HomeMy WebLinkAbout760377.tiff FINDINGS AND RESOLUTION CONCERNING REQUEST FOR LOT SIZE VARIANCE PETITION OF MR. PHIL PENNOCK, JR. The Petition of Phil Pennock, Jr. , Berthoud, Colorado, requesting exemption from definition of subdivision or subdivided land pursuant to Section 9 of the Weld County Subdivision Regulations. The parcel in question contains approximately 57. 30 acres of irrigated agricultural land, and Mr. Pennock desires to split off from said plat a parcel of land containing 12 acres; said parcel of the whole, being more particularly described as follows, to-wit: Lot A of the following described land, to-wit: All of the East Half of the Southwest Quarter of Section 18, Township 4 North, Range 68 West of the 6th P. M. , Weld County, Colorado, more particularly described as follows: Considering the South line of said Southwest Quarter as bearing North 89°32'39" East with all bearings contained herein relative thereto. Beginning at the Southwest Corner of said Section; thence along the South line of said Southwest Quarter North 89 32'39" East 1, 132. 26 feet to the Southwest Corner of the East Half of said Southwest Quarter; thence along the West line of said East Half North 1°04'13" East 30. 01 feet to a point on the North Right of Way Line of Colorado State Highway 56, said point being also the TRUE POINT OF BEGINNING. Thence continuing North 1°04'13" East 2, 577. 52 feet to the Northwest Corner of said East Half; thence along the East-West Centerline of said Section 18 North 89°19'15" East 925. 78 feet to the Northeasterly line of Parcel 6 as shown on that certain plat recorded under Reception Number 147081 in Book 5 of Maps, Page 20, Records of said County; thence along said line South 39° 02'09" East 651. 69 feet to the North-South Centerline of Said Section; thence along said Centerline South 0°57'51" West 2, 071. 39 feet to the North Right of Way Line of said Highway; thence along said North Right of Way Line South 89°32'39" West 1, 349. 48 feet more or less to the TRUE POINT OF BEGINNING. The above described Parcel A contains a gross acreage of 57. 30 acres, more or less, came on for hearing on April 26 , 1976, and the Board of County Com- missioners of the County of Weld, State of Colorado, having heard the testimony and evidence adduced upon said hearing and having considered the testimony, evidence, remonstrances and recommendations of the Weld County Planning Commission filed with said Board, and having carefully weighed the same, now makes the following findings: 1 . The evidence discloses that the applicant failed to sustain the burden of proof as to the need for a lot size variance, and that good cause has not been shown why such a variance should be granted as required by Section 9-4 A (6) of the Weld County Subdivision Regulations. 2. The evidence discloses that the proposed land division is not in conformance with the intent of the recorded exemption procedure which 760377 is defined as "a means whereby nonproductive agricultural lands may be developed for higher or more productive uses, insofar as such uses are compatible with surrounding agricultural uses in areas where such land divisions are proposed". 3. The evidence and investigation shows that the property in question is composed of class II and class III irrigated agricultural lands. 4. The evidence discloses that the proposed land division does not conform to the Weld County Comprehensive Plan in that it promotes non- agricultural use of agricultural land. 5. That each of the preceding findings in and of themselves and independent of each other constitutes a separate and individual ground for denial of a lot size variance under Section 9-4A (6) of the Weld County Subdivision Regulations. RESOLUTION WHEREAS, the Board of County Commissioners of the County of Weld, State of Colorado, has heard the application of Phil Pennock, Jr. , Berthoud, Colorado, for a recorded exemption pursuant to Section 9 of the Weld County Subdivision Regulations, of a parcel of land as hereinabove recited and made a part hereof by reference, and WHEREAS, said Board has made its findings on the evidence and testimony submitted to it, which findings precede this Resolution and by reference are incorporated herein and made a part hereof, and WHEREAS, the Board has carefully considered the Petition, the evidence, testimony and remonstrances and the recommendations of the Weld County Planning Commission and have given the same such weight as in its discretion deems proper, and is now fully advised in the premises. NOW, THEREFORE, BE IT RESOLVED, that the Petition of Phil Pennock, Jr. , Berthoud, Colorado, requesting recorded exemption under Section 9 of the Weld County Subdivision Regulations, of a parcel of land indicated above be, and it hereby is denied on each of the grounds set forth in the Board's findings therein. Mr. Pennock is seeking approval of this lot size request so that he may apply for a recorded exemption on the same parcel of land. The subject property is Lot A of Recorded Exemption #98 which was approved by the Boar ,f ommissioners on January 16, 1974. Said property contai 57.30 . —.S in the area are predominantly Class II with some Cla soils bordering Newell Lake. The request is to split off approxi tely 12 acres h1ch borders Newell Lake. Based upon the information submitted, the Planning Commission staff recommends for denial for the following reasons: 1 . The proposed split does not comply with the Weld County Comprehensive Plan because it would promote non-agricultural use of agricultural land and it would encourage urban encroachment on rural land use. 2. The lot size variance request is not in compliance with the intent clause of the recorded exemption procedure (Section 9-2 of the Weld County Subdivision Regulations). Said clause states: "The intent in establishing the Recorded Exemption procedure is to provide, in accordance with the Weld County Comprehensive Plan, a means whereby non-pro- ductive agricultural lands may be developed for higher or more productive uses, in-so-far as such uses are compatible with surrounding agricultural uses in areas where such land divisions are proposed. The granting of this request and a subsequent recorded exemption would allow for the conversion of productive agricultural lands since a new set of improvements would be allowed on the 12 acre parcel . 3. The proposed split is not in conformance with the intent clause of the Agricultural Zone District (Section 3.3 A of the Weld County Zoning Resolution) which states: "Intent - The intent in establishing the A-I Agri- cultural Zone District is to allow all agricultural and related uses in those areas in which agriculture is and should continue to be the predominant land use. This district is intended to discourage en- croachment of incompatible uses upon the agricultural land in the district, to discourage agricultural uses as the highest and best use of the land in the dis- trict as compared with other uses in conflict there- with, and to provide for the orderly expansion of urban growth in conformance with the Weld County Comprehensive Plan." The request would not be encouraging agricultural uses as the highest and best uses, it would not be providing for the orderly expansion of urban growth, and it would further diminish the size of the agricultural unit. 4. As stated earlier, Mr. Pennock was granted a Recorded Exemption on January 16, 1974 for a request to split off 20 acres from the 77.30 acre parcel he then owned. And now, only a little more than two years later, Mr. Pennock is requesting to further split the property. As stated in Section 9-4 (A) of the Weld County Subdivision Regulations: "The Board shall not approve the exemption of the pro- posed land division unless it finds the following: (Rev. 4/17/74) (1 ) That the proposed lots are not part of a re- corded exemption from the definition of "Sub- division" or "subdivided land" or a subdivision approved within less than five (5) years previous" . It should be pointed out that Mr. Pennock's request is before you due to financial hardship. As he has stated in his letter to you requesting this Board of County Commisisoners April 12, 1976 Page 3 lot size variance, the granting of the recorded exemption in 1974 did little to relieve his financial burden and it is unproven that the grant- ing of his request would relieve the present financial burden. The subject case lies adjacent to and along the north side of State Highway 56. Any future improvement along State Highway 56 would require a minimum right of way of 120' (60' from centerline) with a desirable right of way width of 150' (751 from centerline). When the last improvement was made on State Highway 56, the Division of Highways purchased 75' of right of way from centerline in those locations where right of way was purchased.
