Conway Commissioner Scott K. James Commissioner Steve Moreno Also present: Acting Clerk to the Board, Selena Baltierra Assistant County Attorney, Bob Choate Planning Services Department representative, Michael Hall Public Works Department representative, Evan Pinkham Health Department representative, Lauren Light The following business was transacted: 2 I hereby certify that pursuant to a notice dated March 27, 2019, and duly published April 3, 2019, in the Greeley, for a Site Specific Development Plan and Use by Special Review Permit, USR18-0124, for any Use permitted as a Use by Right, Accessory Use or Use by Special Review in the Commercial or Industrial Zone Districts (Saint Vrain River Ranch - event venue for weddings, graduations, parties, conferences and similar private gatherings), provided that the property is not a lot in an approved or recorded subdivision plat or part of a map or plan filed prior to adoption of any regulations controlling subdivisions in the A (Agricultural) Zone District. Bob Choate, Assistant County Attorney, made this a matter of record. Chair Pro- Tern Freeman reviewed, for the applicant and the public, the procedures to follow should this case result in a tie vote due to four (4) Commissioners being present and Chair Kirkmeyer excused. Michael Hall, Department of Planning Services, presented a brief summary of the proposal and stated the site houses existing residential and agricultural uses. He stated the proposed use will be located on approximately five (5) of the 40 -acre parcel, and will support up to 200 people, including staff, at each event. He explained the site will operate in two (2) phases and provided the details of each phase. He described the parking on the site and stated no new landscaping is proposed or recommended by Planning Staff. He indicated a fence will be installed and a sign is proposed. He described the outdoor lighting associated with each phase, mentioned the existing gravel drive will be widened to allow for two (2) way traffic, and stated there will be no outdoor storage or overnight use. Mr. Hall stated the proposed use will promote agritainment and indicated the site is located within the three (3) mile referral areas of the Towns of Johnstown, Milliken, and Platteville. He described the surrounding uses and noted there had been no correspondence from surrounding property owners (SPO). He stated ten (10) referrals were sent out, with five (5) responses received, and provided images of the site and surrounding views. He mentioned adjacent county roads and stated the site is within the St. Vrain Creek Floodplain, which is reflected in the Development Standards (DS). He indicated the site is zoned A (Agricultural) and described the surrounding USRs and lands. He noted no agricultural land will be removed from production, and presented a draft layout of the USR map. He entered the favorable recommendation of the Planning Commission into the record, as written, and in response to Commissioner Moreno, Mr. Hall reiterated the hours of operation during each phase. 3 Evan Pinkham, Department of Public Works, provided a brief overview of the transportation plans and requirements, and reiterated the location of the access at the corner of CR 38 and CR 19.5. He explained the Department of Public Works (PW) had safety concerns with the configuration of the access, and reviewed the staff suggestions for the access to mitigate concerns. He provided the latest traffic counts, average speeds, daily roundtrips, and direction of traffic, and indicated Tracking Control and an Improvements and Road Maintenance Agreement will be required. He stated the site meets an exception for drainage, and in response to Commissioners James and Conway, Mr. Pinkham further explained some of staffs concerns and suggestions with the access. Lauren Light, Department of Public Health and Environment, reviewed the water and sewer provisions and explained the existing home is serviced by the Little Thompson Water District. She indicated the current septic system is permitted for three (3) bedrooms and provided the requirements of the commercial septic system. She stated portable toilets can be used, per Environmental Health (EH) policy for seasonal use, noted Planning Commission added screening of the portable toilets to the Resolution, and specified the requirements for catering and, food preparations. She stated the noise restriction and indicated DS #19-30 address EH items. Commissioner Conway prompted discussion regarding the portable toilets screening and, in response to Commissioner Moreno, Ms. Light confirmed the noise level to be commercial. . Kelsey Bruxvoort, AGPROfessionals, represented the applicant and reiterated the proposed use. She displayed a PowerPoint presentation (Exhibit D) and described the two (2) operation phases of the project. She provided the hours of operation, and stated the applicants will live on the site and oversee the operations. She explained the site location and described the surrounding area. Ms. Bruxvoort reiterated the site will be located on approximately five (5) of a 40 -acre parcel and the applicants will continue to live onsite and use the existing outbuildings. She presented the site plan, including the sign location, screening, parking and staging area for restrooms, trailers and vendors, proposed fencing and barn, and lighting. She described the visions of the proposal and explained how the application meets the criteria of the Code. She reviewed the provisions for the protection of the health, safety and welfare, including the Nuisance 2019-1593 PL2662 HEARING CERTIFICATION - VERONICA AND CAMERON SILBAUGH (USR18-0124) PAGE 3 Management Plan, the water and sewage disposal, the Landscaping and Screening Plan, traffic control, and the requirements of the Resolution. She presented images of the access, reiterated information regarding traffic, and explained the proposed use of the access with manual traffic control. Ms. Bruxvoort briefly mentioned the referral responses received, and the requirements of the Conditions of Approval (COA) and Development Standards (DS). la No public testimony was offered concerning this matter. Ms. Bruxvoort asked the Board to consider deleting COA #1.B and COA #1.C.19 concerning the access and the Board agreed. She additionally requested road base be allowed as tracking control for COA #1.C.17 and after further discussion, the Board provided direction to staff on the requirements of tracking control. After lengthy discussion regarding DS #13 (tracking control), the Board agreed to add "with over 100 persons in attendance"to the standard. Commissioner James expressed remaining concerns with the safety of the access, and in response to Commissioner Conway, Ms. Bruxvoort additionally explained the proposed traffic control for the site. After additional discussion between the Board and staff, Chair Pro-Tem Freeman confirmed the access will remain in its existing location, and any additional traffic control will be included in the Improvements Agreement at the discretion of PW. In response to discussion regarding DS #5 (liquor license), Esther Gesick, Clerk to the Board, clarified the requirements of the State Liquor Code. In response to a clarification question from Commissioner James on DS #3, Mr. Choate explained it is within the authority of the Board to require a limitation to the number of guests allowed. After discussion, the Board agreed to change the maximum number of guests to 350 people. The Board agreed to delete DS #28 (noise standard) and Mr. Choate clarified DS #33 allows staff access to the property which is standard language and should remain. E No public testimony was offered concerning the changes to the Conditions of Approval and Development Standards. I In response to Chair Pro-Tem Freeman, Ms. Bruxvoort indicated she reviewed, and the applicants agree to abide by, the Conditions of Approval and Development Standards, as amended. Commissioner Conway moved to approve the request of Veronica and Cameron Silbaugh for a Site Specific Development Plan and Use by Special Review Permit, USR1 S-0124, for any Use permitted as a Use by Right, Accessory Use or Use by Special Review in the Commercial or Industrial Zone Districts (Saint Vrain River Ranch - event venue for weddings, graduations, parties, conferences and similar private gatherings), provided that the property is not a lot in an approved or recorded subdivision plat or part of a map or plan filed prior to adoption of any regulations controlling subdivisions in the A (Agricultural) Zone District, based on the recommendations of Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards, as amended. The motion was seconded by Commissioner Moreno, and it carried unanimously.
