HomeMy WebLinkAbout20191443.tiffHEARING CERTIFICATION DOCKET NO. 2019-33 RE: A SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT, USR18-0112, FOR A MINERAL RESOURCE DEVELOPMENT FACILITY INCLUDING OIL AND GAS SUPPORT AND SERVICE (OUTDOOR STORAGE OF PIPES, EQUIPMENT, AND OTHER MATERIALS USED BY OIL AND GAS) IN THE A (AGRICULTURAL) ZONE DISTRICT - GUTTERSEN RANCH, LLC A public hearing was conducted on April 17, 2019, at 10:00 a.m., with the following present: Commissioner Barbara Kirkmeyer, Chair - EXCUSED Commissioner Mike Freeman, Pro-Tem Commissioner Sean P. Conway Commissioner Scott K. James Commissioner Steve Moreno Also present: Acting Clerk to the Board, Jessica Reid Assistant County Attorney, Bob Choate Planning Services Department representative, Angela Snyder Public Works Department representative, Evan Pinkham Health Department representative, Ben Frissell The following business was transacted: I hereby certify that pursuant to a notice dated February 8, 2019, and duly published February 13, 2019, in the Greeley Tribune, a public hearing was conducted to consider the request of Guttersen Ranch, LLC, for a Site Specific Development Plan and Use by Special Review Permit, USR18-0112, for a Mineral Resource Development Facility including Oil and Gas Support and Service (outdoor storage of pipes, equipment, and other materials used by oil and gas) in the A (Agricultural) Zone District. Bob Choate, Assistant County Attorney, made this a matter of record. Chair Pro-Tem Freeman reviewed for the applicant and the public, the procedures to follow should this case result in a tie vote due to four (4) Commissioners being present and Chair Kirkmeyer excused. IR Angela Snyder, Department of Planning Services, presented a brief summary of the proposal, and stated the site will be used for the outdoor storage of pipes, and have an office trailer. She indicated the site is not within the three (3) mile referral area of any municipalities and indicated ten (10) referrals were sent out with three (3) responses received, and stated the site is in a floodplain. She provided the hours of operation and traffic associated with site, and mentioned no screening or landscaping is proposed. She noted there was no correspondence from surrounding property owners (SPOs) and explained how the site is compatible with surrounding uses. She displayed images of the site and surrounding properties, and entered the favorable recommendation of the Planning Commission into the record as written. GG PL CaS(TP), PwC EP), EH( GF) os/83ft9 2019-1443 PL2648 HEARING CERTIFICATION - GUTTERSEN RANCH, LLC (USR18-0112) PAGE 2 El Evan Pinkham, Department of Public Works, provided a brief overview of the transportation plans and requirements, and stated the access for the site is on County Road (CR) 32. He indicated there are no traffic counts for this area, but the applicant did submit a narrative with traffic information. He stated tracking control, as well as an Improvements and Road Maintenance Agreement (RMA) are required, and presented the drainage and grading requirements. Ben Frissell, Department of Public Health and Environment, reviewed the water and sewer provisions and stated the site will have two (2) full-time employees, and bottled water and portable toilets are acceptable. He noted there will be no fuel storage, washing of vehicles or floor drains onsite, and Development Standards (DS) #15-21 address Environmental Health (EH) items. Shannon Toomey, AGPROfessionals, represented the applicant and presented a PowerPoint presentation (Exhibit D) with images of the site location and plan. She mentioned they have obtained their Flood Hazard Development Permit, noted the silos onsite will screen portable toilets from surrounding residences, and described site operations. She explained the site is consistent with the A (Agriculture) Zone District, and compatible with surrounding uses, and described traffic and access associated with the proposed use. No public testimony was offered concerning this matter. El Ms. Toomey requested clarification on the requirement of a drainage report, and Mr. Pinkham confirmed the site meets a drainage exception, so the Board agreed to delete COA #1.B and COA #1.D.10 regarding drainage. Chair Pro-Tem Freeman suggested deleting the second sentence of COA #4.A (tracking control specifics), and DS #5 (hours of operation). In response to Commissioner Conway, Ms. Toomey confirmed two (2) full-time employees are sufficient. At Commissioner James' suggestion, the Board agreed to delete DS #19 (noise standard). In response to Commissioner Conway, Ms. Snyder confirmed there were no letters received from SPOs. No public testimony was offered with regard to the changes made to the Conditions of Approval and Development Standards. In response to Chair Pro-Tem Freeman, Ms. Toomey indicated she reviewed, and on behalf of the applicant agreed to abide by, the Conditions of Approval and Development Standards, as amended. El Commissioner James moved to approve the request of Guttersen Ranch, LLC, for a Site Specific Development Plan and Use by Special Review Permit, USR18-0112, for a Mineral Resource Development Facility including Oil and Gas Support and Service (outdoor storage of pipes, equipment, and other materials used by oil and gas) in the A (Agricultural) Zone District, based on the recommendations of Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards, as amended. The motion was seconded by Commissioner Moreno, and it carried unanimously.
