U., being the time and place specified in our appointment, and proceeded to view the road prayed for in said petition, as follows: We commenced at the starting point named in said i petition, and run As above described. i The last named point being the terminus thereof, and the road as above laid out and viewed being over the most practicable route which we in our judgment can find. We found it necessary to make the following changes in the proposed route as prayed for, viz.: We the undersigned viewers recommend that the roads herein described be granted with the .. following exceptions, viz: - f. THIS INDENTURE, Made this 7th day of September, A. D., 1921, between the State of Colorado, by its duly authorized officers, party of the first part, and Weld County of the State of Colorado, party of the second part, WITNESSETHt WHEREAS, party of the second part has made application to the State Board of Land Commissioners, having control of the lands held by the State of Colorado, for Right of Way over, upon and across the sur- face of certain portions of Section 36, Township 9 North, Range 60 West, as hereinafter described, for county road or public highway purposes, and WHEhriAS, said State Board of Land Commissioners has, in man- ner and form as provided by statute, granted such Right of Way for the purpose aforesaid and none other, upon the terms and conditions herein set forth, and has duly authorized the proper officers of said State to execute Right of hay deed: NOW, THEREFORE, THESE PRESENTS WIThESSETH, that said party of the first part, in consideration of the premises, and in further consider- ation of the sum of One Dollar (+l.uu), lawful money of the United States by second party to first party in hand paid, the receipt whereof is hereby . confessed and acknowledged, has granted, and by these presents does grant unto the party of the second part, its successors and assigns, Right of Way over, upon and across the surface of those certain ;ortions of the herein described lands as follows, towit: A strip of land for road purposes 30 feet in width, entirely along, adjacent and parallel to the South boundary of Section 36, Township 9 North, Range 60 West. /rl its, l r o7 -17 -2- Containing in all the following areas: SWA of SWA .91 Acres SE of SW; .91 9 SW4 of SEA .91 S 4 of SE_ .9] 5.64 Acres, more or less This grant of Right of Way is made subject to any and all easements and Rights of Way heretofore legally obtained and now in full force and effect, if any there be. The party of the second part in accepting this deed cove- nants and agrees to construct and maintain upon and adjacent to said Right of Way hereinabove described such fences, crossings, culverts and subways as shall or may in the opinion of the State Board of Land Commissioners be necessary to the proper use and enjoyment of the lands adjacent thereto. It is expressly understood and agreed by end between the parties hereto that this grant of Right of Way is made for the sole and only purpose of a county road or public highway as hereinabove described, and for no other purpose whatsoever, and in the event that the party of the second part, its successors or assigns shall at any time use or attempt to use the said described strip or parcel of land for any other purpose whatsoever, or shall abandon or discontinue the use of the strip or parcel of land hereinabove described, or shall in any manner fail or refuse to comply with any of the terms or conditions hereof, then this grant shal] become void and of no effect, and all rights hereunder granted to the party of the second part shall imme- diately terminate.
