HomeMy WebLinkAbout751067.tiff • • REPORT OF THE FINANCE AND TAXATION COMMITTEE WELD COUNTY HOME RULE COMMISSION Greeley, Colorado April 8 , 1975 The Weld County Home Rule Commission Committee on Taxation and Finance met on Saturday afternoon , April 5 , 1975 , and submits the following recommendation as a supplement to the previous reports made to the Home Rule Commission: The Committee recommends the following Charter provisions : 1. Auditor A. The Board of County Commissioners shall appoint the County Auditor and have an audit of all county offices at least once annually. B. The same auditor or firm shall not serve as County Auditor for more than five (5) consecutive years. C. All audits shall be filed in the office of the County Commissioners and shall be available for inspection by the public during business hours. 2. Budget A. The County Commissioners shall have prepared and adopt , after hearings, a budget for all County departments annually in accordance with the requirements of the statutes of the State of Colorado. 3. Capital Expenditures A. Any one project requiring capital expenditures out of funds procured from ad valorem taxation in excess of three million dollars ($3,000,000.00) shall be prohibited until such time as the question of expenditure of said funds shall have been first submitted to a vote of the Weld County electors and shall have received a majority vote approving of such expenditure. 4. Limitation on Annual Tax Levy A . Limitation: Except as otherwise provided herein , all ad valorem tax levies for county purposes , when applied to the total valuation for assessment of the county or other taxing district to which such levy may apply, shall be so reduced as to prohibit the levying of a greater amount of revenue than was levied in the preceding year plus five percent (5%) , except to provide for the payment of bonds and interest thereon. B. If an increased levy is approved by such state agency, the board may make such increased levy as is authorized by such approval. (2) In the event the division of local government or other state agency refuses or fails within ten (1O) days after submission of an adopted budget to grant such increased levy, the question may be submitted to the qualified electors of the county or other taxing district at a general or special election called for the purpose and in the manner provided by law for call- ing special elections in the county. (3) Due notice of the question of whether to grant the increased levy shall be given by the Board of County Commissioners for at least thirty (3O) days in advance of the date set for the general or special election by publication in some newspaper published within the County. If a majority of the votes cast at any such election shall be in favor of the increased levy as named in said election notice, then the Board may make such increased levy for the year voted upon. (4) In the event such increase shall be allowed by the division of local government or other state agency, or voted by the electors under the preceding subsections , the increased revenue resulting therefrom shall be included in determining the five percent (5%) limitation in the following year. 5. Duties of Finance Officer A. The County Finance Officer shall on behalf of the Board of County Commissioners act as Chief Accounting Officer of the County and manage , supervise, coordinate and direct the activities of the Department of Budget , Central Purchas- ing, Accounting and Data Processing. He shall be responsible to the Board of Commissioners for the proper execution, admini- stration and functioning of the affairs of the above described departments of Weld County, including the performance by the respective departments and officers of those functions , duties and services permitted or required by this charter. B. (3) Exercise control over purchases and expenditures and keep the Board of County Commissioners advised of the financial condition and future needs of the County. (4) Appoint and remove, subject to the approval of the Board of County Commissioners, all personnel working in the departments subject to the jurisdiction of the Finance Officer. G. County Treasurer A. The County Treasurer shall , with prudence, invest available funds of the County in national and state banks doing business in Weld County, Colorado , upon first receiving pledged securities from such banks to cover all monies deposi- ted by Weld County. B. All earnings of interest from County funds invested in banks of Weld County shall become a part of the general fund of Weld County, or of any ear-marked fund as may be requested by resolution of the Board of County Commissioners.
