A public hearing was conducted on May 15, 2019, at 10:00 a.m., with the following present:

Commissioner Steve Moreno

The following business was transacted:
El I hereby certify that pursuant to a notice dated February 8, 2019, and duly published
February 13, 2019, in the Greeley Tribune, a public hearing was conducted to consider the
request of Bar Nine, LLC, c/o Greg Johnson, for a Site Specific Development Plan and Use by
Special Review Permit, USR18-0120, for Airports and Airstrips (grass airstrip for taking off and
landing of small skydiving airplanes) in the A (Agricultural) Zone District. Bob Choate, Assistant
County Attorney, made this a matter of record.
Commissioner Freeman recused himself due to his absence at the original hearing.
3 Chris Gathman, Department of Planning Services, indicated a written request was received
from the applicant to withdraw the application. He explained the applicant felt he could not meet
an agreement with the adjacent property owner to share airspace. He clarified, there will still be
parachutists landing on the property as it is a Use by Right.
In response to Commissioner Conway, Mr. Gathman explained a comment per the Federal
Aviation Administration (FAA) letter, and stated the applicant needed to work with surrounding
users of the airspace. Chair Kirkmeyer advised the Board of the withdraw letter and requested
their review.
la Commissioner James moved to accept the request to withdraw the application of Bar Nine,
LLC, c/o Greg Johnson, for a Site Specific Development Plan and Use by Special Review Permit,
USR18-0120, for Airports and Airstrips (grass airstrip for taking off and landing of small skydiving
airplanes) in the A (Agricultural) Zone District. The motion was seconded by Commissioner
Conway, and it carried unanimously. There being no further discussion, the hearing was
completed at 10:10 a.m.
