HomeMy WebLinkAbout20190651.tiffRESOLUTION RE: APPROVE APPLICATION FOR SMALL BUSINESS INCENTIVE PROGRAM AND AUTHORIZE RELEASE OF ECONOMIC DEVELOPMENT TRUST FUNDS (TIER I) - LILY FARM FRESH, INC., C/O LILY MORGAN WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with an Application for the Small Business Incentive Program and a Request for the Release of Economic Development Trust Funds (Tier I), from Lily Farm Fresh, Inc., do Lily Morgan, to the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Department of Planning Services, with terms and conditions being as stated in said application, and WHEREAS, after review, the Board deems it advisable to approve said application, a copy of which is attached hereto and incorporated herein by reference, and release Economic Development Trust Funds (Tier I), in the amount of $20,000.00, payable to Lily Farm Fresh, Inc., do Lily Morgan, to offset various impact fees previously paid by Lily Farm Fresh, Inc. Date: February 4, 2019 I am pleased to submit to the Board of County Commissioners Lily Farm Fresh's Small Business Incentive Application. Lily Farm is a small business operating in unincorporated Weld County with six (6) employees. The owner of Lily Farm Fresh is Mrs. Lily Morgan. As part of the application requirements, Mrs. Morgan submitted her business plan and met with representatives from the Small Business Development Center (SBDC). Jesse Esparza reviewed the business plan and found it adequate. Attached is the confirmation letter from SBDC. The Small Business Incentive Plan was created by the County Commissioners to help offset land, building permit, septic and impact fees associated with development. Below is a breakdown of the fees: USR Fee: Recording Fee: Building Permit Fee(s): Misc. Fees: $2,500.00 $113.00 $28,542.00 $1,125.00 Total $32,280.00 According to the Small Business Application requirements, Lily Farm Fresh falls under Tier 1 and is eligible to receive up to $20,000.00. The business is obligated to cover the first $2,500.00. Therefore, Lily Farm Fresh can receive a total of $20,000.00 The Planning Services Director recommends approval of this application and respectfully requests that the County Commissioners authorize and release $20,000.00 from the Economic Development Fund. The program is designed to reduce upfront capital outlay for small businesses located in unincorporated Weld County. WHO CAN APPLY? Any business owner or tenant located in unincorporated Weld County who meets the eligibility requirements. WHAT ARE THE ELIGIBILITY REQUIREMENTS? • The subject real property must be located within the unincorporated areas of County (the "Property"). • The business shall hire at least fifty (50) percent of their new workforce from Weld County. For the purpose of this application a full-time employee works a minimum of 32 hours per week. The business may have a combination of part-time employees that is the equivalent of at least one (1) full-time employee. • The applicant must be the record owner(s) of the Property or a tenant. • The business must have been undertaken after the date of the adoption of this policy. • This program shall only apply to businesses with 35 or fewer employees at the time of submitting an application. WHAT CAN BE DONE WITH THESE FUNDS? The intent of these funds is to offer financial assistance to small businesses that want to operate in unincorporated Weld County. The financial assistance helps reduce the business's land use application fees, building permit fees, and impact fees. Fees incurred by the business that are not eligible for funds include consultant and attorney fees, on -site and off -site bonding, collateral requirements, etc. WHAT IS THE APPLICATION PROCESS? 1) Complete a Small Business Incentive Program Application form available at the Weld County Department of Planning Services (1555 N. 17th Ave., Greeley) or online in the Planning and Zoning section of the county web site: www.weldgov.com. 2) Mail the completed application to the attention of the Director of Planning Services: 1555 N. 17th Avenue, Greeley, CO 80631. There is no application or processing fee. 3) The Planning Services Director will review all requests and make a recommendation to the Weld County Board of Commissioners who will provide approval/denial. APPROVAL SHALL BE BASED ON THE FOLLOWING: • Submittal of a business plan. • Documentation that the business owner has consulted with the Small Business Development Center (SBDC). FUNDING OVERVIEW: 0-9 employees: Fees between $2,500 - $25,000. County max: $20,000 Applicant portion: $2,500 + any amount above $25,000 10-15 employees: Fees between $2,500 - $35,000 County max: $30,000 Applicant portion: $2,500 + any amount above $35,000 16-35 employees: Fees between $2,500- $45,000 County max: $40,000 Applicant portion: $2,500 + any amount above $45,000 Example 1: $10,000 total fees assessed and 5 employees. Applicant would pay $2,500 and County would grant $7,500 Example 2: $40,000 total fees assessed and 14 employees. Applicant would pay $2,500+$7,500410,000 and County would grant $30,000. Example 3: $80,000 total fees assessed and 35 employees. Applicant would pay $2,500+$37,500 and County would grant $40,000. Funds shall be distributed on a first -come first -served basis. All applications are confidential and at the full discretion of the Weld County Board of County Commissioners. Applicants must be a property owner or be a tenant (with written permission from the building owner) operating a retail, commercial or industrial business as defined and permitted under the Weld County Code. Applicant must be current on all County taxes prior to receiving funds.
