RE: DENIAL OF LOT SIZE VARIANCE NO. 54 - HOWARD HALEY.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners has determined
at a public hearing held on the 28th day of December, 1977, in
the Chambers of the Board of County Commissioners of Weld County,
Colorado, that a certain parcel of land is owned by Howard
Haley, which land is more particularly described as follows,
to-wit:
That part of the North one-half North one-
half North one-half Section 13, Tcwnship 1
North, Range 68 West of the 6th Principal
Meridian, Weld County, Colorado, lying East of
the Union Pacific Railroad R.O.W. , being more
particularly described as follows:
Beginning at the Northeast corner of the Northeast
one-quarter of said Section 13; thence S89°34'40" W on an
assured bearing along the North line of said North one-half
North one-half North one-half Section 13 a distance of
30.00 feet to the true point of beginning; thence
S00°00'00" W along a line parallel to and 30.00 feet West
of the East line of said North one-half North one-half North
one-half Section 13 a distance of 663.80 feet to a point on the
South line of said North one-half North one-half North one-
half Section 13; thence S89°43'31" W along said South line a
distance of 2168.50 feet to a point on the Easterly R.O.W.
line of said Union Pacific Railroad; thence N 12°14'55" E
along said Easterly R.O.W. line a distance of 674.63 feet to
a point on the North line of said North one-half North one-half
North one-half Section 13; thence N 89°34'40" E along said
North line a distance of 2025.41 feet to the true point of
beginning.
WHEREAS, the owners of said tract of land desire to obtain
a variance from the minimum lot size requirement so that
Howard Haley may make application to the Board of County Com-
missioners to apply for a recorded exemption, as set forth in
Section 9-4.A. (6) of the Subdivision Regulations, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, based upon the recommendations of the Department of
Planning Services, feels that the applicant has not shown good
cause for granting a lot size variance under Section 9-4.A. (6)
of the Weld County Subdivision Regulations.

NOW, THEREFORE, BE IT RESOLVED by the Board of County Corn-
missioners of Weld County, Colorado, that a variance from lot
size requirements , be, and hereby is, denied to Howard
Haley for the above described parcel of land.
The above and foregoing Resolution was, on motion duly
made and seconded, adopted by the following vote on the 28th
day of December, A.D. , 1977.

Dear Commissioners :
The attached letter and related materials are in reference to a
request by Howard Haley for a lot size variance. The subject
property is described as Pt . of the N2N2N2 Section 13 , T1N, R68W
of the 6th P.M. , Weld County, Colorado . The property is located
1 mile south of Dacono. The property in question contains ap-
proximately 32 acres of Class III and IV non-irrigated soils.
The request is to obtain a variance from the minimum lot size
requirement , Section 9-4(A) (6) of the Weld County Subdivision
Regulations, so that he can apply for a Recorded Exemption.
Section 9-4(A) (6) states :
"That under the original tract or parcel of land to be
divided under this Section meets the minimum lot size
requirements established by the Weld County Zoning
Resolution; variance from this requirement being al-
lowed only upon good cause being shown to the Board of
County Commissioners or where said tract or parcel of
land lies within the comprehensive plan area of an
existing incorporated town of Weld County. (Rev. 4/17/74)
If the lot size variance is approved, Mr. Haley will proceed with
a Recorded Exemption application to create two parcels of approxi-
mately 5 acres and 27 acres . The 27 acre parcel will contain no
improvements while the 5 acre parcel will contain a residence and
dog kennel facilities approved in January 29 , 1975 , under Special
Use Permit 269. As expressed in a letter from Mr. Haley, received
November 25 , 1977, he would desire to divide the property as he is
being transferred and the property would be easier to sell .
Based upon the information submitted and the adopted policies and
regulations of Weld County, the Department of Planning Services
Staff recommends denial of the request for the following reasons :

1 . The proposal does not comply with the Weld County Compre-
hensive Plan. The plan states :
"In order to minimize conflicting land uses and
minimize the cost of new facilities and services
to the taxpayer, . . .residential development will
be encouraged to locate adjacent to . . . incorporated
towns and in accordance with the comprehensive
plans and states wishes of each community. . . "
The plan further states:
"Proposals for new residential development ad-
joining existing municipalities shall be en-
couraged so long as they conform to the desires
of the towns as expressed in their comprehensive
plan . "
A letter dated December 14, 1977, from the Town of Dacono
Planning Commission states the Planning Commission recom-
mends denial of the request . Because the adjacent community
recommends unfavorably, the request does not comply with
the Comprehensive Plan;
2 . The proposal does not conform to the intent of the Agri-
cultural District as defined by the Weld County Zoning
Resolution nor the intent of the Recorded Exemption Pro-
cedure as outlined in the Subdivision Regulations. The
intent of the Agricultural District is to allow agricul-
tural related uses where agriculture is and should con-
tinue to be the predominant land use. Also, the intent
is to discourage encroachment of incompatible uses and
provide for the orderly expansion of urban growth in
conformance with ,the Comprehensive Plan . Division of
the property as proposed would permit encroachment of
urban activity not in an orderly fashion in conformance
with the Comprehensive Plan. The proposal would not be
a higher or more productive use and would not be compat-
ible with surrounding agricultural uses ; and
3 . Good cause has not been shown why the variance should be
granted as stipulated in Section 9-4(A) (6) of the Weld
County Subdivision Regulations.
