RE: APPROVE MODIFICATION OF GRANT FOR 2019 COOPERATIVE LAW
ENFORCEMENT OPERATING AND FINANCIAL PLAN AND AUTHORIZE CHAIR TO
SIGN
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with a Modification of Grant for the 2019
Cooperative Law Enforcement Operating and Financial Plan among the County of Weld, State of
Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the
Weld County Sheriff's Office, and the United States Department of Agriculture, Forest Service;
Arapaho National Forest; Roosevelt National Forest; and the Pawnee National Grassland,
commencing upon full execution of signatures, and ending December 31, 2019, with further terms
and conditions being as stated in said modification and plan, and
WHEREAS, after review, the Board deems it advisable to approve said modification and
plan, a copy of which is attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the Modification of Grant for 2019 Cooperative Law Enforcement
Operating and Financial Plan among the County of Weld, State of Colorado, by and through the
Board of County Commissioners of Weld County, on behalf of the Weld County Sheriff's Office,
and the United States Department of Agriculture, Forest Service; Arapaho National Forest;
Roosevelt National Forest; and the Pawnee National Grassland be, and hereby is, approved.
BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized
to sign said modification and plan.

Brief description of the problem/issue:
DATE: May 7, 2019
The Weld County Sheriff's Office requests to enter into a Cooperative Law Enforcement Agreement with the US
Forest Service for law enforcement services. The US Forest Service is proposing a 2019 contract for up to
$5,800.00, paid at a rate of $64.36 per hour. The Sheriff's Office will invoice the US Forest Service for
expenditures monthly.
This is an annual agreement the Sheriff's Office has been practicing for several years. Due to federal government
closures, The US Forest Service was delayed submitting the proposed agreement.
What options exist for the Board? (Include consequences, impacts, costs, etc. of options)
The Board can reject the agreement. If the Board rejects the agreement the Sheriff's Office will not schedule
dedicated time to patrol the National Grass Lands. Regular law enforcement patrols help to deter crime and
encourage a safe environment for the public.
The Board can accept the agreement. The US Forest Service will reimburse the Sheriff's Office for costs at the
2019 contract rate of $64.36. There are no negative consequences.
Recommendation:
We recommend the Board approve the agreement.

This Annual Financial and Operating Plan (Annual Operating Plan), is hereby made and entered
into by and between Weld County Sheriff's Department, hereinafter referred to as "Cooperator,"
and the USDA, Forest Service, Arapaho Roosevelt National Forests and Pawnee National
Grassland, hereinafter referred to as the "U.S. Forest Service," under the provisions of
Cooperative Law Enforcement Agreement #17-LE1 1021006-019 executed on May 17, 2017.
This Annual Operating Plan is made and agreed to as of the last date signed below and is for the
estimated period beginning on the date of final signature and ending December 31, 2019.

B. Reimbursement for all types of enforcement activities shall be at the following rates
unless specifically stated otherwise:
Wages at the prevailing rate of $64.36/hour (includes mileage).
IL PATROL ACTIVITIES:
A. Time schedules for patrols will be flexible to allow for emergencies, other priorities, and
day-to-day needs of both Cooperator and the U.S. Forest Service. Ample time will be
spent in each area to make residents and visitors aware that law enforcement officers are
in the vicinity.
I. Patrol on following U.S. Forest Service roads:
See attached map "Exhibit B"
Patrols will be in 3 hour increments and 25% of the patrols will occur between
the hours of 1400 and 2000. Compensated patrols will occur during the months
of January -May and August- December.
2. Patrol in the following campgrounds, developed sites, or dispersed areas:

B. Emphasis for Law Enforcement patrols will focus on illegal off -road motor vehicle
use, going around closed gates, natural resource damage, and shooting regulation
compliance: emphasis includes but is not limited to the above activities.
Total reimbursement for this category shall not exceed the amount of: $5,800.00

V. SPECIAL ENFORCEMENT SITUATIONS:
A. Special Enforcement Situations include but are not limited to: Fire Emergencies, Drug
Enforcement, and certain Group Gatherings.
B. Funds available for special enforcement situations vary greatly from year to year and
must be specifically requested and approved prior to any reimbursement being
authorized. Requests for funds should be made to the U.S. Forest Service designated
representative listed in Item I -A of this Annual Operating Plan. The designated
representative will then notify whether funds will be authorized for reimbursement. If
funds are authorized, the parties will then jointly prepare a revised Annual Operating
Plan.
1 Drug Enforcement: This will be handled on a case by case basis. The request will
normally come from the patrol Captain; however, it may come from the Special
Agent in Charge or their designated representative. Reimbursement shall be made
at the rates specified in Section I -B. Deputies assigned to the incident will
coordinate all of their activities with the designated officer in charge of the
incident.
2. Fire Emergency: During emergency fire suppression situations and upon request
by the Forest Service pursuant to an incident resource order, the Cooperator agrees
to provide special services beyond those provided under Section II -A, within the
Cooperator's resource capabilities, for the enforcement of State and local laws

related to the protection of persons and their property. The Cooperator will be
compensated at the rate specified in Section I -B; the Forest Service will specify
times and schedules. Upon concurrence of the local patrol Captain or their
designated representative, an official from the Incident Management Team
managing the incident, Cooperator personnel assigned to an incident where meals
are provided will be entitled to such meals.
3 Group Gatherings: This includes but is not limited to situations which are
normally unanticipated or which typically include very short notices, large group
gatherings such as rock concerts, demonstrations, and organization rendezvous.
Upon authorization by a Forest Service representative listed in Section I -A for
requested services of this nature, reimbursement shall be made at the rates
specified in Section I -B. Deputies assigned to this type of incident will normally
coordinate their activities with the designated officer in charge of the incident.
This includes but is not limited to situations which are normally unanticipated or which
typically include very short notice, large group gatherings such as rock concerts,
demonstrations, and organizational rendezvous.
VI. BILLING FREQUENCY:
See Cooperative Law Enforcement Agreement Provisions II -H and III -B for additional
information.
A. Reimburse the Cooperator for actual expenses incurred, not to exceed the amount shown
in the Annual Operating Plan (AOP). The U.S. Forest Service will make payment for
projects costs upon receipt of an invoice. Each correct invoice shall display the
Cooperator's actual expenditures to date of the invoice, displayed by separate cost
elements as documented in the AOP, less previous U. S. Forest Service payments. Please
put FS agreement number and performance dates on the invoice
B. Billing for services provided under the terms and conditions of this agreement is
approved on a monthly basis. All billings and supporting documentation will be
forwarded to the designated Forest Service Representative named below. The FS -5300-5
Law Enforcement Activity Report shall be completed and submitted annually. A copy
of the FS -5300-5 is included in this Operating Plan.
