RE : SUBDIVISION EXEMPTION NO. 47 - EXEMPTION OF LAND FROM THE
on DEFINITION OF "SUBDIVISION" AND "SUBDIVIDED LAND" .

WHEREAS, the Board of County Commissioners of Weld County,
CC' Colorado, pursuant to Colorado statute and the Weld County Home

rA Rule Charter, is vested with the authority of administering the
O affairs of Weld County, Colorado, and

WHEREAS, the Board of County Commissioners of Weld County,
Colorado, has reviewed the request of Richard Bourassa, for an
exemption of land from the definition of "subdivision" and
"subdivided land" in Section 30-28-101 (10) , CRS 1973 , as amended,
(Na
cS and Section 2-1 of the Weld County Subdivision Regulations, and
WHEREAS , the Board of County Commissioners finds that
Richard Bourassa is the owner of the following described real
estate, to-wit:
A tract of land located in the Northwest Quarter (NW4) of
Section 32, Township 7 North, Range 65 West of the 6th
P.M. , County of Weld, State of Colorado, and being more
particularly described as follows:
Commencing at the Northwest Corner of said Section 32 and
considering the North Line of said Section 32 to bear South
87°57'00" East and with all bearings herein being relative
thereto.
Thence South 87°57'00" East along the North line of said
Section 32, 919.17 feet; thence along the Easterly Right-
of-Way line of a 30 foot wide access road by the following
4 bearings and distances;
South 11°35'00" East, 141.61 feet;
South 30°01'00" East, 297.71 feet;
South 46°47'00° East, 148.31 feet;
South 52°01'30" East, 101.68 feet to the True Point of
Beginning;

Said Tract of land contains 4.45 acres, more or less, and is
subject to any Rights-of-Way or other Easements as granted
or reserved by instruments of record or as now existing on
said tract of land, and
WHEREAS, the Board of County Commissioners finds that the
expansion of the original lot owned by the applicant, Richard
Bourassa, does not conflict with the intent of the Weld County
Comprehensive Plan, and will not have an adverse impact on the
existing use of the land, and
WHEREAS, the Board of County Commissioners has considered
the recommendations of the Department of Planning Services on
this matter and has reviewed information submitted by the
applicant.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the 4 . 45 acre
tract of land owned by the applicant, Richard Bourassa, as de-
scribed above, be and hereby is declared to be exempt from the
definition of "subdivision" and "subdivided land" as set forth
in Section 30-28-101 (10) , CRS 1973 , as amended, and in Section
2-1 of the Weld County Subdivision Regulations, and further finds
that said 4. 45 acre tract shall be considered a single lot.
The above and foregoing Resolution was , on motion duly
made and seconded, adopted by the following vote on the 1st
day of June, A.D. , 1977 .

The owners of the following described preneroy have requested
an eeraotion from Section 2-1 of the 'eld County Subdivision
regulations adopted September 1972 which defines the term
subdivision :

The Planning Department has reviewed this request and recom-
mends that the request be approved for the following
