RE: ACCEPT REQUEST OF NORTH WELD COUNTY WATER DISTRICT TO WITHDRAW
APPLICATION FOR A SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL
REVIEW PERMIT, USR18-0030 FOR MINERAL RESOURCE DEVELOPMENT
FACILITIES, OIL AND GAS SUPPORT AND SERVICE (CLASS II OILFIELD
WASTE DISPOSAL FACILITY - SALTWATER INJECTION FACILITY), IN THE
A (AGRICULTURAL) ZONE DISTRICT
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners held a public hearing on the 28th day of
August, 2019, at the hour of 10:00 a.m., in the Chambers of the Board, for the purpose of hearing
the application of North Weld County Water District, P.O. Box 56, Lucerne, Colorado 80646, for
a Site Specific Development Plan and Use by Special Review Permit, USR18-0030 for Mineral
Resource Development Facilities, Oil and Gas Support and Service (Class II Oilfield Waste
Disposal Facility - Saltwater Injection Facility), in the A (Agricultural) Zone District, on the following
described real estate, to -wit, and:
Lot B of Recorded Exemption, RE -3156; being part
of the E1/2 E1/2 of Section 30, Township 8 North,
Range 65 West of the 6th P.M., Weld County,
Colorado
WHEREAS, at said hearing, the Board was presented with an electronic letter, received
July 31, 2019, from the applicant requesting the withdrawal of the application, stating the purchase
contract between Expedition Water Services and North Weld County Water District (NWCWD) no
longer exists, and NWCWD has no intention to divest the property, and
WHEREAS, the Board of County Commissioners heard all of the testimony and
statements of those present, studied the request of the applicant and all of the exhibits and
evidence presented in this matter and, having been fully informed, deems it advisable to grant the
applicant's request and thereby accept the withdrawal of the application.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the request of North Weld County Water District to withdraw the application
for a Site Specific Development Plan and Use by Special Review Permit, USR18-0030, for Mineral
Resource Development Facilities, Oil and Gas Support and Service (Class II Oilfield Waste
Disposal Facility - Saltwater Injection Facility), in the A (Agricultural) Zone District, on the parcel
of land described above be, and hereby is, accepted and the matter is dismissed.

Subject: Expedition Water Services Case No. USR18-0030, Withdrawal of Application Request
Mr. Gathman,
The North Weld County Water District (NWCWD) requests that Weld County Department of Planning Services
withdraw the Expedition Water Services (EWS) Use by Special Review Application, Case Number USR18-0030.
The previous authorization dated 2018 was granted as a condition of a previous purchase contract that was
terminated by Expedition Water Services in 2018. There is not a current purchase contract between EWS and
NWCWD and no intention by NWCWD to divest the property. As the current landowners of the property and
under direction of the NWCWD Board I request that the application be withdrawn.
