RE: RECORDED EXEMPTION NO. 284 - EARL BERGLAND.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, it has been determined by the Board of County Com-
missioners of Weld County, Colorado, at a public meeting held
on the 24th day of October, 1977, in the Chambers of the Board of
County Commissioners of Weld County, Colorado, that a certain
parcel of land, being the property of Earl Bergland, located in
Part of the NW' of Section 30, Township 3 North, Range 68 West
of the 6th P.M. , Weld County, Colorado, and more particularly de-
scribed as follows, to-wit:
Commencing at the northeast corner of said Northwest 1
of Section 30; Thence S 00°29'00" W 53.07 Feet along
the East line of said Northwest 1 to the South Right-of-
Way line of State Highway line of State Highway #66 and
the True Point of Beginning; Thence continuing along said
East line of the Northwest 1 S00°29'00" W 672.93 Feet to
the Northeast corner of that tract of land conveyed by
deed dated January 15, 1965 in Book 532 as Reception
#1454010 to Donald F. Besack and Beulah B. Besack; Thence
North 90°00' West along the north line of said Besack
tract a distance of 330.00 Feet; Thence N.00°29'00" E
parallel to said East line of the Northwest < a distance
of 673.70 feet to the South Right-of-Way line of said
State Highway #66; Thence along said Right-of-Way line
S 89°52'00" E 330.00 Feet to the True Point of Beginning,
Containing 5.101 Acres more or less.
does not come within the purview of the definition of the terms ,
"subdivision" and "subdivided land" , pursuant to its authority
under Section 30-28-101 (10) (d) , CRS 1973, as amended, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, finds that this particular division of land is not
within the purposes of the Weld County Subdivision Regulations
and the Board desires to exempt this particular division of land
from the definition of "subdivision" and "subdivided land" pur-
suant to its authority under Section 30-28-101 (10) (d) , CRS 1973,
as amended, and Section 2-1A (3) of the Weld County Subdivision
Regulations.
NOW, THEREFORE, BE IT RESOLVED, by the Board of County Com-
missioners of Weld County, Colorado, that the hereinabove de-
scribed parcel of land owned by Earl Bergland, be exempt from the
definition of the terms, "subdivision" and "subdivided land" pur-

suant to its authority under Section 30-28-101 (10) (d) , subject to
the following provisions recommended by the Weld County Department
of Engineering Services, to-wit:
1. Any new access to Lot B from Elmore Road will have
prior approval;
2. An access to Lot A from Elmore Road will require a
C.M.P. , with a minimum size of 15" in diameter and a
minimum length of 20' .
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 24th day of
October, A.D. , 1977.

RE : Recorded Exemption #284
Dear Commissioners:
The attached application, plat, and related materials are in
reference to a request by Earl Bergland for a recorded exemption.
The parcel of land is described as Pt . of the NPR* of Section 30,
T3N, R68W of the 6th p.m. , Weld County, Colorado. Said property
is located 3/4 mile north of Union Reservoir on the south side
of State Highway 66. The subject property contains 5. 101 acres
of Class IV dryland soils. The request is to split the property
into parcels of 4. 101 acres and 1. 00 acres. As stated in a
letter dated September 30, 1977, Mr. Bergland desires to split
off the one acre parcel which is currently unimproved as a home
site for his son. Mr. Bergland currently resides on the proposed
4. 101 acre parcel. The entire 5. 101 acre parcel in question is
currently zoned Estate.
The Longmont Planning Department submitted a letter indicating
they cannot support the request for a recorded exemption as it
is inconsistent with the St. Vrain Valley Plan. However, since
this property is presently zoned Estate which would permit the
subdivision of the property into parcels of 13 , 000 sq. ft . or
larger, it is the opinion of the Department of Planning Services
staff that the comments from the Longmont Planning Department
are inappropriate for this particular situation due to the
existing Estate zoning .

Based upon the information submitted and the adopted policies in
the county, the Planning Commission staff recommends the request
be approved for the following reasons :
1. The proposed split conforms with the intent clause of the
recorded exemption procedure (Section 9-2 of the Weld County
Subdivision Regulations) , and the Weld County Comprehensive
Plan in that the use would be compatible with the surrounding
residential uses.
2. The request complies with the provisions of Section 9-4(a)
of the Weld County Subdivision Regulations.

Dear Mr. McWilliams:
In response to your referral on the application for a Recorded
Exemption from Mr. Bergland, we wish to submit for your consideration
the following:
1) The area is within the Planning Area of the St.
Vrain Valley Plan. This area is planned for
agricultural land uses, with residences being
accessory to the agricultural use. The continued
splitting off of one acre parcels is not consistent
with the agricultural land use designation.
2) The application is in conflict with the Growth
Guidance Policy of the St. Vrain Valley Plan, which
establishes the Prime Urbanized Area as being the
most appropriate and logical area for urban growth
to occur. The property in question is not within
the P.U.A.
3) In view of the present lot pattern in this area it
appears there will be further requests similar to
this application in the future. If the area is to be
split into one acre tracts it would appear the best
solution would be to subdivide the property, rather
than granting further exemptions.
We cannot support the request for an exemption as it is inconsistent
with the St. Vrain Valley Plan. We do appreciate the opportunity to
comment on the application.
