RE: ACCEPT REQUEST OF THE PUBLIC SERVICE COMPANY OF COLORADO TO
WITHDRAW APPLICATION FOR A SITE SPECIFIC DEVELOPMENT PLAN AND USE
BY SPECIAL REVIEW PERMIT, USR18-0100, FOR A 1041 PERMIT FOR A MAJOR
FACILITY OF A PUBLIC UTILITY FOR ONE (1) 230KV TRANSMISSION LINE
EXTENDING APPROXIMATELY 10.4 MILES, ONE (1) NEW SUBSTATION (GRAHAM
CREEK) AND UPGRADES TO AN EXISTING SUBSTATION (WAPA AULT
SUBSTATION) IN THE A (AGRICULTURAL) ZONE DISTRICT
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners held public hearings on the January 23,
May 22, and July 24, 2019, at the hour of 10:00 a.m., in the Chambers of the Board, for the
purpose of hearing the application of the Public Service Company of Colorado, 1800 Larimer
Street, Suite 400, Denver, Colorado 80202, for a Site Specific Development Plan and Use by
Special Review Permit, USR18-0100, for a 1041 Permit for a Major Facility of a Public Utility for
one (1) 230KV transmission line extending approximately 10.4 miles, one (1) new substation
(Graham Creek) and upgrades to an existing substation (Wapa Ault Substation) in the
A (Agricultural) Zone District, which was amended to read (one (1) 230KV transmission line
extending approximately 21 miles, one (1) new substation (Graham Creek) and upgrades to an
existing substation (Wapa Substation) in the A (Agricultural) Zone District on the following
described real estate, to -wit, and:
The transmission line: Sections 2, 3, 4, 5, 6, 10, 15,
22, 26, 27 and 35, Township 7 North, Range 66
West of the 6th P.M., Weld County, Colorado. The
Substation: SW1/4 NE1/4 of Section 35, Township 7
North, Range 66 West of the 6th P.M., Weld County,
Colorado
WHEREAS, at said hearing, the Board was presented with a letter, dated July 23, 2019,
requesting to withdraw the application to allow for additional public and stakeholder outreach on
the overall project and to review additional transmission line routes and substation site
alternatives, and
WHEREAS, the Board of County Commissioners heard all of the testimony and
statements of those present, studied the request of the applicant and all of the exhibits and
evidence presented in this matter and, having been fully informed, deems it advisable to grant the
applicant's request and thereby accept the withdrawal of the application.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the request of the Public Service Company of Colorado to withdraw the
application for a Site Specific Development Plan and Use by Special Review Permit,
USR18-0100, for a 1041 Permit for a Major Facility of a Public Utility for one (1) 230KV
transmission line extending approximately 10.4 miles, one (1) new substation (Graham Creek)

and upgrades to an existing substation (Wapa Ault Substation) in the A (Agricultural) Zone District,
on the parcel of land described above be, and hereby is, accepted and the matter is dismissed.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 24th day of July, A.D., 2019.
