This letter is being sent by Anadarko Petroleum Corporation on behalf of its subsidiary
Kerr-McGee Oil & Gas Onshore LP ("KMOO" or the "Company") to inform you KMOG is
the owner and/or operator of valid oil and gas leases underlying all or parts of Section 15,
Township 2 North, Range 67 West ("Leased Lands"), for which Front Range Dairy
("Applicant") is seeking approval of a USR Permit for a Class I Composting Facility. KMOG
is submitting this comment timely, in accordance with State of Colorado and the Town's
procedural requirements.
KMOG' s recorded oil and gas leases are real property interests entitling it to produce
oil and gas from the Leased Lands (and, as may be applicable, adjacent lands). The Company
has the right to produce from existing wells, to maintain, rework, recomplete, and fracture
those existing wells to enhance production, and to drill new wells to produce oil and gas, in
accordance with applicable Colorado Oil and Gas Conservation Commission regulations and
Colorado Statutes. KMOG' s oil and gas assets have significant t value, and the Company is
consequently concerned about any development, surface use, plan of use, PUD, zoning or
rezoning, or other action by the Town that would impair or preclude its ability to develop its oil
and gas interests.
KMOG does not object to the approval of the subject Land Use Application providing
the applicant conforms to the Surface Use Agreement that was executed on March 24th, 2005,
and recorded on May Td, 2005 with the Weld County Clerk and Recorder at reception number

on April 18th, 2005 with the Weld County Clerk and Recorder at reception number 3278279.
Please note that although KMOG does not object to the application, we continue to assert our
rights to make reasonable use of the surface of the property to develop our oil and gas
leasehold.

Josh,
Lou Vasquez, my neighbor and I, discussed the same concerns as we did with you. Concerns
were any impact on the water table, smell and flies. You assured us that there would not be any
impact on the water table due to the engineering design and the runoff pool. 4 D Farms, now
Revolution Soil and Seed, agrees not to turn the composting pile when there are southerly winds
and this would be reflected in the operating procedures. Fly mitigation will be an on -going
concern that may require a barrier (trees?) at a future date depending on how the facility
operations go, which will be discussed at that time if needed.
Lou and I are very concerned with any impact on the water table since we are on well
water. Based on the engineering designs and compliance with county, state and federal
codes/regulations/industry practices this should not be a problem,{ should it become a problem
in the future we will address it appropriately - however we do not anticipate that this will
become an issue.
Based on the comments noted above we have no objections to the construction of the facility.
