A public hearing was conducted on March 6, 2019, at 10:00 a.m., with the following present:

The following business was transacted:
I hereby certify that pursuant to a notice dated March 19, 2018, and duly published
March 22, 2018, in the Greeley Tribune, a public hearing was conducted on May 9, 2018, and
then subsequently continued to August 8, October 17, January 30, 2019, February 11, 2019, and
again to March 6, to consider the request of WETCO Farms, Inc., fora Site Specific Development
Plan and Use by Special Review Permit, USR18-0001, for any Use permitted as a Use by Right,
Accessory Use, or Use by Special Review in the Commercial or Industrial Zone Districts (sale of
construction equipment, miscellaneous equipment and trucks and trailers, vehicle modification
and dismantling of wrecked vehicles and sale and/or recycling of dismantled vehicle parts)
provided that the property is not a lot in an approved or recorded subdivision plat or part of a map
or plan filed prior to adoption of any regulations controlling subdivisions in the A (Agricultural)
Zone District. On March 6, 2019, Bob Choate, Assistant County Attorney, made this a matter of
record.
El Chris Gathman, Department of Planning Services, presented a brief summary of the proposal
and stated the applicant was seeking to relocate the facility. He described the proposed buildings
and their uses on the northeast side of the parcel, and indicated there will be no outside storage
at the location. He further described the southeast side of the parcel and its' uses, and stated
there will be five (5) full-time employees. He mentioned there will be 10-15 daily visitors to the site

and provided the hours of operation. Mr. Gathman stated the proposed facilities will be serviced
by the Central Weld County Water District (CWCWD) and briefly described the updates to the
application since the May 9, 2018 hearing. He referred to the Department of Public Works to
discuss a proposed emergency access onto County Road (CR) 50 and the primary access onto
U.S. Highway 34. He stated the applicant was in the process of obtaining an access permit from
the Colorado Department of Transportation (CDOT), and reviewed a referral from CDOT
regarding the access permit. Mr. Gathman reviewed other permits, agreements, and
correspondence from various agencies. He provided images of the site and surrounding views,
reviewed the location of the two (2) access locations and surrounding property owner concerns,
and entered the favorable recommendation of the Planning Commission into the record as written.
In response to Commissioner Conway regarding the backflow, Mr. Gathman referenced an
exhibit from the CWCWD, and in response to Chair Kirkmeyer, Mr. Gathman stated there were
no Conditions of Approval (COA) or Development Standards (DS) to address the ditch crossing
due to it already being submitted.
Hayley Balzano, Public Works Engineer representative, provided a brief overview of the
transportation plans and requirements, and reiterated there are two (2) proposed emergency
access points, which she showed on a displayed map. She provided the traffic counts, specified
the vehicles associated with the proposed use. She stated the Department of Public Works is
requiring an Improvements Agreement and Road Maintenance Agreement. She indicated a Final
Drainage Report and detention pond design will be required. She mentioned the ditch crossing
agreement includes the detention pond outlet pipe for the southern pond. She indicated there is
a COA missing for Historic Flow patterns and runoff, and requested it be added.
ei Lauren Light, Department of Public Health and Environment, reviewed the water and sewer
provisions, and reiterated the CWCWD will provide potable water to the site. She stated they will
be installing a commercial septic system for the business, which is addressed in the COAs. She
mentioned maintenance and body work will occur on the site, and a water recycle system, diesel
tank, and a secondary containment will be onsite, which may include other requirements. She
stated DS #9-25 address Environmental Health (EH) items.
• Bill Hughes, Attorney, represented the applicant and reviewed the Right -of -Way Agreement
with the Lower Latham Ditch Company. He reiterated the CWCWD will be supplying water and
the applicant will be drilling a new water well. He stated the new access point will be safer than
the initial access proposed and mentioned the locations of the buildings.
• No public testimony was offered concerning this matter.
• In response to Chair Kirkmeyer, Chris McGranahan, traffic engineer with LSC Transportation
Consultants, explained the reasoning for an emergency access. In response to Chair Kirkmeyer,
Brett Bloom, applicant, described the mitigation for dust and sand concerns. Mr. Gathman
described the allowed, proposed, and recommended signage for the site. After further discussion
regarding the signage, Chair Kirkmeyer clarified DS #8 and confirmed the type of signage allowed.
Regarding the Landscaping and Screening Plan, Chair Kirkmeyer confirmed with the applicant
the location and type of screening that will be put on the site, once approved.

Chair Kirkmeyer suggested deleting COA #1.A (Improvements and Road Maintenance
Agreement) and requested adding to the DSs to ensure the access on CR 50 is an emergency
access. She further recommended deleting COA #1.C -D (address the concerns of the West Soil
Conservation District and Platte Valley Fire Protection District). Chair Kirkmeyer reiterated
COA #1.F includes the screening related to the staging area adjacent and south of the proposed
shop and storage buildings only. Chair Kirkmeyer requested the language from DS #8 be
duplicated to COA #1.G.5 (signage) to address the waiver request, and Ms. Balzano confirmed
COA #5.B (approved access and tracking control) could be deleted.
CI Ms. Light requested deleting language in DS #21 (COGCC compliance), and Ms. Balzano
proposed a new DS #27 (emergency access on CR 50). She also suggested a new DS #30
(historical flow patterns and runoff), and Mr. Gathman proposed a small change to COA #1.E
(CWCWD) regarding the date and form of correspondence.
El In response to Chair Kirkmeyer, Mr. Bloom and Mr. Hughes indicated they had reviewed,
and agree to abide by, the Conditions of Approval and Development Standards, as amended.
er Chair Kirkmeyer reopened the public hearing for changes made to Conditions of Approval
and Development Standards, and there was no public testimony.
Commissioner Conway moved to approve the request of WETCO Farms, Inc., do Brett
Bloom, for a Site Specific Development Plan and Use by Special Review Permit, USR18-0001,
for any Use permitted as a Use by Right, Accessory Use, or Use by Special Review in the
Commercial or Industrial Zone Districts (sale of construction equipment, miscellaneous
equipment and trucks and trailers, vehicle modification and dismantling of wrecked vehicles and
sale and/or recycling of dismantled vehicle parts) provided that the property is not a lot in an
approved or recorded subdivision plat or part of a map or plan filed prior to adoption of any
regulations controlling subdivisions in the A (Agricultural) Zone District, based on the
recommendations of Planning staff to be incorporated into the Resolution Findings, along with the
Conditions of Approval and Development Standards as amended. T -he motion was seconded by
Commissioner Moreno, and it carried unanimously. There being no further discussion, the hearing
was completed at 12:55 a.m.
