RE: ACTION OF THE BOARD CONCERNING PARTIAL VACATION OF MINOR AMENDED
USE BY SPECIAL REVIEW PERMIT, MUSR15-0005, (FORMERLY USR13-0052) -
ANADARKO E&P ONSHORE, LLC
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, on March 11, 2015, Planning Services staff did approve the request of
Anadarko E&P Company, LP, c/o Kerr-McGee Oil & Gas OnShore, LP, for a Minor Amended Use
by Special Review Permit, MUSR15-0005, (formerly USR13-0052), for a 192 -foot tall
Telecommunications Tower to include Mineral Resource Development Facilities, Oil and Gas
Support and Service (Class II Oilfield Waste Disposal Facility — Saltwater Injection Facility) in the
A (Agricultural) Zone District, on the following described real estate, to -wit:
Lot B of Recorded Exemption, RECX17-0184; being
part of Section 3, Township 1 North, Range 68 West
of the 6th P.M., Weld County, Colorado
WHEREAS, the Board has received a request from the current property owner, Anadarko
E&P OnShore, LLC, 1099 18th Street, Denver, Colorado 80202, to partially vacate Minor
Amended Use by Special Review Permit, MUSR15-0005, (formerly USR13-0052), in conjunction
with Recorded Exemption, RECX19-0014, and
WHEREAS, the Board of County Commissioners heard all of the testimony and
statements of those present, studied the request of the applicant and the recommendations of the
Department of Planning Services staff and all of the exhibits and evidence presented in this matter
and, having been fully informed, deems it advisable to dismiss said partial vacation, due to denial
of Recorded Exemption, RECX19-0014.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that Minor Amended Use by Special Review Permit, MUSR15-0005, (formerly
USR13-0052), be, and hereby is, dismissed.

Lot B of Recorded Exemption RECX17-0184; being part of Section 3, T1 N, R68W of
the 6th P.M., Weld County, CO
North of and adjacent to County 12; east of and adjacent to County Road 7
1467-03-3-00-056 Parcel Size: +/- 74.15 acres
A (Agricultural)
Two -lot Recorded Exemption RECX19-0014 in the A (Agricultural) Zone District was
conditionally denied by the Weld County Planning Department on January 30, 2019.
RECX19-0014 will be approved or denied by the BOCC on April 15, 2019. RECX19-0014 will
be dividing Lot B of RECX17-0184 within the five (5) year years allowed, as stated in the
Weld County Code Section 24-8-40.M.1. RECX19-0014 is dividing Lot B of Recorded
Exemption RECX17-0184 into a twenty -seven -point one (27.1) acre lot and a forty-seven
(47) acre lot. There is currently an Oil and Gas Support and Service facility permitted by
MUSR15-0005.
The MUSR15-0005 currently encompasses all of Lot A of RECX17-0184 and Lot B of
RECX17-0184. As detailed in the RECX19-0014 staff report, the applicant shall address
condition of approval #1.A which states the following:
"There is a Use by Special Review Permit MUSR15-0005, Reception #4095187, for An Oil and Gas
Support and Service Facility in the A (Agricultural) Zone District. This USR encompasses portions of
both proposed Lot A and Lot B. The applicant shall address the continued operation of MUSR15-
0005 and which lot(s) it is to be associated with. If the applicant wants to remove any of the lots from
MUSR15-0005 a partial vacation or complete vacation shall be completed prior to recording the
Recorded Exemption plat."
Anadarko E&P OnShore LLC submitted the Partial Vacation request letter for MUSR15-0005. The map
shows the USR13-0014 boundary removed from Lot B of RECX19-0014. Lot A of RECX19-0014 and Lot
A of RECX17-0184 will still be encumbered by MUSR15-0005.
The Department of Planning Services staff has reviewed this request and recommends that this
request be approved.
If approved, the Partial Vacation will satisfy Condition 1.A of RECX19-0014 staff report. The applicant shall
submit a revised MUSR15-0005 partial vacation map to the Department of Planning Services for review
per Section 23-2-260.D and Section 23-2-280 of the Weld County Code. Upon approval, the revised
MUSR15-0005 partial vacation map shall be signed by Anadarko E&P OnShore LLC and recorded prior to
RECX19-0014.
