B D Sanborn having filed his affidavit showing that on December 21 , 1895 P W Allen became the purchaser of tax, sale certificate at said sale of the undivided one half of Block 134, Greeley, said certificate being numbered 269, sales of 1895 for the taxes of 1894; that, on January 16 , 1896 said certificate was assigned to Frederick M. Dille as shown County Treasurer ' s books , and that on July 25, 1902 he sold said property to W L Clayton; that said tax sale, certificate has since been lost and after diligent search he has been and is still unable to find the same ; that said tax sale is a cloud upon the title to said property and he asks that this , Board, by proper order entered of record, authorize the County Treasurer of Weld County to issue his certificate of redemption from said sale. It further appearing to the Board that the said B D Sanborn has filed his indemnifying. bond to save and keep harmless the said County of Weld and all of its officials from all damages that may be occas.oned by said redemption without the Surrender of the original certificate of purchase, it was therefore, on motion ordered that the County Treasurer be and he is hereby authorized and empowered to issue proper redemption certificates for said property from said tax sale upon payment of the proper fees therefor. Spear and petitions the Board of County Commissioners of Weld County, State of Colorado for an amendment of a franchise granted him byithis Board October 7, 1903 and amended November 10, 1904 extending the time mentioned in .paragraphs 4 and 5, namely, 31st day of December 1906 to the 31st day of December, 1907, to begin construction of said Railway, and December 31, 1909 to complete 40 miles of said railway, Fifty miles by December 31, 1910, and 6o miles by December 31, 1911 and so on. After carefully' investigating the matter, and accepting ci legal advice from the County Attorney, the Board were of thee opinion that after the levy had been' ordered and extended it was not in their power to revoke the same, it was therefore on motion ordered that said request be not granted and that the Clerk of this Board so notify Mr. Moore. () George Helps appeared before the Board and complained of having had one of his best horses killed on one of the County Roads West of Greeley and asked ,that the Board reimburse him for the same, claiming that the accident was caused by the road being very rough; after carefully con- sidering the matter . and being well advised in the premises the Board did not consider that the county was in any way responsible, therefore they . could not grant his request and the Clerk was directed to so notify him. Friday, January 4, A. D. 1907 at which time they will be publicly opened and read. IN THE MATTER OF REDEMPTION OF // TAX SALE CERTIFICATE. G. M, Glick appeared before the Board and stated that Tax sale Certificate No. 1, Sales of 1874, which is presumably lost, stands as a cloud against Lots 11 and 12, in Block 2, Greeley and asks that the County Treasurer be instructed tab issue a new certificate therefore. After carefully investigating the matter, it was on motion ordered that the County Treasurer be and he is hereby authorized and directed to issue proper redemption certificate upon the payment to him of the proper fees therefore. Mr. Glick gave his bond to to save and keep harmless the County of Weld and all of its officials from any damages that may be occasioned by the issuance of the new certificate without the return of the old, and which bond was duly accepted and ordered placed on file.
