Dear Folks,
I am writing this letter to oppose the proposed Nunn Downs Horse Race Facility/ at the corner of WCR21
and WCR102. My family and I have lived here for twenty years, and are witnessing unprecented growth,
mostly horse people with large, expensive homes. We are consistently defending our livelyhood from the
likes of uranium mines, tollroads, etc. We live here foe the peace and quiet. Now this! Numerous times
have been told my property values were worth nothing because of these activities, until we rallied to run
them off. I'm confident a Mexican horse race track will do it again. I live two miles west on WCR17, the
major throughway for the area and the only treated road for miles around. I am confident race attendees
will choose to travel WCR17 way more than the proposed route of WCR1Y. The road crews struggle to
keep WCR17 in shape for the current resident use. I question the number of people that will attend the
events. It is suggested there will be only a few hundred, while there is speculation the number could
actually be 1,000 or more. The fire danger is so real. I have witnessed countless prarie fires. The last one
two years ago that brought four fire departments and nearly all tv news stations. It was total kaos as
residents were scrambling to save livestock and structures. The prarie is just as snsitive, and dangerous,
as the mountains concerning devastating fire. The people attending the horse races will not respect that.
It would be very naive to believe there won't be drugs, alcohol, and associated rebel rousing (cartel).
could go on forever about the horrible treatment of the horses, along with potential disease they might
introduce to the healthy horses that reside in the area. My family and I are fearful for our lives, for many
reasons. The good folks out here have learned how to fight these bad things we simply will not tolerate.
We will rise again if the county allows this unscupulous activity. They will be exposed to all media sources
including Fox 31 News, who were partly responsible for bringing down a similar facility in South Denver,
a couple years ago. I would not be a bit surprised if these people are not the same ones. Weld County is
one of the most conserative counties in the entire country, priding itself in American values. I would like
to conclude with a question. Is this making America great again? Thank you.

Thank you, Angela! One thing that worries me to no end, and I didn't
mention in the letter. This area is chuck full of automatic weapon
bearing Donald Trump thumpers. On any given day, especially weekends,
there is shooting all around us. On a couple occasions we have had
bullets zinging over our heads. I have called the Weld County Sheriff
and they gave me the cold shoulder, telling me they will not respond
unless someone gets hurt. I know their type to welly I envision total
chaos and possibly violence if there is a Mexican horse racing track in
their back yard. I think it would be a huge mistake for everyone to not
consider this. Thanks so much!

This letter is to state our strong objections to the proposal to operate an unsanctioned n ctio n e d Horse Race Track.
on Weld County Road 21, Nunn Co, which is across the street from our home.
Some, but not all our objections are:
1. Noise generated by such activity will be unbearable to the surrounding neighbors.
2. Dust generated from the traffic and the horse races will affect those with respiratory issues.
3. Traffic on unpaved road with unregulated intersections will be a safety hazard to both attendees
of the track and the neighbors who live in this area.
4. WCR 21 is not maintained by the County. Commercial use of this unmaintained road should not
be allowed.
S. The danger of grass fires puts the neighborhood in extreme danger. Hundreds of people on the
dry grassland is just too dangerous.
6. Law enforcement in this area has a response time of approx. 2 hours. The area is not patrolled
by Weld County Sherriff.

7. The risk of horses coming and going increases the risk of horse diseases.
8. Drinking, weapons, litter and bad behavior during or leaving the events.
We request that you review the minutes of the hearing held by the County Commissioners on
9/19/2018 regarding the application for a "Temporary Assembly of more than 350 Persons for a Horse
Racing Event". After hearing testimonies by many concerned neighbors along with testimony from
Captain Alan Caldwell, Weld County Sherriffs office who recommended the application not be
approved, all the County Commissioners voted unanimously against the permit for the Race Track. Here
are some excerpts from that meeting:
• Commissioner Freeman stated he is not in support of the Temporary Assembly Permit and
believes this should go through the Department of Planning Service process to obtain a USR.
Commissioner Conway stated the public's health and welfare must be considered and this
needs to go through the USR process. He spoke of the Colorado Department of Agriculture's
health alert concerning diseased horses.
Commissioner Cozad concurred and took seriously the neighbor's concerns. She explained
other Temporary Assembly Permits, which have been granted, have been for established US Rs,
so all the plans and conditions are in place. She stated it was recommended for denial by the
Sharriff's Office, there is a lack of proper permits, and there is not a good traffic plan. She
stated when people behave badly at the event, it is the responsibility of the event holder and
"this is event is not compatible with this area".
• Chair Moreno stated there isn't a plan for how they can control alcohol or drugs being brought
to the event. He believes there are too many unknown factors for this even to take place.
Although many commissioners indicated they should go through the USR process, these concerns still
have not been satisfactorily addressed any further than what they already address at that hearing,

I am writing to ask you to deny r. Eduardo Salvador Rivera Torres' USR application for his
proposed horse racing facility for the following reasons:
1. Mr. Eduardo Rivera started construction of this facility last year and has consistently
ignored permitting requirements. After multiple complaints from neighbors witnessing
the building of his race track, the County, on July 12, 2018, determined that this facility
was a training facility that fell under the Ag Zone District Use by Right rules. The
County determined that no violations were warranted because the facility was not
opened to the public. Yet, as per two FaceBook sites --- Furia Carrerera and Carrerera
de la Union Americana --the intent of this "training facility has always been to hold horse
races. The Facebook page Furia Carrerera started advertising this location to the public
as a race track as early as 07/06118 where they showcased a map of the race track
location with the label "Nunn Downs Race Track". In his USR application, Mr. Rivera
acknowledges that the horse track, fencing, and bleachers are "already constructed" .
The facility was fully constructed and ready for events a year ago! Mr. Rivera has
proven that the rules, regulations, and laws don't apply to him.
2. During the time that Mr. Rivera was building his racetrack, the Furia Carrerera Facebook
site showed two road graders actively moving land which, per Mr. Rivera's own
temporary permit pre application document is 440 yds by 21 yds (65 ft) of training track,
which is equivalent to 1.73 acres. As per County regulations, anything over an acre of
land moving requires a permit; Mr. Rivera did not pull a permit. In a June 27, 2018
email from Chris Gathman, the applicant was informed that more than 1 acre of sod
should not be disturbed. Eduardo Rivera indicated that this was not the case yet this
track and the associated did work exceeded one acre. In spite of the letter Mr. Rivera
received, he still ignored the permitting process and proceeded with his land moving. In
a County Commissioner hearing held on September 19, 2018 regarding Mr. Rivera's
Temporary Assembly application to hold a racing event, Mr Choate, Assistant County
Attorney, reported that the "Department of Public Works stated a grading permit was not
obtained".
3. Mr. Alula Afeworki is still listed at the Registered Agent of the Nunn Downs, LLC,
Captain Alan Caldwell, Weld County sheriff, stated in the County Commissioners
hearing on September 19, 2018 that Mr. Afeworki has had "several criminal incidents
recorded within Weld County." In one of those incidents, Mr. Afeworki "pled guilty to the
sale of a controlled substance". Mr. Rivera's applications vary on the use of alcohol. His
Temporary Assembly permit stated that alcohol would be served on the premises and
cars would be searched so people would not bring alcohol in. Mr. Afeworki stated that it
would not be served. Mr. Rivera's USR application states it would not be served yet,
Mr. Afeworki owns a liquor store! It seems that Mr. Rivera is uncertain if alcohol would
be served but most likely, as per his initial application, the intent is to sell alcohol.
4. The "Nunn Downs, LLC" is not registered as a Non - Profit therefore the intent of this
facility is to hold events to make money. The Nunn Downs Facebook page and the other
two associated Facebook accounts make no mention of entrance fees, registration fees,
etc. Therefore, how does this LLC (which was formed June 30, 2018 after the track was
built), make enough money to pay their participants. The Carrerera de la Union
Americana Facebook page feature video tapes of these events showing participants
actively exchanging money once the horses complete a race.
5. There is uncertainty as to how many customers will be in attendance. The Temporary
Assembly application signed on 08/21/18 estimated that 1800 people would be in
attendance. (500 vehicle trips) Another Temporary Assembly application signed on
08/21/18 estimated that 900 people would be in attendance. The Notice of Application
for Temporary Assembly dated 09/06/18 indicated that the temporary assembly was for
more than 350 persons. Ms. Weibel, attorney for the Registered Agent of Nunn Downs,
LLC, Mr. Afeworki, stated in the hearing on September 19, that there would be between
800 and 1000 people. Now this new USR application states from 50 - 350 attendees
With the uncertainty of the number of people who "could be" in attendance, it is doubtful
that Mr. Rivera could adequately plan for any emergency situation, security staff, or
crowd control..
6. Mr Rivera proposes in his USR application that Weld County "may want to install speed
limit signs on WCR 102....to provide "adequate stopping sight distance at the
intersection of WCR 21 and WCR 102". This confirms that Mr. Rivera is unaccustomed
to the laws of County - it is well known to agricultural property owners that the speed limit
on county roads (dirt and gravel) is 5o mph or whatever is suitable for the conditions.
7 Mr. Rivera states in his USR application that "it is not anticipated that the Nunn Horse
Racetrack would significantly impact the nearby roadway system." This is untrue! This
track would add a significant amount of traffic in the area that is surrounded by homes
and agricultural operations, as well as bog down the driveway of over 20 residents who
live on CR 21. Additionally, that many vehicles on CR102 would greatly impact travel on
that road. (See the attached map).
8. Mr. Rivera states in his Nuisance Management Plan that the" announcers stand and
sound system will be located west of the track facing east away form WCR 21." This
will not make a difference! First of all, we can hear Greeley's loudspeakers and the
crowd during the Stampede - this proposed venue is much closer! Additionally last July
4, 2018, Mr. Rivera's neighbor Pizarro Bernanrdio Orquiz had his speakers so loud that
we could not even enjoy our holiday with our grandchildren! This neighbor was also
firing off his guns at night. My grandchildren were so upset at the gunfire and loud
music, we ended up cutting our evening short. The Sheriffs office was called but, due to
the time of evening and the fact that this is a big county, they did not make it out. Our
neighbor went over to request that they turn their music down and he was threatened!
This is one person in the neighborhood that is a friend of Mr. Rivera's - times that
amount by 50 - 1500 people who are attending this event and the noise level is above
agricultural levels and will be a nuisance. Pointing the speakers in a different direction
will not have an effect on the noise level that is eminent from this type of venue.
9. Mr. Rivera proposes in his USR application that the activities held at this facility will be
from 8 a.m. to 6 p.m. Yet, he also claims that "outdoor lighting is wall -mounted" and
that "sources of light will be shielded so that light rays will not shine directly onto
adjacent properties." If Mr. Rivera is proposing that his events will be over by 6 p.m.,
why does he need lights.
10. Mr. Rivera states in his USR application that "trash containers will be provided
throughout the property for proper disposal" and that "trash pickup crew will pick up trash
on the property and along the main roads leading to the venue." Mr. Rivera will not be
able to control his crowds once events are over. We already have a problem with
people dumping trash on our properties and the County will not pick it up because it is
on private property.
11. Mr. Rivera cited Weld County Code Chapter 22 of the Comprehensive Plan that his
facility aligns with Policy 7.1 - "County land use regulations should support commercial
and industrial uses that are directly related to, or depended upon agriculture to locate
within the agricultural areas when the impact to surrounding properties is minimal or can
be mitigated and where adequate services are currently available or reasonably
attainable". Mr. Rivera stated in his USR questionnaire that the proposed use of the
facility is "directly related to agricultural uses -that of equestrian training." and that is is
"not situated near a resident or any neighboring uses that would be negatively impacted
by the ongoing operation." First, Mr. Rivera's intent as per previous comments on other
applications is to actively hold racing and rodeo events with anywhere from 50 - 1800
attendees. This is not a simple "equestrian training" facility but rather a full commercial
venue. This area is surrounded by over 20 families who would be impacted by this
facility and the events held at this facility. Many of the property owners have children
and grandchildren who ride horses on these roads, drive their motorcycles, walk, and
spend their weekends relaxing on their properties. This facility would have a negative
impact on all of us!
12. Ms. Weibel, Attorney for the Registered Agent of Nunn Downs, LLC, stated at the
hearing on September 19, 2018 that "CR 21 is owned by Mr. Rivera and another
neighbor" (assumably Mr. Alula Afeworki). This road is not soley owned by Mr. Rivera
and "one other neighbor." In fact, this is the driveway to 21 families and this is ONLY a
one lane dirt road that is maintained by the neighbors - except for Mr. Rivera. if two cars
do meet on this road, one car has to stop or both cars are driving off of the driveway.
This driveway gets even worse during rainstorms where only one car is able to get
through at a time - there is not option to "move over" without the risk of getting stuck.
13. The events held at this proposed facility, with the possibility of 50 - 1800 people in
attendance, will present a extreme safety risk to this populated community with homes
on the County Roads 102 and 21 as well as the surrounding areas. Mr. Rivera
indicated in his applications that he has enough parking for 400 vehicles on his property
- this is not enough spaces for 1800 people so most of the vehicles will be parked on
these two roads blocking residents private driveways, infringing on their properties,
damaging grass and landscaping, damaging livestock fences and gates and blocking off
residential traffic and emergency vehicles. County Road 21 is a private driveway and
the only driveway for residents living on County Road 21. The County does not
maintain this road and does classify CR 21 as a "driveway" for the property owners.
Emergency vehicles will not be able to get through these two roads with upwards of
1000 peoples' vehicles parked along these roads.
14. Mr. Rivera states that "this site is proposed to host...races with up to four horses
completing at one time". Yet, he has an eight -gate structure on his property. Mr. Rivera
states that up to "10 horses would be at the facility racing" and that "up to 10 horse races
co Id be held." He also states in his Facility Emergency Plan that he will have a barn
containing up to "twenty horse stalls." A reputable horse racing facility knows to not run
horses in back-to-back races so either there will be many more horses than just 10 or
there will be unethical practices involved to keep horses running.
15. Mr. Rivera reports that he has two domestic/livestock wells - Well #306280 is 360 feet
down and the Well #306279 is 400 feet down. Per the state, his domestic/livestock
wells only allow him to use up to 15 gallons/minute for watering domestic animals and
his livestock on a ranch or farm and 1 acre of lawn and garden. Per State requirements,
livestock watered cannot be anyone else's livestock - just his own! Mr. Rivera proposes
that he will provide bottled water for attendees but he does not address how he
proposes to water the horses who will be participating in these races or the cattle
participating in his rodeos. He also does not state where he will get the water for his
proposed water truck. As per the State. he has no augmentation permits on file allowing
him to water anyone else's livestock except his own.
16. The events proposed at this facility will bring in too many people for this agricultural
community, thus greatly increasing the risk of fires, There are no fire hydrants close to
this facility and the Nunn Fire Department (which is almost 7 miles away and not 2 ' 2
miles as the applicant states) is a volunteer department and it does take time for them to
get out here. We are on the high plains with dry prairie grasses that are extremely dry.
A single cigarette butt can lead to disaster!
17. There is no sheriff or local police presence close by. Additionally, per the Sheriffs
Department, they cannot handle vehicle problems that are parked on private roads and
County Road 21 is considered by the Sheriffs Department as a private road. There is
also no police presence to handle the crowds after the event is over. Ms. Weibel even
stated during the County Commissioners hearing on September 19, 2018 that "they can't
control individuals' behaviour once they leave the event!" As per the Temporary
Assembly application filed last year, alcohol will be served at this event. Mr Rivera
provided a contract with the application showing that he has a security company to
handle intoxicated attendees at the event, but they will not handle these people AFTER
the event after they leave his property. There is no active sheriff presence to respond to
trespassers, litter thrown on our properties, property damage sustained from these event
goers to our trees, shrubs, fences, gates, driveways, livestock safety, etc. Additionally,
as per the videos on these Facebook pages, who will control the angry betters who
lose? Additionally, as per the County's Right To Farm policies, "Law enforcement is
based on responses to complaints more than on patrols of the County, and the distances
which must be traveled may delay all emergency responses, including law enforcement,
ambulance and fire. Fire protection is usually provided by volunteers who must leave
their jobs and families to respond to emergencies"
18. Mr. Rivera included in his Emergency Management Plan that he will have security on
site. This does not work! Mr. Joe Cling, Chief of Police in Nunn was involved multiple
calls to an unsanctioned racing facility outside of the Galeton area. He talks of always
being called out because of the illegal activity occurring at these racing events including
alcohol use, drugs, violence, and gambling. This facility was eventually closed down
due to the illegal activity. We have families in this agricultural community and we do not
want our children and grandchildren exposed to the potential criminal activity associated
with this type of facility.
19. This area is zoned agriculture and many of the surrounding properties have horses and
cattle. These facilities bring in livestock - both cattle and horses - whose owners do not
obtain health certificates prior to crossing the border thus introducing diseases to
surrounding livestock. One instance happened in Kansas where seven equine
infectious anemia cases were traced back to unsanctioned racing. In 2017, there were
"three quarantines in place in Kansas: one in Lakin and two in the Garden City
area. All horses affected have a connection with the original quarantine location
near Garden City. All the horses affected were involved in unsanctioned horse
racing in Finney County"

applications or on his website about the requirement of his participant to have health
certificates on any of the livestock brought in. This lack of compliance and the reported
disease outbreaks tied to these facilities could have a devastating impact on the
livestock we all own in this area.
20. This facility is not compatible with Weld County's Right to Farm land use policies that
"support a high -quality rural character which respects the agricultural heritage and
traditional agricultural land uses of the County, ...which includes those uses which
provide rural lifestyles, rural -based economies and opportunities to both live and work in
rural areas. The natural landscape and vegetation predominate over the built
environment. Agricultural land uses and development provide the visual landscapes
traditionally found in rural areas and communities." This facility does not promote this
policy.
21. Lastly, this type of event is wrong for this area because this is a community of residents
who raise livestock on dry pastures with emergency services that are not easily
accessible and roads that are not built to handle that volume of traffic. The County
commissioners already stated in the hearing on September 19, 2018 the events held at
this facility are not "compatible with this area."
I encourage the Planning and Building to deny Mr. Riv►era's USR application based on the
reason above.

I am writing this to express my opposition to USR19-0022 submitted by Eduardo Salvador Rivera
Torres for the purpose of a commercial horse track.
Previously, Mr. Torres has applied for an Application for Temporary Assembly submitted by Nunn
Downs LLC for the purpose of a horse race, September 22, 2018 at this same location. The
application was met with strong opposition including the Weld County Sherrifs Office and was
denied
I am resubmitting many of the concerns I had with the Temporary Assembly application now
opposing the commercial race track aspect of this application.
The following are a number of concerns for my opposition.
• Traffic. The previous Temporary Assembly application listed approximate attendance at
1000 with a permit limit of 1800 generating 500+ trips. It should be assumed that any race
in the future would reach these figures. Frequency is not mentioned. This is going to place
a high level of stress on the County Roads listed as access points and an immense
amount of dust due to the dry climate. No mitigation plan is proposed. The access point
for the track is listed coming off of Weld County Road 21 but it is actually► a non County
maintained driveway going north from Weld County Road 102 used by a number of
residents as far north as Weld County Road 110. Again, no mitigation or repair plan is
mentioned.
• Location. This area is not as rural as it used to be. There are a number of homes in the
immediate area of this proposed event and many of the owners have been in contact with
each other and myself with their concerns with the event and race track itself.
• Gambling. This will happen. A FOX 31 Problem Solvers report on May 17, 2017
documented an unsanctioned horse race in Deer Trail and presented a number of illegal
activities that occurred. Gambling on horses is illegal, according to Ron Kammerzell, the
senior director of enforcement for the Colorado Department of Revenue. His agency
oversees some 1,400 pages of racing regulations. "The race track and all the casinos we
regulate are subject to IRS requirements, currency transaction reporting, suspicious
activity reports filed with the U.S. Treasury," Kammerzell said. "And the concern there is
with money laundering and activities that are incident to gambling itself." This can be

• Infectuous equine disease has been associated with Unsanctioned Racing. Equine
Infectious Aanemia (EIA) has been traced back to unsanctioned Racing in Kansas. The
highly infectious disease for which there in no cure, euthanasia is recommended for
infected horses to prevent it's spreading. Weld County does not need this. For complete

This is not new for Weld County. A few examples.
On December 7, 2005, following more than five hours of testimony, a permit for the construction
of a rodeo arena and horse racing track was denied by Weld County, Colorado, commissioners.
Introduced in March 2005, this project proposal infuriated local residents, who rallied together to
voice concerns about issues such as increased traffic, pollution, and environmental
repercussions.
In May of 2011, the City of Greeley considered bringing Mexican horse racing to Island Grove
Regional Park. Greeley City Councilman Mike Finn, had a number of concerns, such as the type
of crowds the racing would attract. He said he also wonders about the pay off.
"What benefit is it to the people racing the horses? What's the pay off for them? There's no
consumption of alcohol and no betting, and no winnings for the winning horse," Finn said. "It just
doesn't seem like everything has been presented." May 23, 2011, Greeley Tribune.
Mr. Finn made some very good points!
The proposed USR has no direct benefit for Weld County or the nearby residents and should be
denied by the County Commissioners.

This is a response to USR application #19-0022 an application for a
commercial race track in an agricultural zoned area. We are adamantly
opposed to this application. We have farmed in Weld County for over 50
years, nearly 40 years at our current location. We have seen the
changes. Our area is no longer wide open spaces. The proposed race
track is in the middle of a neighborhood.
County Road 21 is a non maintained county right of way and access for
many families who have built their homes there. There are five major
hilltops on county road 102, between county roads 19 and 23,
where there is limited visibility until you crest the top of the hills.
It is not a question of "if there is a head-on collision, but when." An
increase of 350 vehicles increases the possibility of a catastrophic
event. Who accepts responsibility for possible fatalities, the drivers,
the facility owners, the county for not considering the safety of its'
residents, who already have their homes here, before granting this type
of USR.
We think you need to consider the motive or mind set of someone who
constructs this type of facility without proper permits and as an
afterthought wants it allowed because they have already invested in the
construction of the facility.
Last fall at the county commissioners meeting, the sheriffs department
representative stated that the sheriffs department was in opposition to
the race track. We have an all volunteer fire department. The
applicant at that time said he'd contacted Nunn Fire Protection and they
would be on site. This is not true. They also said they had contacted
surrounding neighbors and there was no opposition, again not true. We
were not contacted and we are directly across the road to the south.
We calve in March and April. We have a field on the corner of CR 19 and
CR 102. This is where our cattle have their calves. The increase of
possibly 350 vehicles coming and going is an infringement on our lively
hood. It is not a good scenario. Despite our best efforts cows and
calves get out on the roadway. We farm our fields between March and late
September. We have farm equipment and trucks on that same stretch of
road moving between fields. We don't have the luxury of not working on
the weekends. 350 additional vehicles is incomprehensible. The dust
from additional vehicles in the drought conditions we have experienced
the last few years is another problem. The trash and debris is a
problem. The fire danger to our pasture, which is directly south of
their property is a huge concern.
We are strongly opposed to the issuing of a USR for this property. Weld
County is a Right to Farm County. We need to preserve that distinction.

I'm writing regarding the subject case. I own the property 50424 County Road 21, adjacent to
the horse track. I'm very concerned about the neighbors and their opposition to this project.
They have taken to some very dirty tactics, spreading gross and racist rumors, doing whatever
it takes to shut down Mr. Torres before he has even had a chance to begin. My wife and I
support the horse track project and the proposal as it now stands.
We have only been in this neighborhood for about two years. We moved from Nunn proper to
build a house. From the beginning the established neighbors have not exactly been friendly. I
got the feeling that they've tolerated us at the best of times. At least one of them went out of
their way to make things difficult in the beginning. It's definitely not a cohesive community. It
makes sense that a person would move to this area to get away from people and when a lot of
new people are suddenly threatening that peace, the residents would react negatively.
Unfortunately, it has gone too far, in my opinion.
Shortly after construction began on the Nunn Downs race track nasty rumors began circulating
around the neighborhood. It's obvious that they all came from one source because everyone
was regurgitating the same racist lies. Things such as the horses will be doped, or drug cartels
run it, illegal gambling, etc. All sorts of things regarding inhumane and illegal activities and
all stereotyped by Mr. Rivera's Hispanic ethnicity. All of it the same, repeated by everyone
that talked about it. I never heard a single original or valid argument. Whoever started that
campaign did a great job feeding on people's fears.
About a year ago, just after the July 4th holiday, one of the neighbors had the audacity to
approach my wife at our gate and say, "Welcome to the neighborhood." He clearly had no
feelings of welcoming us, since he waited a whole year before coming to say hello and as
evidenced by his immediate launch into a racist tirade regarding the horse track owners.
Naturally, the visitor didn't offer his name. Evil prefers to work behind a veil of anonymity.
After spewing all the same gossip we had already heard, he commented on how "they" had
their music up too loud on the 4th of July. He was implying that the residents of 10273 County
Road 102, owned by Luz Elena Perez Ramirez according to county record, are the same
people building the horse track and that "they" are a nuisance to the neighborhood. I'm certain
he knew the truth of the matter, but meant intentionally to mislead. Whatever it takes to get
what you want. The residents at 10273 did have their music unusually loud, but not for a
holiday. And they were playing what was definitely Mexican music, which I happen to be ok
with. In a single comment, this rascal made it clear that he isn't opposed to a horse race track
as much as he is opposed to having Mexicans living near him. My wife refuted his claims,
explained that the people living south of us are not the same people building the track and
mentioned that we have met Mr. Torres and his partner Mr. Moreno and do not feel the same.
I've had the pleasure and opportunity to get to know Eduardo Rivera Torres to a small degree.
He owns a concrete business, works in construction. He's successful and I can't fault him for
that. In his line of work he creates things. The horse track he and his crew built is very
attractive. It was done well. Eduardo is a humble and unassuming man who is pursuing a life-
long dream by establishing his race track. His personality is quite the opposite of those
opposed to his venture. I have no reason to believe he or his associates do or will be engaging
in illegal or inhumane activities. It's unfortunate that an honest man can be found guilty of
such gross crimes when there is no evidence or history of such things. We fully support his
endeavor and encourage you, the county planner, to listen to the facts of the matter and not be
swayed by the gossip. I have reviewed the proposal and I feel that it is sound and the track will
ultimately have little adverse impact on the community. Instead, it is my hope that the horse
track will be a place of gathering and community building. That's something this community
direly needs.

I am writing this letter to you out of shear desperation and fear for
my families, and my life and welfare. I am a 63 year native of this
area, just retiring from a 30 year career, inmunicipal water treatment,
with the City of Fort Collins. We have lived out here on WCR17 (two
miles from the proposed track) for over 20 years. I have witnessed
unprecedented growth here in that time, mostly really nice and expensive
horse type homes and facilities. Just before I retired it was announced
to City employees that Ft. Collins just eclipsed 160,000 population,
with the expectation of another 100,000 within the next ten years. Most
growth expected to the north toward Wellington. This growth is within 10
miles of the Nunn Downs. Even though the track is a Weld County issue,
it will effect Larimer County residents more. Really, it is a
Colorado..United States of America issue! This IS NOT making America
great! You all must know these things foster Cartel, drugs, violent
behavior. They hire their own security, veterinarians, etc. which are
all unscrupulous. Even though the claim several hundred attendees, it
will likely be 10 times that. Prairie fire danger is huge. We have
nearly had to emergency evacuate our place four times because of grass
fire. That risk will be off the charts. Most folks out here simply are
not aware or the track. We all live here for the peace and quiet. This
simply is not wanted and will not be tolerated. If allowed to happen, I
will be making it known to all news and related agents. I just want to
live out my life here in peace like a good law abiding, Go I fearing,
PROUD AMERICAN, deserves, and should be able to do. Please...Please

Statement of Understanding
The Division of Racing Events has approved you for a 45 -day temporary Racing License, This 45 -day temporary license
may still be extended or denied based on the results of your background investigation. In case of denial, you will receive
a "Notice of Denial," Upon receipt of such a Notice of Denial, or at the request of a Division official, you must immediately
surrender your ID badge (the temporary badge) and you may not continue to work as a licensee. Should you receive a
denial of your racing license, the denial is effective immediately, You may appeal the denial of your license application.
Until a determination of that appeal, you cannot possess a Racing Division license, This means that you have no right to
work in any capacity that requires a Racing License unless the Colorado Racing Commission reverses the denial of your
license. You need to understand that you are responsible for knowing about, and complying with, state law and regulations
governing racing. You also need to be aware that you may obtain or view these documents at any Division office. Failure
to comply with any law or regulation may be grounds for disciplinary action, including the suspension or revocation of your
Racing license and a monetary penalty after an administrative hearing. A license status update will be sent to you within
45 days of application. If you have any questions, you may contact the Division at (303) 205-2990.
