RESOLUTION
WHEREAS, it has been determined by the Board of County Commis-
sioners, Weld County, Colorado, that a certain tract of land, being the
property of Victor Sailas, Ft. Lupton, Colorado, and more particularly
described as follows:
That portion of the Northeast Quarter of Section 25, Township 1
North, Range 67 West of the 6th Principal Meridian, County of
Weld, State of Colorado, more particularly described as follows:
Considering the North-South Centerline of said Section as bearing
North with all bearings contained herein relative thereto.
Beginning at the Northwest Corner of said Northeast Quarter;
thence South 2° 45' 13" East 2, 322. 25 feet to the TRUE POINT
OF BEGINNING: thence South 2° 21' 57" East 218. 01 feet to
a point on the Centerline of an existing County Road from which
the Center of said Section bears South 46° 56' 08" West 165. 03
feet; thence along said Centerline North 37° 33' 12" East 366. 13
feet; thence South 72° 40' 17" West 243. 20 feet more or less to
the TRUE POINT OF BEGINNING, containing 0. 59 acres, more
or less,
does not come within the purview of the definition of the terms "subdivision"
and "subdivided lands" as set forth in CRS 106-2-33 (a) and (b) 1963, as
amended, and
WHEREAS, the Board of County Commissioners of the County of
Weld, State of Colorado, has studied the request of the petitioner and
studied the recommendations of the Weld County Planning Commission,
and having been fully informed, now desires to exempt this particular
division of land pursuant to its authority under CRS 106-2-33 (d), 1963,
as amended,
NOW, THEREFORE, BE IT RESOLVED, that the hereinabove
described tract of land owned by Victor Sailas, Ft. Lupton, Colorado,
be exempted from the definition of the terms "subdivision" and "sub-
divided lands" as provided for in the new Weld County Subdivision Regu-
lations at Section 2-1, A. , (3) adopted August 30, 1972.
The above and foregoing Resolution was, on motion duly made and
seconded, adopted by the following vote on the 23rdday of April, A.D. , 1975.

Subdivision Exemption
Dear Sirs:
The Planning staff recommends approval of an exemption from the definition
of "subdivision" or "subdivided land" pursuant to subsection 3d of 106-2-33
of CRS 1963, as amended for the following reasons:
1 . Non-productive lands are to be utilized for a higher and better
use and the use is compatible with surrounding uses.
2. Domestic water is available from the Wattenberg Improvement
Association.
3. Results of the perculation test show the lot is adequate for
a septic system.
4. Natural gas is available from Public Service Company of Colorado.
5. Commercial-grade gravels have already been removed from the site.
6. The lot is not in the 100 year flood plain.
7. A certificate of conveyances shows that no other land transfers
have occurred in the past five years.
