HomeMy WebLinkAbout20194448.tiff HEARING CERTIFICATION DOCKET NO. 2019-126 RE: A SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT, USR19-0047, FOR MINERAL RESOURCE DEVELOPMENT FACILITIES INCLUDING OIL AND GAS SUPPORT AND SERVICE FACILITY (OIL AND GAS LAYDOWN YARD) IN THE A (AGRICULTURAL) ZONE DISTRICT - SS STORAGE HUDSON, LLC A public hearing was conducted on October 16, 2019, at 10:00 a.m., with the following present: Commissioner Barbara Kirkmeyer, Chair Commissioner Mike Freeman, Pro-Tem Commissioner Sean P. Conway Commissioner Scott K. James Commissioner Steve Moreno Also present: Acting Clerk to the Board, Jessica Reid Assistant County Attorney, Bob Choate Planning Services Department representative, Diana Aungst Public Works Department representative, Evan Pinkham Health Department representative, Lauren Light The following business was transacted: I hereby certify that pursuant to a notice dated September 6, 2019, and duly published September 11, 2019, in the Greeley Tribune, a public hearing was conducted to consider the request of SS Storage Hudson, LLC, for a Site Specific Development Plan and Use by Special Review Permit, USR19-0047, for Mineral Resource Development Facilities including Oil and Gas Support and Service Facility (oil and gas laydown yard) in the A (Agricultural) Zone District. Bob Choate, Assistant County Attorney, made this a matter of record. Diana Aungst, Department of Planning Services, presented a brief summary of the proposal, stated 11 referrals were sent out, nine (9) agencies responded, and provided the hours of operation. She indicated there would be no employees working onsite and noted up to two (2) employees may visit the site daily. She explained the proposed fencing and access, nearby residences, and surrounding uses. She mentioned one (1) letter of correspondence had been received by Planning Staff, outlined the concerns expressed in the letter, and stated the site is within the three (3) mile referral area of the Town of Hudson. She entered the favorable recommendation of the Planning Commission into the record as written and displayed images of the site, surrounding views, and the proposed site plan. Evan Pinkham, Department of Public Works (PW), provided a brief overview of the transportation plans and requirements, stated access is on County Road (CR) 41 at the section line of CR 24, and provided daily roundtrip counts and average speeds. He explained the highest traffic will be when a rig is moved onto the site, which happens approximately three (3) to six (6) times a year. In response to Chair Kirkmeyer, Mr. Pinkham confirmed the applicant will need an Oversize/Overweight Permit each time they move a rig. • Lauren Light, Department of Public Health and Environment, reviewed the water and sewer provisions, explained the applicant may utilize the adjacent facility for sanitary uses since they own both parcels, and indicated a screened, portable toilet may also be used on the site. She stated Development Standard (DS)#14-21 address Environmental Health items, and in response to Chair Kirkmeyer's question about fencing around the existing USR (truck and trailer repair shop), Ms. Aungst deferred to the applicant. • Corey Preston, Grant and Hoffman Law Firm, represented the applicant, confirmed there is no screening around the existing USR, stated the land is non-irrigated, and indicated the applicant had been looking for a way to make use of the property. He stated the surrounding uses are similar to the proposed use, the operation would have minimal impact on the access road, and noted they are working with Xcel Energy on transmission lines and engineers on drainage. In response to Commissioner Moreno, Mr. Preston clarified the hours of operation. ▪ No public testimony was offered concerning this matter. In response to Chair Kirkmeyer, Mr. Preston elaborated on the equipment that would be onsite, confirmed no surrounding properties have a fence with slats, described the rig delivery process, and in response to Commissioner Moreno, Mr. Preston discussed the lighting on the site. In response to Chair Kirkmeyer, Ms. Aungst outlined the requirements of the Department of Water Resources, indicated the proposed operation will not use water, and in response, Commissioner Freeman suggested deleting Condition of Approval (COA) #1.C (requirements of the Division of Water Resources). Chair Kirkmeyer suggested deleting COA #1.D.6 (Screening Plan), in response to Commissioner Conway, Mr. Pinkham clarified acceptable tracking control at CR 24, and Chair Kirkmeyer suggested deleting COA #4.A (tracking control). Commissioner Freeman suggested deleting COA #1.D.10 (label tracking control on the site plan), and Chair Kirkmeyer suggested deleting DS#4 (hours of operation)and#5 (screening), and deleting "and/or off-site tracking" from DS #8. There was discussion about portable toilets, and Chair Kirkmeyer suggested deleting DS#18 (portable toilets) and changing the language in DS#20 to address the temporary use of portable toilets when rigs are being moved on-site. The Board agreed to all of the aforementioned changes. • In response to Chair Kirkmeyer, Mr. Preston stated he had reviewed, and on behalf of the applicant, agreed to abide by the Conditions of Approval and Development Standards, as amended. le No public testimony was offered with regard to changes made to the Conditions of Approval and Development Standards. Commissioner Conway moved to approve the request of SS Storage Hudson, LLC, for a Site Specific Development Plan and Use by Special Review Permit, USR19-0047, for Mineral Resource Development Facilities including Oil and Gas Support and Service Facility (oil and gas 2019-4448 PL2710 HEARING CERTIFICATION -SS STORAGE HUDSON, LLC (USR19-0047) PAGE 3 laydown yard) in the A (Agricultural) Zone District, based on the recommendations of Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards, as amended. The motion was seconded by Commissioner Moreno, and it carried unanimously. There being no further discussion, the hearing was completed at 11:04 a.m. This Certification was approved on the 21st day of October, 2019.
