LOMKIN, 15052 WELD COUNTY ROAD 28, PLATTEVILLE, COLORADO 80651. WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners of Weld County, Colorado held a public hearing on the 12th day of September, 1979 at the hour of 2 :00 o 'clock p.m. in the Chambers of the Board of County Commissioners for the purpose of hearing the application of Richard J. Lomkin, 15052 Weld County Road 28, Platteville, Colorado 80651, for a Special Use Permit for a dairy farm on the following described real estate, to-wit: Part of the Northwest Quarter Northwest Quarter, Section 34 , Township 3 North, Range 66 West, County of Weld, State of Colorado, being more particularly de- scribed as follows : Beginning at the Northwest Corner of said Section 34 and considering the West line of said Northwest Quarter as bearing South 00 °00 ' 00 " East with all other bearings contained herein rela- tive thereto. It is the opinion of the Weld County Planning Commission that this proposed operation is in compliance with the provisions of Section 3 . 3 (E) (2) and 6. 1 (4) of the Weld County Zoning Resolution. The proposed use will be compatible with the surrounding area, in harmony with the character of the neighborhood and existing agricultural uses, will not adversely affect the immediate area, will be compatible with the future development in the area and will provide adequate protection of the health, safety and welfare of the inhabitants of the area and the county. This determination is based upon a review of the information submitted by the applicant and the following: A. The management practices of the dairy operation as outlined and controlled in the Development Standards will make this operation compatible with the surrounding area by minimizing potential adverse impacts. B. The proposal is for an agri-business in the agriculturally zoned area, with existing land uses being predominantly agricultural. C. The following referral agencies have set forth no objections to this request: 1. Town of Platteville Planning Commission, letter dated July 31, 1979 2 . Platteville Fire Protection District, letter dated July 18, 1979 3 . State Engineer, Division of Water Resources, letter dated July 24, 1979 4. Weld County Extension Agent, letter dated July 14, 1979 5. Platte Valley Soil Conservation District, letter dated July 17, 1979 6. Colorado Geological Survey, letter dated July 27, 1979 The Planning Commission recommendation for approval is conditional upon the following: 1 . The attached Development Standards being recommended and approved for the Special Use Permit. 2. No building or electrical permits for the dairy operation shall be issued on the Special Use Permit area until the Development Standards for the Special Use Permit have been placed on the Special Use Permit plat and said plat has been delivered to the office of the Department of Planning Services. 0 Richard Lomkin - SUP DEVELOPMENT STANDARDS 1. The permitted uses on the hereon described parcel of land shall be limited to a dairy operation and shall be limited to the facilities shown which are designed to handle a total of 200 head of dairy cattle and all other uses permitted by right under Section 3 . 3B of the Weld County Zoning Resolution. 2. The SpeciallUse Permit area shall be maintained in such a manner so as to prevent soil erosion, fugitive dust, and the growth of noxious weeds . 3. All phases of the operation shall comply with all County and State Health Standards and Regulations pertaining to air quality, water quality, noise emission, and sanitary disposal systems. 4. Pits for wastewater retention shall be installed as per Rules and Guidelines for Water Pollution Control at Livestock Confinement Areas issued by the Colorado Department of Health, May, 1968. The applicant shall be responsible for any additional applicable directives or guidelines issued by the Colorado Department of Health Water Pollution Control Division. 5. All accesses shall have the approval of the Weld County Engineering Department. All accesses shall be constructed in accordance with the recommendations and/or requirements of the Weld County Engineering Department. 6 . There shall be no discharge of wastes into any streams, other bodies of water, or adjacent drainage systems without obtaining a National Pollution Discharge Elimination System Permit from the Colorado Department of Health. 7. All plans, specifications and data pertaining to the dairy operation shall be submitted to the Weld County Health Department for approval prior to obtaining a Building Permit for the dairy operation. 8. All animal confinement areas shall be evaluated by either a professional engineer or the Soil Conservation Service for compliance with Guidelines for the design of Feedlot Run-off Confinement Facilities, May, 1978, published by the Colorado Department of Health. 9. The Special Use Permit shall be limited to the plans shown hereon and governed by the Development Standards stated above and all applicable Weld County Regulations . Any material deviations from the plans and/or Development Standards as shown or stated above shall require the approval of an amendment to the Special Use Permit by the Planning Commission and the Board of County Commissioners before such changes from the plans and/or Development Standards shall be permitted. Any other changes from the plans and/or Development Standards shall be filed in the office of the Department of Planning Services. 0 0 Comments : To date our office has not received any letters of opposition from surrounding property owners within 500 feet of the property in question. The applicant obtained a mobile home permit under Variance 358 :72 :61 in December of 1972 . ,. Chairman Carlson welcomed two members to the Planning Commission being Don Billings of Platteville who replaced Percy Hiatt and Bob Ehrlich of Milliken who replaced Ben Nix. He then called for a motion to approve the minutes of July 17 , 1979. Jim Gilbert made a motion to approve the minutes as presented. His motion was seconded by Frank Suckla. Highway 34 Business APPEARANCE: Gary Merideth DISCUSSION: Mr. Merideth stated that he desires to change the present use to an athletic club comprised of a raquetball/handball facility of 10 courts and a health club containing an exercise, sauna, steam and whirl- pool area. He stated that the usage will be somewhat less in terms of traffic density because of the use and there will also be fewer employees . There being no questions at this time Tom Honn read the Planning Staff ' s recommendation for approval . Chairman Carlson asked if the front half of the property will remain the way it was originally proposed. Mr. Merideth responded that the front half of the property would be vacant land. There are presently no plans for any use of this property at this time. Bob Freemen of Colorado Interstate Gas Company then read a letter . from the Land Department of Colorado Interstate Gas regarding their concern for public safety, health and welfare because CIG owns a 50 foot wide natural gas pipeline right-of-way running north to south through the Planned Unit Development. Within this right-of-way are two high pressure natural gas pipelines . In order to maintain, repair and operate these pipelines they asked that the Planning Commission not approve construction of buildings , roadways or paved parking areas on top of these pipelines . Discussion followed. APPLICANT: Weld County Disposal , Inc . CASE NUMBER: SUP-396 : 79 :18 SUBJECT: Amend SUP-319 : 76 :24 - Oil Field Fluids Recycling and Disposal Site LEGAL DESCRIPTION: Pt. NW4 NW4j Section 12, T1N, R66W LOCATION: 2 miles east and 2 mile south of Fort Lupton DISCUSSION: Tom Honn stated that the applicant has requested this application be continued to the August 21 , 1979 Planning Commission meeting because the applicant needs to submit additional information to the Colorado Department of Health Water Quality Control Division. The information was requested in an attempt to comply with a Notice of a Violation and Cease and Desist Order issued to the operation on March 20, 1979 by the Colorado Department of Health. The Planning Staff' s recommendation reflected this request for continuation. MOTION: Be it therefore resolved to recommend the application be continued to the August 21, 1979 Planning Commission meeting based on the Planning Staff' s recommendation. Motion by Jim Gilbert, seconded by Bette Kountz. A vote of "aye" was cast by Don Billings , Bob Ehrlich, Fred Otis, Chuck Carlson, Jim Gilbert, Frank Suckla, and Bette Kountz. Motion carried. APPLICANT : St. Vrain, Ltd. CASE NUMBER: SUP-397 : 79 :19 SUBJECT : Open Cut Mining Permit for Sand and Gravel Extraction LEGAL DESCRIPTION: Pt. Section 9, T2N, R68W LOCATION: 5 miles south of Mead APPEARANCE: John Haines DISCUSSION: This request for sand and gravel extraction will be on property containing 292 acres of which approximately 135 acres will be mined. The end result of the operation will be a private recreation area. Land use in the area is primarily agricultural with a very small amount of commercial-industrial activity scattered throughout. By use of maps , Mr. Haines was able to show the various stages of reclamation, etc. He also stated the area is in a floodplain and flood storage area of the creeks . Access to the site will be on County Road 7 which is a paved road. Some nesting fowl could be displaced during the operation; however, the ponds from the operation will provide nesting for waterfowl and more lakes. Truck traffic will be approximately 100 trucks per day. Some discussion followed. Tom Honn then read the Planning Staff ' s recommendation for approval, the Development Standards and the comments . Planning Couimission r - ites , Page 3 August 7 , 1979 Chairman Carlson then asked if anyone wished to speak favorably or unfavorably regarding the request. At this time Morton Latovsky in representing William Englehart of Temperature Processing Company stated that his client is opposed to the operation for several reasons , these being : dust; increase in insect population; his well water level will be decrease because of evaporative loss in the four ponds that will be created during the operation; who is responsible for reclamation; there are too many gravel pit operations in the area already and that access to the site will go within 70 feet of Mr. Englehart' s property. However, one of the conditions is that it will be limited to 125 feet. He also stated he was unable to find any record of a current trade name affidavit for St. Vrain, Ltd. Mr. Englehart then went into further detail the items expressed by Mr. Latovsky. He especially wanted it made clear that he owns the property between Pits 3 and 4 which is where the access road would go through. Rosie Heaton was opposed to it because she feels there will be a real problem with hunters and dogs on her property. Trees will also have to be destroyed in the process . W. G. Richards stated he already has a problem with kids swimming in ponds surrounding his property. He was concerned about who will be responsible if someone drowns . Russ Anson responded that it depends entirely upon the circumstances . Ward Burrett stated he was opposed because the roads will be deteriorated and thee are already too many gravel pits in the area. Dorothy Larson stated her property value will be decreased, there will be pollution, and the roads will deteriorate. Some discussion again followed. MOTION: Be it therefore resolved to recommend approval with the Development Standards to the Board of County Commissioners based on the Planning Staff' s recommendation. Also with the condition that the boundary survey be amended to show the 60' access strip owned by Temperature Processing Company and the access moved so that it does not cross said 60 foot access prior to the Board of County Couuuissioners hearing. Motion by Jim Gilbert, seconded by Bette Kountz. A vote of "aye" was cast by Don Billings , Fred Otis , Chuck Carlson, Jim Gilbert, and Bette Kountz. NW4 NW4f Section 34, T3N, R66W LOCATION: 1 mile south and 21/2 miles east of Platteville APPEARANCE: Richard Lomkin DISCUSSION: Mr. Lomkin stated he wishes to have a dairy operation consisting of approximately 400 cows . His property contains 20. 9 acres of which 4 to 5 acres will be used for the dairy operation. , There being no questions at this time, Tom Honn read the Planning r Staff' s recouiuiendation for approval, the Development Standards and the comments. Some discussion followed regarding the access . Mr . Ehrlich questioned whether the pen size for each cow was designed' according to regulations and adequacy of the facility for waste I $ disposal. A PLICANT : Continental Pipeline Company CASE NUMBER: SUP-410 : 79 : 23 SUBJECT : Amend SUP-187 : 73 :2 - Oil Storage Facility LEGAL DESCRIPTION: Pt. NA; NW4i Section 2, T1N, R67W LOCATION : Southeast of the intersection of County Roads 21 and 14 APPEARANCE : Steven Theede DISCUSSION: Mr. Theede stated they Continental Pipeline Company wants to have a crude oil truck unloading facility and a transfer facility to receive pipeline gathered crude into the facility for subsequent delivery by pipeline to their Fort Lupton station to increase the accuracy of measuring receipting volumes from truck transports . Three conditions on the original Special Use Permit were : 1) There would be no night loading; 2) Visual screening of the area; 3) An asphalt type driveway must be installed for access and egress from the facility. In regard to night loading, Mr. Theede stated that electrical lock-out equipment has been installed on the pump units which cuts power from 8 : 00 p.m. until 6 : 00 a.m. This virtually eliminates night hauling. An aluminum type lattice screening has been installed to screen equipment in the facility. He also stated that an asphalt access has also been installed. A 5, 000 barrel tank is presently at the facility to receive crude oil from the pipeline and to receive crude oil from trucks . They wish to install an additional two 500 barrel tanks to increase efficiency at the facility. Tom Honn then read the Planning Staff' s recommendation for approval, the Development Standards and the comments . Chairman Carlson then asked if anyone wished to express their opinion favorably or unfavorably regarding the request. At this time Mr. and Mrs . Jack Berger expressed their opposition because they feel the facility is not safe if the tanks were to explode as condensate is mixed with the oil and could cause a safety problem. They feel the facility is too close to homes in the area to be safe if there was a fire or explosion. Mr. Gilbert stated that they are in compliance with their permit now and assured them they are concerned • too about the safety of people in the area if there was an explosion. Discussion followed. MOTION: Be it therefore resolved to recommend approval with the Development Standards to the Board of County Commissioners based on the Planning Staff' s recouuuendation. Application fir Special Use Permit Dairy Farm My operation is designed so that my family and I can operate this dairy ilithout the help of outside labor. This is to be a commercial dairy. All milk will be marketed through MEDA. This marketing of milk will necessitate increased traffic on the approaching roads of one truck and tanker trailer every other day. The amount of other traffic will consist of feed and supplies coming in and waste material going out. The supply traffic will consist of one supply truck once a month. A dairy milking 100 cows will use around six hundred tons of alfalfa hay per year which will mean forty trucks a year give or take ten trucks depending on the size of the trucks. The cows will consume around S5O tons of grain per year. This will contribute about 52 grain delivery trucks per year. The waste material will also increase the traffic as there will be somewhere in the neighbor hood of 1000 tons of manure per year , which means 50 trips of the commercial manure haulers. As near as I can figure , the increased traffic will amount to 337 additional trucks on the surrounding roads per year. The possible air and water pollution conditions have been described on the waste inventory. Odor is one thing that under good management should not be a problem. With proper cleaning and maintenance of corrals and daily cleaning and washing of the holding pen and milk parlor plus liquid waste handling in compliance with health department regulations , objectionable odors should seldom build up. Liquid wastes from the milking parlor will be collected in an underground , concrete , 2000 gallon holding tank and will be pumped as irrigation water onto the existing wi dbreak of trees. There will also be some dryland pasture acreage which will be happy to get some of this water. This water will consist mainly of the water which is used for equipment and floor 1washup. Cows are not generally guilty of roi_se pollution as they must be kept contented to produce a large volume of milk. Glare and fire do not represent particular hazards with a small , family dairy. There are no specific health or safety hazards that are associated with the dairy farm industry. Lomkin 15052 Weld County Rd. 28 Platteville, Colorado 80651 The following comments are in answer to your request for soil and site information for animal waste sewage disposal systems to be located in a portion of the NW4NW-, of Section 34, Twp. 3N, Range 66W, west of Speer Canal, Weld County, Colcrado. The area described has the presence of three soil types: Olney fine sandy loam, 1 to 3 percent slope, (21B-B) , Renohill clay loam, 0 to 3 percent slope, (66B-AB) , and Valent sand, 0 to 3 percent slope, (72-AB). Please reference the attached soil descriptions for specific information. All three soils have severe limitations for use and construction of sewage lagoons. The Olney and Valent soils are limited due to rapid permeability in the subsurface that can create seepage of affluent material which may contaminate ground waters. The Renohill soil is limited due to the presence of shale within 20-40 inches of the soil surface. The shale material is usually of the weathered quality which will allow for easy digging. However, it may be very consolidated and hard to excavate, causing extra expense to be encountered. Embankments and dikes to be constructed as part of an animal waste system will also be impaired due to the existing soil characteristics. The Olney soil will have a low strength characteristic and piping may occur through the dike. The Valent soil will have piping and seepage losses when constructed into embankments or dikes. The Renohill soil has low strength and has a thin layer of material 20-40 inches over shale that is very compres- sible and will not allow adequate compaction.
