The Weld County Department of Public Works has reviewed this PUD proposal. Staff comments made
during this phase of the application process may not be all-inclusive, as other issues may arise during the
remaining application process.
COMMENTS
GENERAL PROJECT INFORMATION/LOCATION
Project description: A Final Plan for a Minor Subdivision (4 lots zoned for 1-3 Industrial uses along with one
outlot to be utilized for drainage purposes).
This project is south of and adjacent to CR 64 and is west of CR 41.
Parcel number 080332100002.
Access is from CR 64.
ACCESS
Weld County Public Works has reviewed the application materials related to access. The applicant is
proposing the subdivision roadway to intersect with County Road 64 approximately 1175 feet west of
County Road 41. The Weld County Code requirement for spacing of intersections on an arterial roadway is
1320 feet. The location of the roadway intersection does not meet this requirement.
Per Chapter 12, Article 5, Section 12-5-30, an Access Permit is required for access to Weld County
maintained roadways. We strongly encourage you to discuss your access with Public Works prior to laying
out your site plan to ensure the approved accesses are compatible with your layout. Per Chapter 12, Article
V, Section 12-5-30. F, when feasible, there shall be no net increase in the number of accesses to a public
road. Minimum access spacing widths are shown in Weld County Code Appendix Table 12A-2. Please refer
to Chapter 12 of the Weld County Code for more information regarding access.
WELD COUNTY ROADS AND RIGHTS -OF -WAY
Weld County is currently in the process of planning intersection improvements for County Road 64 and
County Road 41 as well as improvements to the Eaton Draw bridge on County Road 64. These
improvements will impact the subdivision intersection and the property adjacent to County Road 64.
County Road 64 (O Street) is a paved road and is designated on the Weld County Functional Classification
Map (Code Ordinance 2017-01) as an arterial road, which requires 140 feet of right-of-way. The applicant
shall delineate and label on the site map or plat the future and existing right-of-way (along with the
documents creating the existing right-of-way) and the physical location of the road. If the right-of-way cannot
be verified it shall be dedicated. Pursuant to the definition of setback in the Weld County Code, Chapter 23,
Article III, Section 23-3-50, the required setback is measured from the future right-of-way line. Be aware
that physical roadways may not be centered in the right-of-way. This road is maintained by Weld County.
Per Chapter 12, Article 4, Section 12-4-30.B, a Weld County Right -of -Way Use Permit is required for any
project that will be occupying, constructing or excavating facilities within, and/or encroaching upon, any
County rights -of -way or easement. Right -of -Way Use Permit instructions and application can be found at

Weld County will not replace overlapping easements located within existing right-of-way or pay to relocate
existing utilities within the County right-of-way.
TRAFFIC
Latest ADT on CR 64 counted 792 vpd with 32% trucks. The 85'" percentile speed is 50 mph.
A Traffic Impact Study (TIS) was submitted with the application. The TIS states that there will be
approximately 198 trips daily, with 28 AM peak hour round trips and 25 PM peak hour round trips. Prior to
the closure of the CR 64 railroad closure (east of Highway 85), 70% of the traffic will be going to and from
the west and 30% of the traffic will be going to and from the east. After the railroad closure, 5% of the traffic
will be going to and from the west and 95% of the traffic will be going to and from the east.
Prior to the railroad crossing closure, the proposed peak hour traffic does hit or exceed any of the auxiliary
lane triggers. After the railroad crossing, the quantity of west bound left hand turns at the intersection would
trigger an auxiliary lane however, the closure will decrease through traffic on County Road 64 so the
conflicting travel will be below 100 vph. The SHAC section 3.5 (5) states that left hand deceleration auxiliary
lane can be waived if the opposing traffic is less than 100 vehicles per hour. Public Works is requesting that
the Improvements Agreement be reviewed as needed, up to once annually to determine if this trigger is
met and traffic on County Road 64 increases to where the left-hand deceleration auxiliary lane may be
required.
ROADS
Application material indicates that the roadway for the subdivision will be recycled asphalt pavement. Public
works is requiring that the subdivision roadway be hot mixed asphalt. A soil -specific pavement design is
required for the Improvements Agreement and Construction Drawings. Include a cross section that is in
compliance with Appendix 24-E of the Weld County Code.
The internal roadway is called out as an easement on the construction drawings. This is to be a Right of
Way dedicated for public use, owned and maintained by the association.
The construction drawings shall show the radius of the cul-de-sac and the right of way around the cul-de-
sac, in compliance with Sec. 24-7-20.A.14 of the Weld County Code.
Sec. 24-7-20.C states that the geometric design standards for the design of the roads shall be in accordance
with the AASHTO Green Book , standards or design criteria published by other governmental agencies,
professional organizations or generally accepted authoritative sources. Curves C7 and C8 do not meet the
requirements of the AASHTO Green Book. If another design standard was used, please indicate what
standards are used. A roadway profile is required for review.
TRACKING CONTROL POLICY
Tracking control is required to prevent tracking from the site onto public roadways. For access to paved
roads, tracking control devices can be double cattle guards with 100 ft. of asphalt or 300 ft of asphalt.
Temporary Tracking Control shall be used during construction unless permanent tracking control is installed
ahead of construction activities. Recycled concrete is not allowed in County right-of-way. A variance request
for alternatives to the tracking control requirement can be submitted to Public Works for review and
consideration.
The submitted construction drawings show approximately 150 feet of tracking control. Please designate
what this material is. It appears that the tracking control may need to be upgraded or a variance request
submitted.
IMPROVEMENTS AND ROAD MAINTENANCE AGREEMENT
Public Works is requesting an Improvements and Road Maintenance Agreement for damage repairs and
triggered off -site public improvements per Chapter 12, Article 5, Section 12-5-60 as well as on -site
improvements for the subdivision per Chapter 24, Article 9, Section 24-9-20.

DRAINAGE REQUIREMENTS
This area IS within an Urbanizing Drainage Area: Urbanizing Drainage Areas typically require detention of
runoff from the 1 -hour, 100 -year, storm falling on the developed site and release of the detained water at
the historic runoff rate of the 1 -hour, 5 -year storm falling on the undeveloped site for URBANIZING areas.
The applicant has submitted a preliminary drainage report and water quality capture design for the site.
This does not proposed detention of the 100 -year, 1 -hour storm. Detention of the 100 -year, 1 -hour storm is
required for the subdivision in a pond that will be shown on the final plat. A final drainage report and
detention pond design completed by a Colorado Licensed Professional Engineer is required prior to
recording the plat. The drainage report must include a certification of compliance stamped and signed by
the PE. A Certification of Compliance form can be found on the Public Works Development Review website.
General drainage report checklist is available on the engineering website. More complete checklists are
available upon request. Subdivision drainage features shall be shown and labeled on the final plat.
Historic Flows:
The applicants will be required to maintain the historic drainage flows and run-off amounts that exist from
the property.
MS4
This site is located in a Municipal Separate Storm Sewer System (MS4) Area which will trigger specific
water quality requirements or other drainage improvements. In addition to compliance with applicable Weld
County regulations, property owner is required to be compliant with any additional MS4 requirements.
Questions pertaining to the MS4 requirements should be directed to the Public Works Department 970-
304-6496.
GRADING PERMIT
A Weld County Grading Permit will be required if disturbing more than 1 acre. Grading Permit applications
are accepted after the planning process is complete (plat recorded). An Early Release Request Form may
be entertained only after the applicant, Public Works and Planning Department have reviewed the referral
and surrounding property owner comments. The Early Release Request may or may not be granted
depending on referral comments and surrounding property owner concerns. Contact an Engineering
representative from the Public Works for more information.
A Construction Stormwater Permit is also required with the State for disturbing more than 1 acre. Contact:
Colorado Department of Public Health and Environment, Water Quality Control Division, 303-692-3575.
CONDITIONS OF APPROVAL
A. Address the location of the subdivision intersection as summarized in the Public Works Referral.

C. An Improvements and Road Maintenance Agreement for damage repairs and triggered off -site public
improvements per Chapter 12, Article 5, Section 12-5-60 as well as on -site improvements for the
subdivision per Chapter 24, Article 9, Section 24-9-20 is required. (Department of Public Works)
D. A Final Drainage Report and Certification of Compliance stamped and signed by a Professional
Engineer registered in the State of Colorado is required. (Department of Public Works)
E. Submit a Stormwater Management Plan to meet the requirements of the MS4 area. (Department of

F. The plan shall be amended to delineate the following:
1. County Road 64 is a paved road and is designated on the Weld County Functional Classification

delineate on the site plan the existing right-of-way. All setbacks shall be measured from the edge

plan. The applicant must obtain an access permit in the approved location(s) prior to construction.

Stormwater ponds should be labeled as "Stormwater Detention, No -Build or Storage Area" and

DEVELOPMENT STANDARDS (NOTES ON THE SITE PLAN)
1. The property owner or operator shall be responsible for controlling noxious weeds on the site, pursuant

Environmental Health Services has reviewed this application a Final Plan for a Minor
Subdivision (4 lots zoned for 1-3 Industrial uses along with one outlot to be utilized for
drainage purposes).
Water will be provided by North Weld County Water District and sewer will be provided by On -
site Wastewater Treatment Systems.
The Department recommends the following conditions, which should appear as notes on the
final plat:
1. Water service shall be obtained from North Weld County Water District.
2. The parcel is currently not served by a municipal sanitary sewer system. Sewage
disposal may be by septic systems designed in accordance with the regulations of
the Colorado Department of Public Health and Environment, Water Quality Control
Division and the Weld County Code in effect at the time of construction, repair,
replacement, or modification of the system.
3. Activity or use on the surface of the ground over any part of the OWTS must be
restricted to that which shall allow the system to function as designed and which
shall not contribute to compaction of the soil or to structural loading detrimental to
the structural integrity or capability of the component to function as designed.
4. During development of the site, all land disturbances shall be conducted so that
nuisance conditions are not created. If dust emissions create nuisance conditions,
at the request of Weld County Environmental Health Services, a fugitive dust
control plan must be submitted.

Dear Mr. Gathman,
North Weld County Water District's requirement for waterline looping has not been reflected in the
submitted Water Main Design and profile. The District has engaged in many conversations with the
developer who, at the time of the last conversations, agreed to an onsite loop of the waterline. The
waterline would extend south to the end of the cul-de-sac then run in exclusive easement along a
shared lot line to the eastern edge of the lots then continue north to Weld CR 64.
North Weld County Water District will require the waterline to be placed in an exclusive easement which
must be approved and recorded before North Weld will sign the Final Plat. The responsibility of
easement acquisition, to the District's satisfaction, lies solely with the developer.
The Cover Sheets for both the Final Plat and the Construction Plans reference the source of water as a
well. This is incorrect per the District's discussion with the developer and additional information
contained in the referral. Please clarify.
The Final Plat, Water Main Design and Profile sheets are nonconforming to the District's current Design
Criteria and Standards.
The District will require further information on the proposed Non -Potable System detailed in the Minor
Subdivision narrative Section 24-3-60.1.3. The system intent, source, yield of the rights, and system
management will be required to begin the review. Additional information may be required as the
District reviews the submittal.

Dear Mr. Gathman:
We have reviewed the above -referenced proposal to subdivide approximately 20.86 acres into
four industrial lots and two outlots. The industrial lots will range in size from 3.45 acres to 5.32 acres.
Outlot A will be 2.18 acres in size and is proposed to be used for roadway. Outlot B nri ll be 1.62 acres
and will be used for water quality detention purposes. This office previously provided comments
regarding this development in a letter dated August 8, 2017 (case no. MINK17-0001) .
Water Supply Demand
Estimated water requirements for the subdivision were not provided; however, information
available in this office indicates that the proposed water supplier (North Weld County Water District)
uses an annual water supply requirement of 0.7 acre-feet per year per tap for planning purposes. The
anticipated demand for this proposed subdivision is therefore 2.8 acre-feet per year.
Source of Water Supply
The proposed domestic water supply is the North Weld County Water District ("NWCWD"). The
applicant has provided a letter from the NWCWD dated October 24, 2018 indicating that the district is
able to provide water service to the subject property, contingent upon all requirements of the district
being satisfied.
The NWCWD most recently provided updated supply and demand information via the Tri-
Districts on December 18, 2012. The document showed that the NWCWD's firm yield supply of 6,392
acre-feet exceeded its dry year planning demand of 4,702 acre-feet. Since the date of that letter,
this office has commented on proposals for a total of 84 additional units to be served by the NWCWD,
including the four units proposed in this development, bringing total demands to 4760.8 acre-feet.
This amount remains well below NWCWD's last reported firm yield, therefore the NWCWD is considered
to be a reliable water source.

Storm Water Detention
Storm water runoff from the development wilt be directed to a small water quality control pond
located within outlot B, which releases to Eaton Draw. The applicant should be aware that, pursuant
to Colorado Senate Bill 15-212, storm water facilities must meet specific criteria to prevent them from
being administered by the office of the State Engineer as detailed in Section 37-92-602(8), C.R.S. The
detention pond must be operated solely for storm water management and be subject to oversight by
a governmental entity (i.e., required as part of a permitting process). Further, it must release or
infiltrate at least 97 percent of all of the water from a rainfall event that is equal to or less than a
five-year storm within 72 hours of the end the rainfall event. Water detained from rainfall events
greater than five-year storms should be released as quickly as practicable, not to exceed the release
or infiltration of 99 percent of all water within 120 hours of the end of the rainfall event. The detention
pond must operate passively, not expose ground water, and not subject the storm water runoff to any
active treatment process. In addition, the operator must submit notice of the proposed detention
facility to the Substitute Water Supply Plan Notification List. Urban Drainage and Flood Control has

State Engineer's Office Opinion
Based on the above, it is our opinion pursuant to Section 30-28-13600M, C.R.S.. that the
proposed water supply is adequate and can be provided without causing injury to decreed water rights.
