A public hearing was conducted on January 30, 2019, at 10:00 a.m., with the following present:

The following business was transacted:
e I hereby certify that pursuant to a notice dated December 13, 2018, and duly published
December 18, 2018, in the Greeley Tribune, a public hearing was conducted to consider the
request of Taproot Rockies Midstream, LLC, for a Site Specific Development Plan and Use by
Special Review Permit, USR18-0096, for Mineral Resource Development Facilities including Oil
and Gas Support and Service Facilities (storage area for fresh water pipelines and related pipeline
equipment, parking for employee vehicles and a 7,380 -square -foot field operations building) in
the A (Agricultural) Zone District. Frank Haug, Assistant County Attorney, made this a matter of
record.
le Chair Kirkmeyer reviewed for the applicant and the public, the procedures to follow should
this case result in a tie vote due to four (4) Commissioners being present and
Commissioner Conway excused.
Kim Ogle, Department of Planning Services, presented a brief summary of the proposal and
stated the property is approximately 11 acres and created through a Recorded Exemption. He
noted the site is adjacent to County Road (CR) 95, a quarter -mile north of CR 94, and is not within
the three (3) mile referral area of any municipality or county. Mr. Ogle described the land uses,
and proximity of the surrounding properties, and stated Taproot Rockies Midstream is going to
reutilize an existing structure for a commercial office, garage, and indoor storage of pipeline
material. He noted company pickup trucks will be parked on the site, provided the company's

business hours and number of employees, and stated gravel parking will be utilized for ten (10)
vehicles. Mr. Ogle explained the applicant will need to submit a Change of Use Permit application
for converting the existing structure to a commercial building. He indicated the Department of
Planning Services did not receive any correspondence regarding the application and reported
ten (10) referral agencies reviewed the case, and four (4) provided comments. He entered the
favorable recommendation of the Planning Commission into the record as written and provided
images of the site and surrounding views.
• Evan Pinkham, Public Works Engineer representative, provided a brief overview of the
transportation plans and requirements, and reiterated the property accesses CR 95. He indicated
there are no traffic counts in this area, and the application indicated there will be approximately
eight (8) to 12 passenger vehicle round trips per day. He stated Public Works is not requiring
tracking control, but is requiring a Road Maintenance Agreement. He stated the site meets an
exception for drainage, presented the grading requirements, and suggested COA #1.B, as well
as Development Standard (DS) #21 should be deleted, as they address drainage and are not
applicable to this site.
• Ben Frissell, Department of Public Health and Environment, reviewed the water and sewer
provisions. He stated there will be up to six (6) full-time employees and explained the applicant
has submitted documentation showing the repermit of the domestic well and a permit for the septic
system to comply with the commercial use of the site. Mr. Frissell requested COA #1.C, #1.D,
and #1.E be deleted as those conditions have been met. He stated there will be no washing of
vehicles, no floor drains, and no chemicals or fuel stored onsite. He stated DS #8 and #9 address
dust and waste, and DS #6-#13 address Environmental Health (EH) items.
• Tim Naylor, AGPROfessionals, represented the applicant and provided an overview of his
PowerPoint. He stated the USR is an oil and gas support business, for storage of freshwater
pipeline equipment and related items, and explained the purchasing process. Mr. Naylor stated
the property is in a remote location, and will be Lot A of a Recorded Exemption. He provided
images, including the site plan and outdoor storage, and requested the Board exempt the site
from screening the outdoor storage due to its remoteness. He explained parking is designated in
front of the building, and reiterated the applicant is obtaining a Change of Use on the building.
Mr. Naylor restated the existing well has been repermitted and the septic system has been
permitted for commercial use. He reviewed the number of employees at the office per day and
requested the hours be changed to 24 hours a day, in case of emergencies. Mr. Naylor stated
he believed the applicant has met all obligations of the Code, indicated traffic will be minimal with
some deliveries, and provided the delivery traffic route.
Ei No public testimony was offered concerning this matter.
Eli In response to Chair Kirkmeyer, Mr. Naylor agreed with staff recommendation to delete
COA #1.B, #1.C, #1.D, #1.E and requested COA #1.F.5 also be deleted. Chair Kirkmeyer further
suggested deleting COA #1.A, and Mr. Pinkham recommended deleting DS #19 both concerning
a Road Maintenance Agreement. The Board agreed to delete COA #1.B, #1.C, #1.D, #1.E, and
Chair Kirkmeyer suggested deleting the word "screened' from COA #1.F.5. The Board agreed to
delete DS #3, #10, #19 and #21. After discussion between the Board, Mr. Haug, and staff,

Chair Kirkmeyer suggested adding new DS #6 to read, "The outdoor storage area for pipe,
pipeline construction materials and other equipment, including company vehicles does not require
screening."
El In response to Chair Kirkmeyer, Mr. Naylor indicated he reviewed, and agreed to abide by,
the Conditions of Approval and Development Standards, as amended.
ID Commissioner Moreno moved to approve the request of Taproot Rockies Midstream, LLC,
for a Site Specific Development Plan and Use by Special Review Permit, USR18-0096, for Mineral
Resource Development Facilities including Oil and Gas Support and Service Facilities (storage
area for fresh water pipelines and related pipeline equipment, parking for employee vehicles and
a 7,380 -square -foot field operations building) in the A (Agricultural) Zone District, based on the
recommendations of Planning staff and the Planning Commission, with the Conditions of Approval
and Development Standards as entered into the record. The motion was seconded by
Commissioner James, and it carried unanimously. There being no further discussion, the hearing
was completed at 11:14 a.m.
This Certification was approved on the 4th day of February, 2019.
