RE: CONSIDER CERTIFICATION TO THE WELD COUNTY TREASURER OF ZONING
VIOLATION PENALTIES AS SPECIAL ASSESSMENT - LANCE RAUSCH
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Weld County, on behalf of the Weld County Department of Planning Services,
filed a complaint in the Weld County Court against Defendant Lance Rausch claiming that
Defendant's property is in violation of the Weld County Code, and
WHEREAS, the County Court found the Defendant's property to be in violation of the Weld
County Code, and
WHEREAS, the Defendant failed to bring the property into compliance with the Weld
County Code, and upon Weld County's motion, the County Court ordered Defendant to pay
$50.00 per day that the property remained in violation of the Weld County Code, beginning on
September 26, 2017, and
WHEREAS, the Board of County Commissioners previously approved the certification of
$9,050.00 to the Weld County Treasurer for the daily penalties accruing period between
January 1, 2018, and July 1, 2018, for a period of 181 days, and
WHEREAS, the property is still in violation of the Weld County Code; and
WHEREAS, C.R.S. §30-28-124.5(1) and Weld County Code Section 23-10-40.A allow
these costs to be assessed against the property and collected as a special assessment by the
Treasurer.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, hereby approves the Certification of $16,700.00 to the Weld County Treasurer
to be collected as a special assessment for the daily violation penalties from July 2, 2018, to
May 31, 2019.

on this site without a Use by Special Review (USR) permit. This site may not be utilized as a
recycle site without a USR permit.
2.) You shall contact my office as soon as you feel you have brought the property into
compliance with item 1 above. Until such time the daily penalty shall continue to accrue in
accordance with the court order (16-C-32622).

Screening Options for
Noncommercial Junkyards
The purpose of this document is to provide guidance
to Weld County Citizens regarding available
screening options for noncommercial (private)
junkyards in the Agricultural Zone District. The Weld
County Code requires noncommercial junkyards to be
completely screened from all adjacent properties and
public rights -of -ways.

WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado; and
WHEREAS, Weld County, on behalf of the Weld County Department of Planning Services,
filed a complaint in the Weld County Court against the Defendant, Lance Rausch, claiming that

the property and obtain legal counsel, and
WHEREAS, on September 12, 2018, after hearing testimony from the Defendant's
representative and the Assistant County Attorney, the Board approves the Certification of
$9,050.00 to the Weld County Treasurer to be collected as a Special Assessment for the daily
violation penalties from January 1, 2018, through July 1, 2018.
BE IT FURTHER RESOLVED, by the Board of County Commissioners of Weld County,
Colorado, hereby approves the Certification of $9,050.00 to the Weld County Treasurer to be
collected as a Special Assessment for the daily violation penalties from January 1, 2018, through
July 1, 2018.
