NOTICE IS HEREBY given that Sigrid Thompson, Myron
Thompson, Dale K. Thompson and Rachel I. Howell, Petitioners,
by their attorneys, Flanders, McCarty, Wood & Sonnesyn, have
filed in this Court a verified Motion herein for an order author-
izing the foreclosure sale by the Public Trustee in and for
Weld County, Colorado, under power of sale contained in a certain
deed of trust executed by Harold F. Baumgartner to the Public
Trustee for the use of Sigrid Thompson, Myron Thompson, Dale
K. Thompson and Rachel I. Howell, whose address is c/o Myron
Thompson, 1506 Twin Sisters Drive, Longmont, Colorado 80501,
said deed of trust being dated December 27th, 1972 , recorded
December 29th, 1972, in Book 682 , Reception No. 1604412 of
the public records in the office of the Clerk and Recorder
of Weld County, Colorado; the real property described in said
deed of trust is sought to be sold under the power of sale
contained in said deed of trust and is situate in the County
of Weld, State of Colorado, described as follows, to-wit:
The southeast quarter (SEa) of the southwest quarter
(SWa) of section 9; the northwest quarter (NW4) of section 16 ;
the east half (E2) of the northeast quarter (NEa) and
the southwest quarter (SWa) of the northeast quarter (NE4)
of section 17 , all in township 2 north, range 68 west
of the 6th P.M. , EXCEPTING from the NEq of said section 17
right of way conveyed by deed recorded in Book 86 , Page 192;

and also excepting parcel of land conveyed by deed recorded
in Book 221 , Page 355 , Weld County records; Also except
Easement as described in Instrument recorded in Book 894,
Page 384 , Weld County records ; and EXCEPT reservations
as contained in Patents recorded in Book 20 , Page 75,
and Book 153 , Page 463, and in Deed recorded in Book 170 ,
Page 69 , Weld County records;
TOGETHER WITH all water and mineral rights owned
by Sellers [grantor] and appertaining to said premises
including 100 acre foot units of water as allotted to
said premises by the Northern Colorado Water Conservancy
District, five (5) shares of the capital stock of The
Plumb and Dailey Ditch Company and one and one-half (11)
shares of the capital stock of The Smith and Emmons Ditch
Company.
Notice is further given that the Motion states that
there has been default in the payment of notes and indebtedness
secured by said deed of trust, particularly the failure to
pay principal and interest installments due on December 27th,
1975, in the aggregate sum of $39 ,673 . 30 , accrued interest
since that date, costs , attorneys fees , ditch assessments ,
and the 1974 general property taxes. The Motion states that
Harold F. Baumgartner, grantor, and James H. Tull, current
record owner, are personally liable on notes secured by said
deed of trust.
Notice is further given that, pursuant to the order
of Court, this Motion be heard in this Court, Weld County Courthouse,
9th Avenue and 9th Street, Greeley, Colorado, on the c-V(, -'
day of April, 1976 , at the hour of 47: - S o' clock 1P.M.

SUPPLEMENTAL PUBLIC TRUSTEE 'S NOTICE.
This is to advise you that Foreclosure Proceedings
No. /46 were commenced in the office of the Public Trustee
of Weld County, Colorado, on the 4th day of March, 1976 . The
foreclosure concerns four promissory notes secured by one deed
of trust executed on the 27th day of December, 1972 , by Harold
F. Baumgartner, the grantor, and James H. Tull, now being the
record owner thereof, both of whom are personally liable on said
notes. The deed of trust was recorded in the records of the
office of the Clerk and Recorder of Weld County, Colorado, on
the 29th day of December, 1972, in Book 682 , Reception No. 1604412.
The real property described in said deed of trust which will
be sold at Public Trustee' s foreclosure, is situated in the County
of Weld, State of Colorado, described as follows, to-wit:
The southeast quarter (SE4) of the southwest quarter
(SW4) of section 9 ; the northwest quarter (NW4) of section 16;
the east half (E_) of the northeast quarter (NE4) and the
southwest quarter (SW4) of the northeast quarter (NE4) of
