC, dba Dewey's Bar and Grill, and cc SoCRS(Jn/ac), ccA.(bc), GZ.PPL. ()con( 19 2019-0789 LC0043 DANCE HALL LICENSE - R AND D 14 CORRIDOR, LLC, DBA DEWEY'S BAR AND GRILL PAGE 2 WHEREAS, said license shall be issued upon the express condition and agreement that the public dances will be conducted in strict conformity to all laws of the State of Colorado, and any violation thereof shall be cause for revocation of the license. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that, pursuant to the criteria in Section 12-6-40 of the Weld County Code, the premises are a safe and proper place for the intended purpose, and that the public morals, public safety or public health of the community, shall be satisfied by the issuance of the license. BE IT FURTHER RESOLVED by the Board that Dance Hall License Number 396, be, and hereby is, granted to R and D 14 Corridor, LLC, dba Dewey's Bar and Grill, to conduct dances at the hereinabove described location. BE IT FURTHER RESOLVED by the Board that said License shall be in effect through 12:00 o'clock midnight, December 31, 2019, conditional upon the applicant conducting all dances in strict conformity to all laws of the State of Colorado. BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized to sign and issue said License.
