promissory Note and Deed of Trust,' The Travelers Promissory Note
and Deed of Trust are not being assumed by the Grantee herein, and
the Grantor herein expressly agrees to pay and perform the same in
accordance with their terms and to indemnify and hold the Grantee
harmless thereon.
The Grantor further agrees to forthwith notify in writing the
Grantee, its eucceasora and assigns, in the event of any default
under the Travelers Promissory Note and Deed of Trust and to pay
all of the Grantee's reasonable expenses and attorneys' fees in
connection with any such default. The Grantor further authorizes
the Grantee to pay any defaulted amounts under the Travelers
Promissory Note and Deed of Trust not being aeeumed by thn
Grantee; and in so doing, the Grantee shall not be deemed a
volunteer. Until the Grantee is repaid, any amounts advanced by
it pursuant to the terms hereof shall be a credit and offset
against the Promissory Note payable to the Grantor, made and
executed by the Grantee on even date herewith, and secured by a
Deed of Trust which encumbers the real property being conveyed
hereby.
The Grantor, for himself and his heirs, administrators, and
assigns, does Covenant and agree to and with the Grantee, its
successors and assigns, that the Grantee, its successors and
assigns :hall and may lawfully and at all times hereafter
peaceably and quietly have, occupy, possess, and enjoy said
premises hereby granted, or intended so to be, with the appurte-
nances, without the lawful hinderanee or molestation of the
Grantor, his heirs, administratorn, or assigns, or of any other
person or persons whomsoever, by or With his consent, privity, or
procurement.
Reservation of Minerals. The Grantor herein expressly
excepts and reserves unto himself, and his heirs, administrators,
and assigns, an undivided one-half (1/2) interest in and to all
oil, gas, gravel, and other mincresla and mineral rights, located
in, on, or under the serfaee of the property being conveyed hereby
which are presently owned by the Grantor. In addition, the
Grantor herein expressly excepts and reserves unto himself, and
his heirs, administrators, and assigns, an undivided one-half
{l/2M interest in and to all existing oil and gas lennes of the
property being conveyed hereby, thereby entitling the Grantor to
one-half (1/2) of all payments made pursuant to said leaees, with
the exception of payments made thereunder for surface damages.
