Dear Folks,
I am writing this letter to you out of shear desperation and fear for my families, and my life and welfare. I am
a 63 year native of this area, just retiring from a 30 year career, in municipal water treatment, with the City of
Fort Collins. We have lived out here on WCR17 (two miles from the proposed track) for over 20 years. I have
witnessed unprecedented growth here in that time, mostly really nice and expensive horse type homes and
facilities. Just before I retired it was announced to City employees that Ft. Collins just eclipsed 160,000
population, with the expectation of another 100,000 within the next ten years. Most growth expected to the
north toward Wellington. This growth is within 10 miles of the Nunn Downs. Even though the track is a Weld
County issue, it will effect Larimer County residents more. Really, it is a Colorado.. United States of America
issue! This IS NOT making America great! You all must know these things foster Cartel, drugs, violent
havior. They hire their own security, veterinarians, etc. which are all unscrupulous. Even though the claim
.„)veral hundred attendees it will likely be 10 times that. Prairie fire danger is huge. We have nearly had to
emergency evacuate our place four times because of grass fire. That risk will be off the charts. Most folks out
here simply are not aware or the track. We all live here for the peace and quiet. This simply is not wanted and
will not be tolerated. If allowed to happen, I will be making it known to all news and related agents. I just want
to live out my life here in peace like a good law abiding. God fearing, PROUD AMERICAN, deserves, and
should be able to do. Please... Please don't let this happen. Thank You, Randy King

Dear Commissioners,
It is our opinion that this facility will disrupt the livelihood of people living in the surrounding areas and
wish to request the permitting of the horse track and all horseracing activities at this facility be denied.
Our concerns are the following:
1. The roads in this area are not maintained/designed to support the additional trafficfor events
held at this facility.
2. The increase in traffic is disruptive to the ranchers, farmers, their livestock, and crops with
increased concerns of fires, trash, etc.
3. It is our opinion that there is a good chance the horses will not be properly cared for based on
reports and articles written about similarfacilities.
4. This environment could encourage illegal gambling based on reports and articles written abo ut
similar facilities as well as other illegal activities.
5. We are concerned bringing in horses from other areas could increase the chance of disease
transmission to horses in this area.
6. There is not enough regulation on these facilities to allow more of them to develop without
further controls in place.

submitted by Nunn Downs, LLC.

Their application seeks to have up to 350 individuals gathering for an unsanctioned horse racing
event in an area zoned agricultural and consisting of several family homes. Essentially placing a
horse race track in the middle of a neighborhood.
Investigative reports by KDVR television station shows that gambling and doping of horses are a
common occurence at these events.
I was asked if I would have the same feelings of opposition if the site planned to host a Saddle
Club. When is the last time you ever heard of even 200 people attending a Saddle Club event
just for the joy of watching horses in athletic situations? A horse race has a completely different
intent.
I have concerns about how unsanctioned means unregulated. There is nothing in place to assure
that the event is done humanely. I've heard them say that an unhealthy horse will not run fast. I
have trained horses for a living and can tell you that a frightened and/or drugged horse who has
checked directly into survival mode will run very fast no matter how unhealthy they may be.
The Planning Commission requires that an unassociated veterinarian is on site to ensure the
health and welfare of the horses. Who will be policing this policy? Will they test for drugs? Is
there a vet check for welts or broken skin from the whips before and after the race? As an
unsanctioned sport, there is no one speaking for the voiceless. Again even though the planning
commission cites policy regarding veterinarian presence, who will be ensuring that this policy is
upheld? These horses deserve better.
I have deep concerns about the health of my own horses who are housed about 1 mile from the
proposed race track. A negative EIA test (Coggins) is required to cross state lines in the United
States. It also is recommended that all equestrian shows, rodeos, fairs, and other equine events
consider requiring a negative Coggins for entry, even if the horses haven't crossed state lines.
Coggins tests are also recommended as an important component of a pre -purchase exam. Even
with these regulations in place Equine Infectious Anemia has been on the rise in recent months.
In fact several of the documented EIA cases have been affiliated with these types of unsanctioned
race tracks. Showing a history of the participants in these events do not regularly follow
regulations.
EIA is a high mortality disease spread by vectors. So flies. Ours and all the other horses within
the vicinity of this proposed race track are at very real risk of a deadly disease that is on the rise
in Colorado, in part, because of the comings and goings of the participants at these types of
events.
The other disease that is rapidly spreading in 14 counties within Colorado is vesicular stomatitis.
Another vector borne, rabies like disease, for which nearly 300 horses are currently quarantined
because of how highly contagious it is.
Facebook pages promoting these types of events readily promote performance enhancing and
pam killing `medicines ' I for one do not support the drugging of horses to enhance performance
or to mask pain so the horses can run faster as a tool for entertainment without taking their life
and emotions into consideration Again the planning commission has recommendations in place
that address these concerns as part of their recommendation to approve I again ask, who will be
policing these policies? If it is up to the surrounding residents to police these events, it puts us at
direct nsk even before the events become a reality
In conclusion, as nearby residents, we are at risk of deadly disease coming to our horses, the
participatmg horses are at nsk of abuse and we, as the nearby residents are put at nsk of violent
crimes because it is up to us to be the policing body for these events with the 46 additional
stipulations that the planning commission has added to their recommendation for approval
These stipulations are, in effect, unenforceable unless, we, the citizens become a police force to
be on hand when these events are bemg run I ask Weld County to deny this permit on the
grounds that public safety and livestock health is at risk.

To whom it may concern,
None of our objections to the race track have changed since the application for the temporary permit
meeting. This track will not only have an extremely negative impact on the families within 500 feet, it
will have a negative impact on the families for miles around. This race track is a danger and health
hazard to our community. We all moved out to the country for peace and quiet. What gives them the
right to put this race track in the middle of all our homes and ruin our lives? This track will lower all of
our homes values. How is that not legal theft from all of us? We do not believe they will have adequate
"in house security" and the sheriff is 45 minutes away. These race tracks have a significant history of
illegal gambling, injecting horses with illegal stimulants, alcohol incidents and inhumane behavior. We
are concerned about horses from all over bringing serious equine diseases to the area. We are
concerned about all of the extra traffic, dust and health hazards that come with it. We are also
concerned about the noise as the speakers will be pointed at our house. If Weld County wants to allow
this type of business to exist it should not be allowed to exist where it is currently located. It will cause
irreparable damage to the families in the surrounding area. Please ask yourself, would you be ok with
this track being put next to your home? Why would it be ok for one person/business to destroy so many
lives?

DEER TRAIL, Colo. -- The FOX31 Problem Solvers first exposed unregulated match '
races: Doping, gambling and abuse of horses going unchecked by regulators and
politicians.
Now, it's been uncovered that Arapahoe County sheriff's deputies not only knew
about the horse races, they profited from them.
Public records show the organizers of an unsanctioned series of "Mexican Horse
Race" events held in Deer Trail hired at least 30 deputies on 14 occasions to
provide extra patrols.
Residents who live near the rodeo grounds said they could easily see drug use,
animal abuse and rampant cash betting on races.
They wonder why dozens of deputies didn't or couldn't stop the illegal activities so
apparent to them.
The well -attended, unlicensed series of match races thrived under the political
cover of Deer Trail Mayor Kent Vashus.
Vashus admitted he allowed Parjeras Racing USA to run more than a dozen
unsanctioned horse races without telling state racing regulators.
He said he was not acting as Deer Trail mayor but instead as the registered agent of
the Deer Trail Jockey Club. That nonprofit owns the rodeo grounds.
Vashus, whom records show is a convicted felon with a violent criminal history, also
owns the only full -service liquor store in town, just a few blocks from the rodeo
grounds. ° a`
On top of armed private security who worked inside and out of the rodeo grounds
on race days, Vashus said he made sure uniformed Arapahoe deputies, in county -
marked vehicles, had a presence outside the horse race arena.
Using the Colorado Open Records Act, "extra -duty" pay approvals on file at the
Arapahoe County Sheriff's Office were obtained that confirmed Vashus' claim.
In 2015 and 2016, the pay sheets show 30 deputies earned more than $23,000
working "traffic and town patrol" in Deer Trail.
The extra duty approval dates match the days where unsanctioned horse races
were held on at least 14 occasions.

Arapahoe Sheriff Deputies earn "extra -duty" pay to work "Mexican Horse Races"
When asked if deputies were "looking the other way" during those events to avoid
spotting criminal activity, sheriff's Cmdr. Glenn Thompson said, "Absolutely not."
Thompson said there are complexities of trying to balance two objectives: Keeping
the community outside the rodeo grounds safe during large crowd situations and
being in a position to respond to a serious, felony level crime.
"The deputies that work the area, what they can see outside the venue is clearly a
lot different from what somebody from inside with a camera can see;' Thompson
said.
He said even though deputies'
extra -duty pay comes from horse race
organizers, that does not give them the
authority to enter the private
property.
"To go onto private property, which the
Jockey Club is, we would need either a
search warrant and, in lieu of that one
of those exceptions to the search
Cmdr Glenn Thompson with the Arapahoe County Sheriff's

warrant, exigent circumstances or a major crime being committed," Thompson said.
He said even after seeing the investigative reports on the questionable activities
inside, Arapahoe County would consider providing deputies for traffic and town
patrol at unsanctioned horse races in the future
"All extra -duty requests would be evaluated to see what the request is," Thompson
said. "And what the specific location of that request is and they'd be evaluated like
any other request"
Not in Yuma County
By contrast, Yuma County Sheriff Chad Day said deputies would not be allowed to
provide any sort of security or oversight at an unsanctioned horse race unless they
were on -duty under his command.
In July, a huge match race was advertised by Parjeras Racing, the same group that
organized the Deer Trail events.
Video recordings show thousands of spectators in danger, cheering from the track
as two horses ran down the straightaway at the Yuma County fairgrounds.

Day, who was not notified of the event, told himself that was going to be the last
unpermitted horse race in the county.
"I think it would be fair to say that it got out of hand;' Day said.
Day said he understood most of the
people who wanted to watch match
races were just there for fun, but
often intermingled into the crowd
was a criminal element.
"Trade of illegal narcotics, some
weapons, some human trafficking,
some underage prostitution. I mean
we've heard about all of these
things," Day said.
At the next pop-up horse race held on the fairgrounds, Day showed up with 50
deputies, a dozen K-9 units, federal customs and immigration agents, the FBI and
state -certified veterinarians.
"It wasn't uncommon to see a car come into the main entrance where they were
collecting the gate and see the line of patrol cars, especially the K-9 vehicles, K-9
officers that were here. They would see those cars and literally turn around and
drive back out," Day said.
"There were also some people very obviously uncomfortable with that presence
and they just left."
But Day took another, more permanent step. He got Yuma County commissioners
to pass a new fairgrounds -use policy.
It says, in part, "(T)he County has determined
that given the unique issues that arise and
the specific experience in the county with for
profit horse and other match races the
following requirements shall apply:
• $10,000 minimum law enforcement and
animal welfare deposit
• A veterinarian is required on site
• All expenses for law enforcement will be billed to the facility user

Since these rules have been in place, Day said nobody has successfully met the
obligations of the new fairground contract.

As it stands, Colorado laws don't give state racing enforcement agents the right to
stop the match races from happening.
The investigation found flaws in the way local governments and law enforcement
attempt to regulate the events.
Gov. John Hickenlooper has said he's going to look into the matter.

Dear County Commissioners:
We would like to state our opposition to the USR 19-0022 application for the following reasons:
1. This application is for a Commercial Race Track that is not held to the 197 -pages of
rules of the Colorado Racing Commission - this is an "Unsanctioned Racetrack" meaning
that there will be no oversight and no regulations.
2. Mr. Torres asserts that his facility is an agricultural establishment and cites Section
23-3-40 in his USR application . Mr. Torres's boarding and training facility is covered
under Part B Agriculture for this Section, which none of us has an issue with. However,
Part C of this Section: Recreational facilities and uses including commercial race tracks
and race courses are what we oppose. This is a recreational facility not an agricultural
establishment. In fact, three Facebook pages including Nunn Downs advertised a horse
racing event not a training facility.
3. Mr. Torres states that his race track is the same as a roping event, barrel racing
practice, or ranching - these activities do not need a USR because they are activities
covered under Section 23-3-40 B. Additionally,they also don't charge admission, there
are no "winner's circles", there are no "gambling brokers," and there are no large crowds
Even the Mounted Shooter events sponsored by the Colorado Regulators are held at
fairgrounds or event centers - not in the middle of a community..
4. The temporary assembly permit application filed last Fall estimated that up to 1800
people would be in attendance. On this USR application Mr. Torres states that he
expects up to 350 guests. The numbers of attendees on the documents Mr. Torres has
provided over the last year range from a low of 50 to a high of 1800. It seems that Mr.
Torres is not really sure how many guests will show up at these events so how will he plan
accordingly for the crowd control. parking. water, security personnel, etc. How does he
plan to put an emergency plan in motion without knowing how many attendees will be at his
events. Even if he -shuts the gates at 350" as he indicated in his application. where will the
excess cars turn around? How will he prevent people from climbing over the fence?
5. Mr. Torres's USR application also seems to also demonstrate that he is uncertain about the
number of parking spots he should have available for these events. On page 3 of the USR
questionnaire #10. he states that the -spectator parking area will hold 300 spaces and
..."hold enough spaces for 30 horse trailers." On Page 3 of the USR application. #11, in
response to the question, "how many parking spaces are proposed," he responded 150
parking spaces are proposed for spectators. 24 spaces are proposed for horse trailer
parking'. That is a difference of 156 parking spaces total. How will he prevent people from
parking along CR 102 or on 21 in front of people's homes or blocking the driveway of those
who live on 21?
6 Mr Torres also isn't clear about the number of trips involved before, during, and after the
events On Page 4 of the USR questionnaire, #1 of the engineering questions, Mr Torres
stated that approximately "117 round trip/day are expected for spectator passenger vehicles
and 12 round taps/day are expected for horse and vendor trailers on event day " In the
Traffic Study provided, Page 6 in the conclusion section, it is stated that the "daily traffic at a
peak event would be approximately 295 trips and during the PM peak hour of the racetrack
approximately 50 trips would be generated"
7 At the hearing last Fall for the Temporary Assembly Permit, the Sheriffs office presented to
you reasons they were against this permit The people who brought that permit to you last
fall are the same that are presenting you with this USR permit today - Mr Torres, Mr
Afeworki, and now a new partner, AgPro are presenting you with a permit to give them
permission to hold these events at least twice a month The Sheriff also presented a letter to
the Weld County Board of County Commissioners regarding this USR stating the concern
that the "approval of the project may substantially iincrease calls for service in the area " The
fact is that there is no Shenff or local police presence close by Additionally, per the
Sheriffs Department, they cannot handle vehicle issues on private roads and County
Road 21 is considered a private road that neighbors maintain There is also no police
presence to handle the crowds after the event is over There is no law enforcement
presence to respond to trespassers, litter thrown on our properties, property damage
sustained from these event goers to our trees, shrubs, fences, gates, driveways,
livestock safety, or fights that could occur on our properties from angry losers
8 There is also an increased risk of fires There have been several fires in our area -
especially when the grasses are dry Although we had a great Spring with a lot of rain,
our pastures have turned from tall green grass to tall dry grass Just a couple of weeks
ago we had a fire in our neighborhood from a neighbor simply trying to keep his weeds
down by mowing - he hit a rock that sparked There are no fire hydrants close to this
facility and while the Nunn Fire Department is good at what they do, they are a volunteer
department and it does take time for them to get out here - they are 6 2 miles away from
the proposed track If the wind is blowing - as it frequently does out here - fires move
quickly and become even more difficult to get under control As you can see by this
(hold grass up) we have extremely dry conditions that exist in this area and a single
cigarette butt can lead to disaster - (submit as evidence)
9 Mr Torres states in his USR application that "it is not anticipated that the Nunn Horse
Racetrack would significantly impact the nearby roadway system " County Road 21 is a
Section Line Right of Way - a private driveway and the only driveway for residents who
have no choice but to use this road to access their homes
10 With the crowds also come noise - the noise studies do not take into account all the
factors - the primary being wind direction Even on a quiet night, sound travels --we can
hear the trains on both sides of us The noise for these events will be much louder than
a conversational level As an example, a neighbor close to the race track had a 4th of
July celebration last year - 2018 - and the music, talking, and gunfire were so loud, it
literally disrupted any outside activities of the neighbors - some over a mile away The
Sheriff was called but at that time, the department was tied up with other calls

cars, people, and activity greatly increases the safety of these residents - even one or
two times a month is too much nski This area is not compatible for a Commercial Race

I want to express my continued opposition to the Nunn Downs Race Track - this is not compatible with our
neighborhood for the following reasons:
1). Greatly increased traffic on hilly roads possibly leading to potentially fatal accidents
2). Infringement of event traffic on a section line county road that is the only road for over 30 households
3). Blocked access for emergency vehicles
4). Lack of Weld County Government resources to oversee activities set forth in the Development Plan
5). No guarantees of limiting attendance to 350
6). No guarantees of Health Certificate checks
7). No way to control noise to an appropriate neighborhood level
8). No guarantee of the control of illegal gambling
9). No law enforcement presence for the surrounding property owners after the event
10). No County control or oversight of events
Imperial Race Track, 18233 County Road 96 near Pierce is surrounded by maintained county roads with very few
neighbors and got their "foot in the door" with the races and now are holding concert events. However, at a recent
concert held at this facility in a more remote area than Nunn Downs, there was a lot of trouble reported including trash
thrown on the surrounding properties, constant amount of traffic (1000 people plus in attendance), noise heard up to 4
miles away, accidents, and assaults - some of these involved the police as can be seen by the reports provided below.

I support property rights and value that individuals should be able to do with their property what they want, however, I
also believe that activities on property should not adversely impact or infringe on the activities of other surrounding
property owners Nunn Downs is not an agricultural event center - it is an entertainment venue that is incompatible
within this agricultural community
I will be unable to attend the hearing on Monday but hope that the Commissioner's will take to heart the concerns of
this community

VS V -positive premises have been confirmed to date in 7 states: Colorado, Nebraska, New Mexico,
Oklahoma, Texas, Utah, and Wyoming. No new states have been confirmed positive since the last
situation report.
Since the last situation report (August 29, 2019), there have been 42 new VSV-affected
premises (11 confirmed positive, 31 suspect) identified:
Colorado (3 new confirmed positive, 20 new suspect premises)

• Delta County — 3 new suspect premises
• Dolores County (New Infected County) - 1 confirmed positive premises
• Douglas County — 1 new suspect premises

Classification of Cases
Premises that have laboratory diagnostic confirmation of VSV are categorized as confirmed positive
premises. Once a county is confirmed as VSV-positive, new equine premises presenting with
clinical signs of VSV in that county are not required to be tested for confirmation of the disease, but
the premises will be quarantined and classified as a suspect premises.
Quarantines
Confirmed positive and suspect premises are quarantined for at least 14 days from the onset
of lesions in the last affected animal on the premises.
Summary of the Outbreak (Updated information in blue)
The 2019 VSV outbreak began on June 21, 2019, when the National Veterinary Services
Laboratories (NVSL) in Ames, Iowa confirmed the first VSV-positive premises in Kinney
County, Texas. New Mexico, Colorado, Wyoming, Oklahoma, Nebraska and Utah
subsequently broke with cases which were confirmed by NVSL on June 26, 2019 (Sandoval
County, New Mexico), July 3, 2019 (Weld County, Colorado), July 24, 2019 (Platte County,
Wyoming), July 29, 2019 (Tillman County, Oklahoma), August 9, 2019 (Lincoln County,
Nebraska), and August 19, 2019 (Emery and Uintah Counties, Utah).
Since the start of the outbreak, 947 VSV-affected premises have been identified (396
confirmed positive, 551 suspect). Nine hundred forty-four (944) of these premises have
only equine species clinically affected and 3 premises have affected cattle (Boulder and Delta
County, Colorado and Gonzales County, Texas). Colorado has identified 632 affected
premises (236 confirmed positive, 396 suspect) in 32 counties (Adams, Alamosa, Arapahoe,
Archuleta, Boulder, Broomfield, Chaffee, Conejos, Delta, Dolores, Douglas, El Paso,
Fremont, Garfield, Gilpin, Grand, Gunnison, Jefferson, La Plata, Larimer, Mesa, Mineral,
Montezuma, Montrose, Morgan, Ouray, Park, Pueblo, Rio Blanco, San Miguel, Summit, and
Wage
Weld Counties). Nebraska has identified 8 affected premises in 4 counties (Dawes, Lincoln,
Morrill, and Scotts Bluff Counties). New Mexico has identified 76 affected premises (47
confirmed positive, 29 suspect) in 12 counties (Cibola, Los Alamos, Mora, Rio Arriba,
Sandoval, San Juan, San Miguel, Santa Fe, Sierra, Socorro, Taos, and Valencia Counties).
Oklahoma has identified 1 affected premises in 1 county (Tillman County). Texas has
identified 170 affected premises (75 confirmed positive, 95 suspect) located in 37 counties
(Bastrop, Bell, Bosque, Brown, Caldwell, Coleman, Collin, Coryell, Dallas, Eastland, Ellis,
Erath, Falls, Gonzales, Guadalupe, Haskell, Hays, Hill, Hood, Johnson, Kerr, Kinney,
Lampasas, Mason, McLennan, Mills, Palo Pinto, Parker, San Saba, Shackelford, Somervell,
Taylor, Tom Green, Travis, Val Verde, Wichita, and Williamson Counties). Utah has
identified 14 affected premises (10 confirmed positive, 4 suspect) in 5 counties (Duchesne,
Emery, Grand, San Juan, and Uintah Counties). Wyoming has identified 46 affected
premises (19 confirmed positive, 27 suspect) in 10 counties (Albany, Big Horn, Carbon,
Converse, Goshen, Hot Springs, Laramie, Park, Platte, and Sweetwater Counties). There
have been a total of 770 previously VSV-infected or suspect premises that have completed
the quarantine period and been released.
