RESOLUTION
RE: ADOPTION OF WELD COUNTY BUILDING CODE.
WHEREAS, the Board of County Commissioners, Weld County,
Colorado, held a public hearing in its Chambers at approximately
2 : 00 P.M. on December 29 , 1976 , to consider the adoption of the
Weld County Building Code as required by Section 30-28-201,
et seq, CRS 1973, and
WHEREAS, the text of the proposed Weld County Building Code
was read into the record, and
WHEREAS, the Board heard the testimony and statements of
those present, and
WHEREAS, the Board has considered the testimony and state-

ments of those present, and has considered the recommendations
of the Weld County Planning Commission, and has accepted the
recommendations of the Planning Commission, with the exception
of Recommendation 1 on Sheet 2 of the Planning Commission ' s
Resolution of Recommendation.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commis-
sioners of Weld County, Colorado, that the proposed Weld County
Building Code be, and hereby is , adopted as the official Weld
County Building Code, to be in effect within the unincorporated
areas of Weld County, being more particularly described in
Exhibit "A" attached hereto and made a part hereof by this ref-
erence, with the following additions and amendments as set forth
by the Board of County Commissioners at its hearing on December 29 ,
1976 . Amendments and additions are underlined.
1. Section III , H. l.a of the proposed Building Code
is amended to read:
Fee Schedule -
A fee for each building permit shall be paid to
the Director of Building Inspection as set forth
in Table 3-A located on Page 32 of the Uniform
Building Code, 1976 edition, which table is hereby
incorporated into and made a part hereof by this
reference. The Director of Building Inspection
shall waive the building permit fee for buildings
or structures to be located on a lot meeting min-
imum lot size requirements , which are to be used for
the sole purpose of providing shelter for agricultural
implements, farm products, livestock or poultry.

2 . Section III.H.2.a of the proposed Building Code
is amended to read:
Mechanical Permits -
A separate mechanical permit fee will be charged
for any mechanical inspections not associated with
a building permit. Any person desiring a separate
mechanical permit shall, at the time of filing an
application therefor, pay a fee to the Director of
Building Inspection as required by the schedule
located on pages 8 and 9 of the Uniform Mechanical
Code, 1976 edition, which schedule is , by this
reference, incorporated into and made a part of this
Building Code.
3. Section III.H of the proposed Building Code is amended
by the addition of a new subsection 4, Plumbing
Permits, to read:
4. Plumbing Permits -
a. A separate plumbing permit fee will be charged
for any plumbing inspection not associated with a
building permit. Any person desiring a separate
plumbing permit shall, at the time of filing an
application therefor, pay a fee to the Director of
Building Inspection as required by the schedule
located on page 5a of the Uniform Plumbing Code,
1976 edition, which schedule is, by this reference,
incorporated into and made a part of this Building
Code.
BE IT FURTHER RESOLVED that pursuant to the adoption of the
Uniform Plumbing Code section of the Weld County Building Code,
and pursuant to Section 4-4 (A) (2) of the Weld County Home Rule
Charter, the responsibility for the conduct of plumbing inspec-
tions in Weld County, be, and hereby is, transfered from the
Weld County Department of Health Services , Environmental Health
Division, to the Weld County Department of Planning Services,
Building Inspection Division, as of January 1, 1977.
The above and foregoing Resolution was, on motion duly made
and •seconded, adopted by the following vote on the 30th day of
DeceVler, A.D. , 1976.

I hereby certify that pursuant to a notice published November 26, 1976,
December 3, 10, 17 and 24, 1976 in the Greeley Booster, a public hearing
was held to consider adoption of a Building Code, Land Use Code and to
consider amendments to the Weld County Agricultural Zoning Districts.
The proposed Building Code was read into the record and after discussion,
Commissioner Carlson made the motion to include in the code a provision requiring
permit fees for any mechanical work not associated with a building permit.
Commissioner Steinmark seconded the motion and it carried with Commissioners
Carlson, Jacobucci, Steinmark and Chairman Billings voting aye. Commissioner
Moser was temporarily out of the room.
After further discussion, Commissioner Carlson made the motion to change the word
from "may" to "shall" in Section III, H. 1 a. with reference to the fee schedule.
Commissioner Steinmark seconded the motion and it carried with Commissioners
Carlson, Jacobucci, Steinmark and Chairman Billings voting aye. Commissioner
Moser was temporarily absent. CommissionerSteinmark further moved to change the
wording in Section III, H. 1 a. of the Building Code to read ". . .building permit
fee for buildings or structures to be located on a lot meeting minimun lot size
requirements, which are to be used for the sole purpose of providing shelter for
agricultural implements, farm products, livestock or poultry." Commissioner
Jacobucci seconded the motion. The motion carried with Commissioners Carlson,
Jacobucci, Steinmark and Chairman Billings voting aye. Commissioner Moser
was temporarily absent.
Discussion then centered around the Planning Commission's recommendation to
increase the valuation of building activity requiring permits from $100.00
to $500.00 in Section III, B. 1 a. of the Code. Commissioner Jacobucci made the
motion to leave the valuation amount at $100.00. Commissioner Moser seconded
the motion and it carried unanimously.
Commissioner Steinmark then made the motion to adopt the propose revised Building
Code with the changes as voted on by the Board and to authorize the Chairman
to sign said document. Commissioner Carlson seconded the motion and it
carried unanimously.
As the new Building Code contains provisions for plumbing inspections, Commissioner
Jacobucci made the motion to transfer plumbing inspections to the Building
Inspection Department from the Health Department as is now set forth in the
Charter. The motion was seconded by Commissioner Carlson and approved
unanimously.
The proposed changes in the Agricultural Zoning Districts were read by Assistant
County Attorney Kay Norton. The proposed Land Use Code was reviewed by Planning
Director, Gary Fortner. After discussion, Commissioner Carlson made the motion
to adopt the Land Use Code which includes the following documents: Official

County, Colorado; Proposed Amendments to Weld County Zoning Resolution;

Commissioner Steinmark seconded the motion and it carried unanimously.
Assistant County Attorney, Kay Norton, read into the record a resolution
adopting the Weld County Land Use Code as voted on by the Board. The
Commissioners signed the resolution.

WELD COUNTY BUILDING CODE
I . Purpose , Scope and Authority
A. Purpose . The Weld County Building Code is adopted in
order to preserve and protect the public health , safety and
general welfare and the safety , protection and sanitation
of dwellings , buildings and structures in Weld County .
B . Scope . The Weld County Building Code provides for the
regulation of the future construction or alteration of
dwellings , buildings and structures , together with plumbing ,
mechanical , and electrical installations therein or in con-
nection therewith , located in Weld County , Colorado .
C . Authority. The Weld County Building Code is adopted
and administered under authority granted by Section 30-28-
201 , et seq . , CRS 1973.
D . Severability. If any section , subsection , paragraph ,
sentence , clause , or phrase of this Building Code is for
any reason held or decided to be unconstitutional by a
court of law , such decision shall not affect the validity of
remaining portions . The Board of County Commissionrs , Weld
County , Colorado , hereby declares that it would have passed
this Building Code and each and every article , section ,
subsection , paragraph , sentence , clause , and phrase thereof ,
irrespective of the fact that any one or more section ,
subsection , paragraph , sentence , clause or phrase might
be declared to be unconstitutional or invalid.
E . Effective Date . This Building Code shall take effect
immediately upon passage by the Board of County Commissioners
of Weld County, Colorado , as provided for by Section 30-28-
201 , CRS 1973.
II . Standards
A. Standard Codes . The standards in this Building Code shall
be those listed in the standard codes named below , which are
hereby incorporated into and made a part of this Building
Code , along with the amendments noted . Unless otherwise
provided in this Building Code , no section of any standard
code incorporated by reference into this Building Code
which deals with the administration or enforcement of said
standard code shall be considered to be incorporated into this
Building Code .
1 . Uniform Building Code . The publication of the
International Conference of Building Officials known
as the Uniform Building Code , 1976 edition , is incor-
porated by this reference as a part of this Building
Code for the purpose of establishing standards for the
construction and inspection of dwellings , buildings
and structures and the issuance of building permits
in Weld County , Colorado .
2 . Uniform Mechanical Code . The publication of the
International Association of Plumbing and Mechanical
Officials and the International Conference of Building
Officials known as the Uniform Mechanical Code , 1976
edition , is incorporated by this reference as a part
of this Building Code for the purpose of providing
for the inspection of heating , ventilating , cooling
and refrigeration equipment and the issuance of
mechanical permits in Weld County , Colorado .
3. National Electrical Code . The publication of the
National Fire Protection Association known as the
National Electrical Code , 1975 edition , NFPA No . 70-1975 ,
is incorporated by this reference as a part of this
Building Code for the purpose of establishing standards
for the inspection of electrical installations and the
issuance of electrical permits in Weld County , Colorado .
4. Plumbing Code. The publication of the International
Association of Plumbing and Mechanical Officials , known
as the Uniform Plumbing Code , 1976 edition , is incor-
porated by this reference as a part of this Building
Code for the purpose of providing standards for the
inspection of plumbing systems and the issuance of
plumbing permits in Weld County, Colorado.

5. Uniform Code for the Abatement of Dangerous Buildings .
The publication of the International Conference of Building
Officials known as the Uniform Code for the Abatement of
Dangerous Buildings , 1976 edition , is incorporated by this
reference as a part of this Building Code for the purpose
of establishing standards for the abatement of unsafe
buildings by repair , rehabilitation , demolition or removal .
6 . Uniform Swimming Pool Code . The publication of the
International Association of Plumbing and Mechanical
Officials known as the Uniform Swimming Pool Code , 1976
edition , is incorporated by this reference as a part of this
Building Code for the purpose of providing standards for
the inspection of swimming pool plumbing systems and the
issuance of plumbing and mechanical permits in Weld County ,
Colorado.
B. Additional Standards .
1 . Insulation Requirements . In addition to the require-
ments of the Uniform Building Code , 1976 edition , insul -
ation in dwellings and buildings in Weld County , Colorado
shall conform to the following standards for thermal
conductivity :

2 . State and Federal Requirements . The standards adopted
in this Building Code are in addition to any standards or
requirements for buildings or structures imposed by statute
or regulation of the State of Colorado or the United States .
Where standards contained in this Building Code conflict
with such State or Federal requirements , the more restric-
tive standard shall apply.
III . Administration
A. Permits Required .
1 . Building Permits - No person , firm or corporation shall
erect , construct , enlarge , alter , repair , move , improve , re-
move , convert or demolish any building or structure in Weld
County or cause the same to be done without first obtaining
a separate building permit for each such building or structure from the Division

of Building Inspection , Department of Planning Services ,
Weld County , Colorado . All such work with a total
valuation of $100 or more shall require a building permit .
2 . Mechanical Permits -
a . No person , firm or corporation shall erect ,
install , alter , reconstruct , replace , add to or
repair or cause to be erected , installed , altered ,
reconstructed , replaced , added to or repaired
any heating , ventilating , cooling , or refrig-
eration equipment in any building or structure in
Weld County , Colorado , without first obtaining a
permit for such installation , alteration , recon-
struction or repair from the Division of Building
Inspection , Department of Planning Services , Weld
County , Colorado.
b . A permit shall be obtained for all heating ,
ventilating , cooling , or refrigeration equipment ,
moved with or installed in any relocated building.
c . A separate permit shall be obtained for the
equipment installed in each separate building or
structure .
3. Electrical Permits -
a . No person , firm or corporation shall construct or
install any electrical conductors or equipment or
" hook up" , any electrical utility or provide service
to any building or structure in Weld County without
first obtaining an electrical permit for such work
from the Division of Building Inspection , Department
of Planning Services , Weld County, Colorado.
b. A separate permit shall be obtained for each
building , structure or installation .
c . Every mobile home or movable structure owner
shall have the electric utility hook up for such
mobile home or movable structure inspected prior
to obtaining new or different utility service .

4 . Plumbing Permits -
a . No person , firm or corporation shall erect ,
install , alter, add to , repair , relocate or re-
place or cause to be erected , installed , altered,
added to, repaired , relocated or replaced , any
plumbing , gas or drainage piping work or any
fixture or water heating or treating equipment
in any building or structure in Weld County ,
without first obtaining a permit for such work
from the Division of Building Inspection , Depart-
ment of Planning Services , Weld County , Colorado .
b. A separate permit shall be obtained for each
such building , structure or installation .
B. Exemptions .
1 . Building Permits - A building permit shall not be
required for :
a . work with a total valuation of less than $100
b. public utility towers and poles
2 . Mechanical Permits - A permit shall not be required
for the following :
a . any portable heating appliance
b. any portable ventilating equipment
c. any portable cooling unit
d. any steam, hot or chilled water piping within
any heating or cooling equipment regulated by this
Building Code
e . replacement of any component , part or assembly of
an appliance which does not alter its original approved
design and assembly and complies with other applicable
requirements of this Building Code.
f. any portable evaporative cooler
g. any refrigerating equipment which is a part of the
equipment for which a permit has been issued pursuant
to the requirements of this Building Code
h . any unit refrigerating system

3 . Electrical Permits - Electrical permits shall not be
required for:
a . installations in automotive vehicles
b. installations underground in mines
c . installations of railways for generation , trans-
formation , transmission or distribution of power
used exclusively for operation of rolling stock ,
or installations used exclusively for signaling
and communications purposes
d . installations of communication equipment under
the exclusive control of communication utilities
located outdoors or in building spaces used ex-
clusively for such installations
e . installations under the exclusive control of
electric utilities for the purpose of commun-
ication or metering ; or for the generation ,
control , transformation , transmission and dis-
tribution of electric energy located in buildings
used exclusively by utilities for such purposes ,
or located outdoors on property owned or leased by
the utility or on public highways , streets , roads ,
etc . , or outdoors by established rights on private
property
4. Plumbing Permits - No plumbing permit shall be required
in the case of any repair work as follows : The stopping
of leaks in drains ; soil pipe , waste pipe or vent pipe ,
provided , however , that should any trap , drainpipe , soil
pipe , waste pipe or vent pipe be , or become defective , and
it becomes necessary to remove and replace the same
with new material in any part or parts , the replacement
shall be considered new work and a permit shall be
procured and inspection made as provided in this Building
Code . No permit shall be required for the cleaning of
stoppages , or the repairing of leaks in pipes , valves
or fixtures , when such repairs do not involve or re-

quire the replacement or rearrangement of valves , pipes
or fixtures .
C. Existing Buildings , Installations and Equipment.
1 . Application to Existing Buildings -
a . General - Buildings or structures to which
additions , alterations or repairs are made ,
shall comply with all the requirements for new
buildings or structures except as specifically
provided in this section . All additions , alter-
ations and repairs with a valuation of $100 or
more shall require a building permit.
b. Additions , alterations or repairs exceeding
50% of value - When additions , alterations , and
repairs withinany twelve ( 12 ) month period exceed
50% of the value of an existing building or struc-
ture , such building or structure shall be made to
conform to the requirements for a new building or
structure .
c . Additions , alterations and repairs exceeding
25% but less than 50% of value - Additions , alterations
and repairs exceeding 25% but not exceeding 50% of the
value of an existing building or structure and com-
plying with the requirements for new buildings or
structures , may be made to such building or structure
within any twelve (12 ) month period without making
the entire building or structure comply. The new
construction shall conform to the requirements of
this Building Code for a new building of like area ,
height and occupancy.
d. Structural additions , alterations and repairs
not exceeding 25% of value - Structural additions ,
alterations and repairs to any portion of an exis-
ting building or structure within any twelve ( 12 )
month period not exceeding 25% of the value of the

building or structure , shall comply with all of
the requirements for new buildings or structures
except that minor structural additions , alter-
ations or repairs when approved by the Director
of Building Inspection may be made with the same
material of which the building or structure is
constructed .
e. Alterations or repairs not exceeding 25% of
value - Alterations or repairs not exceeding 25% of
the value of an existing building or structure
which are nonstructural and do not affect any member
or part of the building or structure having required
fire resistance , may be made with the same materials
of which the building or structure is constructed ,
except that the installation or replacement of glass
in hazardous locations shall be as required for new
installations .
f. Repairs - roof covering - Not more than 25% of
the roof covering of any building or structure may
be replaced in any twelve month period unless the
new roof covering is made to conform to the re-
quirements of this Building Code for new buildings
or structures .
g . Existing occupancy - Buildings in existence at
the time of the passage of this Building Code may
have their existing use or occupancy continued if
such use or occupancy was legal at the time of the
passage of this Building Code , provided such con-
tinued use is not dangerous to life . Any change
in the use or occupancy of any existing building or
structure shall comply with the provisions of
Sections III . H . I . b , Certificate of Occupancy.
h . Historic buildings - Repairs , alterations and
additions necessary for the preservation , restoration ,
rehabilitation or continued use of a building or
structure may be made without conformance to all of

the requirements of this Building Code when
authorized by the Director of Building Inspection ,
provided:
( 1 ) the building or structure has been desig-
nated by official action of the appropriate
historical society as having special historical
or architectural significance
(2 ) any unsafe conditions as described in
Section IV. C. 3 will be corrected in accordance
with approved plans
( 3) any substandard conditions will be cor-
rected in accordance with approved plans
(4) the restored building or structure will
be less hazardous based on life and fire risk
in the existing building
i . Moved buildings - Buildings or structures to be
moved into or within Weld County shall not be re-
quired to conform to all of the requirements of this
Building Code for new buildings or structures provided
that, upon inspection , the Director of Building In-
spection determines that :
( 1 ) any unsafe conditions as described in
Section IV . C . 3 will be corrected in accordance
with approved plans
( 2 ) any substandard conditions will be cor-
rected in accordance with approved plans
2 . Existing Mechanical Equipment - Heating , ventilating ,
cooling or refrigeration systems, incinerators or other
miscellaneous heat producing appliances lawfully instal -
led prior to the effective date of this Building Code ,
may have their existing use , maintenance or repair con-
tinued if the use , maintenance or repair is in accordance
with the original design and location and is not a hazard
to life , health or property.
3 . Existing Electrical Installations - Electrical Con-
ductors and other electrical equipment lawfully installed

prior to the effective date of this Building Code ,
may have their existing use , maintenance or repair
continued if the use , maintenance or repair is in
accordance with the original design and location and
is not a hazard to life , health or property.
4 . Existing Plumbing Installations - Any plumbing
system lawfully installed prior to the effective date
of this Building Code may have its existing use , main-
tenance or repair continued if the use , maintenance or
repair is in accordance with the original design and
location and no hazard to the public health , safety or
welfare has been created by such system.
D. Permittee .
1 . Owner or Agent - The applicant for any permit re-
quired by this Building Code , shall be the owner of the
subject building or structure or his authorized agent .
An agent may be required to submit evidence of his
authority .
2. Non-transferable - No permit issued under this
Building Code is transferable from the permittee to
a subsequent purchaser . Any purchaser of any building
or structure issued a permit under this Building Code
shall apply for a new permit upon his purchase of the
subject property.
E . Powers and Duties of the Director of Building Inspection .
The Director of the Division of Building Inspection shall
direct the administration of this Building Code . He shall
report to the Director of Planning Services . Whenever the
term "Director of Building Inspection" is used in this
Building Code , it includes any authorized representative of
the Director of Building Inspection .
F. Application Requirements .
1 . Building Permits -
a . Application - To obtain a building permit , the
applicant shall first file an application therefor in
writing on a form furnished for that purpose by the
Division of Building Inspection . Every such application

shall :
( 1 ) identify and describe the work to be
covered by the permit for which application
is made
( 2 ) describe the land on which the proposed
work is to be done by lot, block , tract and
house and street address or similar descriptions
that will readily identify and definitely locate
the proposed building or work site
( 3) indicate the use or occupancy for which the
proposed building or structure is intended
( 4) be accompanied by plans and specifications
as required in subsection b of this section
( 5 ) state the valuation of the proposed work
(6 ) be signed by the permittee or his authorized
agent
( 7) give such other information as reasonably
may be required by the Director of Building
Inspection
b. Plans and Specifications - With each application
for a building permit and when required by the Director
of Building Inspection for enforcement of any provisions
of this Building Code , two sets of plans and speci -
fications shall be submitted. The Director of Build-
ing Inspection may require plans and specifications
to be prepared and designed by an engineer or architect
licensed by the State of Colorado. However, when
authorized by the Director of Building Inspection ,
plans and specifications need not be submitted for
the following :
( 1 ) one story buildings of type V conventional
woodstud construction with an area not exceeding
600 square feet
( 2 ) group M division 1 occupancies of type V
conventional woodstud construction

c . Information on Plans and Specifications - Plans
and specifications shall be drawn to scale upon
substantial paper or cloth and shall be of suf-
ficient clarity to indicate the nature and extent
of the work proposed and show in detail that it
will conform to the provisions of this Building Code
and all relevant laws , ordinances , resolutions ,
rules and regulations . The first sheet of each
set of plans shall give the house and streetaddress
of the work and the name and address of the owner
and of the person who prepared the plans . The plans
shall include a plot plan showing the location of
the proposed building and of every existing building
on the property. In lieu o.f detailed specifications ,
the Director of Building Inspection may approve
references on the plans to a specific section or part
of this Building Code or any other ordinances ,
resolutions , regulations or laws . Computations ,
stress diagrams and other data sufficient to show
the correctness of the plans shall be submitted
when required by the Director of Building Inspection .
Plans for buildings more than two stories in height
of other than groups R division 3 and M occupancies
shall indicate how required structural and fire
resistive integrity will be maintained when a
penetration will be made for electrical , mechanical ,
plumbing and communications conduits , pipes and
similar systems .
d. Approval and Issuance of Permits - If the
Director of Building Inspection is satisfied that
the work described in an application for a permit and
the plans filed therewith conform to the requirements
of this Building Code and other applicable laws ,
ordinances , resolutions and regulations , and that

the fee specified in Section III . H has been paid ,
he shall issue the permit applied for to the ap-
plicant. No building permit shall be considered
finally approved until a final inspection of the
building or structure has been performed , and the
inspector has determined that the building or
structure conforms to all applicable requirements
of this Building Code . When the Director of Building
Inspection issues the permit , he shall endorse in
writing or stamp on both sets of plans and speci -
fications "APPROVED" . Such approved plans and
specifications shall not be changed , modified or altered
without authorization from the Director of Building
Inspection and all work shall be done in accordance
with the approved plans.
e . Partial Permit - The Director of Building
Inspection may issue a permit for the construction of
part of a building or structure before the entire
plans and specifications for the whole building or
structure have been submitted or approved , provided
adequate information and detailed statements have
been filed complying with all pertinent requirements
of this Building Code . The holder of such permit
shall proceed at his own risk without assurance that
the permit for the entire building or structure will
be granted .
f. Retention of Plans - One set of approved plans
and specifications and computations may be retained
by the Director of Building Inspection , and one set
of approved plans and specifications shall be returned
to the applicant , which set shall be kept on such
building or work site at all times during which the
work authorized thereby is in progress .
2 . Mechanical Permits -
a . Permit Application - To obtain a permit the
applicant shall file an application on forms furnished

for that purpose by the Division of Building
Inspection .
b . Plans and Specifications - When required by the
Director of Building Inspection for the enforcement
of any provisions of this Building Code , plans and
specifications for the installation of environmental
heating or cooling systems , absorption systems , ven-
tilation systems , and hoods , shall be filed with the
Director of Building Inspection and approved before the
issuance of any permit for the following :
( 1 ) any group A , E , H , or I Occupancy
( 2 ) new buildings having an aggregate floor area
including basements of 15 ,000 square feet and over
( 3) installations other than those listed in
items ( 1 ) and ( 2 ) above where the aggregate input
capacity is 350, 000 Btu/h and over for environ-
mental heating or an aggregate of 25 HP and over
for environmental cooling , or an aggregate of
350 ,000 Btu/h input capacity and over for ab-
sorption units .
The Director of Building Inspection may require
such plans and specifications to be prepared and
designed by an engineer or architect licensed by
the State of Colorado to practice as such .
One set of plans and specifications may be filed for
checking provided that not less than two sets of
corrected plans and specifications are filed before
approval is given by the Director of Building Inspection .
After approval , one set of plans shall be retained by
the Director of Building Inspection and the other set
shall be returned to the applicant , which set shall
be kept on such building or work site at all times during
which the work authorized is in progress .
When the plans and specifications do not comply with
the provisions of this Building Code , the necessary
changes or revisions shall be made thereto prior to
the issuance of the mechanical permit.

Every plan shall be a print or other type of plan
approved by the Director of Building Inspection .
The information contained on the plan shall be clearly
legible and specifically indicated. No plan shall
be of a scale smaller than 1 /8th inch per foot .
Specifications legibly and definitely stated shall
be included either on the plan or on separate sheets .
The approval of any plans or specifications shall
not be construed to sanction any violation of this
Building Code .
No person shall deviate materially from any approved
plans or specifications or fail , neglect or refuse to
comply therewith , unless permission to do so has been
obtained from the Director of Building Inspection .
Plans and specifications shall be of sufficient
clarity to show that the proposed installation shall
conform to the provisions of this Building Code and
of all applicable laws , ordinances , rules , regulations
and orders . The plans or specifications shall show
the following :
( 1 ) layout for each floor with dimensions of
all working spaces and a legend of all symbols
used
(2 ) location , size and material of all piping
( 3) location , size and materials of all airducts ,
air inlets and air outlets
(4) location of all fans , warm air furnaces ,
boilers , absorption units , refrigerant compressors
and condensers , and the weight of all pieces of
such equipment weighing 200 lbs . or more
( 5) rated capacity or horsepower of all boilers ,
warm air furnaces , heat exchangers , blower fans ,
refrigerant compressors and absorption units
(6) location , size and material of all vents and
chimneys

( 7) location and area of all ventilation and
combustion air openings and ducts
( 8) location of all air dampers and fire shutters
(9 ) the address of the proposed work site and the
name and address of the owner or lessee of the pre-
mises on the first sheet of each set of plans and
specifications
c. Approval and Issuance of Permit - When the Director
of Building Inspection determines that the information
on the application is in conformance with this Building
Code , he shall issue a permit upon receipt of the fees
as required by Section III . H. No mechanical permit
shall be considered finally approved until a final
inspection of the equipment and installation has been
performed , and the inspector has determined that the
installation conforms to all applicable requirements
of this Building Code .
3. Electrical Permits -
a . Permit Application - To obtain an electrical permit,
the applicant shall file an application on forms fur-
nished for that purpose by the Division of Building
Inspection .
b. Plans and Specifications - When required by the
Director of Building Inspection , plans and specifications
for major installations of electric conductors and
equipment shall be filed with the Director of Building
Inspection and approved before the issuance of any
permit. Plans and specifications must provide ample
space in raceways and spare raceways and additional
spaces which will allow for future increases in the
use of electricity.
c . Approval and Issuance of Permit - When the Director
of Building Inspection determines that the information
on the application is in conformance with this Building
Code , he shall issue an electrical permit upon receipt

of the fees as determined by Section III . H below.
No electrical permit shall be considered finally
approved until a final inspection of the installation
has been performed and the inspector has determined
that the installation conforms with applicable re-
quirements of this Building Code .
4. Plumbing Permits -
a . Application - The applicant for a plumbing permit
shall make such application on forms provided for that
purpose by the Division of Building Inspection . He
shall give a description of the character of the work
proposed to be done , and the location , ownership ,
occupancy and use of the premises in connection there-
with .
b. Plans and Specifications - The Director of Building
Inspection may require plans , specifications or
drawings to accompany the application , as well as such
other information as he may reasonably deem necessary.
c. Approval and Issuance of Permit - If the Director
of Building Inspection determines that the plans ,
specifications , drawings , description or information
furnished by the applicant is in compliance with this
Building Code , he shall issue the permit applied for.
No plumbing permit shall be considered finally ap-
proved until a final inspection of the installation
has been performed , and the inspector has determined
that the installation conforms to all applicable re-
quirements of this Building Code .
G. Zoning Check. The application , plans and specifications
filed by an applicant for any permit required by this Building
Code shall be checked by the Director of Building Inspection .
Such plans shall be reviewed by the Division of Zoning of the
Department of Planning Services to check compliance with
applicable zoning and subdivision laws , resolutions and
ordinances .
H . Fees .
1 . Building Permits -

a. Fee Schedule - A fee for each building permit shall be
paid to the Director of Building Inspection as set forth in
Table 3-A located on Page 32 of the Uniform Building Code, 1976
edition, which table is hereby incorporated into and made a part
hereof by this reference. The Director of Building Inspection
shall waive the bidding permit fee for buildings or structures to
be located in the A-Agricultural Zone district which are located
on a lot meeting minimum lot size requirements, which are to be
used for the sole purpose of providing shelter for agricultural
implements, farm products, livestock or poultry.
b. Valuation - The determination of value or valuation under
any of the provisions of this Building Code shall be made by
the Director of Building Inspection. The valuation to be
used in computing the permit fees shall be the total value
of all construction work for which the permit is issued as
well as all finish work, painting, roofing, electrical ,
plumbing, heating, air conditioning, elevators , fire extin-
guishing systems and any other permanent work or permanent
equipment.
c. Double Fee - Where work for which a permit is required by
this Building Code is started or proceeded with prior to
obtaining said permit, the fees specified in subsection l .a above
shall be doubled, but the payment of such double fee shall
not relieve any persons from fully complying with the require-
ments of this Building Code in the execution of the work, nor
from any other penalties prescribed herein.
d. Re-inspection Fee - The Director of Building Inspection
may assess a re-inspection fee of $10.00 for each inspection
or reinspection when such portion of work for which inspection
is called is not complete or when corrections called for are
not ready.
2. Mechanical Permits -
a. A separate mechanical permit fee will be charged for any
mechanical inspections not associated with a building permit.
Any person desiring a mechanical permit required by the Building
Code shall , at the time of filing an application therefor, pay
a fee to the Director of Building Inspection as required by the schedule
located on pages 8 and 9 of the Uniform Mechanical Code, 1976

editio. which schedule is, by this refL _rice, incorporated into
and made a part of this Building Code.
b. In the event that an application for inspection is not filed
in advance of the commencement of installation, the inspection
fee shall be twice the amount prescribed therefor in this section.
3. Electrical Permits -
a. Any person desiring an electrical permit required by this
Building Code, shall , at the time of filing an application
therefor, pay a fee to the Director of Building Inspection as
required by the schedule located in Section 12-23-117, CRS 1973,
as amended, which schedule is, by this reference, incorporated
into and made a part of this Building Code.
b. In the event that an application for inspection is not filed
in advance of the commencement of an installation, the inspection
fee shall be twice the amount prescribed therefor in this section.
4. Plumbing Permits -
a. A separate plumbing permit fee will be charged for any
plumbing inspection not associated with a building permit. Any
person desiring a separate plumbing permit shall , at the time
of filing an application therefor, pay a fee to the Director
of Building Inspection as required by the schedule located on
page 5a of the Uniform Plumbing Code, 1976 edition, which
schedule is, by this reference, incorporated into and made a
part of this Building Code.
I. Inspection Procedures.
1 . Building Permits -
a. Conduct of Inspections - All construction or work for which
a permit is required shall be subject to inspection by the
Director of Building Inspection according to the procedures
set out in Sections 304 and 305 of the Uniform Building Code, 1976
edition, which sections are hereby incorporated into and made a
part hereof by this reference.
b. Special Inspections -
(1 ) General - In addition to the inspections to be made as
specified in subsection a above, the owner shall employ a
special inspector during construction on the following types
of work:
(a ) concrete : during the taking of test
specimens and placing of all reinforced con-

crete and pneumatically-placed concrete
Exceptions :
1 . Concrete for foundations con-
forming to minimum requirements of
Table No . 29-A and for Group R ,
Division 3 and Group M , Division 1
Occupancies provided the Director of
Building Inspection finds no special
hazards exist.
2 . For foundation concrete when the
structural design is based on a F ' c no
greater than 2000 psi .
3 . Nonstructural slabs on grade , in-
cluding prestressed slabs on grade when
effective prestress in concrete is less
than 150 pounds per square inch .
4. Site work concrete fully supported on
earth and concrete where no special hazard
exists .
( b ) Ductile Moment-Resisting Concrete Frame :
as required by Section 2626 ( h ) of the Uniform
Building Code , 1976 edition
(c ) Reinforcing Steel and Prestressing Steel :
1 . During all stressing and grouting of
prestressed concrete .
2 . During placing of reinforcing steel ,
placing of tendons and prestressing steel
for all concrete required to have special
inspection by Section b ( l ) (a ) above .
Exception : The special inspector need
not be present during entire reinforcing
steel and prestressing steel placing op-
erations , provided he has inspected for
conformance with the approved plans , prior
to the closing of forms or the delivery of
concrete to the job site .

(d ) Welding :
1 . Ductile moment-resisting steel frame ,
as required by Section 2722 (h ) of the
Uniform Building Code , 1976 edition .
2 . All structural welding , including
welding of reinforcing steel .
Exceptions :
1 . When welding is done in an ap-
proved fabricator ' s shop .
2 . When approved by the Director of
Building Inspection , floor and roof
deck welding and welded studs when
used for structural diaphragm or
composite systems may have periodic
inspections as defined in Section
b( 5 ) below. For periodic inspection ,
the inspector shall check qualifications
of welders at start of work and then
make final inspection of all welds for
compliance prior to completion of
welding .
(e ) High-strength Bolting : during all bolt in-
stallations and tightening operations .
Exceptions :
1 . The special inspector need not be pre-
sent during the entire installation and
tightening operation provided he has :
( i ) inspected the surfaces and bolt
type for conformance to plans and
specifications prior to start of bolting
( ii ) and will upon completion of all
bolting verify the minimum specified
bolt tension for 10 percent of the bolts
for each "type" of connection , for a
representative number of total connec-
tions established by the plans and
specifications

2 . In bearing type connections when threads
are not required by design to be excluded
from the shear plane , inspection prior to or
during installation will not be required .
3. When bolting is done in an approved
fabricator ' s shop .
( f) Structural Masonry : During preparation of
masonry wall prisms , sampling and placing of all
masonry units , placement of reinforcement , in-
spection of grout space immediately prior to
closing of cleanouts , and during all grouting
operations . Where the f' m is less than 2600
psi and special inspection stresses are used,
test specimens may consist of either one prism
test for each 5000 square feet of wall area or
a series of tests based on both grout and mor-
tar for the first three consecutive days and
each third day thereafter.
Exception : Special inspection will not be
required for structures designed in accor-
dance with the values in appropriate tables
for non-continuous inspection .
(g) Reinforced Gypsum Concrete : When cast-in-
place Class " B" gypsum concrete is being mixed
and placed .
( h ) Insulating Concrete Fill : During the
application of insulating concrete fill when used
as part of a structural system.
Exception : The special inspection may be
limited to an initial inspection to check
the deck surface and placement of reinfor-
cing . The special inspector shall super-
vise the preparation of compression test
specimens during this initial inspection .
(i ) Sprayed-on Fireproofing

(j ) Piling, Drilled Piers and Caissons : During
driving and testing of piles and construction
of cast-in-place drilled piles or caissons .
See Items (a ) and (c) for concrete and rein-
forcing steel inspection .
( k ) Special Grading , Excavation and Filling :
During earthwork excavations , grading and filing
operations inspection to satisfy requirements of
Chapter 29 and Chapter 70 of the Uniform Build-
ing Code , 1976 edition .
( 1 ) Special Cases : Work which , in the opinion
of the Director of Building Inspection , involves
unusual hazards .
( 2 ) Special Inspector - The special inspector shall be
a qualified person who shall demonstrate his competence ,
to the satisfaction of the Director of Building Inspec-
tion, for inspection of the particular type of construc-
tion or operation requiring special inspection .
( 3) Duties and Responsibilities of the Special Inspector -
(a ) The special inspector shall observe the work
assigned to be certain it conforms to the design
drawings and specifications .
( b) The special inspector shall furnish inspection
reports to the Director of Building Inspection , the
engineer or architect of record and other desig-
nated persons . All discrepancies shall be brought
to the immediate attention of the contractor for
correction ; then if uncorrected , to the proper
design authority and to the Directorof Building
Inspection .
(c ) The special inspector shall submit a final signed
report stating whether the work requiring special
inspection was , to the best of his knowledge , in
conformance with the approved plans and specifications
and the applicable workmanship provisions of this
Building Code .

( 4) Waiver of Special Inspection - The Director of
Building Inspection may waive the requirement for the
employment of a special inspector if he finds that
the construction is of minor nature .
(5 ) Periodic Special Inspection - Some inspections
may be made on a periodic basis and satisfy the require-
ments of continuous inspection , provided this periodic
scheduled inspection is performed as outlined in the
project plans and specifications and approved by the
Director of Building Inspection .
( 6) Approved Fabricators - Special inspections required
by this Section and elsewhere in this Building Code ,
shall not be required where the work is done on the
premises of a fabricator registered and approved by the
Director of Building Inspection to perform such work
without special inspection . The certificate of reg-
istration shall be subject to revocation by the Dir-
ector of Building Inspection if it is found that any
work done pursuant to the approval is in violation
of this Building Code . The approved fabricator shall
submit a Certificate of Compliance that the work
was performed in accordance with the approved plans
and specifications to the Director of Building
Inspection and to the engineer or architect of record .
The approved fabricator ' s qualifications shall be con-
tingent on compliance with the following :
( a ) That the fabricator has developed and submit-
ted a detailed fabrication procedural manual re-
flecting key quality control procedures which
will provide a basis for inspection control of
workmanship and the fabricator plant .
( b) Verification of the fabricator ' s quality control
capabilities , plant and personnel as outlined in
the fabrication procedural manual shall be by an
approved inspection or quality control agency .
( c ) Periodic plant inspections shall be conducted

by an approved inspection or quality control agency
to monitor the effectiveness of the quality control
program.
(d ) It shall be the responsibility of the inspection
or quality control agency to notify the approving
authority in writing of any change to the procedural
manual . Any fabricator approval may be revoked for
just cause. Reapproval of the fabricator shall be
contingent on compliance with quality control pro-
cedures during the past year.
c . Certificate of Occupancy - No building or structure
of groups A , E , I , H , B or R , shall
be used or occupied and no change in the existing
occupancy classification of a building or structure or
portion thereof, shall be made until the Director of
Building Inspection has issued a certificate of occu-
pancy therefor as provided by this section .
( 1 ) Change in Use - Changes in the character or use
of a building shall not be made except as specified
in Section 502 of the Uniform Building Code , 1976
edition .
( 2 ) Certificate Issued - After final inspection , when
it is found that the building or structure com-
plies with the provisions of this Building Code , the
Director of Building Inspection shall issue a Certificate
of Occupancy which shall contain the following :
(a ) the building permit number
( b ) the address of the building
(c ) the name and address of the owner
(d) a description of that portion of the building
for which the certificate is issued
(e ) a statement that the described portion of the
building complies with the requirements of this
Building Code for a group and division of oc-
cupancy and the use for which the proposed oc-
cupancy is classified
( f) the name of the Director of Building Inspection

(g ) name of inspector finally approving the permit
( 3) Temporary Certificate - A temporary certificate
of occupancy may be issued by the Director of Building
Inspection for the use of a portion or portions of the
building or structure prior to completion of the en-
tire building or structure .
( 4 ) Posting - A certificate of occupancy shall be
posted in a conspicuous place on the premises and
shall not be removed except by the Director of
Building Inspection .
( 5 ) New Buildings and Structures - A certificate of
occupancy shall be required only for new buildings
and structures and residences completed after the
effective date of this Building Code .
2 . Mechanical Permits -
a . Inspection Required - All equipment for which mechanical
permit is obtained under this Building Code shall be inspec-
ted by the Director of Building Inspection .
That portion of any equipment intended to be concealed
by any permanent portion of the building, shall not be con-
cealed until inspected and approved .
b. Final Inspection - When the installation of any equip-
ment is complete , a second or final inspection shall be
made and final inspection approval shall be noted upon the
permit.
c . Connection of Equipment to Fuel or Power Supply -
Equipment regulated by this Building Code , shall not be
connected to the fuel or power supply until authorized
by the Director of Building Inspection , except that the
requirements of this section shall not be considered to pro-
hibit the operation of any heating equipment installed to
replace existing heating equipment serving an occupied
portion of a building , in the event a request for inspection
of such heating equipment has been filed with the Division
of Building Inspection not more than 48 hours after such
replacement work is completed , and before any portion of

such equipment is concealed by any permanent portion
of the building.
3 . Electrical Permits -
a . Inspection Required - All electrical installations
covered by this Building Code shall be inspected by the
Director of Building Inspection .
That portion of any electrical equipment intended to be
concealed by any permanent portion of the building , shall
not be concealed until inspected and approved .
b. Meter Sets - Meter sets must be inspected and approved
by the Director of Building Inspection prior to connection
of an electrical installation with the source of electrical
power. Approval of a meter set shall not constitute final
approval of an electrical permit.
c . When the installation of any equipment is complete ,
a second or final inspection shall be made . Upon final
inspection , final approval of the electrical permit shall
be noted upon the permit .
4. Plumbing Inspections -
a . Inspection Required - All plumbing and drainage systems
covered by this Building Code shall be inspected by the
Director of Building Inspection prior to final approval of
a permit.
All plumbing and drainage systems intended to be concealed
by any permanent portion of the building concerned , shall
not be concealed until inspected and approved .
b. Final Inspection - When the installation of any plumbing
and drainage system is complete , a second or final inspection
shall be made . Upon final inspection , final approval of
the plumbing permit shall be noted upon the permit.
c . Connection to Service System - Systems regulated by
this Building Code shall not be connected to the service
system until authorized by the Director of Building In-
spection .

J . Validity of Permit.
1 . The issuance or granting of any permit or approval
of plans and specifications shall not be construed to be
a permit for or an approval of any violation of any of
the provisions of this Building Code . No permit pre-
suming to give authority to violate or cancel the pro-
visions of this Building Code , shall be valid except
for permits allowing minor deviations previously auth-
orized by the Director of Building Inspection upon a
showing by the applicant that strict compliance with
the provisions of this Building Code will result in
an unreasonable hardship upon the applicant , and that
the proposed deviation from Building Code standards
would not present a danger to the health and safety of
the applicant or the general public .
2 . The issuance of a permit based upon plans and speci -
fications shall not prevent the Director of Building
Inspection from thereafter requiring the correction of
errors in said plans and specifications or from pre-
venting building operations being carried on there-
under when in violation of this Building Code .
K. Expiration of Permit .
Every permit issued by the Director of Building Inspection
under the provisions of this Building Code shall expire by
limitation and become null and void if the building or work
authorized by such permit does not commence within 120 days
from the date of such permit , or if the building or work
authorized by such permit is suspended or abandoned at any
time after the work is commenced for a period of 120 days .
Before such work can be recommenced , a new permit shall
be first obtained so to do , and the fee therefor shall
be one-half the amount required for a new permit for
such work provided no changes have been made or will be
made in the original plans and specifications for such
work ; and provided further that such suspension or aban-
donment has not exceeded one ( 1 ) year.

L . Suspension or Revocation of Permits .
The Director of Building Inspection may , in writing ,
suspend or revoke a permit issued under provisions of
this Building Code whenever the permit is issued in
error or on the basis of incorrect information supplied, or in
violation of any ordinance , resolution or regulation , in-
cluding the Weld County Zoning Resolution and Subdivision
Regulations , or any of the provisions of this Building Code .
M. Right of Entry.
Whenever necessary to make an inspection to enforce any
of the provisions of this Building Code or whenever the
Director of Building Inspection or his authorized repre-
sentative has reasonable cause to believe that there
exists in any building or upon any premises , any condition
which makes such building or premises unsafe as defined in
Section IV. C . 2 of this Building Code , the Director of
Building Inspection or his authorized representative may
enter such building or premises at all reasonable times
to inspect the same or to perform any duty imposed upon
the Director of Building Inspection by this Building Code ;
provided that, if such building or premises be occupied , he
shall first present proper credentials and request entry ;
and if such building or premises be unoccupied, he shall
first make a reasonable effort to locate the owner or
other persons having charge or control of the building or
premises , and request entry. If such entry is refused ,
the Director of Building Inspection or his authorized
representative shall have recourse to every remedy pro-
vided by law to secure entry.
N . Applicants Duty to Provide Access .
No owner or occupant or any other person having charge ,
care or control of any building or premises shall fail
or neglect , after proper request has been made as herein
provided , to promptly permit entry therein by the
Director of Building Inspection or his authorized rep-
resentative for the purpose of inspection and examination
pursuant to this Building Code .

0 . Liability.
The Director of Building Inspection or any employee
charged with the enforcement of this Building Code
acting for the County of Weld in good faith and without
malice in the discharge of his duties , shall not there-
by render himself liable personally, and he is hereby
relieved from all personal liability for any damage that may
accrue to persons or property as a result of any act re-
quired or by reason of any act or omission in the discharge
of his duty. Any suit brought against the Director of
Building Inspection or an employee because of such act or
omission performed by him in the enforcement of any pro-
visions of this Building Code shall be defended by the
Weld County Attorney until final determination of the
proceedings .
P . Alternate Materials .
1 . Alternate Materials Authorized - The provisions of
this Building Code are not intended to prevent the use
of any material or method of construction not specifically
prescribed by this Building Code , providing any such
alternate has been approved .
2 . Approval - The Director of Building Inspection may
approve any such alternate provided he finds that the pro-
posed design is satisfactory and that the material , method
or work offered is , for the purpose intended , at least
the equivalent of that prescribed in this Building Code
in quality , strength , effectiveness , fire resistance ,
durability and safety . The Director of Building In-
spection shall require that sufficient evidence or proof
be submitted to substantiate any claims that may be made
regarding its use .
Q . Conflicting Code Standards - Whenever two sections of
this Building Code conflict in the materials prescribed ,
the more restrictive provision governs .
R. Tests .
1 . Tests Required - Whenever there is insufficient evidence

of compliance with the provisions of the Building Code
or evidence that any material or any construction does not
conform to the requirements of this Building Code , or in
order to substantiate claims for alternate materials or
methods of construction , the Director of Building Inspection
may require tests as proof of compliance, to be made at the
expense of the owner or his agent by an approved agency .
2 . Test Methods - Test methods shall be as specified by this
Building Code for the material in question . If there are
not appropriate test methods specified in this Building
Code , the Director of Building Inspection shall determine
the test procedure .
3. Records of Test Results - Copies of the results of all
such tests shall be retained by the Director of Building
Inspection for a period of not less than two ( 2 ) years
after the acceptance of the structure .
S . Board of Appeals .
1 . Creation - In order to determine the suitability of
alternate materials and methods of construction and to pro-
vide for reasonable interpretations of the provisions of
this Building Code , there shall be , and is hereby created ,
a Board of Appeals consisting of seven ( 7) members who
are qualified by experience and training to pass upon
matters pertaining to building construction , mechanical
construction , electrical installations and plumbing
systems .
2 . Member - The Weld County Building Code Board of Appeals
shall consist of seven ( 7) members qualified as follows :
a . an electrician certified by the State of Colorado
b . a master plumber certified by the State of Colorado
c . a person experienced in the construction and instal -
lation of heating , cooling and ventilating systems
d. a building contractor or other person experienced
in the construction trade
e . a professional engineer licensed in the State of
Colorado

f. a fire marshall or other person qualified in fire
protection measures
g. one person from any of the above trades or with
similar experience
3 . Conduct of Investigations , Findings - The members of the
Weld County Building Code Board of Appeals shall hold office
at the pleasure of the Weld County Board of County Commissioners
and shall adopt reasonable rules and regulations for conducting
its investigations and shall render all decisions and findings
in writing to the Director of Building Inspection with a dup-
licate copy to the appellant who is appealing an order of the
Director of Building Inspection or his authorized agents , and
a copy to the Weld County Board of County Commissioners .
4. Terms of Office - The terms of office of each member of the
Weld County Building Code Board of Appeals shall be three ( 3 )
years . The five members of the Weld County Uniform Building
Code Board of Appeals existing prior to adoption of this
Building Code , shall continue in office until the expiration
of their respective terms , at which time the Weld County Board
of County Commissioners shall select a qualified resident of
Weld County to fill the vacancy according to the terms of sub-
section R. 2 above .
5 . In the event of a vacancy among the members of the Weld
County Building Code Board of Appeals , the Weld County Board
of County Commissioners shall select a qualified resident of
Weld County to fill such vacancy. Any member of the Weld County
Building Code Board of Appeals shall be removed by the Board of
County Commissioners of Weld County upon a recommendation to
the Board of County Commissioners by members of the Building
Code Board of Appeals , pursuant to its rules and regulations .
6 . The expenses incurred by said Board shall be paid by
County Warrants , upon proper vouchers delivered to the Board
of County Commissioners of the County of Weld , State of
Colorado , as provided by law.

7. The members of the Weld County Building Coie Board of
Appeals shall serve without compensation and the members
thereof may be removed by the Board of County Commissioners
for nonperformance of duty , misconduct or demonstrable con-
flicts of interest.
IV . Violations and Enforcement
A. Violation .
1 . Any person , firm or corporation violating this Building
Code or any provision of applicable state law , is guilty
of a misdemeanor and , upon conviction thereof , shall be
punished by a fine of not more than One Hundred Dollars
($100. 00) , or by imprisonment in the County jail for not
more than ten ( 10 ) days , or by both such fine and imprison-
ment . Each day during which such illegal erection , con-
struction , reconstruction , alteration , maintenance or use
continues , shall be deemed a separate offense . In case any
building or structure is or is proposed to be erected , con-
structed , reconstructed , altered , remodeled , used or main-
tained in violation of this Building Code , or of any pro-
visions of applicable state law, the District Attorney of the
District of Weld , the Board of County Commissioners of Weld
County , or any owner of real estate within the area , in ad-
dition to other remedies provided by law, may institute an
appropriate action for injunction , mandamus or abatement to
prevent , enjoin , abate or remove such unlawful erection , con-
struction , reconstruction , alteration , remodeling or use .
2 . It shall be unlawful to erect , construct , reconstruct ,
alter or change the use of any building or other structure
within Weld County without obtaining a building permit .
The Director of Building Inspection shall not issue any
permit unless the plans for the proposed erection , con-
struction , reconstruction , alteration or use fully conforms
to all zoning regulations of the County of Weld , including
the official Weld County Zoning Resolution and Subdivision
Regulations , and all supplements thereto.
B. Stop Orders .
Whenever any building , electrical , mechanical or plumbing

work is being done contrary to the provisions of this
Building Code , the Director of Building Inspection may order
the work stopped by notice in writing served on any persons
engaged in the doing or causing such work to be done , and
any such person shall forthwith stop such work until auth-
orized by the Director of Building Inspection to proceed
with the work.
C. Occupancy Violations , Unsafe Buildings and Equipment.
1 . Occupancy Violations - Whenever any structure is being
used contrary to the provisions of this Building Code , the
Director of Building Inspection may order such use discon-
tinued and the structure or portion thereof vacated by notice
served on any person causing such use to be continued. Such
person shall discontinue the use within ten ( 10) days after
receipt of such notice , or make the structure or portion thereof
comply with the requirements of this Building Code , provided,
however , that in the event of an unsafe building, subsection 2
of this Section shall apply.
2. Unsafe Buildings - All buildings or structures which are
structurally unsafe or not provided with adequate egress or
which constitute a fire hazard or are otherwise dangerous
to human life , or which in relation to existing use con-
stitute a hazard to safety or health or public welfare by reason
of inadequate maintenance , dilapidation , obsolescense , fire
hazard, disaster damage or abandonment as specified in this
Building Code or any other effective law of the State of
Colorado or ordinance or resolution of the County of Weld ,
are , for the purpose of this section , unsafe buildings . All
such unsafe buildings are hereby declared to be public nui -
sances and shall be abated by repair, rehabilitation , demolition
or removal in accordance with the procedure specified in
Chapters 4 - 9 of the Uniform Code for the Abatement of
Dangerous Buildings as adopted by the Weld County Board of
County Commissioners in Section II . as a portion of this
Building Code .
3. Unsafe Building Appendages - Parapet walls , cornices , spires ,
towers , tanks , statuary and other appendages or structural

members which are supported by , attached to or a part of a
building , and which are in a deteriorated condition or
otherwise unable to sustain the design loads which are
specified in this Building Code , are hereby designated as
unsafe building appendages . All such unsafe building
appendages are public nuisances and shall be abated in ac-
cordance with subsection 2 above .
4. Hazardous and Defective Equipment - Whenever the Director
of Building Inspection learns or ascertains that any equipment
as defined in this Building Code has become hazardous to life ,
health or property , he shall order in writing that such equip-
ment be restored to a condition of safety or be dismantled or
removed from its present location . The written notice shall
fix a time limit for compliance with such order. No person
shall use or maintain the defective equipment after receiving
such notice .

Be it resolved that the Weld County Planning Commission hereby recommends that
Board of County Commissioners adopt the Weld County Building Code consisting of the
following sections and/or volumes which are attached hereby and made a part of this
Resolution:
1. Weld County Building Code Administration Section;
2. The publication of the International Conference of Building Officials
known as the Uniform Building Code, 1976 edition;
3. The publication of the International Association of Plumbing and
Mechanical Officials known as the Uniform Mechanical Code, 1976 edition;
4. The publication of the National Fire Protection Association known as the
National Electrical Code, 1975 edition, NFPA No. 70 -. 1975;

7. The publication of the International Association of Plumbing and
Mechanical Officials known as the Uniform Swinming Pool Code, 1976
edition.
Be it further resolved that a copy of this code be certified to the Board of
County Commissioners for their consideration and adoption in accordance with
the requirements of the Weld County Hane Rule charter and in accordance with
the requirements of Colorado Statute. Finally, the Cannission recommends that
the Board, in its review of the Code give due consideration to and take appro-
priate action on the following items:
1. Section III, A.1 of the Administrative Section as proposed requires
that a building permit be obtained for all work with a total value
of $100 or more, the term work being defined by said Section III,
A, 1. It is the opinion of the Planning Ccmnission that the $100
valuation should be changed to a figure of $500 or such other
value as may be found to be appropriate by the Board of County
Commissioners.
2. That the code as proposed be amended to reflect the elimination of
permit fees, for buildings or structures used for the sole purpose
of providing shelter for agricultural implements, farm products,
livestock or poultry. Such exception may be allowed in accordance
with Section 30-28-201 C. R. S. 1973. This is not to be construed
as eliminating the necessity for permits for such structures, but
only the fees for such permits.
