The Issuance of the permit does not assure the applicant that no injury will occur to another vested water right or preclude another owner of a vested water right from seeking relief in a Civil court action. 2) The construction of this well shall be in compliance with the Water Well Construction and Pump Installation Rules 2 CCR 402-2, unless approval of a variance has been granted by the State Board of Examiners of Water Well Construction and Pump Installation Contractors In accordance with Rule 17. 3) Approved as an additional well pursuant to CRS 3790-137(4) and the decree in Case No. 90CW065, Division 1 Water Court The operation of this well Is subject to the terms and conditions of said decree. 4) The maximum pumping rate shall not exceed 15 GPM. 5) The maximum average annual amount of ground water to be appropriated by this well shall not exceed one (1) acre-foot, and the combined average annual amount of ground water to be appropriated by this well and well No. 36075-F (also permit No. 35250-F) shall not exceed 27.5 acre-feet. 6) The entire length of the hole shall be geophysically logged as required by the Statewide Nontributary Ground Water Rules prior to Installing casing. 7) This well shall be constructed not more than 200 feet from the location specified on this permit. 8) Production is limited to the Laramie -Fox Hills aquifer which is located 616 feet below land surface and extends to a depth of 890 feet. Plain casing must be installed and sealed to prevent the withdrawal of ground water from other aquifers and the movement of ground water between aquifers. 9) A totalizing flow meter must be installed on the well and maintained in good working order. Permanent records of all diversions must be maintained by the well owner (recorded at least annually) and submitted to the Division Engineer upon request. 10) The owner shall mark the well In a conspicuous place with well permit number(s), name of the aquifer, and court case number(s) as appropriate. The Owner shall take necessary means and precautions to preserve these markings. 11) Pursuant to CRS 37-90-137(9)(b) and the Denver Basin Rules, no more than 98% of the nontrlbutary ground water withdrawn annually shall be consumed and the well owner shall demonstrate to the reasonable satisfaction of the State Engineer that no more than 98% of the water withdrawn will be consumed. This office recommended approval of the Brady Recorded Exemption on July 14, 1993, to Weld County Planning Department on the basis that the water supply for the 5.00 acre Lot A would be from an existing well, Permit No. 36075-F. It appears from your application that you are applying for an individual on -site well to serve Lot A. It is unlikely your application will be approved. All the Laramie -Fox Hills water underlying Lot A has been appropriated by well, Permit No. 36075-F. Additionally, this water has been decreed to Rudolph R. Zehnder, Jr. by the Division 1 Water Court in Case No. 90CW065. Before this office could consider approval of your application, a portion of this decreed water would have to be conveyed to you by recorded deed or other instrument. Also, the holder of Permit No. 36075-F would have to submit a new application to amend the conditions of approval on Permit No. 36075-F. There may be other requirements as well that would have to be determined should such a transaction take place. Also, in (6) on the back of the application, the distance from the North section line is incorrect. In order to place a well in the approximate center of Lot A, the distances would be as follows: 2,340 feet from the North section line and 1,625 feet from the East section line. This will change the 1/4, 1/4 section designation in item (2) on the front to the SW 1L4 of the NE 114, not the NE 1/4 of the NE 1/4. Then, in the diagram in item (5) on the back, the well would be located approximately where we've placed a penciled "X". In item (10), the 5 acres should be referenced as Lot A instead of B. In support of the application, I have enclosed a copy of the Judgment Decree from Weld County District Court indicating that the Bradys are and were the rightful owners of this property in 1990, having entered into a contract for deed in 1986 with Mr. Zehnder. I enclose a copy of the deed from Mr. Zehnder to the Bradys and a copy of the original Decree under 90 CW 065. It is my understanding that a permit will now issue for the benefit of Mr. and Mrs. Brady under that Decree so long as the cumulative water extracted from the aquifer in any year does not exceed 27-1/2 acre-feet from both wells under the Decree. BRADY, LUCILLE BRADY, JAMES BRADY and LeANN BRADY, Counterdefendants and Third Party Defendants. THIS MATTER, coming on for trial to the Court on October 13 and 14, 1992, involving the following described real property in Weld County, Colorado: the NE 1/4 of the NE 1/4 and the E 1/2 of the NW 1/4 of the NE 1/4, and all of that portion of the S 112 of the NE 1/4 and the W 1/2 of the NW 1/4 of the NE 1/4 of Section 4, lying east of the Beebe Canal as now constructed, all in Township 1 North, Range 65 West of the 6th P.M., containing 131 acres more or less, and the Court having heard the statements of counsel, the testimony of all witnesses. having reviewed the exhibits admitted into evidence, and being otherwise advised in the premises, does find as follows: 1. The Court has no problems with the laws in this case. The Court finds that Exhibit No. 1 was a valid and binding Lease Option Agreement which was properly exercised by the Plaintiffs on September 1, 1988. There is language in the Lease Option Contract which states that the tenant shall abide by all contracts thereon; however, this language is the Defendant's language and does not specifically refer to the CRP contract. The CRP Agreement between the Defendant and the United States Department of Agriculture clouds the issue somewhat; however, the Defendant agreed to sell the property and did not exclude the payments on the CRP contract. Penryr �xi'�i F FEB 2 5'94 STATE F. 2. The Court finds that Exhibit No. 2 was a valid and -" binding contract between Plaintiffs Eldon and Vicki Brady and Defendant Zehnder. The contract was agreed and entered into by these three parties on October 1, 1988. These three parties were the same three parties who were involved originally in the Lease Option Agreement. 3. The Court further finds that the Installment Contract for purchase of the property was later joined into by Sidney and Lucille Brady and Jim and LeAnn Brady. The Defendant's own testimony has indicated that he benefitted by allowing these additional purchasers to join into the Agreement. 4. The Option was properly exercised by the Plaintiffs on September 1, 1988, by payment of $5,000.00, which payment was receipted for by Mr. O'Kane, the Defendant's attorney for the transaction. 5. The Defendant has indicated that the Plaintiffs improperly refused to assume his CRP contract with the United States Department of Agriculture on this property. The Court finds that the Defendant's CRP problem is the Defendant's problem. The Defendant received all of the funds under the CRP contract from the United States Department of Agriculture, and it is up to the Defendant to pay those funds back to the United States Department of Agriculture. The Defendant apparently made a few attempts to bring his CRP contract into compliance prior to the exercise of the option on the property by the Plaintiffs; however, the Defendant's attempts to bring the CRP contract into compliance were not successful and never acceptable to the United States Department of Agriculture. The Court understands why the Plaintiffs did not assume the CRP contract based upon the testimony of the parties. Had the Plaintiffs assumed this contract, and the same had not been in compliance, they then would have been responsible for repayment of all of the funds to the United States Department of Agriculture that had previously been received by the Defendant Zehnder. The Defendant Zehnder received the money and it is his responsibility to resolve this matter with the federal government. 6. The evidence indicated that on December 20, 1988, after the Option had been exercised, Defendant Zehnder recorded a Declaration of Dry Up Covenant on the property which had previously been sold to the Bradys. The Court does not understand the reason or purpose behind this filing, but finds that it was contemptible conduct on behalf of Mr. Zehnder to record this Dry Up Covenant subsequent to the signing of the contract with the Bradys on October 1, 1988. He shall have the same removed from the title to the property. If this can't be done, he shall pay to Plaintiffs any diminution in value of said property by reason of said recording, including reasonable attorney fees for any future hearing necessary to determine any 2 REP 25 t94 diminution in value of said property because of said recor'h1hq'. 7. The Plaintiffs have indicated to the Court that they are prepared to pay off the balance due and owing on the Installment Land Contract and have tendered into evidence as Exhibit No. 24 their amortization schedule showing that as of October 1, 1992, the remaining principal balance due and owing on the contract was $34,153.82 with interest from and after that date at 9% per annum. 8. The evidence further indicated that the Plaintiffs paid 100% of the property taxes in 1988, when in fact they were responsible under the terms of the contract for payment of the 1988 property taxes from October 1, 1988, through the end of the year. While the 1988 tax proration will result in a credit to the Bradys, Defendant is entitled to a credit for the 1989 taxes for which he was paid but did not negotiate the Brady Dairy check. IT IS THEREFORE ORDERED, ADJUDGED AND DECREED that the Contract for sale of the property shall be closed and fully complied with by the Defendant. Upon payment by Plaintiffs to the Defendant in accordance with the amounts set forth on Exhibit No. 24, the amortization schedule, and such adjustments as are necessary to properly amortize the 1988 taxes between the parties, the Defendant shall tender to the Plaintiffs his General Warranty Deed conveying the property to the Plaintiffs free and clear of all deeds of trust and any other monetary liens and encumbrances and any other encumbrances not on the title to the property on October 1, 1988. The attorneys for the parties hereto are directed to assist their clients to secure compliance with this Order. In the event that either of the parties shall fail or refuse to be in compliance with this Order, the parties, through counsel, may request the assistance of this Court to secure compliance. Both parties have requested an award of attorney's fees in this matter. Since the Court's finding in favor of the Plaintiffs, an award of attorney's fees would clearly be inappropriate for the Defendant, and although the Court had difficulty understanding the basis for several of Defendant's defenses and claims, the Court feels that the attorney for Defendant was attempting to present the Defendant's position to the Court as directed by the Defendant. Based upon this finding, the Court cannot find that either the defenses or the claims of the Defendant are totally frivolous. Since there is no provision RECERM FEB 25 14 in any of the contracts or the agreements for an award of attorneys' fees, and since the Court cannot find that the defense by the Defendant was totally frivolous, attorneys' fees will not be awarded to either side.
