MINUTES OF THE WELD COUNTY UTILITIES ADVISORY COMMITTEE
A regular meeting of the Weld County Utilities Coordinating Advisory Committee was held on Thursday,
January 24, 2019 at 1O20 a.m., in the Hearing Room of the Weld County Planning Department at 1555 N 17th
Ave. Greeley, Colorado.
Members Present: Hayley Balzano, LeAnn Koons, Michael Wailes,

A FINAL PLAN APPLICATION FOR A PUD (PLANNED UNIT DEVELOPMENT)
FOR NINE (9) RESIDENTIAL LOTS FOR E (ESTATE) USES, ONE (1)
AGRICULTURAL OUTLOT AND AN OPEN SPACE EASEMENT.
LOT A OF RECORDED EXEMPTION, 2AMRECX17 04-3669, LOCATED IN PART
OF THE E1/2 SE1/4, ALONG WITH THE NE1/4 SW1/4, AND THE W1/2 SE1/4 TO
THE NORTH LINE OF THE LITTLE THOMPSON RIVER, ALL IN SECTION 19,
TOWNSHIP 4 NORTH, RANGE 68 WEST OF THE 6TH P.M., WELD COUNTY,
COLORADO
WEST OF AND ADJACENT TO CR 3 AND 0.5 MILES SOUTH OF STATE
HIGHWAY 56.
Chris Gathman, Planning Services, stated that the applicants are applying for a 9 -lot PUD along with an
Agricultural Outlot (Tract A) that will be non -buildable for residential purposes.
The applicant is requesting an open space easement along the internal roads in the PUD and around an
e xisting pond on Tract A. The Department of Planning Services will be recommending that the open space
e asement be designated as common open space (to be deeded to the homeowners' association) and that the
o pen space easement be removed adjacent to the internal roads in the subdivision with the exception that a
minimum 20 -foot corridor (included as part of the common open space) extend from Prairie Wolf Court to the
designated open space area surrounding the pond.
Utility Easement requirements are outlined in 24-7-60 of the Weld County Code:
A. Easements shall follow rear and side lot lines whenever practical and shall have a minimum total
width of twenty (20) feet apportioned equally on abutting properties.
B. Where front line easements are required, a minimum of fifteen (15) feet shall be allocated as a utility
easement.
C. Easements shall be designed to provide efficient installation of utilities.
Easements shown on the draft PUDF plat include:
A 10 -foot utility easement is delineated adjacent to Prairie Wolf Court and Spanish Fox Court (along the
front of the lots within the PUD).
Twenty -foot utility easements (10 -feet on either side of the lot line) are delineated along the lot boundaries
between Lots 1 & 2, Lots 2 & 3, Lots 2 & 4. Lots 3 & 4, Lots 4 & 5, Lots 5 & 6, Lots 6 & 9 and Lots 7 & 8.
Between Lots 1 & 7, there is a 10 -foot utility easement delineated on Lot 1 and a 30 -foot utility easement
is delineated on Lot 7.
A 10 -foot Utility easement is indicated along the rear property lines for Lots 1-9.
A 30 -foot Utility easement is indicated along the rear property line for Lot 1.
No Utility easements are indicated within the boundaries of Tract A.

Staff recommends the following changes
1) Utility easements adjacent to Prairie Wolf Court and Spanish Fox Court shall be increased to 15 -feet
2) Utility easements along the north property line of Lots 7 and 8 shall be increased to 20 -feet
3) Utility easements along the south property lines of Lot 2, 4, 5, 6 and 7 shall be increased to 20 -feet
4) The utility easement along the eastern boundary of Lot 5 shall be increased to 20 -feet
5) A 10 -foot utility easement shall be delineated within Tract A along the boundary between Tract A and
Lots 1,2,4and 5
6) A 20 -foot utility easement shall be delineated within Tract A along the eastern property line to the
south of Lot 5
7) A 20 -foot utility easement shall be delineated along the southern and western boundaries of Tract A
8) A 20 -foot utility easement shall be delineated along the east boundary of Lot 8 (adjacent to County
Road 3)
Michael Wailes asked if the irrigation easement is open carried or piped Hayley Balzano said that after some
discussion with staff it was determined to be piped
Kent Bruxvoort, 5014 Rose Court, Ft Collins, Colorado, stated that he is the civil engineer representing the
applicants He said that 10 foot access easement on the east side of Lot A was intended to be partnered with
a bus pull out, however they think they will remove that He added that they are fine with the 20 -foot easement
on the east side of Lot 8, which would add an additional 5 feet of additional easement
Mr Bruxvoort noted that in Item 3 of the Staff Recommendation it should read Lot 9 instead of Lot 7 Mr
Gathman agreed
Mr Bruxvoort stated that currently the bulk of the property is zoned agricultural He said that there as a
Recorded Exemption which established a lot in the front and added that Recorded Exemption was amended
and a Subdivision Exemption expanded an existing lot fronting County Road 3 The surveyor, who prepared
this plat, is proposing to dedicate a 10 -foot of utility easement by separate document He added that property
remains within the Bebo family and will recommend to the surveyor that it be a 15 -foot easement, if it is going
to be by separate document, that it be the same width as the other easement
Mr Bruxvoort added that they have no concerns with the Staff recommendations
Ms Balzano referred to the tract that includes the pond and asked if the access will be an easement or its own
lot Mr Bruxvoort said that they envisioned a 50 foot panhandle that is part of the tract Ms Balzano asked if
the 50 -foot open space easement will be its own lot, will it need to designate the additional side lines of 10 -feet
on either side LeAnn Koons said that we should seek the same standard on the lot line adjacent to the 50 -
foot access tract She clarified that it would be 10 -feet from Lot 1 and 10 -feet on the Tract and 10 -feet on Lot
2 and 10 -feet on the Rract Mr Bruxvoort said that he would also designate 10 -foot on the west side of Lot 2
so there will be a continued utility easement within Tract A and crosses into Tract B and continues along the
west side of Lot 2 until it reunites with Tract A
Ms Balzano asked the Board if there were any issues with having no easements around the lake lot The
Board agreed no easements should be around the lake lot Ms Koons said that the access lot covers that
Ms Koons asked what the reason is for the 30 -foot easement on the west side of Lot 7 and the north side of
Lot 1 Mr Bruxvoort replied that it is to allow for a Little Thompson Water District water main
Ms Balzano summarized the following changes
1 Include Lot 9 instead of Lot 7 under Item 3 in the Staff Recommendations
2 SUBX17-0014 will be platted with the matching easement with the front lot along the south side of
Spanish Fox Court
3 The new open space outlot from Prairie Court will include the designated 10 -foot side lot lines on
either side of north, south, northeast, and southwest portions, but not around the actual pond
4 Accept staff recommendations
Motion. Approve the Final Plan for PUDF18-0007, along with the summarized changes, Moved by LeAnn
Koons, Seconded by Michael Wailes Motion carried unanimously
