PERMIT, USR-754, FOR A HOME BUSINESS (AUTOBODY, REPAIR, AND PAINT
FACILITY) IN THE A (AGRICULTURAL) ZONE DISTRICT - KENNETH AND SANDRA
BROOKER
A public hearing was conducted on May 15, 2019, at 9:00 a.m., with the following present:
Commissioner Barbara Kirkmeyer, Chair
Commissioner Mike Freeman, Pro -Tern
Commissioner Sean P. Conway
Commissioner Scott K. James
Commissioner Steve Moreno
Also present:

Planning Services Department representative, Angela Snyder
The following business was transacted:
I hereby certify that pursuant to a notice dated April 30, 2019, and duly published May 3,
2019, in the Greeley Tribune, a Show Cause hearing, PCSC18-0022, was conducted to show
whether good cause exists for the revocation of Use by Special Review Permit, USR-754, for a
Home Business (autobody, repair, and paint facility) in the A (Agricultural) Zone District, held by
Kenneth and Sandra Brooker.
El Angela Snyder, Department of Planning Services, presented a brief summary of the USR and
the Probable Cause hearing. She explained the violations and how the applicant addressed each,
to bring the site into compliance. She indicated, overall, the applicant had removed the
commercial waste and modified the storage of commercial vehicles to comply with the USR
boundary; however, there was wood and personal debris remaining at the site. She stated the
Department of Planning Services recommended dismissal of the Show Cause hearing.
Ken Brooker, applicant, stated his home is heated by a wood stove and explained his use of
the wood stored at his site. He described his efforts to comply with the USR and expressed he
would like to keep working. Chair Kirkmeyer complimented the applicant on his efforts and
Commissioner Conway echoed the comments previously stated.
El No public testimony was offered concerning this matter.
el In the matter of Show Cause hearing, PCSC18-0022, Commissioner Conway stated the
finding that the site is substantially in compliance and moved to dismiss the Show Cause hearing.
The motion was seconded by Commissioner Moreno, and it carried unanimously. There being no
further discussion, the hearing was completed at 9:56 a.m.
