Dear Commissioners :
This letter serves as notice that L.G. Everist, Inc. has filed an amendment application with the Colorado Division of
Reclamation, Mining and Safety (DRMS) to amend the above-referenced permit.
Firestone Gravel Resource is a sand and gravel mine which has been permitted since 1996. The amendment is
simply to add 2.09 acres to the permit area. There are no changes to the mining or reclamation plans. The site
will be reclaimed as developed water storage. The site is located in parts of Section 32, T-3-N, R-67-W, 6th
Principal Meridian, Weld County, Colorado. The site address is 12248 County Road 15, Longmont, CO 80504.
As an Owner of Record of a Structure(s)within 200 feet of the mine, you are receiving this letter and Structure
Agreement(attached) as required by the Colorado Division of Reclamation, Mining and Safety (DRMS). When a
permit application or an amendment application is filed, DRMS rules require either:
a. The operator/applicant requests a Structure Agreement with owners of any permanent man-made
structures within 200 feet of the permit area. In the agreement, the operator agrees to reimburse the
structure owner for any damage done to their structure as a result of the mining operation. OR
b. The operator/applicant can provide the DRMS with a Geotechnical Stability analysis which demonstrates
that any structures within 200 feet of the permit area shall not be damaged by mining or reclamation
activities occurring at the above-referenced site.
L.G. Everist, Inc. already has an approved Geotechnical Stability analysis for this site on file with the DMRS, which
indicates that the structures listed in this agreement will not be damaged by mining activities. Please be assured
that if any damage occurs to your structure(s) as a result of our operations, L.G. Everist, Inc. will reimburse you for
any damage to the structure.
L.G. Everist is sending a Structure Agreement and updated vicinity map, which shows the currently permitted area
and the amendment area. The reason you are receiving this packet is because, while you may have received a
similar document in the past, it was never returned. Your structure(s) is/are listed in the attached agreement.

The Colorado Division of Reclamation, Mining and Safety (DRMS), abiding by the State of Colorado, Mined Land
Reclamation (MLR) Law, requires the permit applicant/operator to agree to reimburse the owner of any permanent
man-made structure(s)within 200 feet of the permitted mining area for damage done to the structure(s) as a result
of the permitted operation.
L.G. Everist, Inc. operates the Firestone Gravel Resource, DRMS Permit M-1996-052, a sand and gravel mine.
Weld County owns the following structure(s), which are located within 200 feet of the permitted area:
- County Roads 15, 17, &26.75
L.G. Everist, Inc. agrees to, and certifies this agreement as follows:
The permittee, L.G. Everist, Inc., does hereby certify that the above-named Owner shall be compensated for
any damage to the above-listed Structure(s), which is located within 200 feet of the permitted area, as a result
of the mining operation known as Firestone Gravel Resource, DRMS Permit M-1996-052.
A signature by Weld County Board of County Commissioners and a notary seal in the spaces provided below
shall satisfy the MLR law requirement. A copy of the signed notarized agreement shall be kept by L.G. Everist and
the Structure Owner.

requires a slope study.
