RE: APPROVE ELECTRICAL EASEMENT AND AUTHORIZE CHAIR TO SIGN - PUBLIC
SERVICE COMPANY OF COLORADO (XCEL)
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with an Electrical Easement between the
County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld
County, on behalf of the Department of Buildings and Grounds, and Public Service Company of
Colorado (XCEL), commencing upon full execution of signatures, and with further terms and
conditions being as stated in said easement, and
WHEREAS, after review, the Board deems it advisable to approve said easement, a copy
of which is attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the Electrical Easement between the County of Weld, State of Colorado,
by and through the Board of County Commissioners of Weld County, on behalf of the Department
of Buildings and Grounds, and Public Service Company of Colorado (XCEL) be, and hereby is,
approved.
BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized
to sign said easement.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 12th day of August, A.D., 2019.

In order to provide electricity to the new wing of the Jail (2 -West Addition), Public Service Company (XCEL)
needs an easement. Attached is the proposed route and easement details to accommodate this need.
Therefore, Buildings & Grounds is recommending approving this easement.

PUBLIC SERVICE COMPANY OF COLORADO EASEMENT
The undersigned Grantor hereby acknowledges receipt of good and valuable consideration from PUBLIC SERVICE
COMPANY OF COLORADO (Company), 1800 Larimer Street, Suite 1100, Denver, Colorado, 80202, in consideration of which
Grantor(s) hereby grants unto said Company, its successors and assigns, a non-exclusive easement to construct, operate,
maintain, repair, and replace utility lines and all fixtures and devices, used or useful in the operation of said lines, through,
over, under, across, and along a course as said lines may be hereafter constructed in a portion of Tract A, plat of WELD
COUNTY BUSINESS PARK P.U.D., Weld County Records, also being a portion of that Tract of land described in Reception
Number 2531495, Weld County Records, in the NW/4 of Section 31, Township 6N, Range 65W of the 6th Principal Meridian in
the County of Weld, State of Colorado, the easement being described as follows:
A 10 foot easement more particularly described in: "Exhibit A —Weld Co. Jail, Permanent Easement —Parcel
A", attached hereto and made a part hereof.
The easement is 10.00 feet in width. The side boundary lines of the easement shall be lengthened and shortened as
necessary to encompass a continuous strip of not less than the above width at all points on Grantor's property crossed by the
above described easement and extending to the boundaries of adjacent properties.
Together with the right to enter upon said premises, to survey, construct, maintain, operate, repair, replace, control, and use
said utility lines and related fixtures and devices, and to remove objects interfering therewith, including the trimming or felling of
trees and bushes, and together with the right to use so much of the adjoining premises of Grantor during surveying,
construction, maintenance, repair, removal, or replacement of said utility lines and related fixtures and devices as may be
required to permit the operation of standard utility construction or repair machinery. The Grantor reserves the right to use and
occupy the easement for any purpose consistent with the rights and privileges above granted and which will not interfere with
or endanger any of the said Company's facilities therein or use thereof. Such reservations by the Grantor shall in no event
include the right to erect or cause to be erected any buildings or structures upon the easement granted or to locate any mobile
home or trailer units thereon. In case of the permanent abandonment of the easement, all right, privilege, and interest granted
shall terminate.
The work of installing and maintaining said lines and fixtures shall be done with care; the surface along the easement shall be
restored substantially to its original level and condition.

PERMANENT EASEMENT - PARCEL A
A 10 foot wide strip of land lying in the northwest one -quarter (NW1/4) of Section 31, Township 6 North, Range 65
West, of the 6th Principal Meridian, County of Weld, State of Colorado, being a portion of Tract A, plat of WELD
COUNTY BUSINESS PARK P.U.D., Weld County Records, also being a portion of that Tract of land described in
Reception Number 2531495, Weld County Records, lying 5 feet on each side of the following described line:
Beginning on the north line of that 60 foot wide Utility Easement, as shown on said plat, from which the north one -
quarter corner of said Section 31 bears N66°38'22"E, 1528.48:
thence N00°04'52"W, 46.52 feet;
thence N45°41'21"W, 86.50 feet;
thence N89°11'31"W, 69.00 feet, to the Point of Terminus.
The sidelines of said 10 foot wide strip are to be lengthened or shortened to terminate on said north line.
Parcel A contains 2,020 square feet (0.046 acres) more or less.
As shown and described on Exhibit A Sheet 2 of 2 attached hereto and made a part hereof.
For the purpose of this description, bearings are based on said plat of WELD COUNTY BUSINESS PARK P.U.D.
