Minutes from the March 23, 1978, meeting were approved as submitted.
As a quorum was present , the meeting proceeded as scheduled.
APPLICANT: Gabino Lara

SUBJECT: 6 foot sideyard and 8 foot rearyard setback variance
LOCATION: 5171 - 27th Street, Greeley, Colorado, Lot 13 , B4, Highland Parl
APPEARANCE: Gabino Lara
DISCUSSION: Mr . Lara explained that he had an existing concrete slab
on the northeast corner of his property which he desired to utilize
as a floor for a proposed storage building. Mr. Lacy questioned Mr.
Lara as to its initial use and amount of time it had been on the
property. Mr. Lara replied that its initial use was as a dog run,
and that it was on the property when he bought it . Ms. Archibeque
asked as to the type of construction to be used on the storage
building. Mr. Lara explained that it would be of wood construction .
Mr. Hogan asked Mr. Lara if there was a previous structure on the
slab other than the fence which surrounded it . Mr. Lara stated that
there was not , that the fence was put up for a double dog run by the
people who owned the property prior to him. Mr. Lacy asked as to
the thickness of the existing slab. Mr . Lara replied that it was
approximately 4 inches. Mr. Yamaguchi asked if the slab would meet
the building code. Chuck Cunliffe stated that if the variance was
granted, that the building would have to meet all county building
codes and restrictions . Mr. Hogan asked Mr. Lara about his proposed
use of the building. Mr. Lara stated that it would be used for
storage of lawn equipment , and not for the storage of automobile
parts. Josephine Jones spoke against the request , and asked the
Board if they have received any letters, either opposed or in favor ,
of the request . Mr . Lacy stated that they had received several
letters in opposition to the request . Ms. Straus spoke as to the
covenants existing in Highland Park, and explained that covenants
in the subdivision did speak of setback restrictions. Russ Anson
replied to this statement explaining that if the variance was
granted by the Board that Mr. Lara would still need to get a variance
from the covenants governing Highland Park.
MOTION: Ms . Archibeque moved that V-710 be granted as requested. Mr .
Yamaguchi seconded. Ms. Archibeque, Mr. Yamaguchi and Mr. Miller
voted yes . Mr. Lacy, Mr. Hogan and Mr. Warren voted no. Because
of the split vote , 3-3, discussion continued on the request .

DISCUSSION: Carroll Miller stated that he voted in favor of the request
because he could see no fire hazard or detriments which could arise
from the granting of this variance . Mr. Lacy stated that he could
see no hardship due to the fact that Mr . Lara could build the storage
building within the setback requirements . Mr . Hogan also stated that
he felt that there would be no hardship in moving the concrete slab to
an area where it would meet the county setback requirements. Mr.
Yamaguchi stated that he felt that Mr. Lara would not be allowed to
build on the slab because it would not meet code, so he voted in
favor of the request simply because he would eventually be unable to
build the building anyway. Ms. Archibeque stated that she could see
no problem with building the shed in this location for much the same
reasons as Mr. Miller stated prior. Mr. Warren had the same feeling
about the variance as Mr. Lacy and Mr. Hogan, that there was no hardship
shown , and that Mr. Lara could move the slab and meet the requirements.
MOTION: Ms . Archibeque made a motion to grant the variance as requested.
Mr. Yamaguchi seconded. Ms. Archibeque and Mr. Miller voted yes.
Mr. Lacy, Mr.tHogan , Mr. Warren , and Mr . Yamaguchi voted no, resulting
in a 4-2 vote, defeating the motion.
APPLICANT: J. R. & Jay Hasbrouck
CASE NUMBER: V-712 : 78 : 9
SUBJECT: 30 foot frontyard setback variance
LOCATION: Pt . NA Section 34, T8N, R66W
South of Pierce on Weld County Road 88
APPEARANCE : Jay Hasbrouck
DISCUSSION: Mr . Hasbrouck stated that they need the addition to the
west of the property because of property restrictions due to location
of sheep corrals located to the east and south. Mr. Lacy did the
field check and explained that the labor house on the property sets
on the property line, and actually sits 20 feet closer to the road
than the proposed addition would. Mr . Hogan asked Mr. Hasbrouck if
the addition had been started. Mr. Hasbrouck stated that it had not .
MOTION: Mr . Hogan made a motion to grant V-712 as requested. Mr.
Miller seconded. Motion carried by unanimous vote.
APPLICANT: John Mauck ,
CASE NUMBER: V-711 : 78 :8
SUBJECT: variance of 7 feet from the 180 foot minimum frontyard width
requirement onto a public road
LOCATION: Lot 5, Block 4, CasaGrande Estates
WINW* Section 17 , T2N, R67W of the 6th P.M.
i mile north of Firestone on County Road 15
APPEARANCE: Being no appearance by Mr. Mauck or a representative, the
Board decided the discuss the request at this time , and to make a
motion for denial or acceptance.
DISCUSSION: Mr. Yamaguchi field checked the property and stated that
he could see no problem since the request would simply move the
boundary line between the two properties . Mr. Yamaguchi talked to
the neighbor across the street , and no problems could be anticipated
by the moving of the property line. This shift of property lines

would add 7 feet to Lot 6, making the frontage 187 feet , and
reduce Lot 5 to 173 feet . Mr. Cunliffe explained to the Board
that if the variance is granted, Mr. Mauck will proceed with a
replat application of the lots and surrounding property owners
will be notified.
MOTION: Mr. Hogan made a motion to approve V-711 : 78 : 8 as requested.
Mr. Yamaguchi seconded. Motion carried by unanimous vote.
