RE: ACTION OF BOARD CONCERNING USE BY SPECIAL REVIEW PERMIT,
USR18-0100, FOR A 1041 PERMIT FOR A MAJOR FACILITY OF A PUBLIC UTILITY
FOR ONE (1) 230KV TRANSMISSION LINE EXTENDING APPROXIMATELY 21 MILES,
ONE (1) NEW SUBSTATION (GRAHAM CREEK) AND UPGRADES TO AN EXISTING
SUBSTATION (WAPA AULT SUBSTATION) IN THE A (AGRICULTURAL) ZONE
DISTRICT - PUBLIC SERVICE COMPANY OF COLORADO
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners held a public hearing on the 23nd day
of January, 2019, at the hour of 10:00 a.m., in the Chambers of the Board for the purpose of
hearing the application of Public Service Company of Colorado, 1800 Larimer Street, Suite 400,
Denver, Colorado 80202, for a Site Specific Development Plan and Use by Special Review
Permit, USR18-0100, for a 1041 Permit for a Major Facility of a Public Utility for one (1) 230KV
transmission line extending approximately 21 miles, one (1) new substation (Graham Creek) and
upgrades to an existing substation (Wapa Ault Substation) in the A (Agricultural) Zone District on
the following described real estate, to -wit:
The transmission line will be located in Sections 2,
3, 4, 5, 6, 10, 15, 22, 26, 27 and 35, Township 7
North, Range 66 West; Sections 2, 11, and 12,
Township 6 North, Range 66 West; Sections 7, 15,
16, 17, 18, 22 and 27, Township 6 North, Range 65
West of the 6th P.M., Weld County, Colorado
WHEREAS, the Board heard all of the testimony and statements of those present and
reviewed the request of the applicant and, having been fully informed, finds that this request be
approved and the matter should be continued to May 22, 2019, at 10:00 a.m., to allow Public
Services Company of Colorado adequate time to comply with the terms of the Amended Waiver
Agreement and allow for the Planning Commission hearing continued to March 19, 2019, and
WHEREAS, on May 22, 2019, the Board heard all of the testimony and statements of
those present and reviewed the request of the applicant and, having been fully informed, finds
that this request be approved and the matter should be continued to July 24, 2019, at 10:00 a.m.,
to allow Public Service Company of Company adequate time to comply with the terms of the
Second Amended Waiver Agreement approved by Resolution #2019-1827 on May 13, 2019.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the abovementioned matter be, and hereby is, continued to July 24, 2019,
at 10:00 a.m.
