Dear Mr. Arehart:
Section 29-1-301 (3) of. H.B. 1139 (1976) , concerning the limitation
of local government property tax revenues , provides that the Divi-
sion of Local Affairs will determine whether the provisions of a
county home rule charter are equal to or more restrictive than the
provisions of H.B. 1139 . This section provides that state law will
govern home rule counties if a county ' s charter is less restrictive
than the state requirements.
Weld Cob.nty is hereby requesting a determination from your Division
on the restrictiveness of the Weld County Home Rule Charter. As
you can see from the enclosed relevant portions of our Charter, the
limitation placed on the power of the County Council to approve
increases over 5% is a flexible ceiling, based on the previous -
year's mill levy applied to the current year' s assessed valuation.
The Charter .prccedure.s were based on the then-existing state law,
which has now been modified by H.B. 1139 . Weld County is concerned
with its position as a home rule county under this new statute, and
would appreciate a speedy determination by the Division of Local
Government of the status of its Charter provisions . As you may be
aware, we are in the process of developing our 1977 budget at this
time, -and need to know whether we must have a review by your
Division before October 16.
