Sec. 23-1-40. - Purpose and intent.
A.
The purpose of this Chapter is to provide a unified regulatory system for land USE in the
County. This Chapter is designed to promote the health, safety, convenience, morals,
order and welfare of the present and future inhabitants of the COUNTY. The present and
future inhabitants of the COUNTY will be benefited through;
1. Lessening congestion in the STREETS or roads or reducing the waste caused by
excessive amounts of roads.
2. Securing safety from fire, FLOOD waters and other dangers.
3. Providing adequate light and air.
4. Classification of land USES and distribution of land DEVELOPMENT and utilization.
5. Protecting the tax base of the COUNTY.
6. Securing ec• n •my in g.vernmentai expenditures.
7. Fostering the COUNTY'S agricultural, business, MINING and other economic bases.
8. Protecting both urban and nonurban DEVELOPMENT.
9. Conserving the value of property.
10. Encouraging the most appropriate USE •f land.

To the Weld County BOCC
Dear Sirs and Madam,
This letter is pertaining to Case USR18-0067 (modification and repair of race cars). Although I originally
thought this would require only two trips up to Greeley, it has been stretched out to 5 sessions, and
unfortunately although I did make it to the first 4, I simply can not be there for the fifth session due to
work commitments. I know that being there in person makes a bigger impact, but I hope you will read
this letter and understand my concerns.
At the fourth session the applicant made a presentation starting out with the theme "We are a racing
community". "We", is composed of himself and a lot of his friends that do not live anywhere near Bailey
Drive. They simply drive here to have occasional loud parties and work on their race car engines at his
house. We, Bailey Drive, are not at all a racing community. We, are a small group of about 16 or so
houses out in the country who have lived here for a long time enjoying the peace and quiet. He is the
only household that does any racing, along with his friends that come from quite a long ways away.
The applicant then showed the Planning Committee a bunch of different "race tracks" in the
neighborhood. When I spoke I corrected this, by showing that almost every "race track" they had
pointed out was actually a place where horses are trained. There are several smaller loops that
different individuals have on their properties, and one quite large loop where Jonny Shaw trains many
horses as a professional horse trainer. These loops do not have any kind of motorized vehicles on them.
There is one small zig-zag like track that a few of the neighborhood kids ride go-carts on, but this has
nothing to do with the extremely loud full size race cars in question.
Most of us have lived on Bailey Drive for 15 to 30+ years, and we come here for the peace and quiet that
living in the country provides. We are here to get away from the city, the industrial zones, and the noise
that comes with it. Race car engines are very loud, much louder than any ordinary car engine, and the
applicant already works on his own race car late into the night during the summer months. There have
been numerous times as late as 10:30 at night or even later that I've had my windows closed, a box fan
on high, and even shooting plugs in my ears, and still could not drown out the loud noise to fall asleep. I
have never personally complained, but have seen the sheriff's car there on multiple occasions late at
night telling him to be quiet. If this is the situation as a hobby, then how much worse will it be if the
county blesses this behavior by allowing it to become a full blown business?
Bailey Drive is not zoned for this, and we are counting on the county to enforce the zoning, not just
overturn it because one person doesn't like the rules. Why even have laws, rules, zoning, if we are
simply going to change them as soon as one person decides they don't like them. I have been told that 7
or 8 people signed a petition, that several more have written letters, and that a few more have called in
protest to this application. That's more than 50% of the entire community out here, and just because
we haven't heard from others is not a sign that they are in any way in favor of this. The majority of the
community is against one person changing the rules and taking away the peace and quiet we all came
here for. This business in no way is here for the good of Bailey Drive, as no one else on Bailey Drive
races, it is proposed simply because it helps himself and his friends.
There has been talk of a 55 decibel limit, but who is going to monitor or enforce this? None of the
residents can do this, and as soon as someone of authority shows up he can simply turn off the engines
of run them at low throttle to pass the test. If the sheriff showing up repeatedly in the middle of the
night has not made the message sink in, a piece of paper that says "55 decibels" won't make any
difference at all.
I hope you will consider the residents of Bailey Drive who have relied on the current zoning laws to keep
the city and loud types of industry out of our community for many, many years. Please do not simply
change the rules on us, just because of one person and his friends who don't even live here.

TO WHOM IT MAY CONCERN:
We were planning on attending the Board of Commissioners meeting this Wednesday March 13th in regards to the
above mentioned subject. But due to my husbands terminal illness (Chronic Respiratory failure) and with the current
weather forecast for Wednesday. It looks like we will not be able to attend, as it is approx. a 50 minute drive (depending
o n traffic & weather) from our home @1321 Bailey Drive to the Weld County Office in Greeley. I can't take a chance of
being that far from home and my husband running out of supplemental oxygen if we should happen to run into bad road
conditions or car trouble.
We moved into JoAnn subdivision back in November 2003 and over the years that Adam Hilton has lived in this
subdivision we have heard Adam working on his race car in the past. The only issue was the loud noise we could hear
late at night but we tolerated it as it was not too bad and thought it was neat a person could be in that position to work
o n them and race them. I stated in my email to Bethany that sure we could call 911 every time but I am sure that there
are more important calls for the Weld County Sheriff's or Lochbuie Police Department to concentrate on besides loud
n oise complaints And the priority level of Loud Noise complaints does not warrant a quick response and is pushed back
e ach time a high priority level call comes in.
About a year ago though things seemed to change. Working on more race cars/hi performance engines. They were
getting louder and more often than not we are talking about hearing them later at night after 10PM and on, it didn't
matter what day of the week or weekend. I couldn't imagine how it would be if we were closer to this house and the
constant revving of Hi Performance engines during the week, weekend, day or night based on what we hear inside our
home.
In the Weld County Planning Commission meeting summary from February 2019, Adam addressed the high pitch
e ngine noise and stated he thinks it was when he worked on a boat engine a couple of times. Well he very well may
have worked on a boat engine a couple of times but all the other times were Hi Performance engines with no
mufflers And he apparently is just not working on them and only starting them when they leave the property with the
✓ ehicle. As vre hear them start up, revving engine, then shuts them off to apparently make adjustments, then you will
hear them start again, revving the engine and then they stop. It is just not a one time start up, it is several
times. And this is from what we hear 4 houses down from his and we don't have your standard city yards. My
husband Anthony says "It is hard to believe he is trying to say that it was just a couple of times from a boat motor or
o ther people in the neighborhood". When we can clearly hear it coming for down the street in his direction or look
our south facing windows and you see the shop door open and the shop lite up especially during the late hours of the
n ight in the summer/fall months. And when we say late at night we mean after 10 P.M.

This winter we have only heard a couple times when he has been out there in that shop working Seems like he has cut
back working on them since the Zoning Violation and then applying for the USR We are worried that if this Use By
Special Review Permit is passed and this summer when he is out in his facility/garage working on all of these Race cars &
hi performance engines that this will turn JoAnn subdivision from a peaceful, quiet neighborhood to one where we hear
nothing but Hi performance engines revving up any given day and/or night Because if he was working on anything
other that Race cars or hi performance engines we would not be hearing them inside our home which is 4 houses away
and it does not matter if any of our south facing windows are open or closed
And again to address their statement "They never had a sheriff's officer come out for a noise complaint" sure we
could call 911 every time but I am sure that there are more important calls for the Weld County Sheriffs or Lochbuie
Police Department to concentrate on besides load noise complaints And the priority level of Loud Noise complaints
does not warrant a quick response But from this point forward anytime we hear loud engines being revved up and
disturbing the residences of JoAnn subdivision and it is after 10 at night we will be calling 911 every single time and filing
a formal complaint if necessary
And yes others in this sub -division have ATV's/dirt bikes that their children ride Our neighbor behind us has 2 children
that ride theirs on their property but they are not out there late at night We usually see them on Saturday or Sunday or
week days during summer vacation but then it is during daylight hours Not out there when it is dark and especially not
out when people are trying to sleep late at night And yes there is a dirt track directly across the street from Adam's
but from what we have seen in the past, it is mainly used either by the owner of the property or we have seen Adams
children over there riding, We are not saying with have problem with kids out enjoying themselves, riding their dirt
bikes or ATV's on their property but not down Bailey Drive or County Road 4 like we have witnessed What we do have
a problem with is a Race Car/Auto Shop facility/garage that is known to work on hi performance engines (starting,
revving them up, stopping and repeating) with no consideration for the neighbors and the fact that there have been
several occasions where it has been late at night after 10 p m and sometimes after midnight Now would any of you
like a business of this type in your neighborhood
We could go on and dispute a few other things that we read in the Minutes from the February 19th Planning
Commission meeting that was stated but we are not going to get into a pissing match What we are concerned about
the noise that will be coming from this location if the Board of Commissioners allows this change to take
place Summer is coming up and the racing will be starting soon and we know that Adam races and his girls also race,
he has friends that race and they all will be out there working on them (but hopefully not late in evening/night) If the
BOC does allow for this Use By Special Review Permit so that they can operate a garage/facility to work on race cars
and/or hi performance engines on this property that is in an Agriculture/Residential zoned neighborhood this is not fair
to the residents of JoAnn subdivision And if this change of use is permitted we hope that some very tight/strict
restrictions be set in place as to the hours of operations and the monitoring of the noise level generated from them
working on Race cars or hi performance engines
Also back in May of last year I had placed a call to Bethany Pascoe and sent her email on May 2nd and then on June
12th, she had said she was going to put them in the file I contacted her again on March 7th and she was going to
forward the emails on to someone there I have also attached those emails to this email
And if you check out the following website https //www teamhilton us you will see that he is advertising mainly
for race cars I learned of this website from a friend who happens to be into car racing and he came across it The
following was copied and pasted from that website "After decades of circle track racing in
Colorado, we've created a facility by and for racers of every type."

business not for his own personal use or for friends or hobbies he has, but for a business that he is advertising to work
on Race cars/ hi performance engines at the garage/facility located @1141 Bailey Dr And it seems to us that the noise
generated from this type of business will far exceed the noise level permitted for a RESIDENTIAL NEIGHBORHOOD I
did tell Bethany about this website on March 7th when I talked to her
We were planning on attend the last 3 Planning meeting that were in December, January & February but my husband
unfortunately was either sicker then he usually is or had a doctor appointment/follow-ups Like I stated my husband
is terminally ill and attending the one on March 13th does look like it will be possible But we wanted to voice our
concerns regarding the noise level a garage/business of this type would create in a residential neighborhood and would
hope that the Board of Commissioners not issue this Use By Special Review permit
Again would any of you like to have this type of business/facility/garage in your neighborhood and being disturbed at
night when most of the neighbors are sleeping or trying to sleep, I really don't think you would I know we along with
other residents ofJoAnn subdivision sure won't appreciate it, if is is allowed

I had called and left a message the other day (May 2nd) regarding 1141 Bailey Drive. We are hoping that this business
will not be allowed to operate in the neighborhood and if so that there be some rather strict conditions put in place
since this is zoned a RESIDENTIAL NEIGHBORHOOD. He is repairing race cars and we have to listen to them retying
race motors all hours of the evening and late into the night. I have attached a screen shot of his Facebook page (which
is viewable by anyone who has a Facebook account) that he had updated 22 hours ago (screenshot was taking around 10
pm Friday night so this post was made 22 hours prior that would make it around midnight Thursday) and as you can see
he stated it's a midnight job. Yes we had to listen to engines being ran late at night again and yes we could call the
Weld County Sheriff's but we would be calling them almost every night and I am sure there are other calls that are more
important than a loud noise complaint.
We and I also know that his neighbors immediately to the north of them would really appreciated if this Repair Shop
was not allowed to operate like they are doing. And I question that if the intended use is suppose to be used for Race
Cars and hobbies with friends why does he have a page promoting his business (screenshot attached). He apparently
has no consideration for his neighbors or he would not be out there after 9 pm at night running those engines and now
the weather is warming up and there will be more races are we are going to be subjected to engines being worked on
and ran late into the night every night of the week... With warmer weather approaching my hubby and I are going to
want to have our windows open as I am sure that other people living on this block are going to want to have theirs
opened also at night and I am sure they like we do not want to have to keep our windows closed just to try and drawn
out the engine noise late in the evening and into the middle of the night from this so called Repair Shop that supposedly
it's intended use is "Race cars and Hobbies with Friends"
According to his Team Hilton LLC Facebook page this is clearly a repair shop open to the public. As you can see the
page (which is viewable on Facebook to anyone with a Facebook account) it clearly states "Team Hilton is a performance
shop in Brighton, Colorado servicing and tuning street and track vehicles of all makes" so I take this a being a legitimate
business operating as a Repair Shop not some shop that he is just working Race Cars and hobbies with friends If that
was the case then why would he need to have a "GET QUOTE" button on Team Hilton LLC page if he is just working on
cars as a hobby or for friends.
And I guess I should also mention how they apparently think they need to peel out onto the dirt road out of his
driveway onto Bailey Drive or from County Road 4 onto Bailey Drive or into his driveway tearing up the dirt road. Not
sure is it is him, his friends or them test driving race cars!!! But on any given day you can see peel out marks on the dirt
road both going into his residence and leaving it. What makes this bad is the road only gets graded once a month by
the county so we deal with a dirt road that has been torn up from their house south on Bailey Dr to County Road 4. So
if this business is allowed to continue I would also hope that the county would also address this issue and require this
business to make sure the dirt road is not being tore up by the traffic they have entering this place. Like I said it only
gets graded once a month by the county and a majority of the month after it has been graded from CR 4 down to 1141
Bailey Dr gets tore up real fast unlike the rest of the Bailey Dr.
JoAnn Subdivision has always been a quiet residential neighborhood and we would hope that it can continue to be and
not have to listen to race car engines being revved up late into the night from this repair shop...

If you need to contact me you can but I would like to keep our name confidential as unfortunately my hubby is
terminally ill and I do not want any hassles from this individual because I have shared this information with you. But I
feel that this stuff needs to be brought to your attention.
Also the reason I know about the complaint is the individual who made it has been in contact with us and ask if we
would state our concerns also to the county ..
If you note in this last screenshot it is from May 2nd @ 12:14am. Yes

I am real sorry to have to bother you with this again but something needs to be done.
Last night at approximately 10:30 this individual was out there in his shop working on a car and revving up the engine
and we were in bed trying to sleep, like I am pretty sure a lot of the other neighbors were trying to do. We are 4
houses to the north of his Auto repair shop/home and when we have any of the south windows open in our home we
get to hear this and to be falling asleep and hear this it is very irritating. Granted we are somewhat out in the country
and not in city but I don't know of any Auto/Race car repair shop business that should be allowed to operate in a small
Residential neighborhood, especially a business that is working on race cars and that seems to be what he is into
working on and racing them. He is running these race cars yes I say race cars because no passenger car is going to
have a loud engine like what we hear late at night. My husband & I and a few of the other neighbors sure hope the
county does not allow this Race Car/Auto shop to continue in this quiet residential neighborhood and if the county is
going to allow it we would sure hope that Weld County would put some very STRICT RESTRICTIONS into place. It is
unfortunate that this individual has very little if no respect for his neighbors or the neighborhood for that matter,
because if he did he would not be out there at 10:30 at night revving up these engines disturbing his neighbors. I am
pretty sure that none of you guys would want this type of business on your block where you live and have to be woke up
at night by the race car engines.
We are all for someone having there own business, we know several people who do have their own business. But I will
state this again not a Race Car/Auto repair shop in a QUIET RESIDENTIAL NEIGHBORHOOD..

I had called and left a message the other day (May 2nd) regarding 1141 Bailey Drive. We are hoping
that this business will not be allowed to operate in the neighborhood and if so that there be some rather
strict conditions put in place since this is zoned a RESIDENTIAL NEIGHBORHOOD. He is repairing race
cars and we have to listen to them revving race motors all hours of the evening and late into the
night. I have attached a screen shot of his Facebook page (which is viewable by anyone who has a
Facebook account) that he had updated 22 hours ago (screenshot was taking around 10 pm Friday night
so this post was made 22 hours prior that would make it around midnight Thursday) and as you can see
he stated it's a midnight job. Yes we had to listen to engines being ran late at night again and yes we
could call the Weld County Sheriff's but we would be calling them almost every night and I am sure
there are other calls that are more important than a loud noise complaint.

We and I also know that his neighbors immediately to the north of them would really appreciated if
this Repair Shop was not allowed to operate like they are doing. And I question that if the intended use
is suppose to be used for Race Cars and hobbies with friends why does he have a page promoting his
business (screenshot attached). He apparently has no consideration for his neighbors or he would not
be out there after 9 pm at night running those engines and now the weather is warming up and there
will be more races are we are going to be subjected to engines being worked on and ran late into the
night every night of the week... With warmer weather approaching my hubby and I are going to want
to have our windows open as I am sure that other people living on this block are going to want to have
theirs opened also at night and I am sure they like we do not want to have to keep our windows closed
just to try and drawn out the engine noise late in the evening and into the middle of the night from this
so called Repair Shop that supposedly it's intended use is "Race cars and Hobbies with Friends"
According to his Team Hilton LLC Facebook page this is clearly a repair shop open to the public. As you
can see the page (which is viewable on Facebook to anyone with a Facebook account) it clearly states
"Team Hilton is a performance shop in Brighton, Colorado servicing and tuning street and track vehicles
of all makes" so I take this a being a legitimate business operating as a Repair Shop not some shop that
he is just working Race Cars and hobbies with friends If that was the case then why would he need to
have a "GET QUOTE" button on Team Hilton LLC page if he is just working on cars as a hobby or for
friends.
And I guess I should also mention how they apparently think they need to peel out onto the dirt road
out of his driveway onto Bailey Drive or from County Road 4 onto Bailey Drive or into his driveway
tearing up the dirt road. Not sure is it is him, his friends or them test driving race cars!!! But on any
given day you can see peel out marks on the dirt road both going into his residence and leaving
it. What makes this bad is the road only gets graded once a month by the county so we deal with a dirt
road that has been torn up from their house south on Bailey Dr to County Road 4. So if this business is
allowed to continue I would also hope that the county would also address this issue and require this
business to make sure the dirt road is not being tore up by the traffic they have entering this place. Like
I said it only gets graded once a month by the county and a majority of the month after it has been
graded from CR 4 down to 1141 Bailey Dr gets tore up real fast unlike the rest of the Bailey Dr.
JoAnn Subdivision has always been a quiet residential neighborhood and we would hope that it can
continue to be and not have to listen to race car engines being revved up late into the night from this
repair shop...
If you need to contact me you can but I would like to keep our name confidential as unfortunately my
hubby is terminally ill and I do not want any hassles from this individual because I have shared this
information with you. But I feel that this stuff needs to be brought to your attention.
Also the reason I know about the complaint is the individual who made it has been in contact with
us and ask if we would state our concerns also to the county ..

We were looking at the last pdf attachment on E -permit Team Hiltopn LLC.pdf. updated 03/05/2019
We noticed Adam Hilton had put an Ariel view of the Bailey Drive and indicated there was "3 TRACKS"
Please see attached and our notes Yes there are 3 tracks in the neighborhood but 2 are used for horses as indicated
on attachment. The 3rd one is used by the owner of that property and the Hiltons also utilize that one to ride their
ATV's/dirt bikes on.
Very seldom do we see an ATV on the Shaw's track and if we do it looks to be for maintenance as they are not out there
constantly riding around each time. Jackie Rosellen has horses and uses that track to ride her horses (this track is
directly across the street). Only motorized vehicle we every see on that track is her tractor or riding lawn
mower. Prior tenants were into racing and created that oval track and tried to use that it a race track but the property
owners evicted them.
So we find Adam Hiltons statement "3 track in neighborhood" very misleading as he did not clarify what those tracks
were used for and I wanted to bring this to your attention as to what we have witnessed these tracks used for.
We are going to try and attend the next BOC meeting just depends on my husbands health.

Thank you for the email, I had looked up the date for this hearing and had hoped we would be able to attend but due to my
husbands Hospice team (doctor & nurse) coming out tomorrow morning I am not going to be able to attend as I need to be
here for that.
We do hope that our concerns and the information from my previous emails that we sent to you and Bethany Pascoe are
passed on to the Board of Commissioners and that there is some careful consideration regarding the issue of allowing an Auto
Repair Shop that they say is dust for their hobby & friends. But are advertising on the internet that they work on RACE
CARS/HIGH PERFORMANCE ENGINES and their garage is located in JoAnnl sub -division.
We will state again, We don't enjoy having to listen to them late at night reviving those engines up. There are 3 houses
houses in-between and so if we have any of our South facing widows open at night we have to listen to them reviving the
engines they are working on. We haven't called the Weld County Sheriff's in the past but we will be in the future.
