HomeMy WebLinkAbout750390.tiff RESOLUTION WHEREAS, a public hearing was held on July 7, 1975, at 10:00 A. M. o'clock at the Weld County Exhibition Building, Greeley, Colorado, for the purpose of hearing the petition of the Platte River Power Authority requesting approval for a proposed Ft. Collins - Ault transmission power line to be con- structed by said Platte River Power Authority in accordance with various exhibits attached herewith and made a part hereof for ready reference, showing thereon and therein the proposed transmission lines and the various accompany- ing transmission facilities, and WHEREAS, the petitioner was present, being represented by John Wittemyer, Attorney, William J. Slimak and Charles R. Huddleson, and WHEREAS, there was some opposition to the request of petitioner for the proposed transmission line, and WHEREAS, the Board of County Commissioners heard all the testimony and statements of those present; has studied the request of petitioner and studied the recommendations of the Weld County Planning Commission, and having been fully informed; NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners that the application of the Platte River Power Authority to run a power transmission line (Ft. Collins - Ault transmission line) along the route as indicated in Weld County and as shown in the exhibits hereinabove mentioned, be, and it hereby is approved under the condition that all applicable subdivision regulations and zoning regulations shall be followed and complied with in accordance with the zoning resolutions of Weld County, Colorado. SLIMAK BEFORE THE PUBLIC UTILITIES COMMISSION • OF THE STATE OF COLORADO PLATTE RIVER POWER AUTHORITY TRANSMISSION LINE PURCHASE AND USE AGREEMENT Y JULY 1974 TRANSMISSION LINE PURCHASE AND USE AGREEMENT THIS AGREEMENT, made and entered into this 7' day of 17.;„)&4,-(,_4,,,, 1974, by and between PLATTE RIVER POWER AUTHORITY, a non-profit Colorado - corporation (hereinafter referred to as "Platte River") and the CITY OF FORT COLLINS, a municipal corporation of the State of Colorado (hereinafter referred to as "Fort Collins") , WITNESSETH: WHEREAS, Platte River sells and delivers to Fort Collins , and Fort Collins purchases and receives from Platte River, all electric power and energy which Fort Collins requires for distribution and resale to the extent that Platte River has such power and energy and facilities available; WHEREAS, Platte River has contracted for electric power and energy from the United States for resale to Fort Collins and other municipal Participants, is participating in the construction of the Yampa Project electric generating plant to obtain. additional power and energy, and is undertaking the construction of transmission facilities to enable it to deliver such electric power and energy to its various municipal Participants ; WHEREAS, to minimize environmental impact and to achieve economies in construction and utilization of rights-of-way, Platte River and its municipal Participants will , wherever practicable, follow a policy of joint use of transmission facilities ; WHEREAS, in furtherance of this policy, Platte River will purchase, construct, or otherwise acquire all necessary transmission lines for the delivery of electric power and energy to its various municipal Participants and, where applicable, will license and permit any and/or all municipal Participants in Platte River to jointly use, on equal terms and conditions , . • • said transmission facilities for local transmission of electric power and energy required for their respective systems ; WHEREAS, the double-circuit transmission line from Station 300 to Drake Road, Fort Collins , was constructed by Fort Collins in anticipation of its own and Platte River's requirements , and the foundations, towers , and 230 kv facilities of such line can be sold to Platte River by Fort Collins on the terms and conditions hereafter contained, without diminishing, restricting or limiting the usefulness of the remaining 115 kv facilities - to Fort Collins, so that the line can economically satisfy the needs and requirements of both parties pursuant to this Agreement; and WHEREAS, Fort Collins has constructed, and desires to operate and main- tain the 115 kilovolt portion of the said double-circuit transmission line, and Platte River desires to grant Fort Collins a License and Permit for such use under the terms and conditions specified herein; NOW THEREFORE, in consideration of the payments as hereafter provided and the mutual covenants , promises and conditions herein set forth, the • parties hereto agree as follows : (1 ) . Condition to Sale Performance under this Agreement is conditioned upon the receipt, on or before the date of Closing as hereafter provided in subpara- graph 2(b) , of evidence that the Union Pacific Railroad Company will consent to an assignment by Fort Collins to Platte River of • all right, title and interest of Fort Collins in and to the right- of-way license agreement with the Union Pacific Railroad Company (C.D. 39850- 5) executed by Fort Collins on Septersher 3, 1970, a copy of which is attached hereto as Exhibit "A" and incorporated herein by this reference. (2) Purchase of Transmission Line Subject to the condition of paragraph 1 , Fort Collins agrees to sell and Platte River agrees to purchase those components of the transmission line described in Exhibit "B" , Fort Collins 230 kv • Transmission Line to be Purchased by Platte River Power Authority, attached hereto and incorporated herein by this reference on the • following terms and conditions: • (a) Purchase Price • • The Purchase Price is $145,981 and shall be due and • payable by Platte River to Fort Collins at the time of Closing as hereafter provided. • (b) Closir� Payment of the Purchase Price and delivery of documents (the "Closing") shall occur on February 11 , 1974 at 10:00 a.m. , or at such other time as may be mutually agreed upon by the parties, at the offices of Platte River, 3030 South College Avenue, Fort Collins, Colorado. (c) Documents Delivered at Closing - At Closing and upon receipt of the Purchase Price, Fort Collins shall deliver to Platte River: (1 ) a properly executed and acknowledged Bill of Sale, conveying to Platte River, free and clear of lien or encumbrance, the Purchased Trans • • - • mission Line. • (2) cost records for the Purchased Transmission Line allocated in accordance with the FPC uniform system of accounting . (3) one (1 ) copy of engineering drawings and specifications for the Purchased Transmission Line. • (4) a properly executed and acknowledged Assign- ment assigning to Platte River all right, title and interest of Fort Collins in and to Exhibit • "ASP (3) License and Permit r Platte River does hereby grant to Fort Collins a License and Permit to install , construct, operate, maintain, repair and replace a 115 kv_, 4 transmission circuit on and along that portion of the Fort Collins- Loveland 230 kv Line between the terminal of said 115 kv circuit at Station 300 and the south side of Drake Road, Fort Collins, • • including: (a) The right to attach and/or maintain its cross-arms , insulators, conductors , related equipment and streetlights on the 115 kv side of the Platte River power pole structures, which equipment shall be and remain the property of Fort Collins notwithstanding that the same may have been affixed to such structures. • (b) The right to use the overhead ground wire and to make such con • - nections thereto as shall be necessary for its common use, pro- - • vided however, that such overhead ground. wire shall be and remain the property of Platte River, be repaired and maintained by Platte River and constitute a part of the facilities the use of which by Fort Collins is licensed and permitted hereunder. • (c) Subject to the restrictions imposed by the mutually acceptable safety procedures hereafter set forth, the right of full access, ingress and egress to enter upon the right-of-way and the power pole structures as necessary for installation, maintenance, repair, replacement and inspection. (4) Term of Agreement • The portion of this Agreement relating to Fort Collins use of Platte River facilities shall become effective on the date of its execution and shall remain in effect for the useful life of the transmission poles acquired hereunder and shall be binding upon Platte River's successors or assigns . (5) Payments by Fort Collins As consideration for the use of the facilities as herein provided, and commencing on the effective date of this Agreement, Fort Collins • shall pay to Platte River each month a rental of $291 .00 for a period of thirty (30) years , after which' such rental shall cease , plus reim- bursement of 39% of Platte River's expense for the previous month for R the maintenance of common poles , foundations , and ground wire, which Fort Collins is licensed to use hereunder, payable at the time of and in addition to payments for power received pursuant to the Electric Service Contract between Fort Collins and Platte River dated October 21 , 1971 , as amended. (6) Respective Obligations Right-of-way maintenance and maintenance, repair and replacement of the Fort Collins-Loveland 230 kv Line, the overhead ground wire, and the power pole structures therefor shall be the sole and exclusive • responsibility of Platte River; similarly, installation, maintenance, repair and replacement of the 115 kilovolt conductor, insulators and cross-arms attached by Fort Collins to the power pole structures shall be the sole and exclusive responsibility of Fort Collins. (7) Safety Procedures • R (a) Fort Collins hereby acknowledges that it is aware of the hazards inherent in high voltage areas , and hereby assumes full responsibility for the adoption. and use of the necessary safety measures required to prevent accidental harm to per- sonneT' engaged in any construction, installation, operation, maintenance, inspection , replacement or repair activities of Fort Collins pursuant to this license. Prior to starting any of the work proposed, Fort Collins shall submit a plan of work to the Director of Engineering of Platte River at Fort Collins, Colorado, which shall indicate the sequence and method of per- - forming the proposed work. At all times during the work activ- ities of Fort Collins pursuant to this license, such activities shall be under the supervision of a 'qualified agent or employee of Fort Collins who shall be authorized to represent Fort - Collins in all matters pertaining to such activities. Fort Collins and Platte River shall keep the other informed of the name of its representative at the work site. (b) Fort Collins shall not permit its agents or employees to enter upon the right-of-way of Platte River for the purpose outlined in this license without having obtained specific permission to do so at a specified time from the duly authorized representa- c. tive of Platte River, and such permission shall be requested by • Fort Collins ' authorized representative at least 24 hours in • advance. Only those agents and employees whom Fort Collins certifies are qualified to work in safety in high voltage areas, r or those workmen who are accompanied by and under the constant supervision of agents and/or employees so certified by Fort Collins , shall have the right to workwithin and adjacent to • the right-of-way of Platte River under this license. . ( ( (c) Fort Collins , unless otherwise advised by a Special Work Permit, shall consider that all circuits in the area are energized and shall keep its agents and employees informed of safe work limits and of such other precautions as may be • necessary for their safety. (d) When it is necessary to de-energize circuits in order to pro- • ceed with work hereunder, or when such work must be done close to circuits that remain energized, Fort Collins' authorized . representative shall request from the authorized representa- tive of Platte River at the work site a Special Work Permit. The authorized representative of Platte River shall arrange for a Clearance or Hot Line Order and will then issue to Fort Collins' authorized representative a Special Work Permit autho- rizing Fort Collins to proceed with the work. The Special Work • Permit shall specify the circuits that have been de-energized or on which a Hot Line Order has been placed , as the case may _ be, and special conditions pertaining thereto. No such work shall be done until a Special Work Permit has been issued, nor shall any work be done in any area not specifically covered by the Special Work Permit. A Clearance or Hot Line Order shall not he released until Fort Collins ' authorized representative has signed and delivered to the authorized representative of Platte River a release of the. Special Work Permit certifying that all personnel are clear of the area covered by the Special ' Work Permit and that the facilities are in proper condition to be returned to normal service. (e) In the event of an emergency occurring on the facilities of either party, such emergency repairs as are necessary shall be made in the most expeditious manner-consi-stent with safe _ work practices , regardless of the time limitations and rou- tine procedures required by this Article, but such time limita- tions and procedures shall be followed to the maximum extent practicable in the circumstances. (f) The safety obligations imposed by this Article upon Fort Collins with respect to Platte River's 230 kv facilities , shall likewise be observed by Platte River with respect to Fort Collins ' 115 kv, facilities. (8) Liability • Fort Collins hereby agrees to indemnify and hold harmless Platte River, its agents and employees , from any loss or damage and from any liability on account of personal injury, death , or property • damage, or claims for personal injury, death , or property damage of any nature whatsoever and by whomsoever made arising out of or r (6) in any manner connected with its operations under this license. Such an application was. entertained by the Commission pursuant to 115-5-1 , CRS 1963, (now section 40-5-101 , CRS 1973) . Thereafter, pursuant to 115-6-8(2) CRS 1963 (now section 40-6-108(2) , CRS 1973) , as implemented by Rule 8 of the Commission's Rules of Practice and Procedure, proper notice of hearing on the application was given. There is attached hereto the certificate of the Secretary of the Commission attesting to the mailing of the notice as required by law. As you will note thereon, a copy of the notice of hearing was sent to the Weld County Commissioners along with a copy of the application. Additionally, a copy of the Notice of Hearing was posted in this Commission' s office in accordance with the Commission' s Rule 8. You express concern over procedures for notification of public hearings when private property is to be taken by public utilities, and that the hearing held by this Commission related to that matter. The motion of Platte River was granted by the Commission by order entered June 4, 1974. Applicant, Platte River Power Authority, is a non-profit • corporation organized and existing under and by virtue of the laws of the • State of Colorado. It is a public utility as defined in 115-1-3, CRS 1963, as amended, and it is subject to the jurisdiction of this Commission. It is engaged in the purchase of electric power and energy from the United States Bureau of Reclamation, and the transmission of that power and energy for sale at wholesale to four Municipalities for resale within the state of Colorado, as follows : City of Fort Collins; City of Loveland; City of Longmont; Town of Estes Park.. Certified copies of its Restated Articles of Incorporation and all amend- ments thereto are on file with this Commission, 2. The Commission has jurisdiction over Matte River, and also over the subject matter of this application. 3. Platte River was created by the four Municipalities listed above, as their agency and instrumentality, to construct, reconstruct, improve and rehabilitate, repair, operate, and maintain generating plants and transmission systems for the purpose of delivering electrical power and energy generated thereby to said Municipalities . • 4. The United States Bureau of Reclamatioh (the "Bureau") has historically supplied the wholesale electric power and energy requirements of the Municipalities but will be unable to supply additional electric power and energy to meet load increases after 1977 (Exhibit B). The electric power and energy available to the Municipalities from the Bureau is sold to Platte River by the Bureau (Exhibit C) and resold by Platte River to the Muni- cipalities (Exhibits D, E, F, and G) . 5. To meet the increasing power and energy requirements of the Municipalities, Platte River is participating in the Yampa Project which comprises the construction, operation, and maintenfince of an electric generating station to be located near Craig, Colorado, together with related transmission and transformation facilities. The Yampa Project and Platte River's participation in that project has been heretofore certificated by this Commission by Decision No. 85132 (Exhibit R), 6. Applicant will receive electric power and energy to which it is entitled by virtue of its participation in the Yampa Project at the Ault, Colorado, terminus of the 345 Kv transmission line to be constructed, owned and operated by the United States Department of the Interior Bureau of Reclamation. It is anticipated that the first unit of the Yampa Project will be ready for test in November, 1977, and. that Applicant will begin to • receive deliveries of electric power and energy at Ault, Colorado, at that time. 7. Applicant proposes to construct a 230 Kv transmission line to connect the Ault, Colorado, delivery point with Longmont, Colorado, and with interconnections to Fort Collins, Colorado, and Loveland, Colorado, together with related transformation facilities, associated facilities and structures.. -3- 4 Applicant proposes to design and construct certain segments of the Ault- Longmont Transmission Line so as to permit joint use of those segments of that line by certain of its Municipal customers and other utilities, thereby minimizing environmental impact and achieving the economics of joint use. 8. A small joint use segment of the Ault-Longmont Transmission Line (about 0.8 miles) was heretofore constructed by the City of Fort Collins, Colorado, which needed transmission capability along that segment prior to the date of construction proposed by Applicant. Applicant subsequently pur- chased this joint use segment from Fort Collins on the terms and conditions contained in Exhibit H. 9. Applicant proposes to construct and own all remaining segments of the Ault-Longmont Transmission Line and to make the segments suitable to joint use available to its applicable municipal customers on similar terms and conditions to those relating to joint use by the City of Fort Collins and contained in Exhibit H, and also to make capacity in the line available to other utilities pursuant to transmission and exchange agreements to be negotiated and to be filed with the Commission when executed, 10. It is anticipated that construction of the Ault-Longmont Transmission Line will begin in 1974, and that the line will be completed, and placed in service in 1978, so as to timely meet the in-service dates r of the Yampa Project. 11 . The Ault-Longmont Transmission Line is required to meet the increasing electric power and energy demands of the Municipalities, Appli- cant's customers. 12. Applicant has the ability to carry out the construction, opera- tion, and maintenance of the facilities and equipment described herein. Applicant proposes to finance the facilities and equipment described herein through the issuance of revenue bonds and other debt financing for said purpose, Applicant will apply to the Commission for approval of the issuance of any securities which may be involved herein and which have a maturity date of more than 12 months after the date thereof. 13. Applicant has given extensive consideration to environmental factors in connection with the location and design of the Fort Collins- Longmont segment of the proposed Ault-Longmont Transmission Line, trans- formation facilities and related equipment. Specifically, while not required by law, numerous studies were undertaken and public hearings held which were the basis for an environmental analysis which was prepared for Applicant. On the basis of the foregoing, the proposed Ault-Longmont Transmission Line will meet all present federal and state environmental standards, and 'that the location, design, construction, and operation of said facility will comply with all applicable Federal and State laws and regulations. 14. The need for the aforesaid Ault-Longmont Transmission Line is based on long-range studies made for the purpose of determining the service requirements of the Municipalities served by Applicant, which studies show the load growth and the anticipated demands for increased delivery of power and energy to the Municipalities. The construction, operation, and maintenance of the aforesaid facility as proposed herein is in the public interest and . required by the public convenience and necessity. The construction of these _ facilities will strengthen the transmission grid in the area and will enable Applicant to make a part of the capacity therein available to other utilities pursuant to agreements to be negotiated and to be filed with the Commission when executed. Negotiations are under way between Applicant and Public Service Company with reference to a Longmont-Fort St. Drain tie.. -4- 4 CONCLUSIONS ON FINDINGS OF FACT Based on the above and foregoing findings of fact, it is concluded that: 1 . Public convenience and necessity require that Platte' River be authorized to construct the 230 Kv Ault-Longmont transmission lines for the purpose of supplying the wholesale electric power and energy require- ments of the Municipalities and that the application for a certificate of public convenience and necessity be granted as set out herein. 2. Pursuant to 115-6-9(2) , CRS 1963, as amended, it is recom- mended by the Examiner that the Commission enter the following Order. ORDER THE COMMISSION ORDERS THAT: 1 . The public convenience and necessity require and will require . the construction of a 230 Kv transmission line to connect the Ault, Colorado, delivery point with Longmont, Colorado, and with interconnections to Fort Collins, Colorado, and Loveland, Colorado, together with related r transformation facilities, associated facilities, and structures and the same is hereby authorized, 2. The public convenience and necessity requires approval of the acquisition, operation, and maintenance by Applicant from the City of Fort Collins of the double-circuit transmission line from Station 300 to Drake Road, Fort Collins, including the foundations, towers , and 230 Kv facilities of such line, and the contract for the acquisition of such facilities by Applicant from the City of Fort Collins is hereby approved. , 3. The Commission retain jurisdiction of this proceeding to the end that it may make such further order or orders in the premises as it may deem proper or_ desirable. 4. This Recommended Decision shall be effective on the day it becomes the Decision of the Commission, if such be the case, and is entered as of the date hereinabove set out. 5. Representatives of the Commission have informed our office that public hearings on the permit were held in Longmont and Denver, and that notice of these hearings were published in newspapers of general circulation in the area involved. I am currently writing the Commission for copies of their decision on this matter, and for copies of all e public notices which were issued prior to the hearings. It seems that since federal funds were not involved in the project, our office did not have the opportunity to review the project prior to issuance of the permit. This causes me grave concern and I feel that the matter should be brought to the attention of public officials for your serious consideration. The Platte Valley Power Authority, as you may know, is in the process of constructing a vast power transmission line stretching from Fort Collins to Longmont. It will run North to South between Route 287 and Interstate - 25 along a line East of the Weld County Line. The line will consist of one-hundred foot high towers, six-hundred feet apart, each having T's supporting a large number of cables. You know that in this region, a person can capture the most breath- taking view of the Rockies. On a clear day, one can view Pikes Peak to the South and clear North beyond Longs Peak. The power transmission line will cut its way through the heart of this region giving the appearance of a huge clothes line in a vast back yard. How fitting it will be, especially as our Centennial year approaches that we erect hundreds of these towering monuments as "The Gateway to the Rockies". In years to come, these will stand as living reminders of the greed, short- sightedness, corruption and insensitivities characteristic of the people of Colorado in the past 100 years. Most, if not all, of the people in this area were unaware that the line was in the planning or proposal stage. People to the North only found out about it when survey teams and construction crews began to infiltrate their land. The standard answer to why they were not previously notified is that a Greeley newspaper carried a public notice. I doubt seriously that along the entire route, one person can be found subscribing to a Greeley newspaper. People were simply told that this is "progress" and that the law of Eminent Domain gave them no choice in the matter. t 1 \ rf As children watched their only tree being cut down, farmers were offered a "just" compensation. Those who were labeled "trouble makers" have yet to be paid. Most farmers and landowners who cooperated re- ceived their meager payment but realized only too late, the abrupt drop in the value of their land and the fact that it never again will appreciate at the same rate. These people were taken and more will follow. Many of the people in this area, myself included, went through the added expense of having REA supply underground service to our homes to make certain that we did not harm our view, or the view of our neighbors. REA even took publicity photographs of one model farm with underground service. Today, the same farm, not by the owners choice, is cluttered with high transmission poles. The cities along the Front Range have always used Weld County as their garbage dupe Over the years they have reduced the rivers and streams to mere trickles of poluted filth. Now they threaten to take the irrigation water from the farmers and then, to pour salt in our wounds, they drape power lines all over our land so that we can forever be reminded that we are the cess pool of the Front Range. These ruthless desecrators in the "spirit of progress" rip their way through every hill and valley, not along existing rights of way, but along the shortest possible path - over lakes and through valleys. When their job is done, they leave, but we and all the people of Colorado are left with the spoils. Most of us feel that at least the spirit of the law has been violated. We believe that ruthless self-interest groups using taxpayers money are pushing this line in a reckless fashion totally unconcerned with its devast- ating consequences. Furthermore, we believe that the concern for beauty in this state should not be limited to the cities along the foothills and the mountain interior. We feel a need to preserve the beauty of farmland on the East side of towns as well. The area affected covers thousands of acres involving hundreds of people. Most of us feel that something is wrong - that this sort of thing cannot happen in a democracy. Certainly, the technology exists to go under- ground or that a more equitable power distribution system can be worked out.
