The purpose of this letter is to transmit the enclosed drawing that further defines our plans with respect to the equipment that we will be installing and the location of the same. You will note that we have relocated the one pressure storage tank and eliminated one tank. This move was necessary in order to comply with insurance regulations. The loading rack is, of course, a necessity for transferring the product from the storage tank to the purchaser's tank trucks and is an addition to the site plan. We have not firmed up our plans on a compressor as yet. This explains why we are leaving the facility in a tentative state. As soon as we select a compressor, I will resubmit this drawing and will incorporate the changes to make the compressor building a permanent structure. We are implementing the plans originally submitted to you when we asked for a Special Use Permit for this site with our initial submittal. Application for a gas treating facility site, and the request contained therein for a conditioned access to that treating facil- ity site. As a result of the aforementioned letter and request, and subsequent appro- val of the P.U.D. Application by the Zoning Commission on September 2, Industrial Gas Services, Inc. has a "building permit" allowing the installa- tion of three pieces of equipment which will permit the contractual fulfill- ment of delivering gas to Great Western Sugar and Monfort of Colorado on October 31, 1975. The decision to submit the August 5, 1975 request for a conditioned approval to install three pieces of equipment on the facility site was, however, bas- ed upon the likelihood of the P.U.D. Application being brought before the County Commissioners on October 6, 1975. Getting the P.U.D. Application on the County Commissioners Agenda by October 6 was in turn predicated on fulfilling the requirement of a 30 day minimum news- paper publication time prior to the County Commissioners' hearing. As it turned out, this was impossible since the P.U.D. Application, in order to meet that 30 day publication time, had to be in the hands of the printer by 12:00 Noon on September 2 -- in other words, prior to the 2:x+5 p.m. Zoning Commis- sion meeting on September 2. Taking the foregoing into consideration, it now appears the earliest the P.U.D. Application could come up for consideration by the Weld County Commis- sioners in a regularly scheduled meeting is October 20, 1975. Weld County Board of County Commissioners September 8, 1975 Page 2 Thanks to the previously mentioned building permit, Industrial Gas Services will now be able to meet the contractual commitments with Great Western and Monfort; however, because of possibly not having the P.U.D. approval prior to the October 20 hearing date, we are now faced with the structural engineering problems of pouring concrete for an air injection compressor foundation in colder weather and a further delay in actually testing and putting the air injection compressor on stream. From an economic standpoint, this delay would result in a time lapse in the work schedule of Darenco, our engineering and construction contractors for this project. This could mean having to shut down the on-site construction, and subsequently, returning to set up work again -- an added cost of sev- eral thousand dollars to the project. Also from an economic standpoint, an out-of-service time of perhaps two weeks necessary for proper testing and connection of the compressor could result in a loss of between $5,000 and $7,500 to Monfort and Great Western for substitute fuel. These problems could at least be partially solved by an advance permit for the construction of the concrete foundation for the air injection compres- sor. This would be a foundation (concrete) measuring 43' 7" by 25' 3" and would be 6" thick except directly under the compressor. The slab under the compressor will be 12" thick and will have double reinforcing rods in both directions. The slab will be underlain by a minimum 6" thick sand pad. The slab will also have a curtain wall which will be 10" thick and will pene- trate 4' into the subsoil and will extend 1' above ground level. With all the foregoing in mind, IGS herewith formally requests an advance permit to construct the concrete foundation, as set forth above. Approval of this request for an advance permit would be conditioned on poss- ible objections resulting from the 30 day minimum publication time of the P.U.D. Application and the County Commissioners' approval on October 20, 1975. Should approval not be forthcoming on the 20th and should the Commis- sioners require it, Industrial Gas would remove the concrete foundation and restore the land to its original condition. The Commission's favorable consideration of this additional request will be most appreciated as it is vital to the success of Industrial Gas Services' project and the supplying of gas to Great Western and Monfort as well as a meaningful source of revenue to Weld County. Approx- imately ten months ago, Centennial Gas Corporation bought the Morningside Gas Field located in T7N, R6OW, Weld County, Colorado, for a price in excess of $1,000,000. The Morningside Field, after it was found to be gas productive, had been shut-in by its developers for several years previously, due to lack of a gas pipeline to market. We proceeded to secure commitments from Great Western Sugar and Monfort of Colorado in Greeley for their purchase of gas from this supply during periods of gas curtailment by their traditional supplier, Greeley Gas Company. As a sign of good faith, a prepayment of approximately $500,000 was made for future gas deliveries. These prepayment funds have already been invested in the project. At the same time, Centennial Gas Corporation agreed to pay a transportation charge to Standard Gas Supply Corporation, a subsidiary of Greeley Gas, to transport the gas through their pipelines to Great Western and Monfort. Standard Gas had the foresight to realize that such an agreement would help Great Western and Monfort in a period when Standard (Greeley) could not, and would also allow them to serve new rural users along the pipeline, in addition to earning Standard Gas an attractive transportation fee. As the project progressed Standard Gas, foreseeing the potential benefits, both to themselves as a source of additional gas supplies and hence revenues, and as a source of energy to entice new industries to locate in Weld County, have become investors in the project. Weld County Board of County Commissioners August 5, 1975 Page Two The project facilities basically consist of approximately one mile of 3-1/2" 0.D. gathering system, 31 miles of 6-5/8" O.D. pipeline, and a Gas Treating Facility. The pipeline construction, mostly along county roads, requires a permit which has been obtained, and construction will start on August 4, 1975. The pipeline portion of the project will cost approximately $700,000, and should be completed in about 60 days. The Gas Treating Facility will be constructed on about six (6) acres of land leased from Mr. W. Graham Howard, located in the northwest corner of Section 9, T6N, R64W, Weld County, Colorado. The Gas Treating Facility will have the following basic components: 1. Receiver for pipeline cleaning spheres ("pig" receiver). 2. Horizontal separator (liquid receiver). 3. Tank for storing liquids periodically removed from the pipeline. 4. Gas odorizer. 5. Meter run for measuring gas volumes. 6. Air injection compressor for B.T.U. stabilization. 7. Combination modular office and living quarters. Articles 1 through 5 are normal components of any pipeline system, and as such require a "building permit" but not, according to our understanding, a "special use permit." The building permit for Articles 1 through 5 was filed on August 6, 1975, and we are currently awaiting its approval. When we first learned that a P.U.D. application would be required for the Gas Treating Facility, we were advised that it would take up to two months to obtain approval after the date of filing. Consequently, to be safe, we set an objective of filing the P.U.D. application by June 1, 1975, to assure its timely approval. As it happened, we were unable to meet the earlier application filing date, and it was not until the first part of July that all application support material became available. The P.U.D. application was personally delivered to the Zoning Director on July 15, 1975. Weld County Board of County Commissioners August 5, 1975 Page Three On July 23 we met with Mr. Tom Honn, Weld County Zoning Director, regarding the P.U.D. application. Mr. Honn requested that we revise certain parts of our application and furnish an engineering statement regarding the suitabil- ity of the soil on the plant site for the installation of the compressor and other heavy pieces of equipment. We have since provided the requested pro- visions and our engineering consultant, Darenco, a registered professional engineering firm in Wyoming, Colorado, and several other states, is furnish- ing a letter which will certify that the soil is acceptable for our planned purposes. Mr. Honn advised that, once the revisions were obtained, the earliest this application could be scheduled for hearing by the Weld County Zoning Commission would be September 2, 1975. If the application was approved at that time, he estimated the earliest it could be considered by the Weld County Commissioners would be at the Commission's meeting on October 6, 1975. Delaying commencement of construction of the Gas Treating Facility until after October 6, 1975, would be detrimental, if not fatal, to the project. Our contracts with Great Western and Monfort have a firm initial delivery date of October 31, 1975. If we are not able to meet that delivery date, the con- tracts can be cancelled. A minimum of forty-five days will be required to install the compressor and other related facilities for the conditioning of the gas stream. This project is very important to us, as a small company, and also to our investors, and especially to Great Western and Monfort. Also it would appear to be important to Weld County as a meaningful source of revenue. We, there- fore, respectfully request the Commission to grant conditioned approval for access on the site following the Zoning Commission's hearing on September 2, 1975. Based on the above requested conditioned approval from the Commission, we could then commence construction of the facilities during the first week of September. We realize that any such interim Commission approval would be subject to final approval by the County Commissioners, and that if such final approval was not ultimately obtained, we would have the potential liability of having to remove the facilities which had been installed and suffer the financial consequences as a result of such removal. Weld County Board of County Commissioners August 5, 1975 Page Four We apologize for this imposition on the Commission's valuable time, and for our inability to more closely coordinate financing and gas contract timing with P.U.D. filing requirements and construction needs. Inability to timely meet all coordination needs has placed the project in jeopardy. To forestall possible failure of the project, we are relying on approval of the above request for special consideration from the Commission, which will permit commencement of construction the first week in September 1975. In support of our request for special consideration, we are ready, at the Commission's convenience, to meet with the Commission and review in more detail all aspects of this project and to provide assurance that all possible steps are being taken to conform to all County rules and regulations. The Commission's favorable consideration of this request will be most appreciated, and will assure completion of the project, and also the much needed supplies of gas for the 1975-76 fall and winter seasons. Application Dear Sir: Natural gas produced from geological reservoirs of the Denver-Julesburg Basin of Colorado contains hydrocarbon constituents such as propane, butane and gasoline. In order that this gas may be utilized for domestic and industrial fuel, it is necessary in many instances that some of these hydrocarbons be removed. Also, as gas wells are depleted, a pressure drop occurs, which makes it necessary to compress the produced gas in order that it may be delivered to domestic and industrial consumers through gas transmission lines. A plot plan of equipment and related facilities is shown on the attached Drawing No. 053-402, together with egress and ingress roads serving the facility. Initially installed equipment will consist of a 300 horsepower gas driven air compressor, pipeline cleaner receiver facilities, separators to remove liquids from the gas stream, storage tanks for hydrocarbons, a meter to measure the gas, a small combination instrument, material storage and workshop building, and a trailer which can be used for living quarters and office. The limited volume of hydrocarbons collected in the two 400-barrel tanks will be trucked from the facility. A truck turn-around and loading faci- lity has been provided. As gas wells are depleted, thus causing a drop in natural pressure at the well, it may be necessary to add a gas compressor. Also a small processing unit may be needed to remove excess hydrocarbons. These items are shown as "future" possible needs. r Mr. Thomas E. Honn June 17, 1975 Page 2 The completed installation will be adequately protected as to fire hazard through installation of 30# Ansul dry powder hand-held extinguishers and a 150# wheeled Ansul fire extinguishers, located at strategic points. Water for domestic use and sanitary facilities will be secured from the North Weld County Water District Water System which is immediately adja- cent to the plant. All drinking water and related sanitary facilities, including the design thereof will be as approved by the Weld County Health Department. For every daylight eight-hour shift, there will be a minimum of one field operator on duty. Essentially the facility will be designed for unattended operation, therefore, service and safety checks are all that would be necessary. Minimum air and noise pollution can be expected from the one gas powered air compressor. A very small volume of water will be discharged from the separators. This will be water condensed out of the gas stream. Hydro- carbons collected will approximate, as a maximum, 80 barrels per day. Therefore, from one to two truck loadings per week is anticipated. Since only one operator will be on duty, traffic from this source will be negli- gible. Drawing No. 053-1019 is a Vicinity Map. This reflects the relationship to the property as to roads, electric power, telephone lines, domestic water system, irrigation canals, and dwellings within one half mile of the property. Attached Drawing No. 053-x+01 is a survey of the property by a registered engineer. Shown thereon is a legal description of the property by meets and bounds. In the past, the County Attorney requested that verification of the legal description be handled by your office. Therefore, we have sent him a copy of the above numbered print and assume you will contact that office. If you prefer we handle otherwise, please advise. Honn July 14, 1975 Page Two The application for a Special Use Permit is for the construction, operation and maintenance of a natural gas treating facility. This facility is to be located on private property approximately 1-1/2 miles Southeast of the town of Galeton, Colorado. The application is being made by Industrial Gas Services, Inc., under Power of Attorney executed by Graham W. Howard, as Attorney-In-Fact for United Bank of Ft. Collins, Trustee, as owners of the property on which the proposed facility is to be located. The application is made on behalf of Centennial Gas Corporation and is executed by Industrial Gas Services, Inc. , as Operator for said corporation. A copy of the aforesaid Power of Attorney from the United Bank of Ft. Collins is attached. Centennial Gas Corporation will own the gas treating facility, and have, there- fore, obtained a lease agreement granting the right to construct the gas treating facility on the property covered by the attached application. A copy of the business lease between Centennial Gas as "Lessee", and United Bank of Ft. Collins as "Lessor", is attached to the application. Agriculture Soil Report for General Site Area, Air Injection Plant near Greeley, Colorado, #D-47175 Dear Mike: Our examination of the area indicates that the foundation conditions at this site are generally the same as we have previously encountered elsewhere, particularly at both sites of the Coors compressor stations. It has been our experience that the materials found here can support moderate loads, if the soils are confined. Our foundation will be of monolithic construction and designed for lateral restraint of all materials for a depth of at least four (4) feet. The proposed grade elevation will, of course, be above any normal expected flooding. I know, of course, that it is not necessary to point out to you, but for the benefit of any other interested parties, the characteristic policy of providing a mass ratio of foundation to rotating equipment of approxi- mately 3:1 results actually in low unit soil loads. Lessee agrees to deliver to Lessor an amount of fuel gas egpP1 to but no more than Five Hundred Dollars ($500) computed at the rate of One Dollar and Thirty-five Cents ($1.35) per thousand cubic feet (MCF), plus Five Cents ($0.05) per MCF per year escalation. Said delivery shall be subject to the conditions set forth in Paragraph 5.0 "c.'.' It is agreed that said fuel gas shall be used by Lessor in Lessor's principal dwelling house for domestic purposes only. c. Lessee agrees to lay the fuel gas line and set the regulator and meter necessary for Lessor to take delivery of said fuel gas at a point to be designated by Lessor at or near his residence. Lessee agrees that all material and labor necessary for Lessor's connection to the fuel gas delivery point as set forth in the preceding paragraph shall be Lessee's responsi- bility. Lessor agrees to defend, protect, indemnify, and save Lessee harmless from and against all claims, demands, and causes of action and character arising in favor of any person or persons, on account of personal injury or death or damage to property in any way incident to or arising out of Lessor's operations in connecting to aforementioned fuel gas delivery point. -4- Lessor agrees to reimburse Lessee for any main- tenance or repair expense that may occur on the gas line from Lessee's plant site to the delivery point near Lessor's dwelling. 6.0 It is expressly understood and agreed by and between the parties hereto that if the rent above mentioned, or any part thereof, sha 1 be unpaid on the date whereof the same ought to be paid as aforesaid, or if default shall be made in any of the covenants or agreements herein contained, to be kept by the said Lessee, its successor or assigns, it shall be lawful for Lessor, upon giving Lessee thirty (30) days prior written notice, to declare said term ended, and to re-enter the leased lands, or any part thereof, either with or without process of law. And, if at any time, said term shall be ended at such election of Lessor as aforesaid, Lessee does hereby covenant and agree to stirrender and deliver up the herein described leased lands peaceably to Lessor immediately upon termination of said term as aforesaid.
